Abstract

In the civil procedural law, the certainty of the truth of the events proposed at the trial depends very much on the evidence carried out by the parties concerned. As a consequence, the truth is said to exist or be reached if there is a match between the judge's conclusion (the result of the process) and the events that have taken place. Whereas if the opposite happens, it means that the truth is not reached. Research conducted by the author is research based on document research (Library Research), meaning that the data that are used as a reference in this study are facts in the field that have been documented in the Court's decision. The results of this study indicate that the contribution of evidence in court is very necessary, because one of the duties of the judge is to investigate whether there is a legal relationship on which the lawsuit really exists or not. The existence of this legal relationship must be proven by the parties in court.

Abstract

This article discuss about method of explanation of akidah in the work of patani ulama and and method of explanantion of imam al-Nawawi about akidah and recognizing clearlly similarities of method of explanation of ulama patani with imam al-Nawawi. The article is qualitative study using library risearch and analytical data in the form of descriftive with two principle of deductive an inductive. Researh findings show that method of al-nawawi in explaining aqidah is a combination of Salaf and Khalaf, but patani ulama use rather the khalaf method. This study also shows that there is a similar method between the two different ulama in dealing with explanation of aqidah. However, there are also points of different between them in the way they use Salaf and khalaf. Imam al_Nawawi uses Salaf method for the first following by Khalaf on the contrary the Patani Ulama applied Khalaf as starting point followed by Salaf.

Abstract

The development of social, cultural and economic forms of human growth today is based on character development as an inseparable part of every human individual. Management of Character Education Management in Discipline Development is part of forming human resources towards sustainable life. Resume & Eulogy Theory as the basis of research. Qualitative method through a process of observation, documentation and interviews developed with a triangulation system. Research questions 1) How is Character Education Planning in Discipline Development; 2) How to Organize Character Education in Discipline Development; 3) How is the Implementation of Character Education in Discipline Development; 4)) How to Supervise Character Education in Discipline Development. The results showed that the Character Education Planning in Discipline Development is defined as an attitude in which the development of knowledge, attitudes and skills is balanced. In the process of organizing all the components of the work unit structure in governance put forward the goal of building the character of the discipline itself. Implementation, the form of development of the educational implementation process leads to the formation of discipline in line with the basic goals of education. Supervision is arranged in line with the planning that human resources aim at achieving its goals.

Abstract

This article discusses strategic management at the school for educators. Strategic management of the school for educators is to support the development and construction of an educational institution for excellence and quality. If in the modern era which are all based on technology, computers, applications and the Internet, it is very unfortunate if there is an educational institution that still apply strategic management within the school administrative data processing by hand. It will not be effective and will take a very long time. With the application of finger print-based strategic management to monitor it all, it will facilitate an educational institution in managing data administration required, especially to see the work ethic of an educator as seen from the attendance list presence. This study aims to determine the extent to which management implementations finger print-based strategies to improve work ethics of teachers in the State Madrasah Aliyah (MAN) 1 Bandung. The research was conducted by interview or observation related technologies, applications, and data administration for educators in the State Madrasah Aliyah (MAN) 1 Bandung. With the finger print-based strategic management, it will be easier for the school to monitor and assess the work ethic of existing educators in the school.

Abstract

MTsN 01 Kota Gorontalo and MTsN 01 Bone Bolango are educational institutions that focus on character development and have programs that can shape the character of their students. The results showed that: First, interpersonal communication has a positive and significant effect on the quality of character education at MTsN 01 Kota Gorontalo and MTsN 01 Bone Bolango. Second, Teacher Pedagogic Competence has a positive and significant effect on the Quality of Character Education at MTsN 01 Kota Gorontalo and MTsN 01 Bone Bolango. Third, interpersonal communication and teacher pedagogic competence together have a positive and significant effect on the quality of character education at MTsN 01 Kota Gorontalo and MTsN 01 Bone Bolango. Fourth, Interpersonal Communication has a positive and significant effect on Student Learning Achievement. Fifth, Teacher Pedagogic Competence has a positive and significant effect on Learning Achievement at MTsN 01 Kota Gorontalo and MTsN 01 Bone. Sixth, interpersonal communication and teacher pedagogical competence together have a positive and significant effect on learning achievement at MTsN 01 Kota Gorontalo and MTsN 01 Bone Bolango.

Abstract

The main problem in this study is the decline in student achievement, which according to the researcher's observations, the school environment and student motivation both have an impact. Based on these views and thoughts, the researcher desires to do more study the impact of the school environment and learning motivation on student accomplishment, focusing on Accounting and Institutional Finance. This study's questionnaire was 156 respondents. The descriptive and verification approaches with a quantitative approach were conducted for data analysis. Path analysis is the analytical technique used, and it is used to showcase a relationship that reveals how much effect an indicated variable has, either directly or indirectly, on many other variables. The results of this research show that partially and simultaneously, Student achievement in Accounting and Institutional Finance is favorably and strongly influenced by the school environment and learning motivation. The school environment and learning motivation variables both have an impact on student performance. This research only focuses on one vocational school and includes the school environment and motivation in measuring student achievement; many other variables have not been studied.

