Abstract

This article discusses the women's movement in the organization BKSWI Indonesia Islam (Islam Women Cooperation Agency) West Java. Discussion of the methodology used is descriptive qualitative analysis. The conclusion based on the results of the discussion that: BKSWI can be assumed as the activities pursued women and can strengthen the organization by emphasizing equality and togetherness with me aim materialized unity among Islamic women's organizations as well as the implementation of Islamic teachings in increasing the degree and character of women in the life personal, household, and community are blessed by God, in order to realize the potential of the field of religious struggles of womanhood and society in me run that purpose, the HR (caretaker), facilities and funding access, information, culture management organizations, internal and external communications, leadership, organizational environment conducive Islamic women.

Abstract

This study aims to examine the influence of investment returns and Risk Based Capital (RBC) Tabarru Funds to the profit of sharia life insurance in Indonesia from 2014-2019. This study The type of this research is quantitative research with descriptive verification as a method. This research method uses descriptive verification method with quantitative approach. The data used in this study were sourced from the financial statements of Islamic life insurance companies in Indonesia for the 2014-2019 period. Then the data obtained were analyzed using multiple linear regression analysis and hypothesis testing consisting of t test and f test with the help of SPSS 21 software. The sampling technique uses non probability sampling with purposive sampling technique. Based on the results of the study it can be seen that the development of investment returns on Sharia Life Insurance in Indonesia has fluctuated and even suffered losses. While the development of Risk Based Capital (RBC) has increased and decreased but overall above 120% as determined by the government. Likewise, the profits earned in each year fluctuate. The results of statistical tests show that investment results partially have a positive effect on profit and Risk Based Capital (RBC) of Tabarru funds partially has a negative effect on profit. Simultaneously investment return and Risk Based Capital (RBC) affect on profit. In addition, the results of the coefficient of determination (R2) were obtained which obtained a value of 81%. This shows that the variable investment returns and Risk Based Capital (RBC) can affect earnings by 81% and the remaining 19% is influenced by other variables not used in this study.

Abstract

Families in Siderang Legok, Cintanagara Village, Cigedug District, Garut Regency, which have family members between 6-14 people, are used to marrying off their children at a young age under the terms of the Marriage Law. This study aims to obtain data and information about internal family communication patterns which consist of causes of early marriage and high childbirth rates; the role of the government and related parties and the daily life of local families in caring for several children. The research method is qualitative with a case study approach. While the subject of research is the head of the family/deputy head of the family as actors, assisted by village officials who understand the actual conditions of the local community. The theory used is prophetic communication consisting of (1) Humanization, (2) Liberation, and, (3) Transcendence. The results of the study show that marriage at an early age which has an impact on childbirth rates is a normal matter as part of an effort to humanize humans because early marriage is better than free association with people of different sexes. Then, the government, through the BKKBN and village apparatus, who have tried their best, have failed to get significant results. Family planning continues, early marriage is still ongoing, and the birth rate is still high. What is unique, their daily life looks as usual, does not seem worried or restless. They are used to having many children and feel obligated to care for them, which is strengthened by a religious atmosphere that makes religion (Islam) the mainstay. The conclusion is that in the Siderang Legok family environment, there are no worries about getting married at an early age and having many children, because once you are married, whatever happens, you have to be ready to face it. Appeals and assistance from the government and related parties are still being followed even though the results achieved are not satisfactory. Then the back of religion ranks first.

Abstract

The Qur’an’s verse, Al-Baqarah: 283, explains rahn in a trip condition, however, the fact that the enforcement of rahn also occurs in muqim condition. Syar’ah fiduciary needs to be included into law as Muslims in Indonesia are the majority and based on the decision of OKI (Islamic Conference Organization), Indonesia is as an Islamic country. Therefore, by being supported by Pancasila, it generates God Sovereignty theory. The research method used is normative juridical method: that is the law research method done by researching literature. The research shows that: 1) the fiduciary truth (rahn) in Islamic law is (syara’) making a thing having value of property in the view of Syara’ as a debt guarantee, which enables to take the whole or part of the debt of the thing. Method of istinbath al-hukmi is related to the fiduciary done by the fiduciary institution using qiyas (metaphor), 2) the emergence of dualism of sharia fiduciary institution and sharia banking was caused by the existence of fatwa of National Sharia Board MUI (Indonesian Council of Religious Scholars) No: 25/DSN-MUI/lII/2002, and Fatwa of National Sharia Board MUI No: 26/DSN-MUI/II1/2002, in which sharia financial institution is allowed to produce the product which accords with syarih principles, 3) critic towards law No. 21, 2008 and governmental regulations No. 51, 2011 are not directly clarified, but has similarities and explanations concerning a product that must accord with sharia principles.

Abstract

Buying and selling or trading in the term fiqh are called al-Ba'i which, according to etymology, means selling or replacing. The word al-Ba'i in Arabic is sometimes used for the understanding of his opponent, namely the word al-Syira (buy). Thus, the word al-Ba'i means selling, but also means buying. In terminology, buying and selling is an agreement to exchange objects or goods that have a good value between the two parties, one receives objects and the other receives them in accordance with an agreement or provision that has been justified and agreed upon. In the Qur'an, there are many statements that describe the life of the Arabs, including trade problems. Islam is very concerned about the problem of trade in this Arab nation by setting for them what they need. Many of the Prophet's hadith mention the legal issues of buying and selling, monopoly, accounts payable, profits, etc. Jahiliyah Arabs have a market as a center of trade. Usury is one type of economic transaction that is actually carried out and developed in Arab society. In Islam, buying and selling if it contains usury, illicit goods, reduces scales, and by force.

