anun: Jurnal Ilmu Hukum (KJIH), the Indonesian Journal of Autonomy Law, is an international journal dedicated to the study of autonomy law within the framework of national and international legal systems. Published thrice annually (April, August, December), KJIH provides valuable insights for scholars, policy analysts, policymakers, and practitioners. Managed by the Faculty of Law at Syiah Kuala University in Banda Aceh, Indonesia, KJIH has been fostering legal scholarship since its establishment in June 1991, with the ISSN: 0854 – 5499 and e-ISSN (Online): 2527 – 8428. In 2020, it received national accreditation (SINTA 2) from the Ministry of Research and Technology of the Republic of Indonesia and the National Research and Innovation Agency. KJIH is actively pursuing indexing in prestigious databases like Scopus, Web of Science and other global indexes. We publish in English for accessibility, not as a political statement. The Editorial Board shall not be responsible for views expressed in every article.

ABSTRACT: Article 20 paragraph (6) of the Law No. 26, 2007 on the Spatial Planning states that "National Spatial Plan is regulated by the Government". The Government Regulation Number 26, 2008 stipulates that the Leuser Ecosystem as one of the National Strategic Areas in Aceh province. However, the determination of the Leuser Ecosystem (LE) as a National Strategic Area is not making as the area that has been specifically required, both regional planning and utilization. Many people do not understand the significance of the area as a national strategic and legal implications if the violation of the provisions set out in the Act. This study aims to analyse and final the ideal legal design of the accountability concept to legislative organ in particular Regional House of Representatives (DPRK). One of The authority of DPRK is stated in Article 24 paragraph (1) of Law Number 11 of 2006 on the Government of Aceh states that: "DPRK has the duty and authority to form district/city qanuns which are discussed with the regents/mayors for mutual approval". In that law, that has not been formulated specific forms of accountability of the legislative organ. In genuine, when the DPRK has not carried out its duties and functions effectively in the field of legislation, there has no legal consequences can be given. This research uses normative legal research with statutory and conceptual approach. The outcomes of this study indicate that, the concept of legislative accountability relates to two aspects, that is political and managerial accountability. This accountability should have electoral implications on the performance of the DPRK in carrying out its functions in the field of legislation. The implementation of legislative accountability on the performance of DPRK in the field of legislation has legal and political consequences.

Penelitian ini mengkaji tentang permasalahan penyalahgunaan keadaan dalam suatu proses yang berkaitan dengan terjadinya perjanjian. Permasalahan yang timbul adalah kondisi salah satu pihak yang lemah secara sosial dan ekonomi pra pelaksanaan perjanjian, dimana pihak lemah ini dimanfaatkan oleh pihak lainnya untuk mendapatkan keuntungan melalui perjanjian tersebut. Hasil kajian menunjukkan bahwa kondisi yang lemah secara sosial dan ekonomi tersebut, maka pihak ini tidak memiliki kebebasan kehendak dalam membuat perjanjian. Kehendak bebasnya tidak penuh akibat kondisi sosial ekonominya dan kondisi lainnya dalam proses perjanjian. Kehendak bebas para pihak dalam suatu perjanjian sesungguhnya telah menyangkut asas hukum perjanjian, yakni asas kebebasan berkontrak yang memerlukan adanya kehendak bebas para pihak yang melaksanakan perjanjian. Tanpa kehendak bebas bagi para pihak yang melakukan perjanjian, maka tentunya perjanjian yang dibuat tersebut, sama halnya perjanjian yang dibuat tersebut tidak memenuhi syarat sahnya perjanjian yaitu terutama syarat adanya kesepakatan para pihak. Misuse of Other Party Condition in Standard Contract This study examines the misuse of conditions in agreement process. The condition of one party that is socially and economically weak in the pre-implementation of the agreement results in the party being utilized by the other party to benefit through the agreement. The results indicate that socially and economically weak conditions result in the party not having free will in making agreements due to their socio-economic and other conditions. The free will of the parties in an agreement actually involves the principle of agreement, namely the principle of freedom of contract which requires the free will of the parties to carry out the agreement. Without the free will of the parties, the same agreement does not meet the legal requirements of the agreement, especially the conditions for the agreement of the parties.

