Abstract

This study examines commodity sales transactions (buyu') containing elements of gharar in Batu Basa from the perspective of muamalah jurisprudence. Gharar, defined as ambiguity or uncertainty in a sale and purchase contract, is prohibited in Islam because it has the potential to harm certain parties and contradicts the principle of justice. This study examines how commodity sales practices in Batu Basa comply with or violate the principle of clarity of the object, price, and transaction contract to avoid gharar. The results indicate that the success of commodity sales transactions depends heavily on transparency and clarity of the contract to avoid elements of gharar, such as uncertainty about the goods sold and uncertain prices. Therefore, the application of muamalah jurisprudence principles that emphasize clarity and mutual agreement in commodity sales in Batu Basa is crucial to maintaining the validity and fairness of transactions and avoiding speculative or fraudulent practices. The implications of this study are encouraging increased understanding and supervision of commodity transactions to ensure they comply with Islamic law

Abstract

Purpose - This research aims to critically examine the use of the term feudalism in describing social relations in Islamic boarding schools and offers a conceptual redefinition that distinguishes between feudal power structures and Islamic ethical systems based on adab. Design/Methodology/Approach - With a qualitative-descriptive approach through the Systematic Literature Review, this study examines classical literature such as Ta'līm al-Muta'allim by Al-Zarnuji and Iḥyā' 'Ulūm al-Dīn by Al-Ghazali, as well as contemporary research on the social dynamics of Islamic boarding schools. Findings - The results of the study show that the hierarchical relationship between kiai and santri does not represent a pattern of domination as in feudalism, but a reflection of adab values that emphasize respect, sincerity, and the search for barokah. The social structure of pesantren is moral and pedagogical, not exploitative. In addition, this study emphasizes that adab values are in line with the goals of pesantren education as stated in Pasal 3 UU No. 18 Tahun 2019, That is, to form individuals who are faithful, knowledgeable, independent, and moderate. Originality/Value - The original value of this research lies in the synthesis of Western social theory and Islamic ethics which produces a new conceptual framework on the social relations of Islamic boarding schools, thus enriching the discourse of Islamic education in the context of modernization and democratization.

Abstract

Purpose - This study examines the persistent phenomenon of nikah sirri (unregistered marriage) in Tanjung Palas District, Bulungan Regency, despite ongoing formal and religious guidance. It aims to explore the socio-legal dynamics underlying the continued practice of nikah sirri and analyze it through the lens of the Islamic legal maxim al-dhararu lā yuzālu bi al-dharari (“harm cannot be eliminated by another harm”). Design/Methodology/Approach - The study employs a normative-empirical design using a qualitative descriptive approach. Primary data were collected through in-depth interviews, observation, and documentation, while secondary data were obtained from books, scholarly articles, the Qur’an, and previous academic works. Data were analyzed through systematic stages of data collection, reduction, presentation, and conclusion drawing. Findings - The findings reveal that nikah sirri is driven by recurring factors, including premarital pregnancy, underage marriage, arranged marriage, intentions to enter polygamous unions, and the absence of divorce certificates from previous marriages. From the perspective of al-dhararu lā yuzālu bi al-dharari, nikah sirri does not serve as a legitimate mechanism for mitigating harm; instead, it creates additional legal and administrative difficulties, particularly in obtaining essential civil documents such as national ID cards, birth certificates, family cards, and other state administrative services.. Originality/Value - This study provides a contemporary evaluation of nikah sirri using the Islamic legal maxim al-dhararu lā yuzālu bi al-dharari, offering a socio-legal perspective that highlights its incompatibility with legal certainty and the protection of family rights within Indonesian society. The research contributes by demonstrating how the practice perpetuates—not eliminates—harm, thus enriching discussions on Islamic legal norms and modern administrative realities. This study contributes to socio-legal discourse by demonstrating that unregistered marriage contradicts Islamic legal principles of harm elimination, thereby supporting state policy on mandatory marriage registration.

