Abstract

This study aims to analyze the legal instruments regulating state responsibility toward environmental health as a fundamental human right and to evaluate the implementation of strict liability principles within the Indonesian legal framework. Main Problem: Despite the constitutional guarantee under Article 28H Paragraph (1) of the 1945 Constitution, a significant gap persists between legal ideals and the reality of environmental degradation, often exacerbated by economic exploitation and suboptimal state supervision. Method: This study employs a normative legal research method with a statutory approach and a conceptual approach, utilizing qualitative-prescriptive analysis on primary and secondary legal materials. Findings: The findings reveal that while Indonesia has established an integrated legal framework—comprising human rights law, environmental management law, and the latest healthcare regulations—state enforcement remains sub-optimal. This issue is particularly evident in regional autonomy, where a conflict of interest often arises between regional economic revenue and environmental protection. Furthermore, the application of strict liability has not been consistently integrated into administrative supervisory functions to prevent corporate pollution. Conclusion: To fully fulfill its constitutional obligation to protect and fulfill the right to a healthy environment, the state must shift from a reactive stance to a proactive approach by strengthening preventive instruments and strictly enforcing administrative sanctions.

Abstract

Micro, Small, and Medium Enterprises (MSMEs) play an important role in supporting economic growth through job creation and improving community welfare. In MSME activities, language becomes one of the important factors influencing the effectiveness of communication between business actors and consumers. This study aims to determine the role of Indonesian language in supporting MSME activities in Socah District, Bangkalan Regency, especially in transaction communication, customer service, product promotion, and business development. This research uses a descriptive qualitative method with data collection techniques through interviews and observations of MSME actors in Socah District. The results show that Indonesian language has a strategic function as a communication tool that helps deliver product information clearly, increases customer comfort, and builds a professional business image. Although people in Socah District still frequently use Madurese language in daily interactions, Indonesian is still used as a connecting language when communicating with consumers from outside the region. The proper use of Indonesian helps MSME actors reduce misunderstandings, improve service quality, and expand marketing opportunities. However, several obstacles were found, such as the dominance of local language and the limited ability of some business actors to use Indonesian effectively in promotional activities. Therefore, improving language literacy through business communication training is needed so that MSMEs can develop and compete in a wider market. This study emphasizes that Indonesian language is not only a communication medium but also an important factor in supporting MSME sustainability and competitiveness.

Abstract

Perkembangan kecerdasan buatan (Artificial Intelligence/AI) dan sistem digital menuntut pengembangan perangkat lunak yang tidak hanya berorientasi pada aspek fungsional, tetapi juga mengintegrasikan nilai-nilai etika. Pendekatan Ethics by Design (EbD) hadir sebagai paradigma yang menanamkan prinsip etika sejak tahap awal Software Development Life Cycle (SDLC) guna menghasilkan sistem yang transparan, adil, akuntabel, dan berpusat pada manusia. Penelitian ini bertujuan mengidentifikasi tren penelitian Ethics by Design, menganalisis model dan metode yang digunakan untuk mengintegrasikan nilai etis ke dalam SDLC, serta mengkaji pengaruh kerangka regulasi terhadap penerapan arsitektur perangkat lunak yang berlandaskan etika. Penelitian menggunakan metode Systematic Literature Review (SLR) melalui tahapan perumusan research question, pencarian literatur, seleksi berdasarkan kriteria inklusi dan eksklusi, penilaian kualitas studi, serta sintesis terhadap artikel ilmiah yang relevan. Hasil penelitian menunjukkan bahwa kajian Ethics by Design mengalami peningkatan dengan pergeseran fokus dari pembahasan konseptual menuju implementasi teknis. Kerangka kerja seperti ECCOLA, Value-Based Engineering (VBE), dan Ethics by Design for AI (EbD-AI) terbukti mendukung integrasi prinsip etika pada setiap fase SDLC. Selain itu, regulasi seperti General Data Protection Regulation (GDPR) memperkuat penerapan prinsip akuntabilitas, tanggung jawab, dan transparansi dalam pengembangan perangkat lunak. Penelitian ini menyimpulkan bahwa implementasi Ethics by Design memerlukan sinergi antara metodologi rekayasa perangkat lunak, budaya organisasi, dan dukungan regulasi untuk menghasilkan sistem yang dapat dipercaya serta memberikan manfaat bagi masyarakat.

Abstract

Local fiscal autonomy positions regional taxes and retributions as key instruments for independence, yet this authority is constrained by the principle of a unitary state. The enactment of Law No. 1/2022 (UU HKPD) significantly alters the boundaries of local government authority in managing local revenues. Utilizing a normative legal research method with statutory and conceptual approaches, this study analyzes the legal basis, boundaries, and judicial implications of these limitations. The findings reveal that while local authority originates from Article 18 of the 1945 Constitution, it is strictly limited by a closed-list system, draft regional regulation evaluations, and central government tariff controls. Consequently, these restrictions reduce regional flexibility and create tension between fiscal decentralization and centralized control. This study recommends harmonizing UU HKPD implementing regulations to ensure balanced local authority without hindering local revenue optimization.

