Abstract

Intellectual property protection contributes significantly to national and international economic development. Indonesia as a developing country must be able to take appropriate steps to anticipate all changes and developments as well as global trends so that national goals can be achieved. Protection for communal intellectual property is one way to reduce the practice of biopiracy, while ensuring fairness and equal treatment between owners and users of communal intellectual property. There are at least three important ways that must be considered:  First, documentation of communal intellectual property is carried out through database development; Second, there is an obligation to fulfill the requirements for Communal intellectual property for which legal protection will be applied for, whether it has been in force or has been determined. Third, the owners of intellectual property rights, must show proof of approval for the use, distribution of ownership, or profit sharing from the owner of the communal intellectual property.

Abstract

This research aims to examine the reformulation meaning of legal standing of state institutions in authority disputes cases between state institutions and the juridical implications of the legal standing of auxiliary state institutions as parties in the authority disputes cases of state institutions. Authority disputes may arise along with the development of state institutions based on their needs and interests in dealing with certain legal issues. This approach uses a normative method with descriptive analytical specifications. The results of the study show that the meaning of state institutions which can be the legal standing in the authority disputes cases between state institutions is not only interpreted by state institutions that are formed and given authority according to the 1945 Constitution. Auxiliary state institutions, which on the one hand carry out their functions as a form of derivation from the 1945 Constitution, can become state institutions litigating at the Constitutional Court. Regarding the implications of determining legal standing for state institutions that are formed by laws to litigate at the Constitutional Court, in fact it does not change the authority of the Constitutional Court itself according to Article 24c of the 1945 Constitution. The state institutions that become the legal standing at the Constitutional Court must of course be able to prove that their objectum litis is a derivation of the constitution.

Abstract

Negara Indonesia merupakan negara agraris, dimana sumber ekonomi dan penghidupan masyarakatnya sangat bergantung pada produksi maupun hasil-hasil pertanian. Hal tersebut mengakibatkan persoalan pada bidang pertanian menjadi masalah pokok bagi masyarakat Indonesia. Salah satu permasalahan pertanian di Indonesia yaitu sengketa tanah perkebunan yang berujung pada konflik perkebunan. Mayoritas konflik perkebun-an terjadi antara petani dengan perusahaan perkebunan yang menyebabkan banyak kerugian, baik material maupun non material. Konflik usaha perkebunan perlu ditangani dengan baik agar tujuan utama dari pengelolaan perkebunan dapat tercapai. Ketika konflik terjadi, pemerintah adalah pihak yang paling berwenang dalam menanganinya, pihak yang obyektif dan tidak memihak salah satu pihak yang berkonflik. Perlu adanya politik hukum penanganan konflik perkebunan oleh pemerintah yang memberikan rasa keadilan bagi pada pihak-pihak yang berkonflik. Legal Politics the Handling of the Plantation Conflict by the Government in Creating the Social Justice Indonesia is a agraris country, where economic and society lifes depend on agriculture product. It makes agriculture problems become the main problem for indonesian. One of agriculture problem in Indonesia is land plantation disputes that cause a conflict on plantation business. The majority of conflicts occur between farmers and plantation companies that cause many losses, both material and non-material. Plantation conflicts need to be handled properly so that the main objective of plantation management can be achieved. When conflict occurs, government is the most authorized party to handle it, the objective and impartial parties of either party in conflict. It is necessary to have a legal policy on handling of plantation conflicts by the government which gives a sense of justice for the parties.

Abstract

ABSTRAK. Pertimbangan hukum memorandum of understanding terkait negara menyerahkan kewenangan penanganan konflik sosial pada TNI-Polri, didasarkan pada Undang-Undang No. 2/2002 tentang Kepolisian, Undang-Undang No. 34/2004 tentang Tentara Nasional Indonesia (TNI), Undang-Undang No. 7/2012 tentang Penanganan Konflik Sosial. Undang-undang tersebut belum ada peraturan pelaksana. Agar ketentuan undang-undang tersebut efektif dalam tugas pembantuan TNI-Polri, maka TNI-Polri membuat kesepakatan dimana aturan pelaksananya tertuang dalam nota kesepahaman antara TNI dan Polri dalam menangani konflik sosial. Pertimbangan dalam membuat MoU tersebut adalah untuk mewujudkan sinergitas TNI-Polri dalam rangka memelihara keamanan dan ketertiban masyarakat sehingga dengan adanya MoU tersebut sebagai pedoman untuk melaksanakan kerjasama memelihara keamanan dan ketertiban masayarakat. Selain itu dalam MoU tersebut sesuai dengan tujuan dan sasaranya untuk mengatur bagaimana mekanisme tugas perbantuannya, dukungan logistik, serta komando dalam pelaksanaannya. The Legal Basis for Coordination and Cooperation of The TNI-Polri in the Resolution of Social Conflict ABSTRACT. The research shows that the MoU consideration in regard with the state providing the power in tackling the social conflict to the Indonesian Military-Police, it is based on the Act Number 2, 2002 on the Indonesian Police, the Act Number 34, 2004 concerning the Indonesian Military, the Act Number 7, 2012 on Social Conflict Tackling that both acts have no clear implementing rules, in making the rules effective in the cooperation hence they make MoU as an agreement between Military and Police in tackling social conflict. The consideration in making the MoU is to create the synergy between the Military and Police in keeping security and peace hence by the MoU it becomes the guidance in conducting cooperation of keeping security and peace in society. Apart from that, the MoU has been in accordance with its aim and target.

