Abstract

As a legal state, every administration of government affairs must be based on applicable law. As a State that embraces decentralization it means that government affairs consist of central government affairs and regional government affairs. This means that there is a set of central government tools and local government instruments, which are given autonomy, namely freedom and independence to regulate and manage regional household affairs. In carrying out the functions of government, it is definitely needed by providers of goods / services that support the optimal performance of the agency. The contract for the procurement of goods / services between PPK and the goods / services provider contains the obligations and rights of the parties in the context of carrying out the procurement of goods / services. In the implementation of contracts, often the goods / services provider does not carry out its obligations perfectly in accordance with what has been stated in the contract. This can result in the unilateral termination of the contract by the PPK, and in this study discussed the procedure for terminating contracts in the procurement of goods / services as well as the legal consequences of unilateral termination of contracts by Commitment Makers (PPK) to providers of goods. This study is a type of Normative Legal Research, using a statutory approach, while the source of legal material is obtained from primary legal materials, namely the applicable legislation and secondary legal material obtained from literature or scientific work that is relevant to the problem appointed. Legal material collection techniques with document studies and legal material analysis are processed systematically and the results are presented in descriptive analysis. From the results of this study it can be concluded that the procedure for unilaterally terminating contracts in the procurement of goods / services contracts is preceded by giving warnings (summons), proving meetings (Show Cause Meeting) and giving Test Cases and legal consequences of unilateral termination of contracts. Contract for the procurement of goods / services is the imposition of administrative sanctions, blacklisted sanctions, civil claims and criminal reporting to the authorities.

Abstract

In everyday life humans are never free from the threat of disaster. This is where the importance of an insurance service as an investment. From the description of the background of the problem, the formulation of the problem in this study is How is the implementation of unit-linked life insurance at PT FWD Life Indonesia Denpasar Branch? What is the legal protection given to unit-link life insurance policy holders at PT FWD Life Indonesia Denpasar Branch? This type of research is a type of normative legal research. The source of legal material consists of primary legal material and secondary legal material. Methods of collecting legal materials using documentation and recording methods. Data analysis techniques use analytical techniques in a legal and descriptive interpretation. Conclusions from this study are unit-link life insurance implementation at PT FWD Life Indonesia Denpasar Branch conducted by fulfilling the requirements of Sales illustration and eSPAJ, Photo of identity card holder or main insured or insured, Complete account auto debit, Credit card auto debit, Signature confirmation form electronics and FNA (Financial Need Analysis) and RPO (Risk Profile Questionnaire) specifically for links in electronic form along with eSPAJ. Legal protection given to unit-link life insurance policy holders at PT FWD Life Indonesia Denpasar Branch is to fulfill the rights and obligations that should be owned by policy holders of PT FWD Life Indonesia Denpasar Branch and business people of PT FWD Life Indonesia Denpasar Branch. Legal protection can also be emphasized by providing compensation, resolving disputes and sanctions against companies that violate giving compensation to policy holders of PT FWD Life Indonesia Denpasar Branch

Abstract

In state administrative disputes has ditermined who can sue and who can be sued. But aside from the plaintiff and the defendan, in a state administrative dispute lawsuit it is possible for everyone with an interest in the dispute to participate or be include in the vetting process. The formulation of the problems are 1) How the mechanism of the inclusion of the third party in the process of dispute resolution in the state administrative court. 2) How the legal consequences of the inclusion of the third party in the case number 23/G/2015/PTUN.DPS. This research is a normative legal research with the problems approach are statute approach and case approach. Everyone who has an interest can be include in a state administrative dispute. The inclusion of the intervention can be due to their self, the wishes of either party or the initiative of the judge. The entry of the intervention gave the intervention the same obligations and rights with the parties. In case number. 23/G/2015/PTUN.Dps the intervention is placed as a defendant II intervention because of the interest that it has the same as the defendant. And that make the third party has the same obligation and the rights as those of the defendant.

