Journal of Islamic Mubadalah merupakan jurnal kajian interdisipliner yang bersifat akses terbuka dan terbit dua kali setahun (Juni dan Desember). Artikel kajian interdisipliner yang terbit dalam Journal of Islamic Mubadalah menekankan analisis Mubadalah (saling menguntungkan), hubungan manusia yang setara, dan menegakkan keadilan gender. Isu kajian Mubādalah tidak terbatas pada kajian hubungan suami istri dalam rumah tangga saja, tetapi juga seluruh anggota keluarga seperti hubungan orang tua dan anak atau kajian hubungan keluarga dan masyarakat (domestik dan publik). Journal of Islamic Mubadalah menyediakan sarana untuk diskusi berkelanjutan tentang isu-isu relevan yang menjadi fokus dan cakupan jurnal ini yang dapat dikaji secara empiris. Jurnal ini menerbitkan artikel penelitian yang mencakup seluruh aspek kajian (kajian interdisipliner) tentang Mubādalah (saling menguntungkan), hubungan manusia yang setara, dan menegakkan keadilan gender. Isu-isu kajian Mubadalah tidak terbatas pada kajian tentang hubungan suami istri dalam rumah tangga, tetapi juga seluruh anggota keluarga seperti hubungan orang tua dan anak atau kajian tentang hubungan keluarga dan masyarakat (domestik dan publik). Abstract

Although Indonesia has made legal reforms in the field of inheritance, in practice there are nevertheless problems with the position of girls. The role of Religious Court judges is very large in providing protection for the inheritance rights of girls. If there is a division of inheritance that is treated discriminatory, judges must dare to make breakthroughs in reform. The goal is so that the position and status of inheritance of girls does not experience discrimination. This issue is interesting because some inheritance teachings differentiate between boys and girls, so that they have received criticism from women activists, although from Islamic law experts. This study aims to determine the arguments of the Supreme Court in interpreting the word walád. The method used is qualitative, with a normative approach, which is analyzed using the mubádalah theory, which emphasizes the distribution of inheritance on the principles of cooperation, mutuality, reciprocity and gender justice. The results of this study indicate that jurisprudence has responded to equality between boys and girls in the contemporary inheritance system, although in its application it has not been fully followed by Religious Court judges. In determining the position of heirs, it is no longer based on gender, therefore must be repositioned on the basis of the closeness of the bloodline relationship between the heir and the testator.

Abstract

This article is about the concept of mubadalah as a pillar of family resilience in Indonesia in facing the challenges of the era of information disruption. Family life in the era of information disruption faces major challenges, especially husband and wife relations. The purpose of this article is to analyze mubadalah as a pillar of household resilience in Indonesia amidst information disruption. This research method uses kualitative, data sources are obtained from library materials. The data analysis uses the theory of mutuality or mubadalah. The results of the study found that the era of information disruption has given rise to challenges for family life such as misinformation, decreased quality of interpersonal communication, technology addiction which has an impact on family disharmony. The concept of mubadalah has significant relevance in strengthening family resilience in Indonesia in facing these challenges. Mubadalah offers a holistic approach to maintaining family harmony and stability. The principle of mubadalah, which emphasizes justice, equality, and cooperation between family members, can be the main pillar in building relationships that are mutually supportive, respectful, and solution-oriented. Mubadalah is not only relevant as a religious concept, however also as a practical solution in responding to the increasingly complex social dynamics in the modern era.

