Abstract

Unregistered marriage (nikah sirri) is a complex legal phenomenon in Indonesia, as it is considered valid under Islamic law but not recognized by state law due to a lack of registration. This research aims to analyze the impact of unregistered marriages on the status of wives, children, and property from the perspectives of Islamic law and Indonesian positive law. The method used is normative juridical research with conceptual, legislative, and fiqh approaches. Primary data sources include Law Number 1 of 1974 on Marriage, the Compilation of Islamic Law, and the Quran and Hadith, while secondary data are derived from relevant academic literature. The findings show that according to Islamic law, an unregistered marriage that fulfills the pillars and requirements is valid, thus wives, children, and property have the same status as registered marriages. However, under Indonesian positive law, unregistered marriages have no legal force because they are not registered at the Office of Religious Affairs or Civil Registry Office, resulting in wives lacking legal protection of their rights, children only having civil relations with their mothers, and joint property cannot be submitted to court without marriage confirmation (itsbat nikah). This research recommends the need for socialization on the importance of marriage registration and stricter law enforcement to protect the rights of women and children.

Abstract

This study aims to evaluate the distance learning model implemented under the Priority Program of the Ministry of Religious Affairs of the Republic of Indonesia at Universitas Islam Negeri (UIN) Siber Syekh Nurjati Cirebon. The research employed a qualitative approach using a case study design. Data were collected through observations, in-depth interviews, and analysis of online learning documents. The findings indicate that the distance learning model at UIN Siber Syekh Nurjati Cirebon integrates multiple approaches, including synchronous, asynchronous, blended learning, and collaborative models supported by a Learning Management System (LMS). This model has proven effective in enhancing accessibility and flexibility in Islamic religious education, as well as encouraging a paradigm shift toward student-centered learning. Nevertheless, the study also identifies several challenges, such as limited access to technology, inadequate internet connectivity, reduced social interaction, and issues related to students’ mental and emotional readiness. The study concludes that while the distance learning model is relatively effective in achieving the objectives of religious education, it requires stronger institutional policies, increased faculty capacity building, and sustained pedagogical innovation.

Abstract

Character education based on Islamic values is an important necessity inresponding to the challenge of moral degradation among elementary school students. Elementary schools, as the foundation of formal education, have a strategic role in instilling moral, spiritual, and social values in an integrated manner. This study aims to analyze the implementation and effectiveness of Islamic values-based character education at SD Negeri No. 107463 Paya Pasir. The study uses a qualitative approach with a case study design. Data collection techniques include observation, in-depth interviews with the principal and teachers, and documentation studies. Data analysis was carried out through the stages of data reduction, data presentation, and conclusion drawing with source triangulation to ensure data validity. The results showed that character education based on Islamic values was implemented in an integrated manner through classroom learning, habit-forming activities, school culture, and extracurricular programs. This implementation is quite effective in shaping students' character, especially in terms of religiosity, honesty, discipline, responsibility, social awareness, leadership, and ethical decision-making skills in everyday life. The success of the program is supported by teachers' exemplary behavior, consistent religious habits, reinforcement of rules and behavior monitoring, and a conducive school climate. However, the study also found challenges in the form of differences in the family backgrounds of students, which affected the consistency of character behavior. These findings confirm that Islamic values-based character education in public elementary schools has strong potential to shape ethical and responsible behavior, provided that there is continuous synergy between schools and families.