Abstract

This article discusses the concept of bribery in the perspective of hadith jurisprudence and its impact on human life. By looking at some definitions of bribery, it is found that all definitions give different meanings, goals, and aspects, there are essence of bribery, or which have similarities to them (such as gratification), because bribery is a social phenomenon and has many patterns making it difficult to define definitions the right and limit the meaning. But a definition that explains the meaning of bribery objectively, namely: Giving given to someone (an official) so that the right becomes wrong and wrong becomes right, because it summarizes the essence of bribery practice and is considered a comprehensive definition of all banned aspects of bribery, so let us choose this. In Qur’ān and Ḥadīth, Allah forbade his servant to eat bribery property, because this property was included as part of consuming other people's assets with vanity. Even though bribery is called a variety of terms in daily life, such as facilitation payments, tips, etc., the legal status and prohibition cannot change with these various terms. Bribes also have the potential to create hate conflicts and hostility among members of the community. Because in essence, bribery is only a tool for those who hold policies to oppress the weak. On the other hand, those who surrendered their wealth to the recipients of this bribe gave their assets very forcefully.

Abstract

This article tries to discuss about law of propagation in hadith perspective. By Using library research, this article found that for every Muslim, da'wah is an obligation that cannot be negotiable. The obligation of da'wah is something that is impossible to avoid from his life, because it is very attached to self-recognition as adherents of Islam. Indirectly, every Muslim as the bearer of missionary mission. Based on the results of the analysis, especially the study of the hadith and according to most scholars in general the da'wah law is farḍ kifāyah, meaning that if it has been done by a group of people, the burden of that obligation falls from the others.

Abstract

Pesantren (Islamic boarding school) is the oldest Islamic institution in Indonesia that often affiliated to the largest mass Muslim organization Nahdlatul Ulama. This organization is well known for its stance to uphold moderate, tolerance Islam and accepting pluralistic state based on Pancasila. Pesantren also often referred as the barometer to understand the way of thinking of Muslims grass root in Indonesia because many Islamic figures in Indonesian village are alumni of pesantren.  There are debates among scholars on whether religious violence has a root in religious doctrine or it is caused by factors outside religion such as poverty or injustice. By assuming that both inside and outside factors have significant contribution to violence or radicalism this study will discuss the doctrine that potentially can be used to justify violence and intolerance by reviewing the opinion of pesantren leaders in West Java on jihad, violence or intolerance and power. This study is aimed to examine whether the commitment of Muslim leaders in national level on democracy and plurality is supported by grass root particularly from pesantren leaders.  Overall the study found that although they agree that democracy is compatible with Islam, this study reveals that their acceptance to pluralism still be questioned as evidenced by almost half of them supported theocratic caliphate carry out by radical group. Although many argued that pesantren promotes tolerance and pluralism, nevertheless this  study shows that some of their teaching tacitly supported violence act in the name of religion that will tarnished the effort of Indonesia to synchronize Islam, democracy and modernity. It means that many of them actually not wholeheartedly accepted democracy and pluralism.

Abstract

Regulation of the Minister of Religion (PMA) Number 2 of 2012 concerning Madrasah Supervisors and Supervisory Islamic Religious Education (PAI) at Schools, is a policy product issued by the Ministry of Religion which gave rise to a new nomenclature, amidst the regulations of School / Madrasah supervisors, namely supervisory functional positions. PAI on Schools. This regulation has implications for the implementation of PAI supervisor duties at schools. This research was motivated by the inadequate implementation of the activities of Islamic Education Supervisors at schools in the Sukabumi District Education Office. The focus of this research is the implementation of Regulation of the Minister of Religion (PMA) Number 2 of 2012 for Islamic Education supervisors at schools in the Sukabumi District Education Office. The purpose of this research is to find out about: 1) Implementation of PMA Number 2 of 2012 for PAI supervisors in the Education Office of Sukabumi Regency; 2) Problems faced by PAI supervisors at the Education Office of Sukabumi Regency in implementing PMA Number 2 of 2012, and 3) Efforts to improve in the future in implementing PMA Number 2 of 2012. This study used a qualitative approach with descriptive methods, data collection was carried out through interviews, observation and documentation study. This is to make a systematic, factual and accurate description of the phenomenon under study. The results of the research findings show: 1) The implementation of PMA Number 2 of 2012 for PAI supervisors at the Education Office of Sukabumi Regency is not running optimally; 2) The root of the main problems faced by PAI supervisors: Policy standards; Budget; Psychological burden; Coordination; and performance appraisal. 3) Improvement efforts are made by: Directorate of PAI by compiling a draft revision of PMA Number 2 of 2012; The Sukabumi District Education Office issues a SK to assign a school supervisor to the PAI supervisor; The Ministry of Religion of Sukabumi Regency has substantially increased the pattern of guidance; PAI supervisors increase creativity and motivation in carrying out their duties and supervisory functions. Recommendations for this study are addressed to the PAI Directorate of the Ministry of Religion of the Republic of Indonesia, in the form of: PMA Revision Number 2 of 2012 so that it is relevant to the regulations of school / madrasah supervisors; Review of Islamic Religious Education (PAI) supervisor nominations in schools; Adequacy of the budget for improving the quality of supervisors; and Strengthen coordination between related institutions.
