Abstract

In maintaining the welfare of women and children involved in early marriage, legal protection has a very important role. This research uses doctrinal legal research which is a process to find rules, principles, and doctrines to answer the issues at hand. The characteristics of the research are prescriptive. The research method used is Normative / Doctrinal / Library Research Researchers concluded that to protect the Law of Early Marriage the age under 19 years according to Islamic law needs appropriate legal regulations, the need for women's empowerment and community education, inter-stakeholder cooperation in the context of the legal protection of early marriage from various parties, including government, non-governmental institutions, international organizations, and civil society. This collaboration is needed to formulate effective policies, provide adequate services, and raise public awareness. According to Islamic Fiqh itself, Marriage scholars differ on the minimum age of marriage. Most of the scholars of the Maliki madzhab argue that the age of menstruation for women and men is 17 years or 18 years, while Abu Hanifah argues that the age of puberty is 19 years or older. Shafi'i, Ahmad, Ibn Wahab, and the majority think that it is the perfect age of fifteen years.

Abstract

This research examines Maslahah in the concept of Islamic law. In the context of guardianship of children out of wedlock in a marriage bond according to the compilation of Islamic law, the substance of this maslahah is very relevant. However, sometimes situations where a child is born outside of marriage can occur. The research method used is Normative/Doctrinal/Literature Research The findings of this study indicate that the concept of guardianship of children out of wedlock in the perspective of the Islamic compilation has been listed in Law No. 1 of 1974 concerning marriage, Article 19 of the Compilation of Islamic Law, Article 53 paragraph 3 of the Compilation of Islamic Law, and Article 75 letter (b) of the Compilation of Islamic Law. That maslahah plays an important role in determining the view of Islamic law on this issue. In this context, it is found that a proper understanding of maslahah, which includes the protection of individual rights and the welfare of society, is essential in dealing with the guardianship of out-of-wedlock children. In this scientific work, several important aspects related to the concept of guardianship of extra-marital children have been discussed. Firstly, there are differences of opinion among scholars regarding the halal or haram guardianship of out-of-wedlock children, Secondly, the importance of paying attention to the values and principles of Islamic law underlying the concept of guardianship of out-of-wedlock children. Third, the a need for a clear and effective regulatory framework to regulate the practice of guardianship of out-of-wedlock children.

Abstract

This study discusses the termination of marriage and its consequences in Fiqh Munakahat. The aim of this research is to examine and understand Fiqh Munakahat which discusses the termination of marriage and its consequences. The method used in this research is a qualitative method of literature review. Essentially, marriage is intended for lifelong happiness between a man and a woman. Divorce is granted if one party fails to fulfill its obligations adequately and the other party is unable to fulfill its obligations, leaving no option but to divorce. The results of this research conclude that the termination of marriage in Islamic law is that the divorce process such as talak, fasakh, or khul' must be regulated with full justice, decency, and caution. Both parties must obtain their rights fairly, including rights to property, maintenance, and child custody. The importance of maintaining family integrity and avoiding divorce except when absolutely necessary is emphasized in Islamic teachings. Furthermore, Islamic law emphasizes peaceful conflict resolution and settlement that respects the rights of all parties involved. By understanding the relevant principles of Islamic law and seeking guidance from qualified scholars and jurists, Muslims can handle the termination of marriage wisely, prioritizing mutual welfare, and upholding the moral values and ethics taught by Islam.

Abstract

This study aims to analyze the role of Pancasila in the formation of national legal norms in Indonesia. As the state ideology, Pancasila influences every aspect of legal development and implementation through the fundamental principles embodied in its five precepts. This research employs a qualitative approach using case studies, document analysis, and interviews to identify how Pancasila's values are integrated into the legal system. Data were collected from legal documents, judicial decisions, and interviews with legal experts and lawmakers. The findings reveal that Pancasila serves as a source of values and normative guidance, ensuring legal consistency, and facilitating evaluation and social control. The study also highlights how Pancasila supports public participation in the legislative process, contributing to a legal system that aligns with national ideals of social justice and democracy. These insights aim to deepen the understanding of how Pancasila’s values are applied withiystem.

Abstract

The application of Pancasila as an ethical foundation in law enforcement against criminal acts of terrorism in Indonesia highlights the importance of integrating humanitarian values and human rights principles. This article analyses how Pancasila, with its focus on social justice and humane treatment, distinguishes Indonesia's approach from repressive methods commonly applied in other countries. The research method used in this article is a descriptive qualitative approach, which includes document analysis as well as in-depth interviews with various stakeholders, including law enforcement, academics, and deradicalisation practitioners. The data obtained is analysed to evaluate the effectiveness of deradicalisation programmes based on the principles of Pancasila and its impact on reducing radicalisation as well as reintegration of former terrorism perpetrators. By emphasising the need for a balanced policy between security and human rights, the Pancasila-based approach proved to be more effective and sustainable in the long run. Challenges in the consistent application of Pancasila values are faced in the context of globalisation and advances in information technology. The results show that this approach not only reduces radicalisation but also facilitates the reintegration of former terrorism perpetrators into society. In conclusion, the application of Pancasila in law enforcement contributes significantly to national stability and can be a model for other countries in countering global terrorism.

