Abstract

This research analyzes the principle of volunteerism in the context of implementing Corporate Social Responsibility (CSR) by companies that are subject to the Limited Liability Company Law. The main objective of the research is to explore the concept of the Voluntary Principle and understand its relevance in the context of corporate social responsibility, with special emphasis on Article 74 of the Limited Liability Company Law as the legal basis for CSR. This research uses normative juridical legal research methods with a statutory regulatory approach. Research findings show that the implementation of CSR in Indonesia, as mandated by Article 74 of Law Number 40 of 2007, creates a contradiction between legal obligations and the Voluntary Principles contained in CSR which was originally interpreted as voluntary corporate charity. However, as time goes by, where companies primarily operating in the Natural Resources sector have contributed to serious damage to the environment, now the Voluntary Principle can be interpreted as company compliance with regulations while making voluntary efforts to exceed existing legal limits. Conclusion of the research illustrates that good integration between Voluntary Principles and legal obligations can create a solid foundation for CSR implementation. Even though CSR obligations are mandatory, companies still have the freedom to determine programs and budgets according to their respective volunteers and abilities. A holistic and sustainable CSR strategy can have a greater positive impact than simply complying with regulations.

Abstract

This journal article discusses intellectual property in civil law regarding the protection of art and technological innovation. The main objective is to explore civil law regulations related to the protection of intellectual property in technology innovation and analyze how the implementation of civil law supports the creation and development of art. The research method employs normative juridical research on issues related to intellectual property in art and technological innovation. The findings reveal that civil law regulations governing intellectual property in Indonesia are found in Copyright Law No. 28 of 2014 and Patent Law No. 13 of 2016. Copyright Law protects copyrights, including computer programs, while Patent Law grants exclusive rights to technological innovations. The implementation of civil law, especially copyright, supports artistic creation by providing exclusive rights to creators, creating a legal foundation for artistic control, and fostering economic and creative incentives.

Abstract

This research was conducted with the aim to find out how the regulation of abortion according to health law relates to human rights and what are the factors that influence the occurrence of abortion to rape in the perspective of human rights. By using normative juridical research methods, it is concluded: 1 Rules regarding abortion in Indonesia are regulated in the Criminal Code and the Law on Health. 2. In general, the factors that influence abortion, the factor of the law itself, the sociological factor of public legal awareness, the psychological factor, and the economic factor.

Abstract

Water pollution in rivers is a serious issue that affects ecosystem life and human health. Various human activities such as industrial, agricultural, domestic waste disposal, and climate change have led to an increase in hazardous substances in river water. River water pollution can cause poisoning to aquatic organisms, kill aquatic life, and disrupt the food chain. Additionally, contaminated river water can pose various health problems for humans who consume it or use it for daily purposes. Preventing river water pollution requires serious measures, starting from strict regulations on industrial and agricultural waste, improved management of domestic waste, to public education on the importance of maintaining river cleanliness. These steps are crucial to ensure the availability of safe and clean water for all living beings and to maintain environmental balance.

Abstract

The term "corporation" is defined broadly in positive criminal law, beyond the limits of the conception of legal entities in civil law. This interpretation includes organized entities involving persons and/or assets, whether or not they have the status of legal entities. Corporate crime has not been explicitly regulated in the Indonesian Criminal Code which refers to the Continental European legal system. The main focus of Continental European criminal law is more inclined to individual responsibility than corporate entities. In contrast, in the Anglo-Saxon legal system, corporate liability in criminal cases is explicitly discussed. However, changes in Indonesian legal views show a shift, directing criminal responsibility to the corporation itself. Nonetheless, criminal law in Indonesia previously tended to direct prosecution towards individuals involved in the management of the corporation. The implementation of corporate liability in corruption cases is still limited, but steps were taken by issuing Supreme Court Regulation No. 13 of 2016 concerning Procedures for Handling Criminal Cases by Corporations (PERMA Korporasi). In this PERMA, the identification of individuals involved in corporate crime is expanded, including those who have a relationship with the company even though they are not formally incorporated into the company structure. The PERMA Corporations approach emphasizes that corporate responsibility only applies if it is proven to be directly involved in the criminal act and benefit from the act. The use of the Business Judgment Rule principle and consideration of the benefits to the corporation are key in assessing corporate guilt. Research on PT Asuransi Jiwasraya highlighted violations committed by management in investment management that harmed the company. These violations include non-compliance with the precautionary principle in investment management, resulting in significant financial losses. Violations of the principles of Corporate Governance were also highlighted in this case.

