Abstract

Institutional restructuring in higher education is strategies used to improve governmance quality, management effeicienty, competitiveness, and institutional sustainability. Such restructuring may take the form of mergers, institutional objectives, it may alaso raise legal issues, particulary concerning employment status, financial right, welfare guarantees and legal certainty for academic and non=academic staff. This articlr aims to analyse the legal protection of workers in higher education instutional restructuring in Indonesia and to formulate legal protection model based on legal certainty an justice. This study uses a normative juridical method with statutory anc conceptual approaches. The findings show that labor law and higher education law provide general protection for workers; homewer, the do not specifically regulate employmen transition mechanisms in higher education restructuring, as aresult employe protection often depend on the internal policies of each governing body. Therefore stronger techinal regulations are needed to govern employment tranfer, recognition of service periode, financial right, employee participation and dispute resolution in higher education institutional restructuring.

Abstract

Article 440(1) of Law Number 17 of 2023 on Health introduces a specific provision governing the criminal liability of health workers for medical negligence resulting in serious injury. Nevertheless, Supreme Court Decision Number 1241 K/Pid/2025 demonstrates that courts continued applying Article 360(1) of the Criminal Code despite the prosecutor’s indictment under Article 440. This study analyses the normative relationship between both provisions and its implications for legal certainty in medical negligence cases. The research employs a normative juridical method using statutory, conceptual, and case approaches. The findings show that the district court, high court, and Supreme Court consistently relied on Article 360 of the Criminal Code in convicting a nurse who performed circumcision without a practice licence outside an authorised health facility, causing permanent injury to a child patient. The judgments did not adequately address the applicability of Article 440 as a specific provision concerning medical negligence. The study identifies conflicts, overlaps, and vagueness of norms that contribute to inconsistent judicial interpretation. Therefore, clearer legislative formulation and Supreme Court guidelines are required to ensure legal certainty and consistency in adjudicating medical negligence cases involving health workers.

Abstract

This study aims to analyze the meaning of early adolescents' existence through the use of a second Instagram account and examine its relevance in Social Studies learning, focusing on socio-cultural change. This study employed a qualitative approach with a phenomenological design, conducted at SMP Negeri 2 Taman, Sidoarjo Regency. Informants consisted of 15 students aged 14–15 selected using a purposive sampling technique. Data were collected through in-depth interviews, observation, and documentation, then analyzed using the interactive model of Miles, Huberman, and Saldana. The results indicate that the second account is interpreted as a digital social space for self-expression, maintaining privacy, achieving psychological comfort, and building self-identity. The primary account functions as a front stage, displaying a self-image according to social needs, while the second account functions as a back stage, allowing for more authentic expression. Driving factors for use include the need for privacy, fear of social judgment, and content restrictions. Impacts include increased comfort in expressing oneself and the risk of overthinking and misunderstanding. In conclusion, the use of a second account reflects adolescents' digital identity management and represents a form of socio-cultural change in the digital era that is relevant as a resource for contextual learning in Social Studies.

Abstract

The increasing intensity of international mobility has generated new challenges for immigration control, including the misuse of residence permits by foreign nationals. This study aims to analyze the misuse of residence permits by Chinese nationals within the jurisdiction of the Class I Immigration Office TPI North Jakarta and examine its implications for national resilience. The research employs a descriptive qualitative approach using document analysis of Immigration Administrative Action (Tindakan Administratif Keimigrasian/TAK) data from 2023 to 2025. The analysis was conducted through the categorization of violations, identification of violation patterns, and interpretation of findings using the perspectives of non-traditional security threats and securitization theory. The findings reveal that Chinese nationals constituted the largest group subjected to immigration administrative actions during the study period. The most prevalent violations involved the misuse of residence permits for economic activities and employment that were inconsistent with the purposes for which the permits had been granted. These findings indicate that residence permit misuse is not merely an administrative issue but also reflects vulnerabilities in migration governance that may affect the economic and social dimensions of national resilience. Therefore, strengthening risk-based immigration supervision and enhancing inter-agency coordination are essential strategies for addressing non-traditional threats arising from international mobility.

Abstract

This study aims to analyze the implementation level of Parental Involvement Management (PIM) at SDN 6 Muara Telang , reviewed through the POAC functions (Planning, Organizing, Actuating, Controlling) and Epstein's six types of parental involvement. It also measures the discipline level of fourth- and fifth-grade students in terms of time discipline, compliance with school rules, and learning responsibility, as well as examining the significant relationship between PIM and student discipline. The research employed a quantitative approach with a survey method. The sample was determined using proportional random sampling involving students and their parents. Data were collected through questionnaires and analyzed using SPSS with multiple regression, t-test, F-test, and coefficient of determination (R²). The findings reveal that the variable PIM_X1 (parental involvement in managerial aspects) does not significantly affect student discipline, indicated by a t-test significance value of 0.437 (> 0.05). Conversely, the parental contribution variable (X2) has a significant positive effect, with a t-test significance value of 0.000 (< 0.05), a regression coefficient of 0.553, and a standardized Beta of 0.634. The regression model obtained is Y = 45.808 + 0.078X1 + 0.553X2. The F-test result shows an F-value of 41.711 with a significance of 0.000, while the R² value of 0.476 confirms that both independent variables explain 47.6% of the variation in student discipline. Thus, parental contribution proves to be more dominant than managerial involvement in shaping student discipline at SDN 6 Muara Telang.

