Abstract

Urban consolidation has become dominant practice in metropolitan planning across Australia’s four largest capital cities – Sydney, Melbourne, Brisbane and Perth – as a result of the escalating need to manage rapid population growth and limit urban expansion. The strategic push for higher-density residential dwellings, such as apartment complexes, around strategic infill locations and activity centres is partly in response to the rising demand for more diversity in Australia’s housing stock. Supplementary factors include demographic shifts, cultural changes, and ongoing concerns regarding housing affordability, liveability, accessibility and climate change. Although this style of development has been at the forefront of state government planning agendas for at least a decade, presently little is understood about the outcomes of inner-city apartment buildings, particularly in Perth, as most of the research on modern infill projects in Australia focuses on Sydney and Melbourne. The primary aim of this research is, therefore, to investigate the outcomes of high- Density inner-city apartment developments for residents, the community and urban planners within Australia’s four largest capital cities, with a particular focus on Perth. The research is informed by a review of academic and government literature concerning infill and apartment developments in the specified cities, as well as a case study of a recently constructed apartment building in one of Perth’s main activity centres, Fremantle. The study found that state and local governments are not always achieving ‘good density’, nor are they developing apartment buildings that engender positive outcomes for both residents and the community. Some of the challenges that must be overcome if this is to change include designing apartments that cater to the needs of a diverse population, getting state governments to provide more support for local councils, and engaging earlier and more effectively with local communities. The research findings provide council planners with a better understanding of the challenges faced by residents in new apartment buildings, as well as the difficulties of meeting community expectations and planning ‘good density’, so that future planning policies and urban development can be more suitably informed.

Abstract

The Indonesian government has not been able to realize sustainable forest management under the 1945 constitutional mandate, causing much forest damage. Indonesia urgently needs good forest governance. Therefore, it is essential to give a more significant role to local communities in managing forests in the future. The primary objective of this research project is to find sustainable forest management practices based on the customary law of the Bayan community. This research uses the literature review and case study method. An additional objective of this research is to study the problems that occur due to the absence of legal protection for local communities with regard to forest use and conflicts. This research demonstrates that the Indonesian government provides extensive support to the private forestry sector (for example through award of permits) and has ignored the rights of people who live around the forest. Forest management through customary law, such as Awiq-awiq in Bayan village, can provide great economic, social, and cultural benefits to local communities. Awiq-awiq regulates prohibitions, sanctions, and the procession of the customary assembly in association with forest management, and has been an effective way to use forests sustainably. The local community is highly compliant with awiq-awiq because they have been directly involved in drafting and reviewing this regulation. The customary law approach used by the Bayan community is an example of sustainable forest management practices that run well; and could be a valuable model for the Indonesian state and other forest conservation managers to consider.

Abstract

Misuse of social media users and lack of knowledge can lead to crime in cyberspace. With the harassment via electronic media carried out by the perpetrator against the victim, the victim feels fear in itself. This research aims to find out how legal protection is for LGBT people from bullying comments via social media. The method used in this research is the normative juridical method with a conceptual approach and a statutory regulatory approach. The results of this research are that bullying comments made via social media towards LGBT people is a serious problem that must be addressed immediately. LGBT people in Indonesia do not have special protection from bullying. However, there are several provisions that can be used to protect LGBT people from bullying comments via social media, namely Article 436 of Law no. 1/2023 and Article 27 letter a of Law no. 1/2024. The lack of reporting and the still closed nature of our society regarding these criminal acts, makes every case of defamation through electronic media difficult to uncover. Therefore, it is necessary to study the legal protection for LGBT regarding bullying comments via social media as a form of criminal act which is the cause of bullying crimes which violate human rights.
