Abstract

ABSTRACTFood waste is growing more prevalent in the globe these days. The global food supply chain and environmental sustainability may encounter issues as food waste increases. According to Economist Intelligence Unit data, Indonesia ranks second in the world behind Saudi Arabia, with an estimated 300 kg of food waste per person each year. The environmental impact is a concern in food supply. Author examines how management of food waste at Untirta Pakupatan Canteen reviewed from Serang City Regional Regulation Number 7 of 2021, using a legal research method that draws empirical facts from human behavior, obtained through questionnaires, interviews, and direct observation. Food waste is food that is wasted due to negligence in the production, processing, distribution processes, or food that is rejected because it is unfit for consumption. According to the research, the phrase food waste is not well understood by general people since they have not received instruction on how to manage trash in an ecologically friendly manner. The manager of the canteen has not provided waste sorting facilities, reduce waste, and handles waste by limiting waste generation, recycling waste, and/or reusing waste in accordance with Regional Regulation of Serang City Number 7 of 2021 and others.Keywords: Food waste; Sustuinable Develpoment Goals; Canteen. ABSTRAKFood waste menjadi semakin penting di dunia akhir-akhir ini. Sistem pasokan makanan global dan kelestarian lingkungan mungkin akan menghadapi tantangan karena meningkatnya food waste. Menurut data studi dari Economist Intelligence Unit, dengan perkiraan 300 kilogram sampah makanan yang dihasilkan setiap tahunnya per orang, Indonesia menempati peringkat kedua di dunia setelah Arab Saudi. Dampak lingkungan dari meningkatnya food waste yakni masalah rantai pasokan makanan. Peneliti meneliti bagaimana pengelolaan sampah makanan yang tidak dikonsumsi di Kantin Depan Untirta Pakupatan ditinjau dari Peraturan Daerah Kota Serang Nomor 7 Tahun 2021 Tentang Pengelolaan Sampah menggunakan metode penelitian hukum yang menarik fakta empiris dari perilaku manusia, yang diperoleh dari kuesioner, wawancara serta observasi langsung. Food waste ialah bahan makanan yang hilang akibat kecerobohan dalam proses produksi, pengolahan, dan distribusi, atau sisa makanan yang dibuang karena tidak dapat dikonsumsi. Berdasarkan penelitian, istilah food waste belum terlalu diketahui masyarakat karena belum mendapatkan edukasi terkait pelayanan dalam pengelolaan sampah secara baik dan berwawasan lingkungan. Pengelola kawasan kantin depan Untirta Pakupatan belum menyediakan fasilitas pemilahan sampah, tidak melakukan pengurangan sampah, dan penanganan sampah melalui pembatasan timbulan sampah, pendauran ulang sampah, dan/atau pemanfaatan kembali sampah sebagaimana Peraturan Daerah Kota Serang Nomor 7 Tahun 2021 Tentang Pengelolaan Sampah dan peraturan lainnya.  Kata Kunci : Sampah Makanan; Pembangunan Berkelanjutan; Kantin.

Abstract

Health and safety factors are important aspects in the tourism industry amid the Covid-19 pandemic. The tourism sector has begun to tighten the implementation of health protocols using the CHSE guidelines. CHSE is a program of the Ministry of Tourism and Creative Economy in the form of implementing health protocols based on Cleanliness, Health, Safety and Environment Sustainability. The application of this program is to certify business actors in the tourism industry. The aim of this research is to provide advice to tourism businesses to continue implementing CHSE supporting indicators well.Identification of the problem in this study, namely, How is the implementation of CHSE standards at Hotel Horison Rahaya Resort Lebak as a tourist accommodation providerbased on Permenparekraf Number 13 of 2020? And how is the implementation of CHSE standards at Hotel Horison Rahaya Resort Lebak as a tourist accommodation provider based on Permenparekraf Number 13 of 2020? The theory used is the theory of tourism management and supervision theory. This study uses an empirical juridical method. The specification of the research used is descriptive analytical research. This study uses primary data sources and secondary data. Data collection techniques in this study are using field research techniques, library research. Data analysis in this study used a qualitative descriptive approach. The result of this study is that Permenparekraf Number 13 of 2020 was not implemented. The conclusion of this study is that the Horison Rahaya Resort Hotel has passed the CHSE audit by the team from Sucofindo by fulfilling 70 CHSE assessment indicators, but there are 12 assessment points that are not met. Supervision by the Regional Government does not work in accordance with Article 20 of Permenparekraf Number 13 of 2020 because there is no coordination with the Certification Agency so that the form of direct supervision, namely monitoring and evaluation, is not carried out by the Regional Government or Sucofindo which has supervisory duties. Suggestions from this study are that the hotel should continue to improve services without reducing the aspects contained in the assessment indicators so that they continue to experience progress. The CHSE monitoring process should be periodically evaluated to ensure that the protocols implemented are truly effective.