Abstract

PKL problems are indeed difficult to solve, this is evidenced by the fact that there are still many street vendors who roam the roadside, say in Badung Regency precisely stricken by Jalan Raya Mengwitani, Mengwi District, Badung, almost along the road there are street vendors selling, even more in the afternoon the number of street vendors increased. The ability of street vendors to organize themselves is what makes researchers interested in conducting research into organizing by street vendors, so that they are able to organize themselves to deal with the pressures experienced. The formulation of the problem in this study are: 1) what is the arrangement of street vendors (PKL) who sell on the edge of the road that has a Circular Mengwitani Badung Regency? 2) What is the action of the Badung District Government in dealing with street vendors (PKL) who sell on the edge of the road that has Circular Mengwitani Badung Regency? The technique of collecting data is done by interviews and documentation. Data were then analyzed using qualitative descriptive analysis. The conclusions of this study are: 1) Arrangement of Street Vendors selling on the edge of the Circular Circular Highway in Badung Regency is regulated in Badung District Regulation Number 7 of 2016 concerning Public Order and Public Peace listed in Article 25 and Article 27. Under the control authority the street vendors are in the Regional Government. But in its implementation the Regent gave a mandate to other agencies namely the Order of Peace and the Badung District Civil Service Police Unit. In this case the Civil Service Police Unit was formed to enforce the Perda, 2) the action of the Badung Regency government in dealing with street vendors in Badung Regency who sell on the roadside by providing sanctions for administrative sanctions and criminal sanctions to violating street vendors. Administrative sanctions can be in the form of reprimand, written warning, revocation of permit, termination and / or demolition. While criminal sanctions in the form of imprisonment for a maximum of 3 (three) months or a maximum fine of Rp. 25,000,000 (twenty five million rupiah).

Abstract

Provisions for granting grants are contained in the Law concerning Regional Government which states that grants and social assistance expenditures are budgeted in the APBD in accordance with regional financial capacity. To overcome confusion over Government funding recipient object in this case the Ministry of Interior issued a Regulation on the Amendment on Guidelines for Grants. Government P rovincial B ali quite cautious in giving grants to Pakraman. The government should be careful in interpreting whether Pakraman including bodies and agencies which are set in the Regulation. The formulation of the problem raised is 1. What are the conditions for awarding grants in Bali Province? 2. What is the procedure for awarding grants in Bali Province? The type of writing is Legal Normative approach to legislation and legal norms in force, t eknik collection started with an inventory by collecting and organizing legal materials into an information system and using description techniques by describing them first and then analyzing and then concluding. Government Authority Bali Province inside gift grant function for ngkatan meni service and welfare of the community, from the results observations of researchers regarding the process of implementing community grant programs in the city of Denpasar are in accordance with the provisions of the law, but there are still grants and social assistance that are not in accordance with the applicable provisions or requirements that have not been met . The mechanism for granting grants to the Bali Provincial Government is based on the Pergub Hibah and Bansos with apply the logic flow that giving grants to community organizations that are not registered in the ministry will support the existence and development of Balinese culture

Abstract

The Enactment of Law (No.) 30 of 2014 on Government Administration raises a new paradigm related to silence or neglect of agencies or officials of State administration where if within the specified time limit does make decisions or actions, then the application is deemed granted law and to obtain an acceptance decision the applicant must submit an application to the Administrative Court. As for the formulation of the problem in this case 1) What is the mechanism of a positive fictitious application in the event that a state administrative body or official does not issue a decision on a request submitted by its citizens? 2) What is the Judge's Consideration in completing the application at the Denpasar State Administrative Court? The method in this study is a type of normative juridical research that is by conducting a legal approach and case approach. The sources of legal material that will be used are sourced from research, the literature in the form of primary and secondary legal materials. The technique of collecting legal materials by means of inventory is then carried out identification and classification of legal materials. Legal materials are analyzed with systematic interpretations by applying inductive logic, which is trying to find legal rules, then do discussions to get answers to the problems under study. Regarding the mechanism for resolving positive fictitious applications set out in Supreme Court Regulation (No.) 8 of 2017. A positive fictitious application is an application for the issuance of a decision and or a new official governmental action, not a cancellation of existing decisions, because the formality of the application is not fulfilled as a fictitious positive application, then at such discretion the Assembly of Judges is of the opinion that the petition of the Petitioner is unacceptable.

Abstract

Perkembangan teknologi saat ini membawa perubahan dalam bidang kehidupan manusia, baik sektor ekonomi, sosial, budaya, politik dan hukum, yang melahirkan aturan baru yaitu Undang-Undang No. 19 Tahun 2016 mengenai Informasi dan Transaksi Elektronik, yang mengatur segala aktivitas elektronik, termasuk juga mengatur mengenai alat bukti electronik. Adapun rumusan masalah dalam skripsi ini yaitu bagaimanakah peranan informasi dan dokument electronik sebagai alat bukti? Dan bagaimanakah pengaturan CCTV sebagai alat bukti dalam persidangan perkara pidana? Metode yang digunakan yaitu metode normatif dengan studi kepustakaan dari bahan bidang hukum primer dan skunder. Adapun simpulan dari rumusan masalah yaitu peran informasi dan atau dokument electronik sebagai alat bukti, haruslah di maknai kususnya frasa informasi serta dokumen electronik yang merupakan alat bukti haruslah di lakukan dalam hal upaya penegakkan hukum atas permintaan dari Kepolisian, Kejaksaan serta institusi penegak hukum lain. Pengaturan CCTV sebagai alat bukti dalam persidangan perkara pidana pada hakekatnya tidak mampu di pisahkan dari UU ITE serta Putusan Mahkamah Konstitusi No. 20/PUU-XIV/2016. CCTV masuk dalam ketentuan Pasal 1 angka 1 dan angka 4 yang merupakan alat bukti sah pada hukum acara yang diterapkan, yang mana bisa dipergunakan sebagai alat bukti dalam proses penyidikan, penuntutan dan persidangan.