Abstract

The State of Indonesia regulates constitutionally in the 1945 Constitution all elements in the territory of Indonesia, including the elements of land and sea with their natural wealth, which is very influential for the survival of human life. So far, the law that was supposed to be the umbrella of the law that guarantees the realization of a subject set in it has not gone as it should. This is demonstrated by the escalation of the agrarian conflict in Rempang Island, Batam, related to the rights to land belonging to indigenous communities that were deprived of land use in the National Strategic Project of Eco City Reservoir. The study aims to analyze the role of law in Indonesia in the settlement of the conflict. The research methods we use are qualitative methods through the study of literature and normative legal (legal) research. Literature studies involve the collection of data sources through journals, articles, news portals, and relevant books related to the research topics taken. Normative legal research is aimed at finding the truth about the existence of legal certainty. The results of our research will show how the existing laws in Indonesia regulate the agrarian conflict on Rempang Island and how the government's efforts to take policy by advancing the laws that have been established in Indonesia for the survival of the rights of indigenous peoples affected by the conflict.

Abstract

This research examines criminal liability related to criminal acts of embezzlement in the context of credit agreements. Embezzlement in credit agreements is a complex issue because it involves aspects of civil and criminal law. The aim of this research is to identify and analyze the criminal liability of embezzlement perpetrators in the context of credit agreements, as well as their impact on the criminal justice system. This research uses a normative legal approach to examine related laws and regulations and relevant court decisions. The data was analyzed qualitatively to gain an in-depth understanding of criminal liability in cases of embezzlement in the context of credit agreements. The research results show that criminal liability in credit agreements can involve various aspects, including breach of contract, falsification of documents, or acts of fraud. In this context, the role of criminal law as a means of upholding justice is important to protect injured parties, including financial institutions or creditors.

Abstract

The city of Bandar Lampung is one of several cities in Lampung Province with relatively high rates of exploitation of children. One form of exploitation is economic exploitation. This research aims to analyze the effectiveness of the roles and duties of the PPPA Bandar Lampung City office. This research uses normative and empirical juridical research methods. The problems discussed in this research are what causes children to become victims of economic exploitation and what is the role of the Women's Empowerment and Child Protection Service (PPPA) in the legal protection of children as victims of economic exploitation. The results of the research show that the biggest factor causing children to experience economic exploitation is economic factors, so this requires special attention from the government, regional government and the women's empowerment and child protection (PPPA) service in reducing poverty rates and helping children obtain their rights by how to provide socialization and assistance to children as victims of economic exploitation practices.

Abstract

International Civil Agreements are legal relationships designed to facilitate support, business, or trade among the involved parties. These agreements entail elements of foreign involvement. The World Trade Organization (WTO) plays a pivotal role in expanding international trade and safeguarding the interests of its member countries, particularly developing nations. The WTO holds significant responsibility in overseeing and facilitating international trade to promote economic development and poverty reduction. Principles in resolving international trade disputes include: Principle of agreement among parties, freedom to choose dispute resolution methods, choice of law, good faith, and the principle of exhaustion of local remedies. The identified problem formulation revolves around how the application of international civil law influences free trade agreements in resolving international disputes and the efforts made in handling free trade disputes through international legal resolution. This study incorporates the theories of Lex loci solutionis, the proper law of contract, legal protection theory, and international agreement theory. The research adopts a normative approach involving the examination and analysis of applicable legal regulations. The application of international civil law here is highly complex and crucial to resolving potential disputes within the context of free trade agreements. Resolving international disputes through international civil law can support fair and regulated free trade while fostering cooperation among nations and relevant parties, employing principles and theories of international civil law such as lex loci solutionis and the proper law of contract. This approach significantly aids in resolving international disputes within free trade agreements. Utilizing international dispute resolution mechanisms like GATT and WTO, as well as bilateral and multilateral agreements, stands as a critical step in safeguarding free trade and promoting equitable rules in international trade. In situations involving trade disputes, efforts toward resolution must encompass both judicial and non-judicial avenues. Non-judicial avenues involve more flexible diplomatic methods such as negotiation, consultation, mediation, and arbitration. Judicial avenues are formal and binding, involving courts or tribunals in dispute resolution. These efforts represent positive strides towards achieving sustainable goals in free trade.

Abstract

Corruption has now become a cultural behavior, even a matter of debate and is always a hot topic, especially in Indonesia. In fact, corrupt practices are also rooted among students in various fields. Students can be said to be the seeds of corruption, if their behavior does not reflect anti-corruption behavior. This will affect the psychological condition of future generations of militants. Lack of supervision from both parents and educational institutions (campuses) is one of the factors causing corruption. The method for implementing anti-corruption education, which is based on the principle of building an anti-corruption culture, is a collaborative process, the implementation of which must involve students as agents of change. Anti-corruption education is considered to be one of the strategies for eradicating corruption because it can create an anti-corruption cultural ecosystem and strengthen the character of the younger generation. The aim of this community service activity is to increase the awareness and responsibility of students as the younger generation to behave anti-corruption and students are expected not to engage in corrupt practices even if the opportunity arises.