Abstract

The Indonesian nation is a highly cultured nation and this culture is valuable for civilization. The state must respect, preserve, protect and develop national culture. The problem is first, how is the authority of the Regional Government in preserving the cultural heritage of Gedung Juang 45 Serang City based on Serang City Regional Regulation Number 6 of 2021 concerning Cultural Heritage Preservation. Second, what are the obstacles and efforts of the Regional Government in preserving the cultural heritage of Gedung Juang 45 Serang City based on Serang City Regional Regulation Number 6 of 2021 concerning Cultural Heritage Preservation. The theory used is the theory of authority and The theory of preservation of cultural heritage. The research method is the empirical juridical legal method. The research specification used is analytical descriptive research. Data sources are primary data research and secondary data. Collection techniques Data is carried out by literature research and field research. Data obtained in this writing uses a qualitative descriptive way, namely analysis that describes or explains the existing rules or regulations, basic principles and applicable theoretical theories. Conclusion of the study on the authority of the Regional Government in the preservation of the cultural heritage of Gedung Juang 45 The Regional Government is authorized to preserve the cultural heritage of Gedung Juang 45 in Serang City in regulating and managing its own government affairs and must be based on law. Second, the constraints are the budget aspect that is not enough for maintenance and the street vendors who sell around Juang 45 Building in Serang City. Meanwhile, the effort is the need for government support to pay attention to the damage that exists in cultural heritage buildings, and also supervise the protection, development, utilization and implementation of revitalization and adaptation of cultural heritage buildings, cultural heritage structures, and cultural heritage areas. The advice given by the author is that the Government should provide more support to pay more attention to cultural heritage and the Government should make an appeal and socialization to pay more attention to cultural heritage objects.

Abstract

Regulation of the Minister of Agrarian Affairs and Spatial Planning/National Land Agency Number 21 of 2020 concerning Handling and Settlement of Land Cases states that the authority of the Land Office is to provide efforts to resolve land disputes by providing mediation for the parties to the dispute. Land disputes as a land problem in Indonesia which continue to occur every year because land is an asset that has high value for human life so it is necessary to increase land administration, one of which is by providing efforts to resolve land disputes in the form of mediation. The theory used is authority theory and alternative dispute resolution theory. the authority of the North Jakarta Administrative City Land Office in carrying out mediation has been carried out in accordance with the Regulation of the Minister of Agrarian Affairs and Spatial Planning/National Land Agency Number 21 of 2020 by holding mediation in 67 cases out of 113 cases reported in the 2016-2020 period with 3 successful cases peace. Abstract

