Abstract

Marriage is not only based on a birth bond between a man and a woman, because marriage is not just a matter of worshiping Allah SWT but also to obtain happiness, peace of mind, and to continue the lineage. This research discusses aims to explore more broadly the causes, impacts and analysis of forced marriages caused by arranged which are viewed from an Islamic legal perspective. The method used in this research is a qualitative method as to obtain information through interviews with various elements of society and through field observations. The result of this research show that the factors that cause forced marriage to occur in society are parental, economic, educational, and customary factors. The practice of forced marriage has negative impacts such as divorce, family conflict, and can lead to infidelity. So it can be emphasized that forced marriage is prohibited in Islamic law.

Abstract

In maintaining the welfare of women and children involved in early marriage, legal protection has a very important role. This research uses doctrinal legal research which is a process to find rules, principles, and doctrines to answer the issues at hand. The characteristics of the research are prescriptive. The research method used is Normative / Doctrinal / Library Research Researchers concluded that to protect the Law of Early Marriage the age under 19 years according to Islamic law needs appropriate legal regulations, the need for women's empowerment and community education, inter-stakeholder cooperation in the context of the legal protection of early marriage from various parties, including government, non-governmental institutions, international organizations, and civil society. This collaboration is needed to formulate effective policies, provide adequate services, and raise public awareness. According to Islamic Fiqh itself, Marriage scholars differ on the minimum age of marriage. Most of the scholars of the Maliki madzhab argue that the age of menstruation for women and men is 17 years or 18 years, while Abu Hanifah argues that the age of puberty is 19 years or older. Shafi'i, Ahmad, Ibn Wahab, and the majority think that it is the perfect age of fifteen years.

Abstract

This research examines Maslahah in the concept of Islamic law. In the context of guardianship of children out of wedlock in a marriage bond according to the compilation of Islamic law, the substance of this maslahah is very relevant. However, sometimes situations where a child is born outside of marriage can occur. The research method used is Normative/Doctrinal/Literature Research The findings of this study indicate that the concept of guardianship of children out of wedlock in the perspective of the Islamic compilation has been listed in Law No. 1 of 1974 concerning marriage, Article 19 of the Compilation of Islamic Law, Article 53 paragraph 3 of the Compilation of Islamic Law, and Article 75 letter (b) of the Compilation of Islamic Law. That maslahah plays an important role in determining the view of Islamic law on this issue. In this context, it is found that a proper understanding of maslahah, which includes the protection of individual rights and the welfare of society, is essential in dealing with the guardianship of out-of-wedlock children. In this scientific work, several important aspects related to the concept of guardianship of extra-marital children have been discussed. Firstly, there are differences of opinion among scholars regarding the halal or haram guardianship of out-of-wedlock children, Secondly, the importance of paying attention to the values and principles of Islamic law underlying the concept of guardianship of out-of-wedlock children. Third, the a need for a clear and effective regulatory framework to regulate the practice of guardianship of out-of-wedlock children.

Abstract

This study discusses the termination of marriage and its consequences in Fiqh Munakahat. The aim of this research is to examine and understand Fiqh Munakahat which discusses the termination of marriage and its consequences. The method used in this research is a qualitative method of literature review. Essentially, marriage is intended for lifelong happiness between a man and a woman. Divorce is granted if one party fails to fulfill its obligations adequately and the other party is unable to fulfill its obligations, leaving no option but to divorce. The results of this research conclude that the termination of marriage in Islamic law is that the divorce process such as talak, fasakh, or khul' must be regulated with full justice, decency, and caution. Both parties must obtain their rights fairly, including rights to property, maintenance, and child custody. The importance of maintaining family integrity and avoiding divorce except when absolutely necessary is emphasized in Islamic teachings. Furthermore, Islamic law emphasizes peaceful conflict resolution and settlement that respects the rights of all parties involved. By understanding the relevant principles of Islamic law and seeking guidance from qualified scholars and jurists, Muslims can handle the termination of marriage wisely, prioritizing mutual welfare, and upholding the moral values and ethics taught by Islam.

Abstract

The overarching goal of this study is to gain a deeper familiarity with Pancasila, its guiding principles, and its significance as a national framework. The theory that serves as the basis for this research's discussion is derived from the findings of literature studies conducted with a variety of existing sources, including in-depth expert journals, articles, and books. Given Pancasila's significance as a state, the author is keen on re-examining its application as the foundation of the state. This highlights the significance of Pancasila's implementation for any nation.

