Abstract

An authentic deed drawn up by a notary, even though it has high legal force, can be revoked if it is made with elements of abuse of circumstances (misbruik van omstandigheden). One example is the case recorded in Decision Number 106 PK/Pdt/2020, where an agreement made before a notary was revoked due to an imbalance in bargaining position that was detrimental to one of the parties. This normative juridical research concludes that abuse of circumstances, especially economic advantage, is a form of defective will that makes the notarial deed not meet the requirements for a valid agreement as stipulated in Article 1320 of the Civil Code. This shows that the principle of freedom of contract is not absolute and must be based on the principles of justice and protection of the weaker party. In addition, notaries have legal and ethical responsibilities for the deeds they draw up. If proven negligent or biased, notaries can be subject to sanctions. This emphasizes the importance of notarial integrity in maintaining public trust.

Abstract

This abstract   aims to determine the effectiveness of e-Litigation in the case resolution process at the Samarinda Religious Court Class IA. This research uses a qualitative-descriptive socio-legal approach. The data sources used are primary data sources obtained directly from the first source and secondary data sources obtained from primary, secondary, and tertiary legal materials. Primary data collection techniques are interviews and secondary data with literature studies, data analysis techniques with interactive analysis models. The results of the study show that the implementation of e-Litigation at the Samarinda Religious Court Class IA has been running in accordance with PERMA No. 7 of 2022 concerning Amendments to PERMA No. 1 of 2019 concerning Case Administration and Trials in Courts Electronically but is not fully optimal. This is due to several factors, including technological infrastructure and uneven understanding of digital literacy among justice-seeking communities. However, e-Litigation makes a positive contribution to the efficiency of time and cost of case resolution.

Abstract

The development of digital technology has driven the emergence of a new modus operandi in human trafficking crimes, namely technology-based human trafficking through online scam schemes. This phenomenon is marked by the recruitment of victims through social media, fake job advertisements, and messaging apps, who are then coerced into committing online fraud under threats, violence, and technological control. The main issue of this research is how Indonesian positive law responds to online scam-based human trafficking practices and to what extent law enforcement can protect victims who experience digital exploitation. This study aims to analyze the adequacy of the national legal framework, the dynamics of crime modus operandi, and the obstacles in cross-border handling. The research method uses a qualitative approach with a socio-legal research type through literature review of regulations, news, and academic research. The research findings show that the online scam practices carried out by the victims fulfill the elements of human trafficking according to Law No. 21/2007 through the concept of forced criminality. However, law enforcement faces challenges such as cross-border jurisdiction, digital evidence, and miscategorization of victims as perpetrators. This study emphasizes the need to strengthen technology-based regulations, improve international cooperation, and establish comprehensive protection mechanisms for the identity and recovery of victims.

Abstract

This article examines the theoretical and normative construction of the use of de facto authority in the Indonesian administrative law system, particularly in relation to the limits of its use and the forms of accountability attached to government institutions. This study uses normative legal research. The discussion concludes that the use of de facto authority generally arises due to emergency conditions, normative vacuums, or unclear regulations, which require government institutions to act to maintain the smooth running of public services and prevent government stagnation. Although it provides flexibility beyond the formal legal mandate, the use of de facto authority remains limited by the principles of legality, material, territorial, and temporal boundaries as stipulated in the Government Administration Law, as well as the obligation to comply with the Principles of Good Governance (AUPB). The study's findings show that every use of de facto authority always has legal consequences through two forms of accountability: (1) official accountability, when actions are taken in the context of carrying out legitimate government duties, and (2) personal accountability, when officials act improperly, abuse their authority, or commit maladministration. This article emphasises that de facto authority remains an important tool but can only be exercised if it complies with the AUPB.

