Abstract

This article discusses consumer protection against overclaim skincare products marketed through e-commerce in Indonesia and examines overclaim practices from the perspective of Islamic economic law. Normatively, producers are expected to provide honest, transparent, and fair information regarding product ingredients in accordance with Law Number 8 of 1999 on Consumer Protection as well as the principles of Islamic economic law, which emphasize honesty (ṣidq), transparency (tablīgh), and justice (‘adālah). However, empirically, overclaim practices are still widespread, where the content of active ingredients such as niacinamide and retinol is significantly lower than what is claimed on the label. This condition causes real harm to consumers in the form of financial losses, skin health problems, and psychological stress that affects self-confidence. Therefore, this study emphasizes the importance of strengthening regulations, ensuring consistent law enforcement, and tightening supervision of products marketed online. In addition, consumer education through social media, universities, and beauty communities is essential to improve product literacy, enabling consumers to be more critical and discerning in evaluating product claims and making appropriate purchasing decisions.

Abstract

The rapid growth of the tourism industry in Central Aceh, particularly in Bintang District, has stimulated the emergence of alternative accommodation businesses such as homestays. Homestay Gardenia and Saijo exemplify the application of the syirkah 'abdān partnership system, a cooperative arrangement in which the parties contribute labour and expertise ('amal) rather than financial (māl). This study aims to analyze the implementation of the syirkah 'abdān contract in the management of Homestay Gardenia and Saijo, focusing on the form of cooperation, the profit-sharing mechanism, and its conformity with Islamic economic law principles. Using a qualitative method with a normative-empirical approach, the data were collected through interviews with homestay owners and managers, supported by a review of relevant Fiqh literature and previous research. The findings indicate that the cooperation practices at Homestay Gardenia and Saijo resemble the syirkah 'abdān contracts, where both parties contribute their respective expertise and effort to achieve shared benefits. Although the agreements are valid in principle, the absence of written contracts poses potential risks of gharar (uncertainty) and unequal accountability. Therefore, formalizing the agreement in written form is recommended to ensure transparency, fairness, and compliance with sharia principles. Overall, the implementation of syirkah 'abdān in homestay management demonstrates the relevance of Islamic partnership ethics in fostering community-based tourism enterprises that promote justice, sustainability, and mutual prosperity.

Abstract

This study analyzes the differences between criticism and insults in the comments section of the Instagram account @aniesbaswedan and their application under the Electronic Information and Transactions Law (UU ITE), specifically Articles 27(3) and 28(2). The background of this study is reviewed in light of the increase in hate speech and impolite language on social media, which often blurs the line between freedom of expression and violations of the law. The method used in this study is a descriptive, qualitative, normative juridical approach, using the technique of observing and recording netizens’ comments on several posts by the @aniesbaswedan account. Data analysis was carried out using the interactive model Miles and Huberm, which includes data collection, reduction, presentation, and conclusion. The results of the study show that many comments contain insulting elements, such as harsh language, sarcasm, and personal accusations. In contrast, rational arguments characterize legitimate criticism and do not attack individual honor. This study emphasizes the importance of digital language ethics and public legal awareness in the expression of opinions politely and responsibly.

Abstract

This study aims to analyse the profit-sharing system between owners and managers at Fourgee Mini Soccer and Bezzie Mini Soccer, and to assess its compliance with the provisions of the mudharabah contract under Islamic economic law. This study uses a normative empirical method, with both a legislative and a case approach. Normative data was obtained from Law Number 21 of 2008 concerning Islamic Banking, the Compilation of Sharia Economic Law, and the DSN-MUI Fatwa concerning Mudharabah, while empirical data was obtained through interviews with the owners and managers of both businesses. The results of the study show that the profit-sharing system at Fourgee Mini Soccer uses fixed nominal payments to managers, so that legally it is more accurately classified as an ijarah contract and does not meet the provisions of a mudharabah contract. Meanwhile, Bezzie Mini Soccer applies profit sharing based on a percentage, but this method is not supported by clear financial records and a written contract, so the applied mudharabah contract is not yet perfect (fasid). This study concludes that the profit-sharing systems in both businesses are not yet entirely consistent with the principles of mudharabah contracts as regulated under Islamic economic law and thus require improvements to the contract structure and recording mechanisms to achieve fair and transparent business cooperation.

Abstract

This study examines the effectiveness of customary law enforcement through Reusam Gampong Peurada Number 01 of 2019 on rental housing regulations. The main problem lies in the suboptimal implementation of customary law at the village level. This study is qualitative, specifically an empirical juridical study. Primary data were obtained through interviews with community members and officials of Peurada village. Primary legal materials were obtained from laws, Qanun Jinayat, and Qanun Reusam Gampong Peurada. There were two findings from this study. First, the enforcement of customary law in cases of Reusam Gampong Peurada violations shows synergy between preventive and curative approaches. Reusam is used for social guidance through warnings and night patrols. At the same time, serious violations, such as khalwat, are referred to Wilāyah Al-Ḥisbah (WH) for processing under the Qanun Jinayat Aceh. This reflects the simultaneous use of two legal channels. Second, Reusam Gampong Peurada has clear rules and adequate supporting facilities, but the effectiveness of its enforcement is not yet optimal. Weaknesses are evident in the lack of a monitoring system, low community participation, and a weak legal culture. Therefore, it is necessary to strengthen social and institutional aspects to support the successful implementation of Reusam.