Abstract

ABSTRAK: Sejak sepuluh tahun perjanjian damai (MoU Helsinki) antara Pemerintah Indonesia dan Gerakan Aceh Merdeka pada Agustus 2005, telah mendapat tantangan dalam pembentukan Komisi Kebenaran dan Rekonsiliasi (KKR), sebagai lembaga penting untuk dugaan pelanggaran hak asasi manusia selama konflik bersenjata di Aceh. beberapa isu politik dan hukum telah menarik perhatian serius untuk kepentingan kedua belah pihak. Kebijakan melalui program uang tunai untuk korban tidak akan mencegah urgensi pembentukan KKR. Oleh karena itu tulisan ini membahas bahwa KKR ini penting tidak hanya bagi para korban yang mencari kebenaran dan keadilan, tetapi juga untuk mengembangkan kembali landasan untuk Indonesia sebagai negara berdaulat yang beradab. Urgensi Pembentukan Komisi Kebenaran dan Rekonsiliasi di Aceh: Melawan Lupa Nasional ABSTRACT: Since ten years of the peace agreement(the MoU Helsinki) between the Goverment of Indonesia and the Free Aceh Movement on August 2005, has posed a challenge over the establishment of the Truth and Reconcilition Body (TRC), as an esential institution for the suspicious of violation of human rights during armed conflict in Aceh. Several  political and legal issues  have attracted serious attention to both parties’ interests. The imposing policy of cash programt for the victims would not prevent to the urgency of the TRC establishment. This paper therefore highlights that the TRC is esential, not merely for the victims who  seeking the truth and justice, but also for  re-developing a foundation for Indonesia as a sovereign  civilised state.

Abstract

Public service has become a critical policy issue due to its limited impact on community transformation. This article explores the range of public services delivered by the Indonesian government under Act Number 25, 2009 on Public Service, as well as the standards and principles governing these services. The research conducted is normative legal research that relies on secondary data to address the issue. Findings reveal that public services can be categorized into two types: services for public goods and services for administration, which are regulated in Article 5 of Act Number 25, 2009 on Public Service. The standards for these services, mandated by the government, can be found in the first paragraph of Article 20 of the same Act. This directive compels the government to provide extensive public services to enhance the well-being of the Indonesian community.

Abstract

Penelitian ini bertujuan untuk menganalisis perubahan paradigma antroposentrisme menuju paradigma ekosentrisme dan efektivitas peraturan perundang-undangan dibi-dang lingkungan hidup di Provinsi Aceh. Penelitian ini menggunakan metode penelitian hukum normatif dengan pendekatan peraturan perundang-undangan dan kasus. Hasil penelitian ini menunjukkan bahwa paradigma ekosentrisme merupakan sebuah solusi yang tepat terhadap krisis pemikiran saat ini. Pada dasarnya, alam sama pentingnya dengan manusia. Pasal 87 ayat (1) UU No. 32 Tahun 2009 tentang Perlindungan dan Pengelolaan Lingkungan Hidup telah mengakomodir konsepsi pencemar membayar. Namun pada tataran implementasinya, dari 11 kasus pembakaran hutan di Indonesia, salah satunya di Provinsi Aceh yaitu, pembakaran hutan lindung Rawa Tripa sebagai-mana yang telah ditetapkan oleh Pemerintah Aceh dengan Qanun No. 19 Tahun 2013 tentang Rencana Tata Ruang Wilayah Aceh 2013-2033 kawasan lindung Aceh di Kabupaten Nagan Raya oleh PT. Kalista Alam yang sudah diputuskan oleh pengadilan dari tingkat pertama sampai upaya hukum luar biasa masih belum dieksekusi oleh pengadilan. The Effectiveness of Laws and Regulations in Managing Tripa Swamp Area This study aims to analyze the change of anthropocentrism paradigm towards the ecocentrism paradigm and the effectiveness of environmental legislation in Aceh Province. This study uses a normative legal research method with a statutory and case approach. The results showed that the ecocentrism paradigm is an appropriate solution to the current crisis of thought. Basically nature is as important as humans. Article 87 paragraph (1) of Law No. 32/2009 concerning Environmental Management has accommodated the concept of paying pollutants. However, at the implementation level, one of 11 cases of forest fires in Indonesia occurred in Aceh Province, namely the burning of Tripa Swamp forest in which the area has been determined by the Aceh Government by Qanun No. 19/2013 concerning Aceh regional spatial plan 2013-2033 as the protected area (kawasan lindung) in Nagan Raya Regency. The case of forest fires by PT. Kalista Alam has been decided by the court from the first instance to extraordinary legal remedies but it has not been executed by the court.