Abstract

This study examines the implementation of Article 24 Paragraph (1) Letter c of Law Number 12 of 2022 on Sexual Violence Crimes (UU TPKS), with a specific focus on its application within the jurisdiction of the West Java Regional Police (Polda Jawa Barat). The research concentrates on the challenges faced in law enforcement, particularly in the process of collecting and validating evidence in sexual violence cases. Although the legal framework clearly permits the use of non-physical evidence, such as victim testimony, psychological assessments, and digital recordings, its practical application remains problematic. Many cases occur in private spaces without witnesses, making it difficult for investigators to obtain concrete supporting evidence. Additionally, strong social stigma and the fear of victim-blaming discourage timely reporting, further complicating investigations. The study finds that limited training and the lack of specialized skills among police officers hinder effective case handling. Therefore, the study recommends strengthening investigator capacity and adopting a more victim-centered, trauma-informed approach to improve justice outcomes in sexual violence cases.

Abstract

  The addition of State Capital Participation (PMN) into the Investment Management Agency (LPI) under Government Regulation Number 111 of 2021 represents a strategic legal policy aimed at strengthening Indonesia’s investment capacity and the capital structure of its sovereign investment institution. This study employs a normative juridical approach by analyzing statutory regulations, legal doctrines, and relevant academic literature to examine the legal framework, conceptual implications, and economic law perspective of PMN within LPI governance.The findings indicate that PMN affirms LPI’s status as a sui generis legal entity operating under private (civil law) principles while managing assets derived from state finances, thereby creating a normative tension between state financial law principles—such as transparency, accountability, and public oversight—and the flexibility of investment management practices. Although the policy enhances    the state’s ability to consolidate strategic assets, attract investment, and accelerate economic development, LPI’s legal privileges, including immunity from asset seizure and limited direct supervision by the Audit Board of Indonesia (BPK), pose risks to fiscal control and public accountability. From an economic law perspective, the policy is justifiable as maslahah only if implemented in line with principles of justice, trustworthiness, and public benefit, thus requiring strengthened governance and oversight mechanisms.

Abstract

Advances in information and communication technology have accelerated the use of digital contracts in cross-border commercial transactions, raising legal challenges regarding choice of law and jurisdiction. This study examines the nature of choice of law and jurisdiction in cross-border digital contracts within the Indonesian legal system using a normative legal methodology with a statutory and conceptual approach. The findings indicate that Indonesian law has recognized the principle of party autonomy in international electronic contracts through Article 18 of the ITE Law; however, its effectiveness is limited by mandatory legal norms and public policy. Therefore, clear and balanced contractual clauses are necessary to ensure substantive legal certainty in cross-border digital transactions.

Abstract

Delegation of authority through delegation and mandate mechanisms constitutes a strategic instrument in public administration to support the effectiveness and efficiency of public service delivery. This study aims to analyze the practice of authority delegation within government institutions and examine its juridical implications for accountability and the quality of public services. The research employs a normative juridical approach by reviewing statutory regulations and their practical implementation. The findings indicate that although the regulation of delegation and mandate has been normatively established in Law Number 30 of 2014 concerning Government Administration, its implementation still faces various challenges. The primary issues lie in the unclear distinction between delegation and mandate, as well as the ambiguity of legal accountability. Furthermore, the use of mandates without substantive transfer of responsibility leads to delays in public service processes. Weak supervisory mechanisms over the delegation of authority also contribute to decreased efficiency and responsiveness. Therefore, there is a need for clearer technical regulations and the strengthening of government officials’ capacity to ensure that the delegation of authority is carried out in an accountable, effective manner and in accordance with the general principles of good governance.

Abstract

This study aims to analyze the structural barriers that hinder the optimization of village government authority within the framework of decentralization as stipulated in Law No. 6 of 2014 on Villages, specifically Articles 18–20. Normatively, villages are granted the authority to regulate and manage their own interests; however, in practice, this has not yet been fully realized. This study employs a normative legal research method using the statutory approach. Additionally, it utilizes the analytical approach and the historical approach. The research results indicate several structural obstacles to the optimization of authority, namely: (1) low understanding among village officials regarding the concept of village authority; (2) an inability to formulate Village Regulations (Perdes) based on community potential and needs; (3) weak coordination between levels of government; (4) strong intervention by local governments in village affairs; and (5) a tendency toward re-centralization.This study contributes to a critical understanding of decentralization practices at the village level and recommends strengthening institutional capacity and reformulating the relationship between local governments and villages. Additionally, legal and technical assistance is needed in drafting Village Regulations so that villages can exercise their authority independently and accountably.
