Abstract

Kitab Nurul Burhan adalah kitab yang ditulis oleh Syaikh Muslih bin Abdurrahman Al Maraqi yang merupakan seorang ulama dari Mranggen, Demak, Jawa Tengah. Kitab Nurul Burhan merupakan syarah dari kitab Maulid Al-Lujjainid Dani karya Syaikh Ja’far bin Hasan bin Abdul Karim Al-Barzanji yang berisi tentang kisah perjalanan hidup seorang ulama sekaligus waliyullah yaitu Syekh Abdul Qodir Al-Jailani. Dimana dalam kisah perjalanan hidup beliau tersebut terdapat beberapa nilai-nilai pendidikan Fiqih yang dapat diteladani dan dapat dijadikan pedoman dalam pendidikan Islam. Rumusan masalah dalam penelitian ini yaitu mengenai apa saja nilai-nilai pendidikan Fiqih dalam Kitab Nurul Burhan karya Syaikh Muslih bin Abdurrahman Al-Maraqi. Penelitian ini bertujuan untuk mengetahui apa saja nilai-nilai pendidikan Fiqih dalam Kitab Nurul Burhan karya Syaikh Muslih bin Abdurrahman Al-Maraqi terbitan Toha Semarang. Adapun kegunaan penelitian ini (1) Secara teoritis untuk menambah khasanah keilmuan serta dapat dijadikan pedoman bagi masyarakat dalam memahami nilai-nilai pendidikan Fiqih dalam Kitab Nurul Burhan karya Syaikh Mushlih bin Abdurrahman Al-Maraqi. (2) Secara praktis yaitu, sebagai referensi bagi peneliti lain yang bermaksud melakukan penelitian lebih lanjut. Jenis penelitian ini adalah penelitian kepustakaan (library research), yang menggunakan sumber data primer berupa Kitab Nurul Burhan Karya Syaikh Muslih bin Abdurrahman Al- Maraqi terbitan Toha Semarang. Sedangkan untuk data sekunder peneliti memakai buku pendukung, artikel, jurnal dan dokumen lain yang terkait dengan judul penelitian. Keabsahan data di uji melalui peningkatan ketekunan dan analisis data dilakukan dengan content analysis atau analisis isi dalam bentuk deskriptif. Nilai-nilai pendidikan Fiqih berkaitan erat dengan filosofi, hikmah, dan maqashhudy syari’ah dari pendidikan Fiqih yang biasa di lakukan seseorang setiap harinya. Setelah ditelaah lebih jauh, terdapat nilai-nilai pendidikan Fiqih yang dimukan dalam kitab Nurul Burhan Karya Syaikh Muslih bin Abdurrahman Al- Maraqi berupa: membiasakan diri untuk menjaga kesucian diri maupun pakaian dari hadats ataupun najis, senantiasa mengerjakan amal sholeh dan menepati nadzar.

Abstract

The secret sale of land raises changes in certificate ownership dilemma. The absence of seller during creation of the Deed of Sale and Purchase (AJB) poses a severe obstacle, coupled with the buyer's lack of knowledge. Another constraint is buyer's inability to create a deed due to seller's unknown address. This research highlights buyer's efforts to overcome obstacles in transferring land certificates from off-the-record land transactions. This is a normative legal approach through literature analysis. The results show that buyers can overcome obstacles by filing a lawsuit for unlawful actions in the district court where the land is located. This lawsuit is related to unlawful actions by the defendant, such as rejection or hindrance to changing the land certificate's name. Through the trial, the court can issue an order instructing the National Land Agency (Badan Pertanahan Nasional or BPN) to transfer the land certificate in the buyer's name. Even without the Deed of Sale and Purchase (AJB), the court order serves as a legal basis for BPN to execute this process. Upon completion, the buyer obtains legal certainty regarding land ownership, and despite lacking AJB, the renamed land certificate becomes valid proof of the buyer's land ownership.

