Abstract

Indonesian workers currently really need social security for their work safety. With social security, it will have a good impact on the survival of their families in the future. If one day a work accident occurs to the worker while they are carrying out their duties, family members can enjoy financial assistance from the government through the BPJS Ketenagakerjaan guarantee program. Basically, this social security will also benefit construction companies in improving the welfare of their employees. The research uses a normative juridical method with a statute approach and a conceptual approach, secondary data is obtained through literature studies in the form of laws, legal journals, and court decisions related to social protection for construction workers. BPJS Ketenagakerjaan has the task and function to organize Employment Social Security through 5 Programs, namely Work Accident Insurance (JKK), Job Loss Insurance (JKP), Old Age Security (JHT), Pension Insurance (JP), and Death Insurance (JKM)

Abstract

The National Health Insurance System (JKN) was established on January 1, 2014, by the Indonesian government as a major step towards the country's goal of providing equitable, fair, and affordable health services for all Indonesians. The JKN's objectives are based on Law No. 40 of 2004 concerning the National Social Security System and Presidential Regulation No. 12 of 2013 concerning Health Insurance. This study examines how the law is applied and propriety in the program for recipients of premium assistance who are not properly targeted, as well as legal protection for PBI issued by the government. This research method uses a normative juridical analysis method, namely by focusing on processing literature materials in case studies as a reflection of the implementation of law in the field of the national health insurance system

Abstract

This study aims to analyze the legal protection for honorary teachers in fulfilling their social security employment rights in Bekasi Regency and to examine the local government’s responsibilities. A normative juridical method with statutory, conceptual, and case study approaches was used. The results show that many honorary teachers are not registered as BPJS Ketenagakerjaan participants due to the absence of local regulations, limited funding, and low legal awareness. Institutions failing to comply may face administrative sanctions, fines, or criminal penalties. The local government should establish regional regulations, allocate contribution subsidies, and strengthen coordination with BPJS Ketenagakerjaan to ensure fair and sustainable social protection. This study emphasizes that social security for honorary teachers is not only a legal obligation but also a moral responsibility of the state

Abstract

This study examines the relevance of social security in strengthening legal certainty for Domestic Workers (PRT) and evaluates the role of the Bekasi Regency Government in implementing such protection. Using a qualitative approach with a case study in Bekasi Regency, data were collected through a review of regulatory documents, semi-structured interviews with domestic workers, employers, and related institutions, as well as field observations on work practices and access to social security. The findings indicate that social security—particularly BPJS Employment programs such as Work Accident Insurance (JKK) and Death Insurance (JKM)—functions not only as a protection mechanism but also as a formal instrument recognizing the status of domestic workers as legitimate workers. Registered domestic workers reported receiving direct benefits. These findings reaffirm that participation in social security strengthens legal recognition, provides certainty in employment relations, and places employers within a clearer legal responsibility framework.

Abstract

This research aims to analyze the legal framework and judicial practice in resolving termination of employment (PHK) disputes in the Industrial Relations Court (PHI) based on the principle of substantive justice. The study employs a normative juridical approach through library research by examining laws, judicial decisions, and academic literature from 2021 to 2025 related to employment termination and industrial relations disputes. The analysis focuses on how procedural justice often dominates the PHI’s decision-making process, while substantive justice intended to protect workers’ rights has not been fully realized. Findings indicate that despite the presence of Law Number 2 of 2004 concerning Industrial Relations Dispute Settlement and the amendments in Law Number 6 of 2023 concerning Job Creation, there remains a gap between legal norms and their implementation. Factors influencing this include regulatory inconsistencies, institutional capacity, and the weak execution of court decisions. The study concludes that the application of substantive justice requires not only legal certainty but also equitable protection for both workers and employers through effective enforcement and clearer regulations to ensure fairness in every PHK dispute resolution

Abstract

This research aims to analyze the legal aspects of unilateral termination of employment disguised as voluntary resignation. The study employs a normative juridical method with statute and case approaches, examining relevant laws, legal literature, and court decisions. The findings reveal that the company's practice of forcing workers to sign resignation letters constitutes constructive dismissal, violating Articles 151, 156, and 162 of Law Number 13 of 2003 concerning Manpower in conjunction with the Job Creation Law. Such actions result in the loss of workers' normative rights, including severance pay, holiday allowance, and social security benefits. Based on legal protection theory and justice theory, these actions are legally invalid as they contradict the principles of fairness and legal certainty. The research concludes that strengthening labor supervision and workers' legal awareness is necessary to ensure effective protection against disguised dismissals in the industrial sector, alongside clear legal mechanisms through Industrial Relations Courts

Abstract

This study examines legal protection for workers in cases of BPJS Ketenagakerjaan contribution arrears by companies and its implications for workers' rights. Corporate non-compliance not only harms workers but also threatens the stability of national social security. The study uses a normative juridical method with a statutory regulatory approach, primary data sources from related laws and regulations, and secondary data from books, journals, and articles. The results show that companies that are in arrears in contributions can be subject to administrative, criminal, and civil sanctions, including fines, restrictions on public services, imprisonment, or compensation. The study emphasizes the role of BPJS Ketenagakerjaan, labor inspectors, and the Attorney General's Office in ensuring company compliance and the need for good faith in resolving arrears. The findings emphasize the need for strict law enforcement for the welfare of workers

Abstract

This study aims to analyze the influence of labor unions’ roles on company productivity within the context of Industrial Relations Court (PHI) decisions. Labor unions hold a strategic position as representatives of workers’ interests in advocating for their rights and welfare through mechanisms regulated under Law Number 21 of 2000 concerning Labor Unions. The research employs a normative juridical method with a descriptive-analytical approach, utilizing literature studies, statutory analysis, and examination of relevant PHI decisions. The findings indicate that the active and constructive role of labor unions can positively influence productivity through effective communication, collective bargaining, and participation in tripartite institutions. However, when unions misuse their functions or when industrial relations become disharmonious, negative impacts such as decreased efficiency, conflict, and strikes may occur

Abstract

This research analyzes the compliance of the manufacturing industry with Ministry of Manpower Regulation No. 5 of 2018 concerning Occupational Safety and Health in the Working Environment (K3L). Using a normative legal method, it was found that industrial compliance is often merely administrative and fails to penetrate the operational level. The main challenges lie in the low ratio of labor inspectors, the lack of technical specialization of supervisors, and legal sanctions that provide no deterrent effect for large corporations. The results conclude that the effectiveness of this regulation requires progressive fine reforms and the strengthening of supervisory functions through digitalization. Abstract

Pasal 27 Ayat 2 of the 1945 Constitution of the Republic of Indonesia states, "Every citizen has the right to obtain employment and a decent living." Occupational safety is a concept and effort to ensure the integrity and perfection of human beings, both physically and spiritually, as well as their work and culture, aimed at the welfare of humanity in general and the workforce in particular.. Furthermore, the company's responsibility for workers experiencing a work-related accident is to provide compensation for transportation costs, examination, medical and/or treatment costs, rehabilitation costs, and monetary compensation. Legal protection for workers in the event of a work-related accident is provided by the Employment Social Security Agency (BPJS Ketenagakerjaan), which provides financial compensation to replace a portion of lost or reduced income and services resulting from a work-related accident
