Postmodernism: Indonesian Journal of Multidisciplinary Islamic Studies is an academic scientific journal published by Lembaga Penelitian dan Pengabdian Kepada Masyarakat (LP2M) Sekolah Tinggi Agama Islam Miftahul Ula (STAIM) Kabupaten Nganjuk, Indonesia.. Abstract

This study analyzes the complexities of enforcing Jinayah Law in Aceh under Qanun Aceh Number 6 of 2014, focusing on the effectiveness of its multi-stakeholder ecosystem. Using a descriptive-analytical qualitative approach through library research, this study reveals that despite a clear legal foundation, the implementation faces significant challenges of systemic fragmentation. Wilayatul Hisbah (WH), as the frontline enforcement agency, is constrained by structural issues such as limited human resource capacity and budget. The Syar'iyah Court navigates the dynamic of balancing substantive Islamic law with modern procedural justice. Furthermore, synergy with traditional institutions (Mukim and Gampong) and coordination with national law enforcement agencies like the police remain suboptimal, often leading to dualism in case handling. The findings indicate that the core problem lies not in the legal norms but in the weak synergy and coordination among all stakeholders. Systemic challenges, including inconsistent political and budgetary support, coupled with the absence of a comprehensive monitoring and evaluation mechanism, further undermine enforcement effectiveness. Therefore, this study recommends establishing an integrated synergy model, such as a Syar'iyah Justice Hub, as a permanent coordinating body to develop standard protocols, conduct cross-institutional training, and perform periodic evaluations. Strengthening this integrated law enforcement ecosystem is crucial for achieving the substantive goal of Jinayah Law: realizing community well-being (maslahah) as intended by the maqasid al-shariah (the higher objectives of Islamic law)

Abstract

This study analyzes the effectiveness of the Qanun Jinayah in Aceh as an instrument of social engineering through the lens of Roscoe Pound's Social Engineering Theory. Employing a qualitative library research method, the findings indicate that while the Qanun is designed as a tool to shape a homogeneous religious society, its implementation faces complex challenges. From Pound's perspective, effective law must balance various interests. However, in practice, the Qanun Jinayah tends to prioritize collective interests in the name of religious morality while overlooking individual interests, such as the right to privacy and protection from degrading punishment, and demonstrates a vulnerability to gender bias. The repressive legal approach, manifested through public caning, has proven more successful in creating temporary, instrumental compliance rather than fostering internal and sustainable value change within society, as evidenced by the phenomenon of violations shifting to private spaces. Further challenges, such as inconsistent enforcement across regions and polarized public attitudes, erode the Qanun's social legitimacy. This research concludes that the Qanun Jinayah has not been fully effective as a social engineering tool. Its revolutionary and legalistic approach is potentially counterproductive, risks reducing religious spirituality to formal compliance, and can undermine social solidarity. A more comprehensive strategy is required for successful social engineering, one that moves beyond punitive measures to build legal consciousness through inclusive public education and dialogue, thereby creating a more equitable balance of interests

Abstract

Productive zakat is a strategic instrument in the Islamic economic system for empowering mustahik and enhancing sustainable welfare. BAZNAS of Sintang Regency, West Kalimantan, has implemented productive zakat programs through business capital assistance, training, and mentoring; however, program outcomes vary among beneficiaries. This study aims to analyze the implementation of productive zakat programs and identify factors influencing their effectiveness in improving mustahik welfare. This research employs a descriptive qualitative approach, with data collected through in-depth interviews, field observations, and document analysis. Informants include BAZNAS administrators, mustahik beneficiaries, muzakki, community leaders, and local government representatives. Data were analyzed using an interactive analysis model and supported by descriptive quantitative data comparing mustahik income before and after receiving productive zakat assistance. The findings indicate that productive zakat programs at BAZNAS Sintang Regency have been implemented systematically and contribute to increased income and economic independence among most beneficiaries. Program effectiveness is influenced by amil managerial capacity, the quality of business mentoring, information technology utilization, local government support, and community zakat literacy. This study concludes that productive zakat is an effective economic empowerment instrument when managed professionally, transparently, and sustainably

Abstract

Perkembangan platform live streaming TikTok menghadirkan praktik monetisasi baru melalui fitur gift yang memunculkan persoalan hukum dalam kajian fikih muamalah, khususnya menurut mazhab Syafi‘iyah. Praktik ini melibatkan pertukaran nilai ekonomi berbasis digital yang belum dikenal dalam formulasi akad klasik, sehingga memerlukan analisis hukum yang komprehensif. Penelitian ini bertujuan untuk menganalisis kesesuaian praktik monetisasi gift pada live streaming TikTok dengan prinsip-prinsip syariah serta mengklasifikasikan jenis akad yang mendasarinya menurut fikih mazhab Syafi‘iyah. Metode yang digunakan adalah penelitian kepustakaan dengan pendekatan kualitatif normatif, yang bersumber pada kitab-kitab fikih klasik bermazhab Syafi‘iyah serta literatur ilmiah kontemporer yang relevan. Data dianalisis menggunakan metode deskriptif-analitis dan analisis isi untuk mengidentifikasi unsur akad, meliputi para pihak, objek akad, dan bentuk sighat. Hasil penelitian menunjukkan bahwa gift digital dapat dikategorikan sebagai harta bernilai yang sah secara syar‘i dan secara hukum dapat diklasifikasikan sebagai akad hibah apabila diberikan secara sukarela tanpa syarat, atau sebagai akad ju‘alah apabila pemberiannya dikaitkan dengan imbalan atas aktivitas tertentu. Temuan ini menegaskan relevansi fikih mazhab Syafi‘iyah dalam merespons praktik muamalah digital kontemporer serta memberikan kontribusi konseptual bagi pengembangan kajian hukum Islam di era ekonomi digital

Abstract

The Carok culture that has existed within Madurese society has often been perceived as an expression of violence and moral transgression. However, behind this representation lies a complex system of values, worldviews, and moral structures that reflect the cultural identity of Madurese society. This study aims to explore the meaning and moral values in the Carok culture through etymological and epistemological approaches, as well as to reconstruct the potential of these values as a source of learning in local culture-based moral education. This study uses a literature review method by examining various scientific sources, such as anthropological research results, ethnographic studies, literary works, and moral education theories. The analysis was conducted thematically and interpretively to identify the dimensions of knowledge (episteme) and the origins of meaning (etymon) of the Carok culture. The synthesis results show that Carok is essentially a symbol of honor (self-esteem), responsibility, and the defense of family values born from the Madurese community's ethical system. These values have significant relevance in the development of contextual moral education based on local wisdom. This study confirms that moral education cannot be separated from the cultural roots of society; on the contrary, local cultures such as Carok can be an epistemological source for character building and ethical understanding in modern education

Abstract

This study analyzes the role of judges' conscience in sentencing from the perspective of Indonesian criminal law and Islamic law. Through a qualitative normative approach, this study explores how judges' conscience functions as an ethically reflective mechanism in the modern justice system that is often trapped in procedural simulations. The focus of the study includes three main aspects: (1) the conceptual framework of judges' conscience in Indonesia's positive criminal law, (2) the meaning of conscience in the perspective of Islamic criminal law, and (3) the operational mechanism and accountability of judges' conscience in criminal practice. Research has found that the judge's conscience has the dual function of being a guardian of justice and ethical reflection, but requires translation into rational and tested legal language. The findings of the study show that the integration of the concept of conscience with positive legal frameworks and Islamic principles can strengthen the legitimacy of criminal judgments while ensuring the accountability of judges. The implications of this research are relevant for the development of criminal guidelines that accommodate the ethical dimension without sacrificing legal certainty
