Abstract

The growth of e-commerce has transformed private law agreements and evidence through electronic signatures (E-signatures). Despite recognition under the UU ITE, classifications of certified and uncertified E-signatures and their evidentiary value still pose normative and practical challenges. This normative juridical research applies statutory, conceptual, and case approaches to analyze the regulation, validity requirements, evidentiary strength, and implementation challenges of E-signatures to ensure legal certainty and party protection. Primary legal sources include the Indonesian Civil Code, UU ITE, PP 71/2019, and Permenkominfo 11/2022. The results show that E-signatures are legally valid if they meet Article 11 of the UU ITE and PP 71/2019. Their evidentiary value equals other electronic evidence, though their weight depends heavily on authentication, system integrity, and Electronic Certification Provider reliability. E-signature effectiveness in court ultimately relies on technical standardization, digital-legal literacy, and consistent evidentiary practices.

Abstract

Disputes over uncertified inherited land trigger serious issues regarding proof of rights, overlapping legal aspects, and the absolute competence of the Religious Court (PA) and the District Court (PN). This normative legal study, utilizing statutory, conceptual, and case approaches, examines the legal basis, judicial competence, evidentiary strength, and litigation obstacles of such cases. The results indicate that inheritance disputes among Muslims fall under the absolute competence of the PA. However, if they involve third parties, non-Muslims, or tort (perbuatan melawan hukum) claims, the PN may have jurisdiction depending on the legal construction. Evidentiary proof for uncertified land relies on girik, letter C, inheritance certificates, witnesses, and physical possession, although its strength remains inferior to registered land. Ultimate legal certainty must be pursued through land administration formatting via inheritance rights registration and certification.

Abstract

Technological advancements increase the risk of adolescent cyberbullying. This complex phenomenon arises because both perpetrators and victims are generally minors. This normative juridical research analyzes cyberbullying regulations, adolescent criminal liability, juvenile justice system law (UU SPPA) implementation, victim protection, and law enforcement obstacles. Results show cyberbullying is not regulated as a distinct offense, but its elements are scattered across provisions regarding defamation, threats, extortion, and hate speech. Criminal liability remains possible for adolescents, but its application must comply with restorative justice and rehabilitation principles under UU SPPA. Conversely, victim protection is still hindered by digital evidence, low legal literacy, informal settlements, and suboptimal inter-agency coordination. Therefore, adolescent cyberbullying enforcement requires a balanced model harmonizing victim protection, juvenile perpetrator rehabilitation, and legal certainty in Indonesia's digital space.

Abstract

Industrial growth has substantially contributed to economic development while simultaneously increasing the risk of environmental pollution through the generation of hazardous and toxic waste (B3 waste). Improper management of B3 waste threatens environmental sustainability, public health, and natural resources, making effective legal regulation essential. This study examines the legal responsibility of the industrial sector in managing B3 waste under Indonesian environmental law, particularly Law Number 32 of 2009 on Environmental Protection and Management and its implementing regulations. The research employs a normative juridical method using statutory, conceptual, and limited case approaches. Primary legal materials include the 1945 Constitution, Law Number 32 of 2009, relevant government regulations, and ministerial regulations concerning B3 waste management, while secondary materials consist of books, scientific journals, and previous studies. The findings indicate that industrial responsibility extends beyond technical waste management activities, encompassing environmental licensing, monitoring, reporting, and preventive risk management. Violations may result in administrative, civil, or criminal liability depending on the nature and impact of the offense. Although the existing legal framework provides a comprehensive basis for environmental protection, its implementation remains constrained by weak supervision, inconsistent compliance, limited institutional capacity, and challenges in law enforcement. Strengthening regulatory oversight, institutional coordination, and consistent enforcement is therefore essential to ensure effective B3 waste management and achieve sustainable environmental governance..

Abstract

The development of financial technology has driven the growth of online lending, yet the expansion of illegal online lending platforms has led to serious personal data violations. Unauthorized access to contacts, galleries, and locations is frequently followed by intimidating debt collection that degrades consumer dignity. This normative juridical research analyzes data protection regulations, types of violations, operators' legal liabilities, and the effectiveness of victim protection in Indonesia. Utilizing statutory, conceptual, and case approaches, this study examines the Personal Data Protection Law (UU PDP), the ITE Law, and OJK regulations. The results indicate that although the UU PDP strengthens the normative legal framework, protection for victims remains sub-optimal due to illegal operators functioning outside the official network, weak law enforcement, and low digital literacy. Therefore, consumer protection requires cross-sector supervisory strengthening, aggressive law enforcement, and firmer personal data rights within the digital ecosystem.