Abstract

The rising divorce rate in Indonesia has had a significant impact on family dynamics, particularly in the implementation of child custody (hadanah) by single mothers. This study aims to explore and analyze the implementation of hadanah by single mothers after divorce using the theoretical approaches of Maqashid Syariah and Qira’ah Mubadalah (as formulated by Faqihuddin Abul Kodir). Employing a qualitative method through a literature review approach, this research is designed to uncover a deep, normative, and contextual understanding of hadanah practices in Indonesia. The study is based on data sourced from journal articles, books, and relevant statistical reports (including BPS data on divorce). The findings indicate that the implementation of child custody often faces systemic issues, such as the lack of equitable financial responsibility from fathers, ultimately placing a disproportionate burden on mothers. These conditions do not fully meet the five dimensions of Maqashid Syariah (hifz ad-din, hifz an-nafs, hifz al-‘aql, hifz an-nasl, hifz al-mal), nor do they reflect the ethical principles of Qira’ah Mubadalah such as taradhin, tashawur, and mu’asyarah bil ma’ruf. Therefore, this research contributes to the discourse on gender-just custody practices within Islamic legal thought and Indonesian family law.

Abstract

Digital sexual harassment is increasingly becoming a real threat to adolescent girls in the era of social media, including in areas that are less accessible to protection systems, such as Mesuji Regency, Lampung. This phenomenon shows that digital space is not yet completely safe, especially for vulnerable groups with minimal gender and digital literacy. This study aims to answer two main questions: (1) what are the forms of digital sexual harassment experienced by adolescent girls in Mesuji, and (2) how the Mubadalah concept can be used as an alternative solution to deal with this problem. The study was conducted using a qualitative approach collected through observation, in-depth interviews, and documentation of two adolescent girls in Masuji, then analyzed through data reduction, data display, and conclusions/verification. The results of the study showed that respondents experienced various forms of digital violence, such as explicit sexual comments, vulgar messages, to body shaming, which causes serious psychological impacts. Whereas, low digital literacy and strong social stigma are inhibiting factors for victims to report. In this context, the Mubadalah perspective is present as an Islamic interpretation approach that emphasizes gender justice and equality, and is relevant to building collective awareness in creating a safer and moreover equal digital space for adolescent girls.

Abstract

This article is about the implementation of Mubadalah as an effort to prevent sexual violence in the family. Data shows that violence in the family is increasing and women are often victims. The purpose of this article is to analyze the model of preventing sexual violence in the household based on a multidisciplinary approach by emphasizing the concept of Mubadalah. The perspective of Mubadalah as a concept of husband and wife relations as an equal and mutually supportive relationship, which can be a foundation in dismantling patriarchal norms that perpetuate violence. This research method uses a qualitative approach, by analyzing in depth the concept of Mubadalah as an offer of resolution of household conflict, this type of article is library research with a phenomenological approach, data sources are obtained from data from the National Commission on Violence Against Women, WHO data and religious courts. The findings show that sexual violence in the household is nevertheless high due to patriarchal norms, lack of gender education, and weak law enforcement. Analysis with the Mubadalah perspective shows that relational justice and mutuality are strategic approaches in education, community empowerment, and the formulation of policies to prevent sexual violence. The results of this study indicate that the concept of Mubadalah can be integrated into education programs, legal interventions, and community-based empowerment to build just and equal families.

Abstract

This article is about the concept of Al-Narajil reasoning as an interpretation approach based on gender-just fiqh. The facts in society nevertheless point to the inequality between men and women, which has an impact on the subordination of their roles in public and domestic. So there needs to be a reinterpretation in the gender approach in order to achieve a partnership between the two. This article aims to analyze how Al-Narajil reasoning can provide a moreover inclusive and fair reinterpretation of gender issues, especially in the relationship between men and women, and their roles in society. The method used is qualitative, which emphasizes the analysis of religious texts and literature studies with a critical hermeneutic approach to Al-Narajil reasoning with comparative theory, library research type. The results of the study show that Al-Narajil reasoning offers space for reinterpretation of texts that are often considered gender biased, by emphasizing the principles of justice (al-'adl) and welfare (al-maslahah). This approach can be a foundation for building a moreover equal understanding of gender in the context of contemporary Islam, while responding to the challenges of modernity without ignoring the spiritual and ethical values of Islam. Al-Narajil rational idea offers a new perspective on the renewal of Islamic law, especially in the context of justice between men and women.