Discourses on the Pancasila legal state conception has been long time to be issues in several academic and scientific forums that is not finally discussed and debated. This article is exploring the problems: (1) why a legal culture is important in national legal system development? (2) How to understand the culture? (3) How the culture in the Public Mining Law? Based on the problems, it can be decribed that the crucial of legal culture in national development caused by public as a target of regulation and the imposition of punishment. In this case, it should understand the culture as a basis for the basis of national legal system by putting the Pancasila values to be united. ABSTRACT: This article aim is to describe any considerations that form the background done amendment toward the act Number 22 of 1999 and explains regarding the development current authonomy concept and its relation to the dynamic of regional people needs, especially under the act Number 32 of 2004. Through the study shows that the main consideration promulgating the act Number 22 of 1999 is caused many changes in social, and political aspect in the community life, beside that the present of this act also as an effort in responding regional area needs. It occured caused available independent and innovation challenge under impleneted decentralization in regions area. Beside the impact emerged in the act Number 22 of 1999 aplication as the background enacted revision toward this act, the revision challenge to this act emerged in the global perspective caused strategic, in which the economic globalisation and free trade which challenge competitive efisiency of the regional people. Therfore, the changes stipulation of the autonomy issue from day to day as stated above is concreat evidence that exist the dynamic of regional people needs move away routinely. This fact must be noted by the law maker and other related stakeholders so that in law making process must be sensitive and carefull in overseeing the dynamics. ABSTRACT: The regulations on spatial planning in Qanun Aceh (local law in Aceh) is an important and a priority for areas that are prone to earthquake and former tsunami. This research aims to (a) know, somprehend and analyse the power of central government and local government in the planning matter in Aceh (b) to know, comprehend and analyse the legal drafting process of Qanun regarding the Planning in Aceh. This is descriptive analytical research by juridical normative approach by obtaining data from secondary data comprise of primary, secondary and tertiary legal sources. The data then are analysed qualitatively. The research is also conducted through socio legal approach by interview to complete secondary data. The research shows that firstly, the power of the government in the spatial planning inter districts or municipalities that is about planning, using, and controlling the space. The planning should not againts provincial planning, and the last should not against national spatial planning. Qanun Aceh is enacted in terms of running the Government and especially the autonomy, the assist duty and more elaborated in the act. Legalizing alcoholic beverages under Indonesian Presidential Decree Number 10 of 2021 concerning to Investment Business raises conflicting view with Islamic norms in Indonesian as religious state. Under Islamic norm such prohibition intended to maintaining of reason (ḥifẓ al-ʿaql), while on the one hand it is for the improvement of the country’s economy (ḥifẓ al-mal). This paper measures such contradictory under maqasid Syariah auspice. The method used is a normative research with a content analysis approach. This paper found that the legalization of investment in alcoholic beverages has not reached to the stage of necessity (ḍaruriyya), while the acquisition of property (ḥifẓ al-mal) was obtained through the legalization of alcoholic beverage investments, only at the level of (taḥsiniyyah). Therefore, something related to the tahsiniya level should not negate the position of ḍaruriyya of ḥifẓ al-ʿaql. Eliminating the potential of greater mafsadah must be put forward by the Indonesian government rather than producing uncertain maslahah.