Abstract

Child abuse is a serious issue with lasting impacts. While positive law provides legal protections for children, its implementation faces challenges. In Islamic tradition, fiqh from the four major schools of thought—Maliki, Shafi'i, Hanbali, and Hanafi—also offers guidelines for child protection. This study explores the integration between positive law and fiqh to enhance child protection. Using a qualitative, library research method, the research examines whether Indonesian legislation aligns with the views of these schools. The findings reveal both alignments and differences. Positive law offers a clear legal framework, while fiqh provides a moral and religious foundation that supports the social and ethical dimensions of child protection. Integrating these perspectives can lead to a more holistic approach, combining legal rigor with religious principles to safeguard children's rights. This collaboration may strengthen child protection strategies by being more adaptive to socio-cultural contexts, offering a comprehensive solution to combat child abuse and ensure children's rights are effectively protected.

Abstract

The growth of information technology has introduced challenges like cyberbullying, especially on platforms like TikTok. The real-time nature of TikTok and insufficient moderation exacerbate the psychological harm caused to victims. In Indonesia, cyberbullying is a criminal offense under Law Number 19 of 2016 (ITE Law) as it violates human rights. From an Islamic perspective, it is seen as a serious sin, contradicting Islamic moral values. The four major Islamic schools of thought—Hanafi, Maliki, Shafi'i, and Hanbali—guide punishing offenders, ranging from fixed (hudud) to discretionary (ta'zir) penalties depending on the severity of the offense. This study uses a doctrinal legal approach and library research to examine cyberbullying on TikTok from the perspectives of both criminal law and Islamic jurisprudence. The findings highlight that integrating the principles of positive law with Islamic jurisprudence could create a more holistic and effective framework for addressing cyberbullying. A combined approach can strengthen anti-cyberbullying policies, fostering a safer digital environment. Additionally, promoting education that emphasizes Islamic values such as respect can help prevent cyberbullying. The study recommends increasing public awareness, integrating Islamic and positive legal principles into policies, and improving law enforcement’s capacity to address cyberbullying more effectively.

Abstract

This study aims to analyze the impact of foreign direct investment (FDI) on citizenship policies in Indonesia and explore how changes in these policies can affect citizens' rights and national sovereignty. The research uses a qualitative approach with a literature review method. A literature review is a type of research conducted by collecting and analyzing existing data or scholarly articles to address problems and understand fundamental issues. The reason for using library research is that the researcher needs data from various sources such as books and previous research journals. Using this method, the researcher identifies relevant topics aligned with the research goals and then analyzes journals and books to answer questions about how FDI significantly impacts Indonesia's economy, driving growth, job creation, and global competitiveness. However, citizenship policies related to FDI require careful attention to balance investment needs with national sovereignty. Reforming policies to simplify residency and citizenship status for foreign investors could make Indonesia a more attractive investment destination, but it might also raise concerns about the impact on the rights of native citizens and national integrity. To manage these effects, Indonesia needs to develop integrated citizenship policies, conduct regular evaluations, enhance transparency, and learn from international practices. With a careful approach, Indonesia can maximize the benefits of FDI while maintaining national interests.

Abstract

This study examines the legal protection for stateless persons within the framework of citizenship and human rights. The focus is on assessing the effectiveness of international legal frameworks and national policies in safeguarding the fundamental rights of individuals without citizenship. The research employs a qualitative analysis of key legal instruments, including the 1954 Convention Relating to the Status of Stateless Persons and the 1961 Convention on the Reduction of Statelessness, alongside case studies of policy implementation across various countries. The findings reveal that, despite a robust international legal framework, there are significant gaps in implementation and enforcement, leading to ongoing discrimination and human rights violations against stateless persons. The study recommends comprehensive policy reforms and enhanced international cooperation to improve legal protection for this vulnerable group.

Abstract

The phenomenon of unregistered marriage, or nikah siri, conducted without official state registration, presents challenges in legal and social aspects, particularly regarding inheritance rights, legal protection for wives and children, and equality of rights. This study aims to analyze the perspectives of Islamic law, Pancasila values, and Indonesian constitutional law on unregistered marriages in Indonesia. This research uses normative and conceptual legal approaches, with primary data consisting of relevant laws and secondary data from literature addressing the legal and social dimensions of nikah siri. The results indicate that, from the perspective of Pancasila and the constitution, nikah siri does not align with the principles of social justice and human rights. From the perspective of Islamic law, the importance of marriage registration is also consistent with the objectives of maqasid sharia, which aims to protect family rights. This study recommends educational programs and policy reforms on marriage registration as steps to enhance legal protection and promote social justice within society.
