Abstract

This journal examines the legal aspects of unlawful strikes, focusing on the case of Sunarto, a permanent employee and Chairman of the PB-FGSBM Workers' Union at PT Sinar Terang Kencana, who was terminated following a strike deemed unlawful under Indonesian labor law. The study analyzes the compliance of the strike with the provisions of Ministerial Decision No. KEP.232/MEN/2003, particularly Article 3(a), which outlines the procedural requirements for a lawful strike. The research employs a normative juridical method with a case study approach, evaluating the validity of the strike and the legal protection for union leaders. The findings highlight that the strike failed to meet the formal requirements due to inadequate bipartite negotiations, leading to the court's ruling in favor of the termination's legality. This study underscores the importance of procedural clarity in industrial actions and the need for stronger legal protections for workers to ensure fairness in industrial relations

Abstract

The weaknesses of labor unions, both from internal factors such as limited resources and weak leadership, and external factors such as government intervention and company pressure, significantly impact the welfare of their members and their families. This study employs a normative juridical method with a statutory approach, including Law No. 21 of 2000 and Law No. 13 of 2003, as well as agency theory and stakeholder theory. The findings reveal that these weaknesses lead to decreased income, loss of social security, and limited access to welfare programs. Solutions include strengthening the organization's internal capacity, increasing member participation, and fostering collaboration with companies and the government

Abstract

This research discusses the legal protection of pkwt workers regarding compensation rights after unilateral termination of employment using normative juridical methods. This research aims to analyze how compensation payment arrangements are implemented at PT Fuji Prospek Indonesia based on PP No. 35 of 2021. Based on PP no. 35 of 2021, companies are obliged to provide compensation money to employees after the end of the employment relationship, but in fact there is a lack of clarity regarding compensation payments made by PT Fuji Prospek Indonesia, the employee's rights regarding compensation payments are not fulfilled, which is contrary to the provisions of the applicable laws and regulations

Abstract

The COVID-19 pandemic has caused serious disruptions to business activities in various sectors, including PT Tempa Jaya, Pulogadung. The drastic decline in the company's turnover resulted in a policy of adjusting employee wages as a form of efficiency. This study uses an empirical legal method with an interview approach to management, permanent workers, and contract workers, to assess the extent to which the wage policy is in accordance with applicable labor law principles. The results of the study show that wage cuts were carried out without going through a deliberation mechanism or bipartite agreement as stipulated in laws and regulations. This policy has a negative impact on work motivation and the economic welfare of workers, especially contract workers who do not have long-term employment security. This study recommends improving industrial communication, utilizing flexible work policies, and strengthening the government's role in supervising the implementation of worker protection during the crisis. A participatory justice-based approach and a win-win solution are essential in maintaining healthy industrial relations in times of uncertainty

Abstract

Cases of employment termination (layoffs) involving workers who are ill continue to occur, despite being prohibited under Article 153 paragraph (1) letter g of Law Number 13 of 2003 concerning Manpower. One such case took place at PT Sumber Batu Cakrawala (SBC) in Katibung, South Lampung, where the company allegedly dismissed a sick employee without following the proper legal procedures. This study aims to examine the implementation of the relevant legal provisions at PT SBC and analyze the action from the perspective of Islamic law. Using a normative juridical method with a literature study approach, the research found that the dismissal violated positive law and contradicted the principles of justice in Islam. Therefore, stronger supervision of labor law enforcement and the integration of Islamic justice values are needed to create a fair, humane, and ethical employment system

Abstract

This study aims to examine PERMENAKER No. 6 of 2020 concerning the Implementation of Domestic Internships, reviewed from Article 27 paragraph (2) of the 1945 Constitution which guarantees the right of every citizen to obtain decent work and a decent living. This study uses a normative legal method by analyzing laws and regulations, legal theory, and expert opinions. The results of the study found that the regulations governing current internships do not fully provide certainty and legal protection for interns, especially regarding the right to decent wages and social security

Abstract

Unilateral termination of employment (PHK) remains a serious issue in the practice of industrial relations in Indonesia. One case that reflects this issue occurred at Company X, where six workers were dismissed without following lawful procedures. This study aims to analyze the legal protection for workers in cases of unilateral termination of employment based on Law Number 13 of 2003 concerning Manpower and to identify violations of workers' normative rights. The research method used is a normative juridical approach with literature study techniques and secondary data from labor institution documents. The results of the study indicate that Company X violated the provisions of Article 151 and Article 156, such as failing to conduct bipartite negotiations and not providing compensation. The conclusion affirms that although legal protection is normatively regulated, its implementation in practice remains suboptimal, thus requiring strengthened supervision and law enforcement

Abstract

This study aims to analyze the implementation of the freedom of association as a fundamental right within industrial relations in Indonesia. It highlights the application of this right as guaranteed by the 1945 Constitution of the Republic of Indonesia, Law No. 13 of 2003 on Manpower, Law No. 21 of 2000 on Trade Unions/Labor Unions, and the ILO Convention No. 87 of 1948 on Freedom of Association and Protection of the Right to Organize. Using a normative juridical approach, this research examines the effectiveness of legal protection for workers against discriminatory practices such as union busting, which refers to systematic efforts by companies to obstruct the establishment or activities of labor unions. The results show that although the right to organize is legally guaranteed, its implementation remains weak due to inadequate law enforcement and unequal power relations between workers and employers. Therefore, stronger labor supervision, firm legal sanctions, and the empowerment of labor unions are required to realize fair and democratic industrial relations

Abstract

This study examines the adequacy of Indonesia’s labor regulations in protecting workers’ mental health within the national occupational safety and health (OSH) framework. The research aims to analyze whether current laws including the Manpower Act No. 13/2003, the Job Creation Law, and social security schemes such as BPJS Ketenagakerjaan and BPJS Kesehatan provide sufficient legal protection for mental health risks arising in the workplace. Using a normative juridical method supported by qualitative analysis of recent studies and policy documents, this study finds that Indonesia’s regulatory framework remains heavily focused on physical hazards while lacking explicit provisions on psychosocial risks such as stress, burnout, and excessive workload. The results show a significant legal gap between existing norms and the increasing cases of work-related mental disorders reported in recent years. BPJS Ketenagakerjaan has not recognized mental disorders as occupational diseases, and BPJS Kesehatan provides only general psychiatric services without specific coverage for work-related psychological conditions. The study concludes that Indonesia urgently needs a dedicated regulation on psychosocial OSH, setting clear standards for risk assessment, employer obligations, mental-health support services, and government supervision. Strengthening mental-health protection is essential to ensuring worker welfare, safety, and dignity amid evolving workplace demands

Abstract

This study aims to examine the legal obligations of employers in implementing the Job Loss Guarantee Program (JKP) based on the provisions of applicable laws and regulations and analyze the form of legal protection for workers in cases of manipulation of BPJS Ketenagakerjaan participant data in the program. The research method used is a normative juridical method with a statutory approach, through a review of legal regulations governing the implementation of the JKP Program and the protection of workers' rights against manipulation of BPJS Ketenagakerjaan participant data. The results of the study indicate that manipulation of participant data, such as changing the employment relationship status from termination of employment (PHK) to resignation, is a violation of workers' rights that can result in administrative and criminal sanctions. Legal protection for workers who are harmed can be achieved through administrative data correction, industrial relations dispute resolution, and criminal legal proceedings in the event of data falsification