ABSTRACTThe Mount Halimun Salak National Park (TNGHS) area continues to experience illegal logging caused by irresponsible human actions carrying out illegal logging in the area which causes deforestation and also degradation of the forest. Therefore, it is necessary to enforce the law against the perpetrators of illegal logging in order to create a deterrent effect for the perpetrators. The aim of this research is to determine the form of law enforcement against perpetrators of illegal logging in the Halimun Salak Forest and to determine the impact and prevention of illegal logging in the Halimun Salak Forest. The research method used in this research is a normative legal research method which uses a statutory approach and comes from primary and secondary data sources which are then analyzed using qualitative analysis methods. The results of the research in this study are that the government has actually made various regulations related to law enforcement against perpetrators of illegal logging, both in the form of laws and regional regulations to deal with this problem. The government has also implemented strict sanctions for perpetrators of illegal logging. However, these regulations have not been fully implemented well because there is still a lack of real action or implementation from the law enforcers themselves, which makes it difficult to handle or act on this problem optimally. Suggestions, in this case, the government can make preventive efforts first so that illegal logging can be overcome so that the community can avoid the impacts that occur due to illegal logging. Prevention can be done by granting appropriate permits, appropriate supervision and approaching the surrounding community. Apart from that, prevention can be carried out preventively, pre-emptively and also repressively. Keyword: Law Enforcement, Illegal Logging, Law, Halimun Forest ABSTRAKKawasan Taman Nasional Gunung Halimun Salak (TNGHS) terus mengalami penebangan liar yang diakibatkan oleh ulah tangan manusia yang tidak bertanggung jawab melakukan penebangan secara illegal pada kawasan tersebut yang menyebabkan terjadinya deforestasi dan juga degradasi terhadap hutan tersebut. Oleh karena itu perlu adanya penegakan hukum terhadap para pelaku penebangan liar tersebut agar tercipta efek jera bagi para pelaku. Tujuan penelitian ini adalah untuk dapat mengetahui bentuk penegakan hukum terhadap pelaku penebangan liar Hutan Halimun Salak serta untuk mengetahui dampak dan pencegahan terhadap penebangan liar di Hutan Halimun Salak. Metode penelitian yang digunakan dalam penelitian ini adalah metode penelitian hukum normatif yang mana menggunakan pendekatan perundang-undangan serta berasal dari sumber data primer dan sekunder yang kemudian di analisis dengan metode analisis kualitatif. Hasil penelitian dalam penelitian ini adalah bahwa pemerintah sebenarnya sudah membuat berbagai regulasi terkait dengan penegakan hukum terhadap para pelaku penebangan liar baik itu dalam bentuk Undang-Undang maupun Peraturan Daerah untuk menangani permasalahan tersebut. Pemerintah juga telah menerapkan sanksi-sanksi yang tegas bagi pelaku-pelaku penebangan liar. Namun, regulasi-regulasi tersebut belum sepenuhnya berjalan dengan baik karena masih kurangnya tindakan nyata atau implementasi dari para penegak hukum itu sendiri yang menimbulkan sulitnya menangani atau menindak permasalahan ini secara optimal. Saran, pemerintah dalam hal ini dapat melakukan upaya pencegahan terlebih dahulu agar tindakan penebangan liar ini dapat diatasi sehingga masyarakat dapat terhindar dari dampak-dampak yang terjadi akibat penebangan liar tersebut. pencegahan yang dilakukan dapat dilakukan dengan pemberian izin sesuai, pengawasan yang sesuai dan melakukan pendekatan dengan masyarakat sekitar. Selain itu, dapat dilakukan pencegahan secara preventif, pre-emtif dan juga secara represif. Kata Kunci: Penegakan Hukum, Penebangan Liar, Hutan Halimun

Abstract

One of the problems related to the use of digital technology that has no boundaries in its use is the presence of an entertainment media in the form of electronic games, which in its content contains harmful elements if it can be accessed freely by children on the internet. There needs to be supervision by the government in handling policies regarding the classification of games in Indonesia, because Indonesia has unique customs and cultural values that are not owned by other countries in the world. How is the authority exercised by the Classification Committee in testing the suitability of game classification results in Indonesia. In addition, the theories used are the theory of authority and the theory of supervision. This research uses a research method that is empirical juridical. The research specification used is descriptive analytical. The research data sources used are primary and secondary data. Data collection techniques used in this research. This research uses field research techniques, library research. Data analysis in the research used is descriptive qualitative approach. The result of the research is an age game rating logo policy that is not in accordance with the rule of law (das sollen and das sein). Conclusion based on the Regulation of theMinister of Communication and Information Technology Regulation Number 11 of 2016 concerning Classification of Electronic Interactive Games, that the Classification Committee in carrying out the authority to test the suitability of online game classification results is to carry out a testing process related to age game ratings in accordance with the age classification applied through the game rating logo provided through the classification registration process through the IGRS policy (Indonesian Game Rating System). Supporting factors in the authority of the Classification Committee. Classification Committee's authority in the form of support from the Directorate General of APTIKA's Work Team, the existence of a plan for international cooperation, adequate facilities and facilities. While the inhibiting factors are legislation and society Suggestions. expected, namely an evaluation related to the legal provisions contained in the regulation so that it is binding, has obligations and sanctions. Abstract