Abstract

The enactment of Law Number 1 of 2023 on the New Criminal Code (KUHP) brings a paradigmatic shift by recognizing restorative justice. This normative legal research aims to analyze the position of Alternative Dispute Resolution (ADR) in criminal-dimensional disputes, formulate the boundaries of criminal liability, and examine its legal implications. The results show that the position of ADR in the criminal realm is legitimate but limited, only covering civil consequences of crimes, complaint offenses, minor offenses, or cases meeting restorative justice requirements. The boundaries of criminal liability cannot be completely eliminated through ADR because the principle of legality and the public nature of criminal law still require state intervention. Unrestricted use of ADR potentially triggers the commercialization of justice, impunity, and weakening of criminal law's preventive function. This study recommends detailed and integrated technical guidelines by law enforcement agencies to operationally implement these boundaries consistently

Abstract

Information technology developments have birthed a new form of cyber-faced sexual violence, namely Electronic-Based Sexual Violence (EBSV). This normative juridical research aims to analyze the legal framework of EBSV after the enactment of the TPKS Law, forms of victim protection, and implementation barriers. The novelty lies in the integrated analysis of three legal regimes (TPKS Law, ITE Law, Criminal Code) incorporating the latest implementing regulations, Government Regulation Number 30 of 2025 and Government Regulation Number 29 of 2025. The results indicate that the TPKS Law successfully fills legal lacunae and shifts the paradigm toward victim-oriented enforcement. However, its effectiveness remains hindered by regulatory disharmony, digital proof burdens, social stigma, and technical issues regarding victim trust funds. This study recommends regulatory harmonization, strengthening digital forensics capacity, and optimizing restitution mechanisms.

Abstract

Corporate activities drive economic growth but also serve as a primary source of environmental degradation in Indonesia, including waste pollution and land fires. This normative legal research examines the characteristics of corporate criminal liability in environmental offenses using statutory, conceptual, and case approaches. The analysis focuses on liability characteristics, positive law regulations, and enforcement obstacles. The results indicate that corporate liability is both derivative and autonomous, where institutional fault is construed as a systemic failure in policy and environmental compliance culture. Although Law No. 32/2009 and Supreme Court Regulation No. 13/2016 are established, implementation remains hindered by mens rea proof difficulties, judicial disparity, and weak judgment execution. This study recommends strengthening corporate fault doctrine through a corporate compliance failure model.

Abstract

Child sexual abuse as an extraordinary crime prompted the issuance of chemical castration policies under Law No. 17/2016 and Government Regulation No. 70/2020. However, its implementation triggers legal dilemmas regarding human rights and medical ethics. This normative legal research aims to analyze the regulations, implementation dilemmas, countermeasure effectiveness, and future ideal legal models of chemical castration. The results indicate that chemical castration is designated as a rehabilitative measure (maatregel), not retribution. This sanction conflicts with the prohibition of torture under Article 28G Paragraph (2) of the 1945 Constitution, medical ethics rejection, and limited clinical assessment infrastructure. This study recommends a comprehensive policy reconstruction: restricting application only to offenders with paraphilic disorders, establishing independent specialized medical teams, and strengthening rehabilitation alongside victim recovery systems.

Abstract

This article is entitled " Japanese Smock Sewing Decorative Techniques on Exotic Dramatic Style Clothing". The creation of this work was inspired by an exotic dramatic style that displays a more expressive impression and elevates elements of local culture and wisdom. The artist embodies this concept into clothing by using Lurik Woven Fabric and Silungkang Songket combined with Satin material. The clothing created consists of three levels of clothing, namely Ready to Wear, Ready to Wear Deluxe, and Haute Couture. In the creation of this work, the artist uses the Japanese smock technique which will produce a raised texture in the form of waves arranged regularly to create decorative flowers. The choice of the Japanese smock technique is also based on the artist's experience in learning the technique through fabric manipulation during college so that the artist understands the character and visual potential that will be produced. The materials used in the creation of the work are Donatello satin fabric, Lurik woven fabric, Silungkang songket. The creation method starts from searching for sources of ideas and references, making designs, selecting materials, to changing the work. The results of the work show that the application of Japanese smocking techniques to Exotic Dramatic Style clothing is able to produce a unique clothing appearance through the Fabric Manipulation Technique.