Abstract

Religious tolerance is a critical issue in pluralistic societies such as Indonesia. Without tolerance, the expressions of beliefs can lead to fanaticism, conflict, and hostility that negatively impact social security and stability. This article addresses the dilemma of religious tolerance by exploring and connecting the concept of “the Other” in Emmanuel Levinas’ thought as an ethical subject who requires protection and respect for the individual with the discussion of tolerance indicators in the context of religious moderation. This qualitative study employs a literature review method, with data collected through literature review and analyzed descriptively using Emmanuel Levinas’ philosophical perspective. The results indicate that religious tolerance in the framework of religious moderation, as found in Emmanuel Levinas’ thought, entails the recognition and respect for the identity of the “Other”. The “Other” is an ethical subject with the right to live free from discrimination and oppression. In the framework of tolerance, the “Other” is not merely allowed to exist and differ but necessitates the growth of respect and appreciation through fair and respectful treatment of those who are different. From Levinas’s viewpoint, the practice of religious tolerance must be carried out by considering the concept of ethical relationships between individuals and “The Other.” Religious tolerance manifests ethical responsibility to recognize and respect the existence of others with different religions and beliefs. This article proposes that Levinasian philosophy can provide a useful critique and proposal for the dilemma of religious tolerance in pluralistic societies

Abstract

Modern community today showed the current issues that related to the complexity of personality. Islam offers a therapeutic meaning to overcome the global human crisis through the holy Quran. The aim of this study is to provide a qualitative analysis of logo therapy alternative to global human being who has experience critical conditions such as for someone who becomes the door of death (Sakarat al-Maut), acute illnesses, HIV Aids, kidney illness, stroke, coma, depression or stress, due to the hazards, and the other refractory diseases. Through the Quranic analytical perspective, the result of this study showed that the therapy of Islamic meaning based on the holy Quran can be seen as the broader and more comprehensive than the meaning therapy by Viktor E. Frank’s method.

Abstract

This study is to discuss the tabarru contract in the form of guaranteeing oneself (Kafalah and Wakalah) and giving something (Grants, Gifts, Waqf, Zakat, Infaq, Alms), where basically the tabbaru contract is giving something (giving something) or lending something. (leding something) adak tabarru the purpose is to help each other. When the tabarru contract has been agreed, it cannot be converted into a tijarah contract whose purpose is to gain profit, except by agreement between the two parties to the contract. However, it is different from the tijarah contract that has been agreed upon, this contract may be changed into a tabarru contract if the party whose rights are retained gives up their rights, thereby canceling the obligations that have not carried out their obligations. The function of this tabarru contract, apart from the orientation of this contract, is to seek the afterlife, not for commercial purposes. However, in its development, this contract is often related to commercial transaction activities, because this tabarru' contract can function as an intermediary that bridges and facilitates the tijarah contract

Abstract

This research is to find out how the leadership system, strategy, process, results of constraints and support as well as hypothetical concepts that exist in Inabah. The theory in this study refers to Reconstructionism theory. The method used is descriptive analytical with a qualitative approach. The research techniques using observation techniques, interviews and documentation as a data collection tool. The results of this study: first, the leadership system developed at Inabah indicated the transformational leadership model/pattern. Second, the strategy or approach used by Inabah leaders towards drug victims through the Qodiriyah Naqsabandiyah Order (Tarekat Qadiriyah-Naqsabandiyah [TQN]) with a religious non-medical approach. Third, the process developed at Inabah with therapy underwent three main practices with the TQN method which was carried out continuously and continuously through activities such as purification (thaharah ), bathing, ablution, prayer, and dhikr. Fourth, the results developed can be said to be successful if the santri have carried out all education in the Suryalaya, Fifth, Islamic boarding schools. Support and support in Inabah is: Serba Bakti Foundation, Forrnal and Non-formal educational institutions, Koperasi Hidmat, Inabah Youth Cottage, Mrs. Belia, Young Generation Suryalaya, Radio Inayah, Sinthoris Magazine. Sixth, the hypothetical concept of the leadership of Abah Anom refers to the purpose of the TQN which is the same as the goal of Islam itself, which is to guide people to get the blessing of Allah, prosper in the World and happy in the Hereafter.

Abstract

A commercial insurance contract is deemed invalid by many Muslim scholars due to the fact that it is a mu`awada (financial exchange) contract, which is overwhelmed by prohibited elements such as gharar (uncertainty), riba (interest), and maysir (gambling). As an alternative, a Shari`acompliant insurance scheme (also known as takaful) that supposedly run on the principles of mutual co-operation was proposed by the scholars and subsequently institutionalized in the late 1970s. Nevertheless, after more than 30 years, it appears that the majority of takaful operators currently exist worldwide were established as joint-stock or public limited companies (PLCs). As a result, it could be argued that the original concept of takaful was later overshadowed by the element of profit-making as observed in commercial insurance entities. This paper therefore sets out to examine those issues, which directly relate to this form of commercialisation. It argues that since the establishment of insurance companies based on commercial framework is impermissible, it could possibly affect the validity of present takaful arrangement. This study is mainly qualitative and relies greatly upon the documentation method. It is also based on afieldwork method, since the business models adopted by several takaful operators in Malaysia are carefully examined. In general, it is found that the characteristics of a commercial takaful entity may not necessarily be similar to that of its conventional counterpart.