Penelitian ini untuk mengetahui alasan pemerintah kabupaten tidak melibatkan perancang peraturan perundang-undangan dari Kantor Wilayah Kementerian Hukum dan Hak Asasi Manusia dalam pembentukan qanun. Sebagaimana ditentukan dalam Undang-Undang Pembentukan Peraturan Perundang-undangan, setiap tahapan pemben-tukan peraturan perundang-undangan melibatkan perancang peraturan perundangan-undangan. Hal ini berdampak pada beberapa qanun yang dibatalkan oleh pemerintah. Metode pendekatan yang digunakan penelitian ini adalah yuridis empiris, yakni dengan memadukan data primer dan sekunder. Hasil penelitian menyatakan bahwa pemerintah kabupaten tidak memiliki anggaran untuk melibatkan perancang peraturan perundang-undangan, selain subtansi pengaturan dalam qanun belum perlu melibatkan perancang serta belum adanya kententuan yang mewajibkan melibatkan perancang dalam setiap pembentukan qanun. Penelitian ini menyarankan kepada pemerintah kabupaten untuk melibatkan perancang peraturan perundang-undangan demi menghasilkan sebuah produk hukum yang berkualitas dan dapat berdaya laku dalam masyarakat. The Involvement of Legal Drafter from Kemenkumham Aceh In Formstion of District Qanun This study aims to find out the reason for the district government not involving the drafting of laws and regulations from the Regional Office of the Ministry of Law and Human Rights in the formation of qanun. As determined in the Laws Formation of Laws and Regulations, each stage in the formation of laws and regulations involves the drafters of laws and regulations. This resulted in several qanuns being canceled by the government. This research uses an empirical juridical approach, which is by combining primary and secondary data. The results showed that the district government did not have a budget to involve the drafter of laws and regulations, in addition to the substance of the regulation in the qanun, it was not necessary to involve the designer and the absence of provisions requiring the involvement of the designer in each formation of the qanun. This research recommends that the district government involve the drafting of legislation in order to produce a qualityof legal product that can be empowered in society.

ABSTRAK: Desa atau yang dikenal dengan istilah lain merupakan satuan pemerintahan terkecil yang memiliki kewenangan otonom untuk mengatur dan mengurus pemerintahannya sendiri. Sebagai satuan pemerintahan terkecil yang berada di daerah, banyak persoalan pemerintahan terkait penataan desa yang dihadapi seperti: efektifitas penyelenggaraan pemerintahan, peningkatan kualitas pelayanan publik dan kesejahteraan masyarakat, yang tentu saja membutuhkan peranan aktif pemerintah daerah melalui regulasi yang mendukung pembangunan desa. Tulisan ini bertujuan memberikan algoritma/formula Peraturan Daerah Penataan Desa yang mampu mewujudkan desa yang maju dan berdaya saing. Dengan menggunakan pendekatan socio legal dan teori perundang-undangan serta konsep hukum pengayoman dan hukum progresif, dihasilkan algoritma peraturan daerah sebagai berikut: Peraturan Daerah Penataan Desa harus beranjak dari persoalan riil yang secara umum terjadi di suatu daerah dengan melandaskan pembentukannya pada aspek filosofi, sosiologis dan yuridis; peranan pemerintah daerah harus ditegaskan sampai pada aspek pendanaan hingga pengawasan dan evaluasi; memberikan ruang akses yang seluas-luasnya bagi desa untuk mengembangkan potensinya terkait pemekaran maupun perubahan status. Dengan demikian, diharapkan desa yang maju dan berdaya saing dapat terwujud melalui Peraturan Daerah Penataan Desa. Local Regulation Algorithm of Village Arrangement Toward A Visible and Competitive Village ABSTRACT: The village or other known term is the smallest unit of government with autonomous authority to regulate and administer its own government. As the smallest government unit in the region, many governance issues related to village arrangement are faced such as the effectiveness of government administration, improvement of public service quality and community welfare, which of course require active role of local government through local regulation that supporting village development. This paper aims to provide an algorithm/formulation of Local Regulation Village Arrangement that is able to realize a visible and competitive village. By using socio legal approach and the theory of legislation as well as the concept of hukum pengayoman and hukum progresif, the result of local regulation algorithm as follows: Local Regulation of Village Arrangement must be moved from real problem which generally occur in a region by based its formation on philosophy, sociology and juridical aspect; The role of local government should be emphasized to funding aspects up to monitoring and evaluation; Provide the widest possible access space for villages to develop their potential for division and status change. Thus, it is expected that visible and competitive villages can be realized through the Local Regulation of Village Arrangement.
