Abstract

This study examines the constitutional issues surrounding the authority of the Religious Harmony Forum (Forum Kerukunan Umat Beragama/FKUB) in issuing recommendations for the establishment of houses of worship in Indonesia. The main issue lies in the tension between the guarantee of freedom of religion and worship as a non-derogable constitutional right and the administrative licensing mechanism requiring social approval and FKUB recommendations. Such a mechanism potentially gives rise to majoritarianism by placing the fulfillment of minority groups’ constitutional rights under the approval of the majority. This study aims to critically analyze the legitimacy and practice of FKUB’s authority within the framework of Indonesian constitutionalism and to formulate a reconceptualization of FKUB based on a rights-based approach. The research employs a normative juridical method combined with a socio-legal approach through the analysis of legislation, academic literature, and other relevant data. The findings reveal that FKUB’s authority has shifted from a facilitative function to a quasi-regulatory power with determinative characteristics, thereby creating potentially unconstitutional conditions in the fulfillment of religious freedom. This condition demonstrates a disharmony between the regulatory regime governing houses of worship and the principles of Pancasila constitutionalism and minority rights theory. Therefore, this study proposes the reconceptualization of FKUB as a non-discriminatory mediator without the authority to determine the fulfillment of the right to worship.

Abstract

Abstract. The high number of cases of violence against children, particularly children with disabilities, presents unique challenges for law enforcement, especially during investigations. One case that has captured public attention occurred in the Sleman judicial district. A child with a disability was abused in various ways by a caregiver at a daycare center. The research questions addressed in this study are, How does the law enforcement process for cases of violence against children with disabilities (a case study of child abuse in Sleman Regency) proceed at the investigation and prosecution stages; What challenges are encountered in the law enforcement process for cases of violence against children with disabilities at the investigation and prosecution stages? The research method used is empirical legal research, with data sources obtained through direct field research at police stations and district attorneys’ offices. Data were collected through interviews with informants. The research findings indicate that the legal enforcement process for cases of violence against children with disabilities, both at the investigative and prosecutorial stages, proceeds in accordance with procedures up to Stage 1 (the first stage), wherein the investigator submits the case file to the prosecutor’s office, and the prosecutor’s office has returned the case file (P19) to be supplemented in accordance with the public prosecutor’s instructions. The challenge faced is that the victim is no longer proactive regarding the reported case. Keywords: Violence, Children with Disabilities, Daycare, Investigation. Abstrak. Banyaknya kasus kekerasan pada anak, terutama anak dengan disabilitas menjadikan penegakan hukum memiliki tantangan tersendiri terutama pada saat pemeriksaan. Salah satu kasus yang menyita perhatian public terjadi di wilayah hukum Sleman. Anak disabilitas dianiaya oleh pengasuh dari tempat penitipan dengan berbagai cara. Rumusan masalah yang diangkat dalam penelitian ini, yaitu: Bagaimana proses penegakan hukum kasus kekerasan anak disabilitas (studi kasus kekerasan anak di wilayah Kabupaten Sleman) di tingkat penyidikan dan penuntutan; Bagaimana kendala yang dihadapi dalam proses penegakan hukum kasus kekerasan anak disabilitas (studi kasus kekerasan anak di wilayah hukum Kabupaten Sleman) di tingkat penyidikan dan penuntutan. Metode penelitian yang digunakan dalam yaitu penelitian yuridis empiris dengan sumber data melakukan penelitian secara langsung di lapangan, yakni di kepolisian dan kejaksaan. Pengambilan data dilakukan dengan wawancara narasumber. Berdasarkan hasil penelitian menunjukkan bahwa proses penegakan hukum kasus kekerasan anak disabilitas (studi kasus kekerasan anak di wilayah hukum Sleman) baik di tingkat penyidikan dan di tingkat penuntutan berjalan sesuai prosedur sampai dengan tahap 1 (pertama) yaitu penyidik melakukan kirim berkas perkara kepada pihak kejaksaan dan dari pihak kejaksaan telah melakukan pengembalian berkas perkara (P19) untuk dilengkapinya berkas tersebut sesuai dengan petunjuk Jaksa Penuntut Umum. Kendala yang dihadapi yaitu pihak korban sudah tidak proaktif terkait kasus yang dilaporkan. Kata kunci: Kekerasan, Anak Disabilitas, Rumah Penitipan Anak, Penyidikan.