Abstract

ABSTRAK: Pluralisme hukum merupakan turunan dari realitas pluralisme sosial mereka, maka hanya ada satu sistem hukum dalam masyarakat bahwa mengabaikan kenyataan. Studi pluralisme hukum, yang awalnya terbatas pada konflik antara hukum negara dan hukum adat, atau hukum yang timbul dalam masyarakat luar hukum negara. sekarang mulai tumbuh pengakuan hukum lainnya, seperti hukum agama dan hukum internasional. Pengembangan pluralisme hukum di Indonesia mulai mengarah pada pengakuan dan penegakan hukum adat memungkinkan ruang oleh hukum nasional. Tetapi untuk konteks Aceh, pengakuan hukum oleh negara (hukum setempat disebut sebagai qanun) tentang hukum adat dapat diartikan bahwa itu adalah berarti hukum negara yang mengatur prosedur hukum adat. Qanun bahkan untuk mengatur prosedur atau mekanisme adat dan jenis sanksi. Legal Pluralism in The Dispute Settlement Mecanism of Natural Resource in Aceh ABSTRACT: Legal pluralism is a derivative of their social pluralism reality, then there is only one system of law in society is that ignoring to the reality. Study of legal pluralism which was initially limited to a conflict between state law and customary law or law that arise in the community outside of the state law. Right now start growing recognition of other law, such as religious law and international law. The development of legal pluralism in Indonesia began to lead to the recognition and enforcement of customary law allowing room by national law. But for the context in Aceh, legal recognition by the state (local law / qanun) on customary law can be interpreted that it is mean that state law regulating the procedure of customary law. Qanun even to set up procedures or mechanisms of indigenous and the types of sanctions.

Abstract

Lahirnya Undang-Undang No. 7/2016 tentang Perlindungan dan Pemberdayaan Nelayan, Pembudidayaan dan Petambak Garam, memunculkan masalah baru bagi nelayan kecil. Undang-undang ini memperbesar ukuran gross tonnage kapal nelayan kecil dari ukuran 5 GT menjadi 10 GT. Ketentuan ukuran 5 GT diatur dalam Undang-Undang No. 45/2009 tentang Perubahan Undang-Undang No. 31/2004 tentang Perikanan. Perubahan GT tersebut tidak sederhana. Masalah utama adalah terdapat perbedaan antara undang-undang yang mengatur perlindungan nelayan dengan undang-undang yang mengatur perikanan. Implikasi dari perbedaan ini tidak terbatas pada kapal semata, melainkan pada jalur penangkapan ikan, fishing ground, hingga proses perizinan kapal. Dengan semakin besar GT, maka fishing ground yang selama ini dipakai oleh kapal nelayan ukuran 5 GT, turut dipakai oleh kapal berukuran 10 GT. Hal ini berpotensi konflik sesama nelayan. Tawaran pemetaan untuk harmonisasi hukum diharapkan akan menjawab permasalahan hukum perlindungan nelayan. Legal Arrangement of Small Fishermen Protection The birth of the Act No. 7/2016 on Protection and Empowerment of Fishermen, Cultivation and Fishers of Salt, raises new problems for small fishermen. This act enlarges the gross tonnage size of small fishing vessels from 5 GT to 10 GT. The 5 GT size requirement is regulated in the Act No. 45/2009 on Amendment of the Act No. 31/2004 on Fisheries. The GT changes are not simple. The main problem is that there are differences between laws governing the protection of fishermen and the laws governing fisheries. The implications of this difference are not limited to ships alone, but to fishing lanes, fishing ground, to the licensing process of ships. With the bigger GT, then the fishing ground that has been used by fishing boats size 5 GT, also used by the ship size of 10 GT. This has the potential to conflict among fellow fishermen. The legal to harmonization mapping offer is expected to address legal protection issues of fishermen.
