Abstract

Abortion is a contentious legal and moral issue, as it involves two equally important rights: the right to life of the fetus and a woman's right to bodily autonomy and reproductive health. Under Indonesian criminal law, abortion is generally classified as a criminal offense, as stipulated in the Criminal Code (KUHP). However, exceptions are recognized under specific conditions such as medical emergencies and pregnancies resulting from rape, in accordance with Law Number 17 of 2023 on Health. This study aims to examine the legal boundaries between prohibited and permitted abortions and to analyze the challenges of implementing these provisions in practice. The findings indicate that despite the existence of legal exceptions, implementation remains difficult due to complex procedures, limited facilities, and inadequate understanding among law enforcement and health workers. Therefore, clear technical regulations and cross-sectoral education are essential to ensure fair legal protection for both women and medical professionals.

Abstract

This research aims to conduct a juridical analysis of cases of circulation of illegal cosmetic products. The method used is normative-dogmatic juridical research, which focuses on relevant legal doctrines and principles. The approach used is a conceptual approach and a statutory approach, with primary legal sources including the Health Law, BPOM Regulations, the Criminal Code (KUHP), and the Criminal Procedure Code (KUHAP). Secondary legal sources include journals, books, and other references that support the analysis. The results show that the distribution of illegal cosmetic products that do not meet safety and quality standards, as in the case of the defendant Megawati binti Rahmat alias Mega in verdict number 39/Pid.Sus/2020/PN Slr, is a serious violation of health law and consumer protection in Indonesia. Based on the principle of liability based on the element of fault, the defendant can be held legally responsible because it is proven that she distributed cosmetics without a distribution permit containing hazardous substances such as mercury. The Panel of Judges considered that the defendant's actions fulfilled the elements of unlawful acts in accordance with Article 1365 of the Civil Code and Article 196 of Law of the Republic of Indonesia Number 36 of 2009 concerning Health. The implications of this research emphasize the importance of strict law enforcement and the application of the principle of responsibility to protect public health from dangerous cosmetic products.

Abstract

The ethical violation committed by Constitutional Court Justice Anwar Usman in the Constitutional Court Decision No. 90/PUU-XXI/2023 underscores the urgent need to strengthen ethical oversight mechanisms to safeguard the integrity of the judiciary. This article analyzes the ethical breach and its implications for public trust and the legitimacy of the Constitutional Court as the guardian of the Constitution. The research employs a normative legal method with statutory, case, and conceptual approaches. The findings indicate that violations of the principles of impartiality, independence, and integrity not only tarnish the image of individual justices but also erode public confidence in the constitutional justice system. Therefore, systemic reform and greater transparency in the enforcement of judicial codes of ethics are essential to restoring the moral authority and professionalism of Indonesia’s highest judicial institution.

Abstract

The protection of human rights is a fundamental element of Indonesian constitutional law. Although it has been constitutionally regulated through the 1945 Constitution and a number of laws, the implementation of human rights protection still faces various challenges, including discrimination, violence by the authorities, and inconsistency in legal politics. This study aims to analyze the effectiveness of the constitutional law system in ensuring human rights protection as well as the role of state institutions such as Komnas HAM, the legislature, the executive, and the judiciary. The results show that human rights protection has not been optimal due to weak coordination, lack of accountability, and lack of support for independent institutions. The conclusion emphasizes the importance of legal reform, institutional strengthening, and harmonization between national law and international human rights standards. Suggestions include improving human rights education, empowering civil society, and consistent law enforcement to create a democratic and just rule of law.

Abstract

Mixed marriages between Indonesian citizens (WNI) and foreign nationals (WNA) often give rise to legal issues, particularly in divorce cases involving the division of marital property. A key challenge arises from the restriction on land ownership for foreign nationals under the Basic Agrarian Law. This study examines Decision Number 146/Pdt.G/2021/PA.Dps, in which an Indonesian wife was accused of extortion against her foreign husband in the context of a mixed marriage divorce. Using a normative juridical method and a descriptive-analytical approach, the study finds that the wife’s act of withholding her husband’s documents does not constitute extortion, but rather a form of self-protection due to the husband's failure to provide financial support. The findings emphasize that the division of marital assets in mixed marriages must consider the provisions of the Marriage Law, the Compilation of Islamic Law for Muslim couples, and the Basic Agrarian Law, especially regarding land ownership by foreign nationals. Therefore, resolving property disputes in mixed marriages requires a careful legal approach to ensure compliance with applicable laws.

Abstract

The agrarian dispute that occurred in Pakel Village, Banyuwangi, illustrates the complexity of legal issues and structural inequalities that still linger from the New Order era. Several local farmers were detained on charges of vandalism and incitement, despite the fact that they were defending ancestral land that had been managed for generations against the unilateral claims of a plantation company. This article examines the incident through the lens of agrarian law, land ownership rights, and principles of social justice, while also analyzing the state's role in balancing the rights of indigenous communities and corporate interests. This case study shows that a repressive legal approach actually deepens inequality and hinders the process of agrarian reform. The conflict in Pakel Village is a clear reflection of the state's inability to handle agrarian conflicts fairly and sustainably.

