Journal of Islamic Mubadalah merupakan jurnal kajian interdisipliner yang bersifat akses terbuka dan terbit dua kali setahun (Juni dan Desember). Artikel kajian interdisipliner yang terbit dalam Journal of Islamic Mubadalah menekankan analisis Mubadalah (saling menguntungkan), hubungan manusia yang setara, dan menegakkan keadilan gender. Isu kajian Mubādalah tidak terbatas pada kajian hubungan suami istri dalam rumah tangga saja, tetapi juga seluruh anggota keluarga seperti hubungan orang tua dan anak atau kajian hubungan keluarga dan masyarakat (domestik dan publik). Journal of Islamic Mubadalah menyediakan sarana untuk diskusi berkelanjutan tentang isu-isu relevan yang menjadi fokus dan cakupan jurnal ini yang dapat dikaji secara empiris. Jurnal ini menerbitkan artikel penelitian yang mencakup seluruh aspek kajian (kajian interdisipliner) tentang Mubādalah (saling menguntungkan), hubungan manusia yang setara, dan menegakkan keadilan gender. Isu-isu kajian Mubadalah tidak terbatas pada kajian tentang hubungan suami istri dalam rumah tangga, tetapi juga seluruh anggota keluarga seperti hubungan orang tua dan anak atau kajian tentang hubungan keluarga dan masyarakat (domestik dan publik). Beberapa isu kajian yang dapat dipublikasikan antara lain: Politik Mubadalah; Ekonomi Mubadalah; Peran Perempuan dalam Pendidikan; Peran Perempuan dalam Tradisi Adat Lokal; Kepemimpinan (Qiwamah) dalam Perspektif Mubadalah; Gerakan Ulama Perempuan; Reformasi Hukum dalam Perspektif Mubadalah; Mubadalah dalam Pola Pengasuhan Anak; Mubadalah dalam Konteks Seksual; Mubadalah dalam Rumah Tangga.

Abstract

This article is about the position of husband and wife regulated in Article 31 of the Indonesian Marriage Law (UUP). The provisions of the position of husband and wife are allegedly gendered and contradictory, because they place husbands and wives not on equal footing, Article 31 when read textually has implications for the subordination of women. The purpose of this article is to analyse the provisions of the position of husband and wife in the Indonesian Marriage Law from the perspective of Mubadalah. Mubadalah theory is used to analyse the equality of husband and wife in the household. The method used is qualitative, the type of this article is librabry research (library research), a normative approach with a focus on analysing Article 31, data sources are obtained from literature related to mubadalah. The results show that Article 31 of the UUP places the position of husband and wife differently, the husband as the head of the household while the wife is a housewife, this text can be gendered and seems masculine. In the perspective of mubadalah, Article 31 of the UUP is not in line with the values of justice and equality. Article 31 of the UUP needs a jucial review for the realisation of a maslahah family based on the principle of equality between husband and wife in the household.

Abstract

This article examines gender discrimination against women with disabilities, this discrimination is due to the article on polygamy regulated in Islamic family law. The question to be answered is how are the rights of women with disabilities in Islamic family law in the perspective of mubadalah? Then what are the steps to fulfill the rights of women with disabilities in Islamic family law? The method of this article uses qualitative, the type of research article is library research, namely literature study, the approach is carried out normatively, which is focused on the Polygamy Article in Islamic Family law, the theory used is mubadalah. The results show that Islamic family law governing polygamy shows a gender-biased law that discourages women with disabilities. The article on polygamy is not in line with the values of equality in mubadalah theory. Recommendations, the polygamy article needs a judicial review to the Constitutional Court, changing the article to make it more equal between men and women.

Abstract

This article analyses women's justice rights in criminal law regulation and in relation to criminal punishment. This article is a comparative study between Indonesia and America (Ecuador and Argentina). The conception of human rights is echoed in the international world, but the status of women is still experiencing injustice in the application of law. The purpose of this article is to analyse the construction of Indonesian and American criminal law in providing justice rights for women. The approach used is qualitative, library research, data sources are taken from existing criminal law literature in Indonesia and America. The approach used is a normative study that explores the norms in criminal law in the two countries. The results show that Indonesian criminal law still leaves gender bias articles, the implication is that women suffer from vulnerability in the law. Criminal law in America is also the same, although America has passed the Second Chance Act, Fair Sentencing Act, and First Step Act women and girls are more likely to get legal sanctions than men, patriarchy and skin colour still seem to be high factors. Abstract

Identity politics in Indonesia is often influenced by social dynamics that are discriminatory towards gender. The concept of Mubadalah, meaning reciprocal or mutual, offers an inclusive approach to addressing gender injustice. This research examines the implementation of Mubadalah in transforming identity politics in Indonesia from 2009 to 2023. This study uses a qualitative approach with literature analysis, in-depth interviews with politicians, activists, and gender experts, as well as policy document analysis and election data. Findings indicate that Mubadalah-based education successfully changes traditional views on gender roles. Public policies adopting Mubadalah principles enhance women's representation in politics. Despite challenges from conservative groups, successes in several regions demonstrate the substantial potential of Mubadalah to achieve gender equality and justice in Indonesia.