Abstract

This research examines issues related to citizenship and criminal responsibility in the context of international courts, with a focus on how these challenges influence law enforcement processes. Through a case study-based qualitative analysis approach and a review of recent literature, this research explores how dual citizenship, the political status of perpetrators, and globalization influence jurisdiction and justice in international courts. Case studies analyzed include The Prosecutor v. Al-Bashir and The Prosecutor v. Dominic Ongwen, who shows how these issues hamper international courts' efforts to enforce the law. The findings of this research underscore the need for reform in the international legal system, including legal harmonization, reform of extradition mechanisms, and increased coordination between courts. This research also highlights the importance of continuous education and training for international law officials to face new challenges in the era of globalization.

Abstract

This study investigates the role of citizenship in the context of dual identity in Indonesia's multicultural society, as well as how Islamic law and national law interact with law enforcement. Due to the extraordinary cultural and religious diversity, Indonesia faces challenges in integrating the dual identities of its people. Cultural and religious identities often lead to conflicts among citizens governed by national law, especially when it comes to religious rules and Islamic law. How dual identity affects law enforcement in Indonesia is explored through qualitative research using descriptive-analytical techniques. Data was obtained through in-depth interviews with relevant individuals and analysis of national legal and religious documents. The research results indicate that although Law No. 12 of 2006 on Citizenship provides a legal basis for all citizens. In reality, Islamic law often plays a larger role in the lives of Muslim communities. The disagreement between religious law and national law causes chaos in law enforcement, especially regardingin heritance and family issues. In addition, this research examines the legal systems in other countries with multicultural populations, such as Malaysia, India, and Canada. These countries demonstrate similar issues in creating fair legal policies for multicultural societies. This research concludes that an inclusive approach must be used in the formulation of legal policies in Indonesia so that dual identities in society can be accepted by the state’s legal system, allowing.

Abstract

This research discusses the concept of dual citizenship in the perspective of Indonesian positive law and Islamic law. Dual citizenship refers to the legal status in which a person is recognized as a citizen by more than one country, a phenomenon that is increasingly relevant in the era of globalization. In Indonesian positive law, dual citizenship is generally not recognized, except in special cases such as children from mixed marriages. However, increasing global mobility and individual rights have prompted discussion on the need for wider recognition of dual citizenship. Meanwhile, Islamic law provides a more flexible approach by considering the maqasid al-shariah principle which emphasizes the protection of basic human rights. Through a normative juridical and sociological approach, this research explores how the two legal systems deal with dual citizenship and what the implications are for individuals as well as the state. A comparative study of dual citizenship Dual Citizenship, Positive Law, Islamic Law, Maqasid al-Shariah, Citizenship Regulation practices in several other countries, such as the United States, Canada, Egypt and Pakistan, was also conducted to gain greater insight and understand the best practices that can be adapted in Indonesia. The results show that despite resistance to dual citizenship, its implementation can provide significant benefits, both in terms of protecting individual rights and strengthening international relations. Therefore, it is recommended that Indonesia consider a more comprehensive and inclusive policy regarding dual citizenship, which is in line with positive legal values and Islamic legal principles. This research can hopefully serve as a reference for policy makers and academics in developing regulations that are adaptive to global dynamics.

Abstract

Pancasila, as the basis of the Indonesian state, is a philosophical system that underlies national and state life with the principles of divinity, humanity, unity, democracy and social justice. The background to this research focuses on the urgency of Pancasila in globalization and also rapid social change, where new challenges require adaptation so that Pancasila remains relevant and effective. The aim of the research is to analyze the hierarchical and pyramidal structure of Pancasila, the formulation of the relationship between the precepts which complement and qualify each other, as well as the dynamics and challenges faced by Pancasila as a philosophical system. The research method uses library research to collect and analyze data from various relevant sources. The research results show that Pancasila, with its hierarchical structure that positions the precepts in a mutually supportive order, functions as a strong moral and ideological guide. The relationship between the Pancasila principles complement each other and also clarify each other's principles, forming a coherent and comprehensive system. However, challenges such as globalization, social inequality and political dynamics require adjustment and adaptation to maintain the relevance of Pancasila. This research emphasizes the importance of further study and development to ensure that Pancasila remains the basis of a strong and effective state in the modern era.

Abstract

This research discusses the relationship between citizenship in international law, with a focus on two implications, namely extradition treaties and diplomatic immunity. Citizenship has an important role in the extradition process and the application of diplomatic immunity because often an individual's citizenship status influences legal and diplomatic decisions. Through literature analysis, recent case studies, and international comparisons, this research identifies that legal and political decisions on extradition and the application of diplomatic immunity are influenced by citizenship. Modern cases, such as the involvement of Julian Assange and Chelsea Manning, forgivemin prove the lack of balancing between international obligations and individual rights. Variations in legal practices between countries, including differences between European countries, the United States, and Asian countries, highlight the need for more consistent international standards. This research recommends increased multilateral dialogue, transparency of legal processes, and long-term case studies to improve understanding and practice regarding citizenship in international law.