Abstract

The National Strategic Projects (PSN) launched by the Indonesian government aim to accelerate development and drive national economic growth. However, in practice, many of these projects overlap with customary territories that lack formal legal certainty. This legal uncertainty gives rise to various problems, such as agrarian conflicts, criminalization of indigenous peoples, and the loss of living space and cultural identity of local communities. This study aims to analyze the forms of legal uncertainty experienced by indigenous peoples in the implementation of PSN and its impact on the protection of their collective rights. Additionally, this study explores the relevance of the principle of legal pluralism as a normative foundation for reforming national development policies to be more inclusive and ensure legal certainty for indigenous peoples. The approach used is normative qualitative with a literature study of regulations, court decisions, and reports from civil society organizations. The results of the analysis show that the legal imbalance between state law and customary law is the root cause of the marginalization of indigenous peoples in large-scale national development projects. The principle of legal pluralism, which recognizes the existence of customary law as a legitimate legal system, can be an alternative approach in formulating future development policies. The application of legal pluralism enables the state to build a development model based on social justice, participation, and respect for legal and cultural diversity. Thus, policy reform based on legal pluralism is an urgent necessity in addressing the challenges of structural justice for indigenous communities amid the tide of national development.

Abstract

This research is motivated by the suboptimal Innovation of Village Government in Realizing Food Security in Lumbungsari Village, Lumbung District, Ciamis Regency. The purpose of this study is to determine the Innovation of Village Government in Realizing Food Security in Lumbungsari Village, Lumbung District, Ciamis Regency. The method used in this study is a qualitative descriptive research method. Data collection techniques include: Observation, Interviews and documentation. Data processing techniques in this study are: data reduction, data presentation, and drawing conclusions. The results of the study show that the Innovation of Village Government in Realizing Food Security has not been running optimally. From the results of the observation, several indicators of problems were found related to the Innovation of Village Government in Realizing Food Security in Lumbungsari Village, Lumbung District, Ciamis Regency, including lack of funds to support food security, lack of adequate facilities and infrastructure to support agricultural activities, low public awareness to achieve new innovations, and low community skills in using information technology and applications.

Abstract

As an agricultural country, farmers in Indonesia have a crucial role, their existence must be safeguarded within the agricultural sector. Encouraging farmers to engage in breeding or develop new superior plant varieties is essential for fostering independent and advanced Indonesian farmers. These breeding activities are governed by Law Number 22 of 2019 on Sustainable Agricultural Cultivation System, and Law Number 29 of 2000 Plant Variety Protection. However, these laws have led to challenges for farmers involved in breeding, as the Plant Variety Protection Law adopts liberal approach that prioritizes individual economic benefits and specifically protects breeders who have registered their new varieties. As a result, farmers who use traditional knowledge in their breeding practices are vulnerable to criminalization due to the registration system. This paper will examine the rights of farmers in breeding activities under Indonesian law and compare with regulations in Malaysia, which shares geographical proximity, customs, and membership in the World Trade Organization. The research method is normative legal research, utilizing both conceptual and comparative approach. The objective to explore the legal protection of farmers’ rights in breeding activities in both Indonesia and Malaysia, and provide recommendations for improving the protection of farmers' rights in the future.

Abstract

Di era transformasi digital dan big data, perlindungan data pribadi menjadi isu yang sangat mendesak, terutama dengan diberlakukannya Undang-Undang Nomor 27 Tahun 2022 tentang Pelindungan Data Pribadi (UU PDP) di Indonesia. Artikel ini bertujuan untuk melakukan tinjauan kritis terhadap pelaksanaan UU PDP 2022, mengeksplorasi tantangan, peluang, serta dampaknya terhadap hak atas privasi individu. Metode yang digunakan adalah studi pustaka kualitatif dengan pendekatan deskriptif-analitis, mengkaji literatur terkini dan dokumen hukum melalui analisis tematik. Hasil kajian menunjukkan bahwa meskipun UU PDP 2022 telah memberikan kerangka hukum yang kuat, implementasinya masih menghadapi hambatan, mulai dari rendahnya literasi digital masyarakat, lemahnya pengawasan kelembagaan, hingga dominasi platform digital raksasa. Artikel ini memberikan kontribusi dengan menawarkan pemahaman baru tentang urgensi tata kelola data yang inklusif dan berbasis kepercayaan publik, sekaligus memberikan rekomendasi praktis bagi pemangku kepentingan. Kesimpulannya, perlindungan data pribadi memerlukan sinergi lintas sektor untuk menciptakan ekosistem digital yang adil, aman, dan berdaulat, serta perlu didukung penelitian lanjutan yang lebih mendalam dan komparatif.