Abstract

The study at SDN 11 Air Kumbang aimed to analyze the principal's managerial competency in following up on curriculum development, assess the effectiveness of clinical supervision and ongoing professional development, and identify barriers and supports for transformational leadership. Using descriptive qualitative methods through interviews, observation, and documentation, the informants in this study included the principal, student representatives, teachers, and school operators. The results showed that the principal possessed adequate skills in designing curriculum follow-up through regulatory review and participatory planning with all stakeholders. Managerial functions were effective through routine clinical supervision, providing constructive feedback, and facilitating teacher development through In-House Training (IHT) and the use of the Merdeka Mengajar (PMM) Platform. The principal's transformational leadership was a key factor in building an adaptive vision and culture, despite still facing limited infrastructure and technical challenges in digital data management due to inadequate internet connectivity at the school. Overall, managerial competency and transformational leadership played a crucial role in the successful implementation of the curriculum through optimizing existing resources and strengthening internal collaboration within the school.

Abstract

This research aims to analyze teachers' linguistic strategies in understanding the desires of eighth-grade students at SMP Negeri 8 Denpasar using a Systemic Functional Linguistics (SFL) approach. The primary focus of this study is the interpersonal metafunction of language, specifically within teacher-student interactions during the learning process. The method employed is a descriptive qualitative approach with a case study design, utilizing data collection techniques such as participatory observation, interviews, and documentation. The results indicate that students' desires are often not stated explicitly but are instead expressed through indirect utterances, such as questions, complaints, or emotional expressions. Teachers who possess linguistic sensitivity and implement communication strategies based on interpersonal metafunctions encompassing mood, modality, and residue are able to respond to such utterances empathetically and functionally. The strategies utilized by teachers include affirmation, light humor, emotional validation, and reflective questioning. This study concludes that the application of SFL in classroom communication practices can strengthen interpersonal relationships, create a supportive learning environment, and encourage active student participation. The findings of this research are expected to serve as a guideline for teachers in understanding students' needs and desires within the pedagogical.

Abstract

This study aims to analyze the effect of information and communication technology use and the quality of school facilities and infrastructure on learning quality in public elementary schools in Muara Telang District, Banyuasin Regency. The study employed a quantitative approach with an explanatory research design. The population comprised of teachers in public elementary schools in Muara Telang District, and the sample was selected using a cluster sampling technique based on the geographical distribution of schools. Data were collected through a Likert-scale questionnaire that had been tested for validity and reliability, and then analyzed using multiple linear regression to examine the partial and simultaneous effects among variables. Theoretically, ICT use is expected to broaden access to learning resources, enhance classroom interaction, and improve instructional efficiency. Meanwhile, the quality of school facilities and infrastructure is assumed to create a safe, comfortable, and conducive learning environment for effective instruction. The findings are expected to indicate that both independent variables have a positive and significant effect on learning quality, both individually and jointly. These findings emphasize that improving basic education quality requires strengthening teachers' ICT utilization competence and improving school facilities and infrastructure in a planned and sustainable manner.

Abstract

This study aims to analyze the influence of principal leadership and principal competence on the performance of public elementary school teachers in Muara Telang District, both partially and simultaneously. The research is motivated by the ongoing variation in teacher performance in the aspects of planning, implementation, and evaluation of learning, as well as the suboptimal implementation of academic supervision and teacher coaching by the principal. The study uses a quantitative approach with a survey method. The research population is all 114 public elementary school teachers in Muara Telang District, with a research sample of 89 teachers determined using the Slovin formula. Data collection is carried out through a Likert scale questionnaire that has been tested for validity and reliability. Data analysis techniques use simple linear regression and multiple linear regression with the help of the SPSS program version 26. The results of the study indicate that: (1) principal leadership influences teacher performance. (2) principal competence influences teacher performance. (3) principal leadership and principal competence influence teacher performance. These findings indicate that improving teacher performance requires synergy between effective principal leadership and adequate principal competence in managing schools and implementing continuous academic supervision.

Abstract

Limited Liability Companies as a legal entity that adheres to a three-tier board system consisting of the General Meeting of Shareholders (GMS), the Board of Directors, and the Board of Commissioners require clear legal certainty regarding the division of authority and responsibility of each organ. One of the legal issues that often arise in practice is regarding the status and responsibilities of the Board of Directors who have submitted their resignation in relation to the holding of the Extraordinary General Meeting of Shareholders (EGMS). This study aims to analyze the legal responsibility of the Board of Directors who have resigned from the implementation of the EGMS and to examine the legal certainty for shareholders on the EGMS held by the Board of Directors during the transition period, based on Law Number 40 of 2007 concerning Limited Liability Companies. This study uses a normative legal research method with a statute approach and a case approach. The results of the study show that the resignation of the Board of Directors does not necessarily relieve the person concerned from his legal obligations and responsibilities. During the transition period until the GMS accepts or decides on the resignation, the Board of Directors remains obliged to carry out its duties, including facilitating the implementation of the EGMS; Negligence in this case can give rise to civil liability that cannot be avoided by taking refuge behind the doctrine of the Business Judgment Rule. Legal certainty for majority shareholders is realized through the guarantee of the validity of EGMS resolutions held by the Board of Directors during the transition period as long as all formal and procedural requirements are met, while legal certainty for minority shareholders is realized through protection instruments in the form of the right to sue for annulment of the GMS resolution, appraisal rights, and alternative EGMS implementation mechanisms through the Board of Commissioners or court determinations.