Abstract

Purpose- This article aims to analyze hoaxes in the social media ecosystem and formulate a hadith-based digital communication ethical framework that is relevant to the contemporary technological context. Design/Methodology/Approach - This study uses a qualitative method with a literature study approach, by analyzing primary sources in the form of thematic hadiths on communication, honesty, verification, and speaking ethics, as well as secondary sources that discuss hoaxes, social media algorithms, and religious digital literacy. Findings - The results of the study show that the character of hoaxes on social media is influenced by a combination of technological factors (algorithm of engagement), psychological (impulsivity and cognitive bias), and social (symbolic authority and echo chamber). From the perspective of hadith, the principles of ṣidq, amanah, tabayyun, and adab al-qawl have proven to be the foundation in preventing hoaxes and disinformation. However, the application of these principles faces structural obstacles due to the design of digital platforms that prioritize virality over accuracy. Originality/Value - The novelty of this research lies in the effort to integrate hadith about hoaxes not only at the normative-individual level, but also at the structural level through the concept of internalizing the value of hadith into the design of digital platforms. This article offers a conceptual framework of Islamic digital communication ethics that links the principles of hadith, maqaṣid al-shari'ah, and value-sensitive design approaches as theoretical and practical contributions in the study of hoaxes on social media.

Abstract

Purpose -This study examines the Sekaten ceremony at the Kasunanan Palace in Surakarta and Yogyakarta as a reflection of Javanese-Islamic civilization. It aims to analyze the religious significance of this tradition in commemorating the birthday of Prophet Muhammad SAW and the Islamic New Year. Design/Methodology/Approach -  A qualitative approach was used, combining traditional methods like observation, interviews, and documentation with modern digital ethnography, including the analysis of videos and TikTok content. Findings - The research shows that Sekaten bridges 16th-century Javanese roots with deep Islamic values. While aesthetic elements like Gamelan Guntur Madu and Guntur Sari remain central, the use of agricultural products, such as tumpeng and jodhang to symbolizes communal gratitude for a prosperous life. These rituals function as a reflection of faith, allowing the Javanese community to unite in a religious and cultural celebration. Originality/Value - This article highlights the resilience of ancient traditions in the digital age. By integrating modern social media platforms like TikTok into the study of a centuries-old ritual, it provides a unique perspective on how Islamic civilization maintains its meaning amidst globalization.

Abstract

Purpose – This study aims to discuss mutual cooperation in Islam as explored from the main sources of the Quran and Hadith. Design/Methodology/Approach – This qualitative descriptive study with literature review uses content analysis to sort data according to the focus of the study. Findings – This study found that Islam encourages mutual cooperation in goodness and piety, and prohibits mutual assistance in significant crimes, as stated in Surah Al-Maidah verse 2 and Surah Ali Imran verse 104.  Mutual cooperation is encouraged because of social awareness among individuals, prioritizing togetherness to create harmony among members of society, as stated in Surah Al-Mujadilah verse 11. Mutual cooperation is also significant in HR. Muslim, HR. Bukhari and Muslim. Islam also allows cooperation and mutual assistance with those of different religions, as stated in Surah At-Taubah verse 6. There are three historical events in Arab civilization related to the culture of mutual cooperation, both before and after the arrival of Islam, namely: the renovation of the Kaaba, the construction of the Prophet's Mosque upon first arriving in Medina, and mutual cooperation in building a trench as a defense during the Battle of Khandaq. Originality/Value – The original value in this study is the discovery of the significance of mutual cooperation with Islamic values based on the Quran and Hadith, which has not been discussed by previous researchers.

Abstract

This research examines the concept of mountains as Earth’s Stakes through an interdisciplinary lens, integrating Qur'anic perspectives with modern geological science. The study aims to bridge the gap between classical and modern exegesis (tafsir), specifically focusing on Tafsir Ibn Kathir and Quraish Shihab’s Tafsir Al-Misbah, and contemporary scientific understanding. The study employs an interdisciplinary approach, synthesizing qualitative textual analysis of religious scriptures with established scientific theories. It compares the linguistic and theological descriptions of mountains in the Qur'an (specifically Surah An-Naba: 6-7) with empirical geological data, including plate tectonics and the principle of isostasy. The results indicate that the Qur'anic term "autad" (stakes) aligns with modern geological findings which reveal that mountains have deep "roots" embedded in the Earth's crust. These structures contribute to the Earth's geodynamic stability, mitigate seismic impacts, and provide essential resources for life. Furthermore, the study finds that while classical interpretations focus on physical stability, modern interpretations expand this to include the spiritual significance of divine balance in creation. This research demonstrates a profound harmony between divine revelation and empirical science. By validating the stabilizing function of mountains through both theological and scientific frameworks (including perspectives from scholars like Keith L. Moore), it provides a foundation for developing faith-based scientific knowledge and encourages a holistic view of the relationship between religion and the natural world.