Abstract

This study examines the validity of employment agreements based on verbal agreements from the perspective of ijarah al- ‘amal, a form of employment contract in Islamic law. In the informal sector, employment relationships are often established verbally, based on trust and community customs, even though this raises legal issues regarding the proof and clarity of the parties’ rights and obligations. This study uses a normative juridical method, with a conceptual approach, drawing on a review of classical and contemporary fiqh literature, the Qur’an, hadith, and labour laws and regulations. The results of the study show that Islam permits verbal employment agreements provided the contract meets the following conditions: the existence of the contracting parties, a clear object of work, a known reward, and the willingness of both parties. However, verbal agreements that contain elements of gharar (uncertainty) or zulm (injustice) may render the contract invalid under both moral and legal principles. The hadith of the Prophet Muhammad SAW, which prohibits sales and purchases that contain gharar, emphasises the importance of clarity in every contract. In the contemporary context, although verbal agreements remain valid under the principle of ijarah al-'amal, written records are highly recommended to prevent disputes and protect workers’ rights. Thus, the concept of ijarah al-'amal provides legal legitimacy to verbal agreements and emphasises the importance of justice, trustworthiness, and transparency in modern employment relationships.

Abstract

The penalty system and its effectiveness in reducing fraud in Perum Pegadaian products are examined through the lens of ta’widh. Ta’widh is a form of compensation imposed on customers due to negligence or delay in fulfilling contractual obligations, intended to cover the actual losses suffered by Islamic financial institutions, not as a means of profit-seeking. This study focuses on the mechanism for imposing fines at Perum Pegadaian, their effectiveness in preventing fraud and customer default, and their conformity with the principle of ta’widh as defined in sharia provisions. This study uses a normative empirical method with a descriptive qualitative approach. Data were obtained through interviews with Pegadaian Syari’ah employees and analysis of relevant documents. The results show that the penalty system at Perum Pegadaian serves a preventive function, improving payment discipline and reducing the potential for fraud through deliberate late payments and contract misuse. However, in practice, penalties are still imposed on a standard basis and are included in the contract, so they may not fully reflect the actual losses as required by the principle of ta’widh. This study suggests that the penalty system at Perum Pegadaian is functionally effective in reducing fraud but needs improvement to better align with the principles of justice and Sharia compliance, particularly in determining the amount of ta’widh based on actual losses.

Abstract

This study was motivated by the rapid development of the bakery industry in Banda Aceh, which has not been fully accompanied by the fulfillment of the obligation to provide product information to consumers. Problems arise when bakery products still lack important information, such as ingredient composition, expiry date, and a halal label, thereby potentially posing health risks, harming consumers, and contradicting the principles of consumer protection. This study examines the practice of providing bakery product information to consumers in Kuta Alam District, Banda Aceh, the forms of consumer protection implemented by business actors, and their conformity with the concept of maqāṣid al-syarī‘ah. This study uses a qualitative method with field research. Primary data was obtained through interviews with business actors and bakery employees. In contrast, secondary data was sourced from the Consumer Protection Law, sharia economic law literature, scientific journals, and other written sources relevant to the concept of maqāṣid al-syarī‘ah. The results show that most bakery business actors have not met the standards of information transparency and food safety, resulting in information asymmetry between producers and consumers. These practices are not in line with the principles of maqāṣid al-syarī‘ah, particularly in the aspects of ḥifẓ al-nafs, ḥifẓ al-‘aql, and ḥifẓ al-māl. This study concludes that consumer protection for bakery products in Kuta Alam Subdistrict remains suboptimal, requiring increased awareness among business actors, strengthened government supervision, and the internalisation of Islamic business ethics to realise food safety, honesty, and public welfare.

Abstract

Market liberalisation in Southeast Asia through the ASEAN Economic Community (AEC) has created a new economic paradigm that emphasises the free flow of goods, services, and investment. However, this integration poses significant challenges to the sustainability of local products, especially those produced by Micro, Small, and Medium Enterprises (MSMEs). This journal aims to analyse in depth the legal protection mechanisms for local products in Indonesia within the framework of ASEAN liberalism and review them from the perspective of Fiqh Muamalah. Using a normative juridical approach, this study examines the synchronisation of Indonesian positive law, such as the Trade Law and the Job Creation Law, with sharia principles such as justice (‘adl), benefit (maslahah), and protection (himayah). The analysis shows that although national legal instruments have sought to protect through non-tariff measures and the empowerment of MSMEs, structural imbalances and regulatory ambiguities continue to harm local producers. The Fiqh Muamalah perspective offers a reconstruction of policy through the state’s role as murabbī (guide) to ensure market balance and economic sovereignty for the people.