Abstract

Freedom of expression is a fundamental human right essential for sustaining democracy. While social media has become the primary space for digital expression, it raises critical concerns regarding the limits of state intervention in maintaining public order without violating human rights. This study aims to analyze the legal standing of freedom of expression on social media from a human rights perspective, its legal boundaries under Indonesian law, and the challenges in its enforcement. Utilizing a normative legal research method with statutory, conceptual, and case approaches, the study reveals that while digital expression is constitutionally protected and guaranteed under Article 19 of the ICCPR, it remains a derogable right open to lawful restriction via the three-part test. However, current provisions in Articles 27A and 28 of the UU ITE produce ambiguities that risk criminalizing legitimate criticism and undermining legal certainty. Consequently, this article recommends refining the UU ITE norms, consistently applying the proportionality test by judges to protect public criticism, and strengthening public legal literacy.

Abstract

Corruption as an extraordinary and organized crime demands the role of a justice collaborator (JC) to dismantle its core networks. This instrument was initially regulated under Supreme Court Circular (SEMA) Number 4 of 2011, strengthened by Law Number 31 of 2014, and now holds operational technical grounds through Government Regulation Number 24 of 2025. Employing a legal doctrinal method with statutory and conceptual approaches, this study aims to analyze the legal standing, forms of protection, and implementation hurdles of JCs in corruption cases. The results indicate that a JC holds a dual status as both a perpetrator and a key witness. The state provides physical and psychological protection, severed case files, and rewards such as sentence reduction. However, its effectiveness remains hindered by an ambiguous "main perpetrator" criterion, disparate views among law enforcement officials, LPSK's resource constraints, and weak identity confidentiality at trial.

Abstract

The Online Single Submission (OSS) system represents a licensing reform following the enactment of the Omnibus Law on Job Creation, which mandates business actors to possess a Business Identification Number (NIB). To enforce this obligation, the state implements administrative sanctions. This legal doctrinal study, employing statutory and conceptual approaches, aims to analyze the legal framework, the forms of sanction enforcement, and their effectiveness under Government Regulation Number 28 of 2025. The results indicate that administrative sanctions within the OSS regime are structured progressively, ranging from written warnings to license revocations. However, their effectiveness remains hindered by weak field oversight, overlapping institutional authority, low digital literacy among business actors, and underutilized government coercion (bestuursdwang). This study concludes that the effectiveness of administrative sanctions relies not merely on regulatory completeness, but on consistent implementation, institutional coordination, and strengthening the legal culture of business actors.

Abstract

Village Regulations (Peraturan Desa or Perdes) serve as an attributive legal instrument for villages, yet their standing has sparked debate since their omission from the formal hierarchy under Article 7 Paragraph (1) of Law Number 12 of 2011 jo. Law Number 13 of 2022. Using a legal doctrinal approach with statutory, conceptual, and historical perspectives, this study analyzes the legal status, hierarchical relations, and legal implications of the current standing of Perdes. The results indicate that Perdes remain valid and binding legislation based on Article 8 of the aforementioned Law, as they are enacted through attributive authority. The position of Perdes is sui generis lying outside the formal hierarchy but remaining bound by the lex superior derogat legi inferiori principle. Consequently, their review relies on executive preview and executive review by Regents/Mayors, leaving a lacuna in comprehensive judicial review mechanisms at the Supreme Court.

Abstract

This study aims to describe the patterns of Indonesian and Madurese language use, identify the factors influencing language choice, and analyze the role of both languages in enhancing the effectiveness of Micro, Small, and Medium Enterprises (MSMEs) and social interaction among the community in Tanah Merah District, Bangkalan. The research employed a qualitative descriptive method with an ethnographic case study design and discourse analysis. Data were collected through direct observation at Tanah Merah Market, in-depth interviews with MSME actors, and documentation in the form of photographs and interview recordings. The findings reveal that Madurese dominates daily communication because it fosters closeness and trust with local customers, while Indonesian functions as a lingua franca when interacting with buyers from outside Madura. Code-switching between the two languages proved to be an adaptive communication strategy primarily motivated by the need for social capital maintenance rather than market expansion alone. The implications of this study confirm that bilingual competence constitutes both an economically and socially valuable communicative asset for MSME actors in multiethnic regions, warranting greater attention in MSME development programs by relevant stakeholders.

Abstract

This study aims to analyze the role of the Business Development Division in supporting business development at PT Len Industri (Persero). The research employed a descriptive qualitative method, with data collected through observation during the internship program, company documentation, and literature review related to business development. Data were analyzed descriptively to provide an overview of the activities carried out by the Business Development Division in supporting the company's objectives. The results indicate that the Business Development Division plays a strategic role in providing business insights and analyses that support corporate decision-making. The activities include brand awareness analysis, the preparation of Astha Cita branding and Pentahelix strategy studies, Business Model Canvas (BMC) analysis, Porter's Five Forces analysis, and business potential assessment in the Maritime Surveillance System sector. These activities help the company understand market conditions, identify business opportunities, strengthen its competitive position, and formulate business development strategies in accordance with industry needs and technological developments. Therefore, the Business Development Division contributes to supporting business development and enhancing the competitiveness of PT Len Industri (Persero) through the provision of strategic information relevant to the company's long-term sustainability.
