Abstract

The application of Pancasila in handling criminal acts of terrorism plays a crucial role in efforts to maintain the security and welfare of Indonesian society. This article aims to analyze the application of Pancasila values in countering terrorism. Through a comprehensive literature study approach, this article assesses the extent to which Pancasila values have been applied to counter terrorism crimes, including how the basic principles of Pancasila such as humanity, social justice, and unity are applied in countering terrorism. With in-depth analysis, this article finds that the values of Pancasila have not been fully implemented in counterterrorism. Through this study, it is hoped that a more effective and integrated solution can be found in fighting terrorism while still upholding the values of Pancasila as a guideline.

Abstract

Corruption is a problem that threatens the social, economic, and political foundations of Indonesia. This study analyzes the role of Pancasila as the legal foundation for anti-corruption efforts. As the state ideology, Pancasila contains moral, ethical, justice, and humanitarian values that are relevant to strengthening the fight against corruption. This qualitative research employs literature analysis, case studies, and interviews. The findings reveal that the five principles of Pancasila—Belief in One Almighty God, Just and Civilized Humanity, Unity of Indonesia, Democracy Guided by the Inner Wisdom of Deliberation and Representation, and Social Justice for All Indonesians—can serve as moral and ethical grounds for developing anti-corruption policies and regulations. The study highlights the importance of applying Pancasila values in education, public policy, and law enforcement to build a strong anti-corruption culture. With this holistic approach, Indonesia is expected to combat corruption both repressively and preventively, achieving justice and social welfare.

Abstract

Pancasila, as the state foundation and ideology of the Indonesian nation, plays a crucial role in formulating legal policies, including in efforts to eradicate terrorism. This article discusses how Pancasila values, such as justice, humanity and unity, are integrated into anti-terrorism legal policies in Indonesia. Pancasila provides a philosophical foundation that ensures the policy is not only effective in maintaining national security, but also respects human rights, prevents discrimination, and strengthens national unity. Thus, anti-terrorism policies prepared based on Pancasila are expected to realize law enforcement that is just, based on humanity, and supports the integrity of the Indonesian nation. The research method used is the Normative Juridical Approach method, this method focuses on literature studies and legal regulations, such as the Anti-Terrorism Law in Indonesia. Researchers usually analyze legislative documents, legal theory, and how Pancasila values are applied in existing legal policies. The results of this research reveal that a study of how Pancasila shapes anti-terrorism policy in Indonesia shows that the ideology and philosophy of Pancasila functions as an ideological and philosophical foundation.

Abstract

Citizenship is a legal status connecting individuals to a country, encompassing rights, obligations, identity, and protection. This study evaluates the impact of citizenship status on economic access and socio-economic inequality in Indonesia, focusing on disparities in well-being and economic opportunities. The research employs a normative legal method with approaches including legislation, case studies, conceptual, historical, and comparative analyses. The results show that citizenship inequality creates significant gaps in income, quality of life, and access to services. Individuals with full citizenship have better access to jobs and education compared to those with limited citizenship or no citizenship. This study recommends more inclusive policy reforms to reduce inequality and improve access for individuals with limited citizenship. The findings aim to assist academics and policymakers in designing strategies to enhance community well-being.

Abstract

This journal examines how Pancasila values—such as social justice, people’s sovereignty, and unity can remain relevant and dominant within the framework of constitutional law amid various dynamics of democracy and globalization. One of the main issues discussed is the concern that legal and political practices in the democratic era often deviate from Pancasila values, as seen in various cases of injustice, abuse of power, and social disintegration. The journal also highlights the influence of globalization on Indonesia’s legal system, where international standards on human rights, democracy, and the rule of law demand adaptation within national laws. However, this adaptation must be carried out while maintaining a national identity rooted in Pancasila. Therefore, it is crucial to find a balance between adjusting to global demands and upholding Pancasila values in constitutional law. The writing of this journal is driven by the urgent need to reassess the relevance of Pancasila in constitutional law, especially in facing new challenges such as uncontrolled freedom, rising individualism, and the threat of social disintegration. This journal offers solutions to strengthen Pancasila’s role as the foundation of constitutional law through the reaffirmation of its principles in legal and political policies. Through this study, it is expected to make a significant scholarly contribution in preserving and sustaining Pancasila as the foundation of the state and law in Indonesia, and ensuring that Indonesia’s constitutional law continues to reflect national values in the era of democracy and globalization.