Abstract

Overcrowding or excess capacity in correctional institutions is a serious problem in the criminal justice system in Indonesia. One alternative that could be a solution is the application of social work punishment. Social work punishment offers a more humane approach and does not burden correctional institutions. Aim. This study aims to examine the policy of social work sanctions in Indonesia as an alternative sentencing approach and its potential as a solution to address the issues of overcrowding in correctional institutions. It explores the feasibility and effectiveness of implementing social work penalties within Indonesia’s legal framework, specifically in mitigating prison overcrowding and improving rehabilitation outcomes for offenders. Methods. The research employs a normative juridical approach by analyzing laws, regulations, and relevant literature related to criminal sanctions in Indonesia. In addition, qualitative data is gathered through interviews with legal practitioners, corrections officers, and policymakers to understand the perspectives and readiness of the criminal justice system to implement social work penalties. Comparative analysis with international practices is also included to evaluate the adaptability and potential challenges in Indonesia. Results. Findings reveal that social work penalties can serve as an effective alternative to custodial sentences for non-violent offenders, reducing the burden on correctional facilities. Implementation challenges include the need for regulatory support, coordination among institutions, and public awareness. Nevertheless, social work sanctions show promise in promoting rehabilitative justice, lowering recidivism, and creating a more balanced criminal justice system in Indonesia.

Abstract

The enactment of Law Number 1 of 2023 concerning the Criminal Code marks a pivotal moment in Indonesia’s effort to reform and decolonize its national penal system. Among its most significant departures from prior codifications beyond the elimination of the misdemeanor category is the removal of capital punishment as a primary sanction. This measure reflects a longstanding view that the death penalty is incompatible with Indonesian cultural values and, by extension, inconsistent with Pancasila as the supreme source of national law. This study investigates Pancasila’s function as the philosophical cornerstone in structuring the criminal justice system and defining the purposes of punishment within the National Criminal Code. Employing normative legal research through statutory and conceptual approaches, the findings reveal that the open character of Pancasila ideology accommodates an explicit legislative articulation of penal objectives embracing retributive, corrective, rehabilitative, and restorative orientations simultaneously. Article 51 of the new Criminal Code further demonstrates substantive congruence with Pancasila’s five principles: (1) the preventive objective embodies the Second Principle on just and civilized humanity; (2) the social reintegration of convicts is anchored in the Fifth Principle of social justice; (3) conflict resolution reflects the Third and Fourth Principles on national unity and deliberative democracy; and (4) cultivating genuine remorse in offenders expresses the First Principle of belief in the One Almighty God. Taken together, the national criminal law reform has successfully elevated Pancasila from an abstract foundational norm into a functioning normative guide for the conduct of criminal justice.

Abstract

Abstract.The enactment of Law Number 1 of 2023 concerning the Criminal Code (the New Criminal Code) brings a fundamental repositioning to the national criminal law system, particularly through the recognition of the material legality principle that accommodates the living law in society under Article 2. On one hand, this approach represents a form of legal decolonization; however, on the other hand, it triggers a paradigmatic tension between legal positivism in Article 1 and the sociological jurisprudence in Article 2. This article analyzes the existence and dialectics of these two articles using a dogmatic legal framework that balances protective functions and integrative criminal law paradigms. The research method employed is normative legal research with conceptual and statutory approaches. This article offers a novelty in the form of a conceptual synthesis regarding the process of "positivization of customary law" through Local Regulation (Perda) instruments, as well as a dogmatic analysis of measuring fault (mens rea) in customary offenses. The research findings indicate that Article 2 paragraph (2) of the New Criminal Code functions as a constitutional anchor that compels customary law to submit to the pillars of lex scripta and lex certa of Article 1, thereby preventing overcriminalization and judicial subjectivity. Abstract

