Abstract

Abstract

The development of Islamic financial products in Indonesia has generated various innovations, one of which is the gold rotating savings scheme (arisan emas) administered by Pegadaian Syariah Cinere. This product integrates a collective rotating savings mechanism with gradual gold ownership through an installment system. This study aims to analyze the contractual structure applied in the gold arisan scheme and to assess its compliance with the Fatwa of the Dewan Syariah Nasional Majelis Ulama Indonesia Number 77/DSN-MUI/V/2010 concerning non-cash gold transactions. This research employs a qualitative method with an empirical legal approach using a case study design. Data were collected through interviews, direct observation, and documentation, with in-depth interviews conducted with the branch manager as the primary informant. The findings indicate the following. First, the gold arisan scheme applies solely a rahn (pledge) contract, initiated by the down payment and the signing of the agreement by the group leader. The scheme operates for a six-month period, and the group leader assumes responsibility if any participant withdraws. Second, the implementation of the gold arisan does not fully conform to Fatwa Number 77/DSN-MUI/V/2010 on non-cash gold transactions, although general procedural requirements such as application through the Islamic pawnshop institution and a minimum of six participants are fulfilled.

Abstract

The purpose of this study is to analyze the implementation of DSN-MUI Fatwa No. 134/DSN-MUI/II/2020 concerning real costs in the rescheduling of the Ijārah Muntahiya bi at-Tamlik (IMBT) contract at the Sharia Business Unit of PT Bank DKI. This issue is significant because rescheduling financing has the potential to lead to usury (riba) practices due to additional costs, a matter that contradicts the principle of justice in sharia finance. This qualitative research uses an empirical case study approach. Primary data was collected through observation and interviews, while secondary data was obtained from literature. The research findings show two main results. First, the restructuring process begins with the customer's application, followed by a bank evaluation, and is concluded with a new contract. Second, the practice of charging real costs at the Sharia Business Unit of PT Bank DKI has been implemented in accordance with the DSN-MUI Fatwa, with costs limited to factual expenses, such as stamp duty. This con clusion proves that the bank has successfully implemented sharia principles in handling non-performing financing.

Abstract

The DSN-MUI Fatwa No. 107/2016 requires Islamic hospitals to establish cooperation with Islamic financial institutions. However, in practice, collaborations between Islamic hospitals and BPJS Kesehatan (Indonesia’s national health insurance agency) are still common, raising concerns regarding the compliance of such agreements with Sharia principles and the reliance of Islamic hospitals on conventional institutions. This study aims to analyze the contractual mechanism applied in the cooperation between Ridhoka Salma Islamic Hospital and BPJS Kesehatan and to evaluate its conformity with DSN-MUI Fatwa No. 107/2016 and Fatwa No. 98/2015. A qualitative case study approach was employed, collecting primary data through interviews with the Sharia Committee and hospital management, as well as direct observation of BPJS patient services, and secondary data from fatwas, regulations, agreements, books, and scholarly articles. The findings reveal that the cooperation is conducted through an Ijarah ‘ala al-A‘mal contract, which restricts the scope of transactions to services directly managed by the hospital. Sharia compliance is maintained through the mechanism of takhsis, grounded in the principles of ḥājjah ‘āmmah, maṣlaḥah mursalah, and ḥifẓ al-nafs, supported by active supervision of the Sharia Supervisory Board and mitigation of potential non halal revenues. Therefore, the cooperation can be considered compliant with Sharia principles as stipulated in the DSN-MUI fatwas.

Abstract

Abstract

This study examines the exclusivism of Hare Krishna Sampradaya followers at Radha Rasesvara Ashram, Sibanggede Village, Abiansemal District, Badung Regency during the period 1999-2022. The background of this research is the phenomenon of exclusivism or self-isolating behavior practiced by Hare Krishna followers following the issuance of the Joint Decree of PHDI and MDA Bali Number: 106/PHDI-Bali/XII/2020 and Number: 07/SK/MDA-Prov Bali/XII/2020 concerning restrictions on the propagation of non-Balinese dresta sampradaya teachings. This study aims to analyze the background of followers joining the Hare Krishna sampradaya, identify the causes of exclusivist attitudes, and examine their implications for the surrounding community. The research employs historical method encompassing heuristics, source criticism, interpretation, and historiography using Max Weber's Rational Instrumental Action theory. Data collection was conducted through in-depth interviews with Hare Krishna followers, ashram managers, and local residents, as well as literature review of relevant documents and publications. The findings reveal that followers joined Hare Krishna due to interest in spiritual books and the teachings conveyed. The exclusivism emerged as a defensive response to hate speech, threats of ashram closure, and persecution experienced by one member. This self-isolating attitude manifested through reduced public activities, stricter visitor regulations, and the avoidance of religious attributes in public spaces. The implication of this exclusivism is decreased social interaction between followers and the surrounding community, although neighborly relations continue normatively.

Abstract

This study aims to analyze and compare the ideas of three prominent figures in Classroom Action Research (CAR), namely John W. Creswell, Robert P. Pelton, and Geoffrey E. Mills. Each of these scholars has made significant contributions to the development of CAR methodology, particularly in research design, action procedures, and reflective approaches to improving classroom instructional practices. This study employs a literature review method by examining the primary works and academic references related to each theorist. The findings indicate that Creswell emphasizes a systematic research framework supported by in-depth qualitative analysis; Pelton focuses on practical strategies that empower teachers to conduct action research; while Mills introduces a flexible reflective spiral model oriented toward continuous improvement. Despite their different emphases, all three share a common view of CAR as a means to enhance instructional quality through cycles of action and reflection. This research concludes that integrating the perspectives of these three scholars can produce a comprehensive and applicable CAR model, particularly within the context of Indonesian education.

Abstract

The development of digital technology has brought significant changes in the world of education, including in the provision of reading materials that are more interactive and flexible. One of the innovations utilized in increasing students' interest in reading is the use of digital storybooks. This study aims to explore students' experiences in using digital storybooks and identify the supporting and inhibiting factors in increasing interest in reading. This study used a qualitative approach, which was conducted at SMP Negeri 1 Tongauna involving 25 students of class VIII A as research subjects. Data collection techniques included observation, questionnaires, documentation, and data triangulation through interviews with teachers. The results showed that most students felt a more interesting, comfortable, and enjoyable reading experience through digital storybooks compared to printed books. Supporting factors include attractive visual displays, ease of access, interactive features, and support from teachers and school infrastructure. Meanwhile, inhibiting factors include technical constraints, distractions from social media, and physical discomfort such as eyestrain. The findings suggest that digital storybooks have great potential to increase students' interest in reading if supported by a conducive learning environment and appropriate technology utilization strategies.