Abstract

Pancasila, as the ideological basis of the Republic of Indonesia, plays a fundamental role in the formation and application of constitutional law, especially in the reform era that began in the late 1990s. Major transformations in Indonesia's political and legal system during this period, including the amendment of the 1945 Constitution, the renewal of laws, and the reform of state institutions, posed challenges in maintaining the relevance and application of Pancasila principles. This research aims to explore how Pancasila was integrated in the new legal and constitutional policies and to assess the impact of legal reforms on the implementation of Pancasila values. Using academic sources, empirical data, and up-to-date theoretical analyses, this research identifies the challenges faced and possible solutions to ensure Pancasila principles remain relevant and effective. The results show that although Pancasila faces various challenges, it remains a vital ideological foundation in Indonesia's legal system. In conclusion, Pancasila as an ideological foundation cannot be separated from the life of society and the state.

Abstract

This study aims to analyze the harmonization between Indonesian citizenship law and Islamic legal principles. Indonesian citizenship law is governed by Law No. 12 of 2006, which outlines various aspects of citizenship administration, while Islamic legal principles encompass teachings from the Qur'an and Hadith regarding individual responsibilities and rights within a state community. This research employs a qualitative approach with methods including document analysis, interviews, and observations to evaluate the alignment and misalignment between the two legal systems. Findings indicate alignment in principles such as trust and equality of rights, yet highlight discrepancies concerning dual citizenship and certain provisions that diverge from Sharia principles. To address these issues, it is recommended to revise policies, foster dialogue between policymakers and scholars, and enhance legal education and outreach. This study aims to contribute to achieving a harmonious balance between Indonesian citizenship law and Islamic legal principles.

Abstract

This study aims to analyze the journalistic regulations stipulated in Law Number 40 of 1999 on the Press and to identify its positive impacts on journalists in Indonesia. A descriptive qualitative approach is used in this research, with primary data sourced from the text of Law Number 40 of 1999 on the Press and secondary data consisting of academic literature, journal articles, and related reports. Data collection is conducted through literature study, and data analysis involves data reduction, presentation in descriptive narratives, and drawing conclusions. The results show that Law Number 40 of 1999 on the Press serves as a significant milestone in press freedom in Indonesia. This law guarantees freedom of expression, protects journalists' rights, enhances professionalism, and promotes the development of responsible media. Moreover, the existence of the Journalistic Code of Ethics and the role of the Press Council in resolving reporting disputes provide legal protection and ensure journalistic integrity. Its positive impacts include increased freedom of expression, legal protection, improved professionalism, enhanced media credibility, and encouragement of innovation in journalism. Overall, Law Number 40 of 1999 on the Press has established a strong foundation for a free, independent, and responsible press, enabling journalists to fulfill their strategic role as a pillar of democracy.

Abstract

Pancasila as the foundation of the Indonesian state plays a key role in building a legal order that reflects the noble values of the nation. As the basis of constitutional law, Pancasila is not only an ideological symbol, but also a normative foundation that influences legislation, government systems, and national policy-making. This article aims to analyze the philosophical and juridical implications of Pancasila as the basis of law in Indonesia’s constitutional system and outline the application of its values in a dynamic legal context. Through a comprehensive literature review approach, the article identifies how Pancasila influences policy formation, law implementation and creates a balance between national stability and the principles of social justice, humanity and democracy. It also examines the challenges and constraints in implementing Pancasila values amidst socio-political dynamics as well as the need for legal reforms that are in line with changing times. Thus, this discussion provides insight into the continuing relevance of Pancasila in shaping a just and democratic legal framework to realize the ideals of the nation.

Abstract

Islamic law provides a comprehensive framework that regulates the rights and obligations of individuals in their relationships with God, fellow humans, and the state. The integration of Islamic law into public affairs in Indonesia, a predominantly Muslim country, presents the challenge of aligning the principles of this religion with the country's pluralistic legal framework. This research explores how Islamic legal principles regarding the rights and responsibilities of citizens interact with the Indonesian legal system, which is based on the principles of Pancasila and the national constitution. This research uses the research methodology of a legislative approach (law approach), legal cases (case approach), conceptual analysis (conceptual approach), historical perspective (historical approach), and comparative. The research results show that although there is potential conflict between Islamic law and national law, proper integration can strengthen social order and justice. This research also highlights the importance of dialogue between stakeholders to formulate legal policies that are inclusive and fair, and support the supremacy of law in Indonesia. This research provides a critical assessment of the application of Islamic law in Indonesia, especially in the context of citizenship, and proposes several solutions to overcome potential conflicts between legal systems. By highlighting real cases in several regions that strictly apply Sharia law, this research concludes that harmonization of Islamic law with the national legal system is not only important to maintain the religious identity of the majority of Indonesian society, but also to maintain the integrity of the nation in the midst of diversity.