ABSTRACTThe Javan rhino, also known as Rhinoceros sondaicus, is a protected species under the Minister of Environment and Forestry Regulation No. 106 of 2018 concerning Protected Plant and Animal Types. The Javan rhino population is currently mainly located in Ujung Kulon National Park (TNUK). According to the International Union for Conservation of Nature (IUCN), the Javan rhino has been declared in the Critically Endangered category, which indicates a level of risk approaching extinction in its natural habitat. The Javan rhino faces serious threats due to poaching which has caused a significant decline in its population. This research highlights the Javan rhino poaching incident in Ujung Kulon National Park (TNUK) which occurred in August 2023. Collaboration between the TNUK Center, the police and the Ministry of Environment and Forestry succeeded in identifying six perpetrators through camera traps. To date, the six perpetrators have not been punished due to requests from the public for a postponement of detention. This case shows the seriousness of illegal hunting of the Javan Rhino which has long threatened the Javan Rhino population. Even though regulations have been issued, such as Law Number 5 of 1990 concerning Conservation of Biological Natural Resources and Ecosystems, as well as Pandeglang Regency Regional Regulation No. 2 of 2013 concerning Management of Ujung Kulon National Park, illegal fishing still continues. The research method used in this research is normative legal research with qualitative juridical analysis of legal materials. The results show that the implementation of Pandeglang Regency Regional Regulation No. 2 of 2013 concerning Management of Ujung Kulon National Park has not been implemented optimally, especially in terms of law enforcement for perpetrators of illegal arrests. However, the local community and government continue to strive to maintain the Javan rhino population TNUK.Keywords: Javan Rhinoceros, Illegal Capture, Conservation. ABSTRAKBadak Jawa, yang juga dikenal sebagai Rhinoceros sondaicus, termasuk dalam spesies yang dilindungi berdasarkan Peraturan Menteri Lingkungan Hidup dan Kehutanan No. 106 Tahun 2018 mengenai Jenis Tumbuhan dan Satwa Dilindungi. Populasi badak Jawa saat ini utamanya berada di Taman Nasional Ujung Kulon (TNUK). Menurut International Union for Conservation of Nature (IUCN), badak Jawa telah dinyatakan dalam kategori Kritis (Critically Endangered), yang mengindikasikan tingkat risiko mendekati kepunahan di habitat alaminya. Badak Jawa menghadapi ancaman serius akibat perburuan liar yang menyebabkan penurunan populasi secara signifikan. Penelitian ini menyoroti insiden perburuan badak Jawa di Taman Nasional Ujung Kulon (TNUK) yang terjadi pada Bulan Agustus 2023. Kolaborasi antara Balai TNUK, polisi, dan Kementerian Lingkungan Hidup dan Kehutanan berhasil mengidentifikasi enam pelaku melalui kamera trap. Hingga saat ini, keenam pelaku belum dihukum karena permintaan penundaan penahanan dari masyarakat. Kasus tersebut menunjukkan seriusnya perburuan ilegal terhadap Badak Jawa yang telah lama mengancam populasi Badak Jawa. Meskipun peraturan telah dikeluarkan, seperti Undang-Undang Nomor 5 Tahun 1990 tentang Konservasi Sumber Daya Alam Hayati dan Ekosistemnya, serta Peraturan Daerah Kabupaten Pandeglang No. 2 Tahun 2013 tentang Pengelolaan Taman Nasional Ujung Kulon, penangkapan illegal masih terus ada. Metode penelitian yang digunakan dalam penelitian ini adalah penelitian hukum normatif dengan analisis bahan hukum yang dilakukan secara yuridis kualitatif. Hasilnya menunjukkan bahwa implementasi Peraturan Daerah Kabupaten Pandeglang No. 2 Tahun 2013 tentang Pengelolaan Taman Nasional Ujung Kulon belum dilaksanakan secara maksimal terutama dalam hal penegakan hukum bagi pelaku penangkapan illegal. Meski demikian, masyarakat dan pemerintah setempat terus berupaya menjaga populasi badak jawa di TNUK. Kata Kunci : Badak Jawa, Penangkapan Ilegal, Konservasi.

Abstract

Equalization of administrative positions into functional positions has been carried out by the Banten Province Energy and Mineral Resources Agency. The problem identification is regarding the procedure for equalizing administrative positions into ASN functional positions at the ESDM Office of Banten Province as an increase in the quality of professionalism of the State Civil Apparatus based on Regulation of The Minister of State Apparatus Empowerment and Bureaucratic Reform Number 17 of 2021. As well as the efforts of the Banten Province ESDM Office in improving the quality of ASN professionalism after the procedure for equalizing administrative positions into ASN functional positions at the ESDM Office of Banten Province as an increase in the quality of professionalism of the State Civil Apparatus based on Permenpan-RB Number 17 of 2021. The theories used are Authority Theory and Personnel Management Theory. The research method is empirical juridical. The research specification is descriptive analysis. The data source is primary data supported by secondary data. Data collection techniques are literature study and field study. Data obtained and analyzed descriptively with a qualitative approach method. The results of the study, the Energy and Mineral Resources Agency has implemented the procedure for equalizing administrative positions into functional positions in accordance with Article 14 Permenpan-RB No. 17 of 2021, but the equalized functional officials still carry out the duties and functions of structural officials because there are no further rules regarding reports and responsibilities. Efforts made by the ESDM Service to improve the quality of professionalism of ASN functional officials are attending seminars, socialization and training. The conclusion, based on the research, is that due to the absence of further regulations related to reports and accountability for performance results, the equalized functional officials are still carrying out their old duties and functions so that the original purpose of equalizing positions is not implemented. The suggestion is that BKN is expected to issue policies related to the report system and accountability for performance results.