Abstract

The level of discipline and understanding of the rules and low courtesy of road users are things that need special attention in their efforts to solve problems in the field of traffic. Various efforts have been carried out by the government to improve traffic conditions in Indonesia but still have not been able to keep up with the rapid development of traffic. Based on the background of the problem above, the problem can be formulated as follows: how are the legal consequences for the perpetrator in a traffic accident whose victims died and how are the legal considerations for the perpetrators in criminal liability for traffic accidents. The type of research used is juridical empirical legal research because in this study, besides based on existing theories, it is also compared with research based on interviews and data in the field. The results of the discussion in this study: The legal consequences for the perpetrators in traffic accidents whose victims died were punished with a minimum prison sentence of 5 years. In accordance with Article 359 of the Criminal Code. Legal considerations for perpetrators in criminal liability against traffic accidents include elements of accident (negligence), never been punished, there is peace between the parties, giving information is not complicated, there are witnesses who lighten, then the threat of punishment can be lighter.

Abstract

The problem of village boundaries is indeed often a debate in several areas in Bali, especially those that occur in Tabanan Regency. In Tabanan, boundary problems occur between Bealalang Village, Kediri District, Tabanan Regency and Pangkung Tibah Village, Kediri District, Tabanan Regency. The chaos of the boundary between Belalang and Pangkung Tibah villages began to erupt in 2009. The conflict began with a claim of 18 hectares of land in subak Belong in the Pangkungtibah area. Claims from the locusts are based on ancestral inheritance. This action had ended in the fencing of disputed land. the formulation of the problem in this study is as follows: How to Resolve State Administrative Disputes Through the efforts of State Administrative Courts on Settlement of Village Boundary Cases (Case Study of Decision Number: 12 / G / 2011 / PTUN.Dps.) and How the Judges consider decisions in the Case of a Suit Against the Settlement of a Village Boundary Case (Case Study of Decision Number: 12 / G / 2011 / PTUN.Dps.). The type of research used is the type of normative legal research. The results of the study in this discussion are as follows: State Administration Dispute Resolution Through the efforts of State Administrative Courts to Settle Village Boundary Cases (Case Study of Decision Number: 12 / G / 2011 / PTUN.Dps.) Has not fulfilled legal certainty and a sense of justice, this can be seen from the refusal by the Supreme Court. Consideration of the Judge in making a decision in the Case of the Claim Against the Settlement of the Village Boundary Case (Case Study of Decision Number 12 / G / 2011 / PTUN.Dps.) located in the Belong area, there is a lake pond located in the belong area and the existence of customary land rights in belonged land. Abstract

Pre prosecution is the authority of the public prosecutor to examine and study investigation and interrogation report before the investigation assigned to the Court. The police act as investigators while the prosecutor's office is a public prosecutor, because the Criminal Code Procedure provides different authority. As a result of differences in authority, investigation and interrogation report made by investigators must be examined first before being delegated to the trial. This research is about: (1) how is the authority of the police and prosecutors in the pre-prosecution stage? (2) What is the procedure for the settlement of criminal investigation and interrogation report in pre-prosecution stage at the Denpasar District Prosecutor's Office? This study uses normative legal research methods with sources of primary, secondary and tertiary legal materials. The results of this study can be concluded (1) the authority of the police in the pre-prosecution stage is to conduct an investigation and make a case file. The authority of the prosecutor's office in the pre-prosecution process only checks and examines case files whether the case files made by the investigator have met the terms and conditions of the Criminal Procedure Code. (2) The procedure for settling this case file is carried out by receiving a notification letter on the start of investigation, the appointment of a public prosecutor, research of case files by prosecutors, prosecution, delegation of suspects and evidence, additional inspection by the prosecutor general, transfer of case files, suspects and evidence to court.