Abstract

This study evaluates the Regional Autonomy laws 32 of 2004 and 23 of 2014 in light of the Republic of Indonesia's 1945 Constitution. Where the power of autonomy to manage their own households is granted to the partition of these territories. This study is normative in character and is a legal normative study. The strategy is a normative juridical strategy. Primary data, namely the 1945 Constitution of the Republic of Indonesia and in particular Law Number 32 of 2004 and Law Number 23 of 2014 respecting Regional Autonomy, as well as secondary data were used, namely library data which includes documents official books, books on Regional Autonomy and Regional Economic Development, scientific journals and so on. And tertiary data taken from encyclopedias and dictionaries. The data obtained is then analyzed using Content Analysis on laws and regulations which are primary data. Based on the results of the research and analysis that has been carried out, it can be concluded that there are several ways to apply the principle of regional autonomy that can improve welfare and cooperation between regions nationally with unbalanced regional potential conditions such as geography and human resources. Regional autonomy as one of the instruments to realize prosperity in the form of ideal cooperation.

Abstract

The curriculum at SMPIQu Al-Bahjah Cirebon faces a challenge in integrating the formal, official curriculum with the non-formal pesantren (Islamic boarding school) curriculum. This disconnect has resulted in the pesantren curriculum becoming somewhat "hidden" or underrepresented. The core issue addressed in this research is how to design, implement, and evaluate the development of this hidden pesantren curriculum. Using a qualitative research method, the study draws from both primary and secondary data, collected through observation and interviews. The findings reveal a five-step approach to developing the hidden curriculum. Implementation is achieved through structured activities such as work meetings, scheduling academic activities, enhancing the management information system (SIM), improving teaching staff and student resources, strengthening students' morals, and increasing proficiency in foreign languages. The evaluation process includes supervision, regular meetings, audits, and reporting. The study concludes that effective curriculum development hinges on a morals and creed-based education, improved administrative and management systems, optimization of media as a development tool, and active participation in competitions and events. This research contributes to the formulation of strategies for developing the hidden pesantren curriculum, offering practical benefits for all stakeholders involved.

Abstract

This study aims to analyze the role of Pancasila in the formation of national legal norms in Indonesia. As the state ideology, Pancasila influences every aspect of legal development and implementation through the fundamental principles embodied in its five precepts. This research employs a qualitative approach using case studies, document analysis, and interviews to identify how Pancasila's values are integrated into the legal system. Data were collected from legal documents, judicial decisions, and interviews with legal experts and lawmakers. The findings reveal that Pancasila serves as a source of values and normative guidance, ensuring legal consistency, and facilitating evaluation and social control. The study also highlights how Pancasila supports public participation in the legislative process, contributing to a legal system that aligns with national ideals of social justice and democracy. These insights aim to deepen the understanding of how Pancasila’s values are applied withiystem.

Abstract

This research examines issues related to citizenship and criminal responsibility in the context of international courts, with a focus on how these challenges influence law enforcement processes. Through a case study-based qualitative analysis approach and a review of recent literature, this research explores how dual citizenship, the political status of perpetrators, and globalization influence jurisdiction and justice in international courts. Case studies analyzed include The Prosecutor v. Al-Bashir and The Prosecutor v. Dominic Ongwen, who shows how these issues hamper international courts' efforts to enforce the law. The findings of this research underscore the need for reform in the international legal system, including legal harmonization, reform of extradition mechanisms, and increased coordination between courts. This research also highlights the importance of continuous education and training for international law officials to face new challenges in the era of globalization.