Desa Wisata Sitiwinangun di Kabupaten Cirebon terkenal sebagai penghasil gerabah kelas dunia dan tertua di Jawa Barat, menghadapi tantangan serius dengan berkurangnya jumlah pengrajin gerabah dari 1000 pengrajin tersisa 100 pengrajin sehingga berdampak menurunnya eksistensi gerabah. Pendekatan collaborative governance dalam pengembangan desa wisata berbasis budaya memiliki peran krusial dalam menciptakan keberlanjutan pariwisata di Desa Sitiwinangun. Penelitian ini mengkaji strategi collaborative governance, factor penghambat, serta peran dan upaya aktor dalam pengembangan Desa Wisata Sitiwinangun. Penelitian menggunakan metode kualitatif naturalistic melalui analisis model collaborative governance dari Ansell dan Gash. Hasil penelitian menunjukan pendekatan collaborative governance dalam pengembangan desa wisata di Desa Sitiwinangun belum berjalan optimal. Hal ini didapatkan dari indikator collaborative governance Ansell dan Gash yang belum seluruhnya tercapai, yaitu: belum ada aturan resmi yang mengikat para stakeholder untuk berkolaborasi, transparansi dan ketidakseimbangan sumber daya, kurangnya kepercayaan antar stakeholder serta kepemimpinan. Faktor penghambat proses kolaborasi dan pengembangan wisata yaitu SDM yang terbatas, kurangnya pelatihan dan pemsaran gerabah, kurangnya pelatihan dan pemahaman masyarakat. Namun demikian, pemerintah desa, stakeholder dan masyarakat telah berperan dan mengupayakan pengembangan Desa Wisata Sitiwinangun yang berkelanjutan.

Abstract

Penempatan Pancasila sebagai sumber dari segala sumber Hukum Negara sesuai dengan Pembukaan Undang-Undang Dasar Negara Republik Indonesia Tahun 1945 aliran ke empat yaitu “Ketuhanan yang maha esa, Kemanusiaan yang adil dan beradab, Persatuan Indonesia, Kerakyatan yang dipimpin oleh hikmat kebijaksanaan dalam permusyawaratan perwakilan, keadilan sosial bagi seluruh rakyat Indonesia.”. Masalah yang Pertama yaitu, Bagaimana Pelaksanaan Mekanisme Pengangkatan Guru Honorer Sebagai Pegawai Pemerintah dengan Perjanjian Kerja (PPPK) di Sekolah Menengah Kejuruan 2 Negeri Kota Serang Berdasarkan Peraturan Pemerintah Nomor 49 Tahun 2018 Tentang Manajemen Pegawai Pemerintah dengan Perjanjian Kerja (PPPK) Kemudian Kedua Bagaimana Hambatan Pelaksanaan Mekanisme Pengangkatan Guru Honorer Sebagai Pegawai Pemerintah dengan Kerja (PPPK) di Sekolah Menengah Kejuruan 2 Negeri Kota Serang. Teori yang digunakan ialah Teori Perlindungan Hukum dan Kepastian Hukum. Metode Penelitian yaitu yuridis empiris. Spesifikasi penelitian yaitu deskriptif analisis. Sumber data yaitu data primer yang ditunjang oleh data sekunder. Teknik pengumpulan data adalah wawancara dan dokumen yang terkait dengan penelitian. Data diperoleh dari analisis secara deskriptif dengan metode pendekatan kualitatif. Studi Lapangan dan Studi Kepustakaan di Sekolah Menengah Kejuruan 2 Negeri Kota Serang Berdasarkan Peraturan Pemerintah Nomor 49 Tahun 2018 Tentang Manajemen Pegawai Pemerintah dengan Perjanjian Kerja (PPPK). Adanya Juknis Pengangkatan Guru Honorer sebagai Pegawai Perjanjian Kerja (PPPK) Keputusan Menteri Pendidikan, Kebudayaan, Riset dan Teknologi Republik Indonesia Nomor 349/P/2022 Tentang Petunjuk Teknis Pelaksanaan Seleksi Calon Pegawai Pemerintah Dengan Perjanjian Kerja Untuk Jabatan Fungsional Guru Pada Instansi Daerah Tahun 2022 sebagai proses pengangkatan Guru Honorer menjadi Pegawai Pemerintah dengan Perjanjian Kerja (PPPK) dan SK Menteri Nomor 800/KEP.073-BKD/.
