Abstract

This study examines the Pension Guarantee scheme as a form of worker protection that, in practice, still faces various challenges. A normative-juridical approach is employed in this research. The implementation of the pension guarantee faces several hurdles, including low worker participation rates—particularly in the informal sector—a lack of understanding regarding social security, administrative and service-related obstacles, and threats to funding sustainability caused by demographic shifts. Consequently, it is deemed necessary to reformulate pension guarantee policies to ensure legal certainty and fairness for workers in Indonesia

Abstract

The Old-Age Security (JHT) program is a form of employment-based social security designed to provide economic protection for workers, particularly when they enter a non-productive phase or upon the termination of their employment. However, in practice, the fulfillment of JHT rights for workers following termination of employment (PHK) continues to give rise to various legal issues, particularly regarding legal certainty in the benefit disbursement process. Research findings indicate that, while the regulatory framework for JHT provides a basis for legal protection for workers after termination, implementation issues persist—specifically concerning eligibility requirements, disbursement timelines, and workers' understanding of their rights. Consequently, there is a need to strengthen regulations, improve public awareness and outreach, and ensure consistent implementation by the social security administrator

Abstract

The National Social Security System (SJSN) reflects the state’s constitutional responsibility to ensure workers’ rights to social protection. BPJS Ketenagakerjaan plays a crucial role in providing employment social security against social and economic risks. However, its implementation faces several challenges, including low employer compliance, weak enforcement of sanctions, limited access for informal workers, and complex claim procedures. This study uses a normative juridical method with statutory and conceptual approaches. The results indicate the need to strengthen regulation and supervision to ensure effective and equitable fulfillment of workers’ rights.

Abstract

This study examines corporate liability for violations of occupational safety and health (OSH) standards in Indonesia from the perspectives of labor law and criminal law. Using a normative juridical research method with statutory, conceptual, and case approaches, The findings indicate that corporate responsibility for OSH violations remains weakly enforced, as legal accountability is predominantly imposed on individuals rather than corporations as legal entities. Sanctions provided under existing regulations are relatively lenient and fail to create a strong deterrent effect. Furthermore, the effectiveness of government supervision and law enforcement is limited due to institutional constraints and gaps between legal norms and practical implementation. This study also highlights the relevance of the corporate criminal liability doctrine, particularly through the corporate culture model, in addressing systemic and structural OSH violations. Therefore, strengthening sanctions, enhancing supervisory mechanisms, and consistently applying corporate criminal liability are essential to improve worker protection and ensure effective enforcement of OSH regulations