Abstract

This study investigates the role of citizenship in the context of dual identity in Indonesia's multicultural society, as well as how Islamic law and national law interact with law enforcement. Due to the extraordinary cultural and religious diversity, Indonesia faces challenges in integrating the dual identities of its people. Cultural and religious identities often lead to conflicts among citizens governed by national law, especially when it comes to religious rules and Islamic law. How dual identity affects law enforcement in Indonesia is explored through qualitative research using descriptive-analytical techniques. Data was obtained through in-depth interviews with relevant individuals and analysis of national legal and religious documents. The research results indicate that although Law No. 12 of 2006 on Citizenship provides a legal basis for all citizens. In reality, Islamic law often plays a larger role in the lives of Muslim communities. The disagreement between religious law and national law causes chaos in law enforcement, especially regardingin heritance and family issues. In addition, this research examines the legal systems in other countries with multicultural populations, such as Malaysia, India, and Canada. These countries demonstrate similar issues in creating fair legal policies for multicultural societies. This research concludes that an inclusive approach must be used in the formulation of legal policies in Indonesia so that dual identities in society can be accepted by the state’s legal system, allowing.

Abstract

This research discusses the concept of dual citizenship in the perspective of Indonesian positive law and Islamic law. Dual citizenship refers to the legal status in which a person is recognized as a citizen by more than one country, a phenomenon that is increasingly relevant in the era of globalization. In Indonesian positive law, dual citizenship is generally not recognized, except in special cases such as children from mixed marriages. However, increasing global mobility and individual rights have prompted discussion on the need for wider recognition of dual citizenship. Meanwhile, Islamic law provides a more flexible approach by considering the maqasid al-shariah principle which emphasizes the protection of basic human rights. Through a normative juridical and sociological approach, this research explores how the two legal systems deal with dual citizenship and what the implications are for individuals as well as the state. A comparative study of dual citizenship Dual Citizenship, Positive Law, Islamic Law, Maqasid al-Shariah, Citizenship Regulation practices in several other countries, such as the United States, Canada, Egypt and Pakistan, was also conducted to gain greater insight and understand the best practices that can be adapted in Indonesia. The results show that despite resistance to dual citizenship, its implementation can provide significant benefits, both in terms of protecting individual rights and strengthening international relations. Therefore, it is recommended that Indonesia consider a more comprehensive and inclusive policy regarding dual citizenship, which is in line with positive legal values and Islamic legal principles. This research can hopefully serve as a reference for policy makers and academics in developing regulations that are adaptive to global dynamics.

Abstract

Pancasila, as the basis of the Indonesian state, is a philosophical system that underlies national and state life with the principles of divinity, humanity, unity, democracy and social justice. The background to this research focuses on the urgency of Pancasila in globalization and also rapid social change, where new challenges require adaptation so that Pancasila remains relevant and effective. The aim of the research is to analyze the hierarchical and pyramidal structure of Pancasila, the formulation of the relationship between the precepts which complement and qualify each other, as well as the dynamics and challenges faced by Pancasila as a philosophical system. The research method uses library research to collect and analyze data from various relevant sources. The research results show that Pancasila, with its hierarchical structure that positions the precepts in a mutually supportive order, functions as a strong moral and ideological guide. The relationship between the Pancasila principles complement each other and also clarify each other's principles, forming a coherent and comprehensive system. However, challenges such as globalization, social inequality and political dynamics require adjustment and adaptation to maintain the relevance of Pancasila. This research emphasizes the importance of further study and development to ensure that Pancasila remains the basis of a strong and effective state in the modern era.

Abstract

This research discusses the relationship between citizenship in international law, with a focus on two implications, namely extradition treaties and diplomatic immunity. Citizenship has an important role in the extradition process and the application of diplomatic immunity because often an individual's citizenship status influences legal and diplomatic decisions. Through literature analysis, recent case studies, and international comparisons, this research identifies that legal and political decisions on extradition and the application of diplomatic immunity are influenced by citizenship. Modern cases, such as the involvement of Julian Assange and Chelsea Manning, forgivemin prove the lack of balancing between international obligations and individual rights. Variations in legal practices between countries, including differences between European countries, the United States, and Asian countries, highlight the need for more consistent international standards. This research recommends increased multilateral dialogue, transparency of legal processes, and long-term case studies to improve understanding and practice regarding citizenship in international law.