Penelitian ini bertujuan untuk mengetahui Bagaimana Penyelesaian sengketa Informasi (PSI) Publik melalui Ajudikasi Non Litigasi berbasis konsep Pelayan Publik yang Adaptif oleh Komisi Informasi Jawa Timur. Dalam Penelitian ini Analisa yang digunakan melaui pendekatan Teori Peran (Anis Rachma Utary, 2014) yang berkaitan dengan judul serta menggunakan Metode Pendekatan Kualitatif yang bersifat Deskriptif (Sugiyono, 2017). Observasi yang dilakukan dengan melakukan metode wawancara (M.Nazir, 2017) pada 6 orang informan yang mengetahui masalah penelitian.Dari Hasil Observasi yang dilakukan terkait indikator Dimensi yang ada yaitu : Regulatory Role; Enabling Role; Direct Provision of good and Services, 2 (dua) indikator menunjukan bahwa Penyelesaian Sengketa Informasi melalui Ajudikasi Non Litigasi sudah tercapai dengan baik sesuai pendekatan indikator yang ada diantaranya melalui kesepakatan damai (Mediasi) dan pencabutan gugatan. Salah satu indikator tidak tercapai karena pengelolaan penyelesaian sengketa tidak menunjukan hasil yang maksimal dalam total jumlah kesepakatan damai (mediasi) dan total jumlah pencabutan gugatan, namun secara keseluruhan berdasarkan pendekatan teori yang ada, Penyelesaian sengketa Informasi (PSI) Publik melalui Ajudikasi Non Litigasi berbasis Pelayan Publik yang Adaptif sudah sesuai. Abstract

The Village Fund Policy is a state instrument in realizing village-based national development as mandated by Law Number 6 of 2014 concerning Villages. The Village Fund was designed as a form of state affirmation for villages that have experienced development inequality for years. However, in practice, the policy of cutting or reducing the allocation of the Village Fund resulting from changes in national fiscal policy, budget refocusing, and state economic pressures has created serious problems for the direction of the legal politics of village development. This study aims to analyze the legal politics of cutting the Village Fund and its implications for the principle of social justice as contained in the fifth principle of Pancasila and Article 33 of the 1945 Constitution of the Republic of Indonesia. The study uses a normative juridical method with a legislative approach, a conceptual approach, and a philosophical approach. The sources of legal materials consist of primary legal materials in the form of laws and regulations, secondary legal materials in the form of books, journals, and scientific articles, and tertiary legal materials in the form of legal dictionaries and encyclopedias. The results of the study indicate that the cutting of the Village Fund in legal politics indicates a shift in the state's orientation from the welfare state concept to a more centralized and pragmatic fiscal approach. This policy has hampered village development, increased social inequality, weakened village community empowerment, and potentially violated the principle of distributive justice. Therefore, fiscal policy regarding Village Funds should maintain villages as the primary subjects of national development by strengthening the principles of fiscal decentralization and social justice. Abstract

This article aims to analyze the urgency of criminal law policy reform toward corruption crimes in the digital era and to examine the direction of legal renewal needed in the national legal system. The method used is normative legal research with statutory, conceptual, and library approaches. The results indicate that the development of information technology has transformed corruption patterns from conventional forms into more systematic, concealed, transnational, and electronically facilitated digital corruption. In this context, Indonesian criminal law policy still faces obstacles in the form of disharmony between the Anti-Corruption Law, the Electronic Information and Transactions Law, and Law Number 1 of 2023 concerning the Criminal Code. Criminal law reform is needed through strengthening the criminalization of digital-based corruption, expanding corporate criminal liability, modernizing electronic evidence, and synchronizing law enforcement institutions. In conclusion, criminal law policy reform is an urgent necessity so that corruption eradication can adapt to the challenges of the digital era.
