Abstract

The recent labor regulation reform through the Job Creation Law (Undang-Undang Cipta Kerja) has introduced new dynamics in regulating Fixed-Term Employment Agreements (PKWT), impacting social justice in Indonesia. This study aims to analyze the effects of PKWT regulation within the Job Creation Law on the principle of social justice, particularly in the context of Indonesia’s Asta Cita 4, which emphasizes protection for the entire nation. Employing a qualitative approach through literature review, the study systematically examines relevant laws, academic works, and related research. The findings indicate that although the law enhances labor market flexibility, the resulting legal uncertainty for fixed-term workers risks social inequality that contradicts the ideals of social justice. This research underscores the need for legislative reforms that prioritize worker protection and social security to align labor regulations with national aspirations embodied in Asta Cita 4. The implications provide recommendations for policymakers and future researchers to develop more empirical and in-depth studies to strengthen labor protections going forward.

Abstract

Child marriage in Indonesia is still a serious problem despite regulations that limit the minimum age of marriage. The revision of Law No. 16/2019 sets the minimum age at 19 years, but the practice of marriage dispensation has actually increased. This phenomenon reflects the gap between formal legality and social reality which is influenced by factors such as low education, patriarchal culture, conservative religious interpretations, social pressure, and poverty. Dispensation for marriage is often granted without an in-depth assessment of the child's readiness, ignoring the principle of the best interests of the child. Law enforcement has not been effective due to the lack of legal literacy, weak supervision, and the dominance of local values. Prevention efforts require an interdisciplinary approach through reproductive health education, strengthening social protection, community participation, and synergy between institutions. Therefore, the elimination of child marriage must be a strategic policy based on the transformation of social norms and the protection of children's rights in a holistic and sustainable manner within the framework of gender perspective development and social justice.

Abstract

Appreciation of IPR in Indonesia is still relatively low and many people consider IPR to be unimportant and even many lay people do not understand IPR. One of them is the protection of trade secrets which plays an important role for both personal and public interests. The research method is normative legal with prescriptive data analysis. Trade secrets cover aspects of pre-production to post-production, including marketing and sales. The use of trade secrets without permission and approval from other parties is a violation of Law Number 30 of 2000 concerning Trade Secrets. The use of information includes production methods, frying, grinding, to marketing and sales of CV ground coffee. Tiga Putra Berlian resembles CV. Bintang Harapan by recruiting employees, offering coffee products that have been produced to CV customers. Bintang Harapan, causing losses and violating Article 17 of Law Number 30 of 2000.

Abstract

Maritime conflicts in Southeast Asia place regional stability at great challenge, especially due to the importance of these waters as international transport routes. Claims for overlapping maritime areas, illegal activities such as trespassing and unregulated copyright fishing, in particular increased geopolitical tensions in the South China Sea, have created a complex maritime security environment. These disputes not only affect state jurisdictional and maritime sovereignty, but also affect regional economic activities, including trade and marine tourism. This study uses a qualitative approach in literature research to examine the effects of these various topics on maritime stability and efforts to address legal channels and diplomatic conflicts. Using conflict theory, this study highlights the importance of regional co-operation, adherence to the International Sea Council, and the importance of adaptive security strategies as a step in mitigation. It also focuses on the relationship with maritime security with other important sectors such as logistics, energy and tourism, highlighting the need for collective action between countries in Southeast Asia.

Abstract

The determination of compensation in the process of land acquisition for infrastructure development in Indonesia still faces various complex legal problems. Although has been regulated in Law Number 2 Year 2012, its implementation often creates inequality, both in terms of compensation value and procedures for community involvement. The phrase “decent and fair” in the regulation opens wide room for interpretation, so there is often a mismatch between the value set by the government and the expectations of the community. This imbalance is exacerbated by weak public participation, lack of legal literacy, and the dominance of legal-formalistic approaches. Agrarian conflicts, legal uncertainty, and disregard for the social and cultural values of indigenous peoples also exacerbate the situation. Therefore, policy reforms based on a participatory approach, institutional strengthening, and the use of digital technology to realize transparency and accountability are needed. Fair compensation must ensure protection of citizens' human rights and build trust in the legal system in the development process.