Abstract

This article analyzes the Indonesian feminist critique represented by the Indonesian Women Ulema group, this critique is related to the discrimination of women in the context of female circumcision. The purpose of this article is to analyze the reasons why Indonesian Muslim feminist critics attack female circumcision, and how female circumcision is viewed from a human rights perspective. This article uses a qualitative method, the type of article library research / literature study that examines the reasons for Indonesian Muslim feminists who prohibit circumcision for women, data collection techniques through extracting literature related to the prohibition of female circumcision, the theory used is the theory of human rights. The results show that the criticism of Indonesian Muslim feminists who prohibit circumcision for women is that female circumcision causes kemadhorotan (damage), circumcision for women is contrary to women's human rights, this refers to the International Convention on women. The contribution of this article is shown for the legislative government to make a policy to prohibit the act of P2GP / female circumcision.

Abstract

This article examines the stories of the glory of women in the Qur'an, with the method of human stories can take moral messages in it, because the fact is that until now the position of women is not only in the public sphere, in the domestic sphere (family) women still experience a lot of discrimination and injustice, women are often positioned as officers who play a role in the "well, kitchen and bed". Whereas in the Qur'an the position of men and women have the same degree, have the same rights and obligations, have the same glory. The purpose of this article is to analyse the verses about the glory of women as husband and wife relations in the household, then correlated with the actualisation of gender equality in the family. The method used is qualitative, using normative and historical approaches, the type of this article is library research, with data sources from literature on verses about the glory of women in Islam. The results found that the verses about the glory of women in the Qur'an show that Islam came to proclaim women as noble creatures who have dignity, men and women were created from the same element (nafs wahidah). The stories of women's qualifications are relevant to be applied in the household, as a method of husband and wife relations towards a maslahah family

Abstract

This article is about the method of resolving conflict in the household through the application of mubadalah jurisprudence. The household conflict in question is like inequality in the division of tasks and responsibilities, as well as the lack of balance in decision-making which often becomes a source of disputes between husband and wife. The formulation of the problem in this article is how mubadalah jurisprudence can be applied as a solution to resolving household conflict and what are the obstacles faced in its implementation. The method used is qualitative with a phenomenological approach. Primary data was obtained through in-depth interviews with married couples who face conflict, community leaders, and family consultants. The location of the research was carried out in urban and rural areas in Lampung Province, Indonesia. Data analysis was carried out using the mubadalah theory which emphasizes the principle of mutuality in husband and wife relations. The results of the study indicate that the application of the mubadalah concept can be an effective solution in reducing household conflict, mubadalah prioritizes a more balanced husband and wife relationship. However, obstacles in implementing this principle include the strong patriarchal cultural factor and the weakness of society regarding the principles of mubadalah. The practical contribution of this research is to the understanding of society and institutions implementing Islamic law, such as the Religious Court and the Office of Religious Affairs, when making peace efforts or fostering the bride and groom to understand the importance of the principles of mubadalah.

Abstract

Men are heads of households and wives are housewives. That is the paradigm embedded in our society in general, because so far men have always been the main ones in the front line while wives have always been in a limited area, the problem is that contextually, the role of women is no longer in the domestic area alone, but many have also played a role outside the home to help their husbands earn a living. The question in this article is how can the rights and obligations of husband and wife be carried out in this context? The purpose of this research is to obtain a reconstruction of new rights and obligations that are based on fikih mubadalah. This research is a literature research study, qualitative analysis approach with analysis of mubadalah theory, primary data sources obtained from several documents related to this study. The result of this study is that partners between men and women in realizing justice in the household must be equal, such as mutual deliberation, mutual realization of democracy and mutual good deeds in relationships. The contribution of this article can be applied in households to achieve a harmonious and prosperous household.

Abstract

This article examines the influence of gender on student engagement and academic achievement of middle school students in China. School education plays a major role in reducing gender inequality and promoting equality. This study aims to analyze the influence of gender on student engagement and academic achievement in China. It is important to have a more comprehensive understanding of the influence of gender on student performance. A quantitative survey method was used to conduct a T-test to compare the means between boys and girls in their engagement and academic achievement. Simple random sampling was used to select participants from secondary schools in China (n = 341). The findings of the study indicate that student gender does not significantly affect student engagement or have a significant impact on academic achievement. This study analyzes the findings in terms of the changing role of women in China's rapid development and changes in Chinese culture and policies, which predict important implications for advocating for gender equality in education. The practical contributions of this study are for teachers, school managers, and parents to formulate strategies to eliminate gender inequality, especially in educational institutions.

Abstract

This article analyzes the economic resilience of former migrant worker families in East Lampung Regency. Former migrant workers have assets in the form of capital, but are often poorly organized, which creates challenges, including the double burden they face. The purpose of this article is to analyze what is the government's strategy in responding to the economic resilience of migrant worker families from the perspective of intrinsic justice? The analysis method is carried out qualitatively using the theory of intrinsic justice; Phenomenological approach; The object of research was carried out in East Lampung Regency; Primary data sources through mapping of former migrant workers. Data collection through observation, interviews and documentation. The results of the study found that the participation of former migrant workers in decision-making and utilization of empowerment programs is still limited. The majority of former migrant workers are women (74% or 347 people). Intrinsic justice in migrant worker families is a major concern so that there is no bias in everyday life. The government's strategy is also still limited to providing pre-departure access and provision, but has not been optimal in post-return assistance for sustainable economic empowerment. The contribution of this research requires a comprehensive strategy from the government that is just through sustainable assistance that pays attention to the specific needs of former migrant women in an effort to achieve family economic independence.