Abstract

The implementation of dengue fever control in Tanjungpinang City through the 1 House 1 Jumantik Movement program has not been optimal until now. The problem in controlling dengue fever through this program is that the community is inactive and does not know about the implementation of this program. The purpose of the researcher was to determine the implementation of dengue fever control through the 1 House 1 Jumantik Movement program in Tanjungpinang City. Qualitative Method and Policy Implementation theory by Marilee S Grindle. The results of the study showed (1) Content of policy, the researcher found from the indicators of the resources used, namely financial resources, the wages given were only enough for transportation costs. Insufficient resources also limited the number of jumantik cadres working, plus there was a change in funding sources to BOK which caused several health centers to experience a budget reduction in Jumantik honorariums (2) Context of Implementation found that the authority of each actor was not in accordance with the implementation manual for the 1 House 1 Jumantik Movement by the Ministry of Health. In addition, the government also did not provide guidance to the community so that many people did not know about this program.

Abstract

The selection of the head of government is a fundamental aspect of the constitutional system that reflects the political and legal character of a state. Although Indonesia and Malaysia share similar historical roots, they adopt significantly different systems of governance. This study addresses two core issues which are about the structure and mechanism of executive and legislative power, and the impact of the presidential threshold and parliamentary coalition on governmental stability. Using a normative juridical method with statutory and comparative approaches, the findings reveal that Indonesia, under a presidential system, applies a nomination threshold to ensure political stability, yet it may restrict political access. Meanwhile, Malaysia’s parliamentary system is more flexible but vulnerable to instability due to coalition dynamics. This study recommends a reassessment of Indonesia’s presidential threshold for a more democratic process and strengthening of political stability mechanisms in Malaysia.

Abstract

The high inequality of land ownership in Indonesia shows that the enforcement of social justice in the implementation of land redistribution has not been running optimally. The agrarian reform program which is expected to be a solution to overcome agrarian inequality is often hampered by structural, legal, and institutional problems. This study aims to examine legally and empirically how the principle of social justice is upheld in the practice of land redistribution through the agrarian reform program. The method used is qualitative research with a normative and empirical legal approach, through a literature study of regulations and academic literature as well as secondary data analysis from government reports, scientific journals, and field studies. The results of the study show that although there is a supporting legal framework, the implementation of land redistribution still faces obstacles such as weak transparency, lack of community participation, and ineffective supervision of the use of ex-HGU land. This study contributes to understanding the importance of integration between legal aspects and social justice in agrarian reform policies. In conclusion, the enforcement of the principle of social justice in agrarian reform requires more inclusive policies that favor marginalized groups, as well as further in-depth and interdisciplinary research to formulate strategies for implementing equitable and sustainable reforms.

Abstract

Athis study explores the optimization of labor inspection to ensure legal protection for the fulfillment of workers’ rights in Indonesia. Despite existing regulations, violations of labor rights frequently occur due to weak enforcement. Using a qualitatibe descriptive method through literature review, this research highlights issues such as the PT GNI case that demonstrate inadequate preventive and enforcement actions by labor inspectors. The study recommends strengthening labor inspection through preventive and repressive measures, the use of technology, community-based monitoring, and the implementation of transparent and accountable oversight principles. These findings aim to provide recommendations for the government to enhance the labor inspection system for better protection and legal enforcement for workers.

Abstract

This article examines the role of the Formed Police Unit (FPU) in the perspective of international humanitarian law and international human rights law, particularly in the context of civilian protection in conflict areas. The FPU is an armed police unit deployed in UN peacekeeping missions with a mandate to protect civilians, maintain order, and support post-conflict recovery. Despite its strategic role, the FPU faces legal, operational and socio-cultural challenges. This study uses a normative-juridical approach by analyzing international legal documents, UN operational standards, and academic literature. It is emphasized that the effectiveness of the FPU is highly dependent on human rights-based training, clarity of mandate, logistical readiness, and the ability to build trust with local communities. This article recommends strengthening accountability mechanisms and cross-sector integration in peace missions, so that the FPU is able to carry out its protection mandate substantially and in accordance with applicable international legal principles.
