Abstract

Legal remedies are measures provided by law to individuals or legal entities for specific purposes to challenge a court ruling as a means for parties dissatisfied with a court ruling deemed inconsistent with their wishes, failing to meet the standards of justice, as judges are also human beings who may make errors or omissions, thereby rendering an incorrect decision or favouring one party over another. Decisions of the Constitutional Court have a special characteristic, namely they are final and binding and apply in accordance with the principle of erga omnes, meaning they cannot be subject to any further legal action. Until now, if there are decisions of the Constitutional Court ( ) that are deemed to violate regulations, the maximum action taken is to conduct an Ethics Code Review of the Constitutional Court Justices by the Constitutional Court's Ethics Council. However, even if the Constitutional Court Justices are found to have violated the Ethics Code, their decisions remain valid and must be enforced, leading to controversy and public unrest. Therefore, it is time for the Constitutional Court to establish a legal remedy institution called the Objection Institution. In this regard, a solution to establish this Objection Institution can be pursued by adopting or using the rules applied in the examination of Simple Lawsuits in District Courts as a comparison. This study employs a normative legal research method, as the research objective is the law or legal principles, specifically the rules governing Simple Lawsuits, as a basis for comparison regarding the establishment of a Legal Remedies Institution at the Constitutional Court. The analytical method used is qualitative, employing authentic, grammatical, and systematic interpretations.

Abstract

This study aims to assess the readiness of Small and Medium Enterprises (SMEs) to adopt Human Resource (HR) Analytics, focusing on barriers, enablers, and the resulting strategic impact. Using a literature review method, this study examines various academic sources, industry reports, and practical publications to identify common patterns and key findings related to the implementation of HR Analytics in the SME sector. The study results indicate that the main barriers include limited technological resources, low data literacy, and resistance to organizational culture change. Conversely, enabling factors include visionary leadership, the availability of analytics training, and government policy support. The literature findings also indicate that effective implementation of HR Analytics can have strategic impacts in the form of improved data-driven decision-making, optimized employee performance, and strengthened long-term competitiveness. This study provides practical implications for SME owners and policymakers to develop more structured and sustainable HR Analytics readiness strategies.

Children are part of the younger generation, a human resource that represents the potential and future of the nation's aspirations. The recent social reality in society is the issue of behavioural deviations among children, and more than that, there are children who commit unlawful acts, particularly motorbike theft. The issues discussed are: 1) What form of legal protection is available for children who  and 2)  What obstacles do the police face in implementing legal protection for children who commit motorbike theft? Based on the author's observations on the chosen topic, it is concluded that legal protection for children who commit the crime of motorcycle theft in the investigation process emphasises special handling that considers the psychological condition and maturity of the child. The investigation process must ensure that the rights of children are protected, including the right to be heard, assisted by parents or guardians, and protected from violence or torture. Law Number 11 of 2012 concerning the Juvenile Criminal Justice System (SPPA) regulates the procedures for handling children who commit crimes, including in the investigation process.

Abstract

The use of CCTV recordings as electronic evidence in criminal murder cases, the conclusions of which are as follows: First, that the regulation of the use of CCTV (Closed Circuit Television) recordings, which are electronic evidence, as circumstantial evidence in criminal law enforcement, as stipulated in Law Number 8 of 1981 concerning Criminal Procedure Law (KUHAP) Article 188 paragraph (1), where circumstantial evidence is an act, event or circumstance which, due to its consistency, either between one another or with the criminal act itself, indicates that a criminal act has occurred and who the perpetrator is. However, because evidence can only be obtained from witness statements, letters, and statements from the accused, the Indonesian Criminal Justice System adheres to the stelsel negatief wettelijk, whereby only evidence that is valid according to the law can be used for proof. This means that outside of these provisions, CCTV (Closed Circuit Television) cannot be used as valid evidence in such cases. Second, that in terms of legal interpretation, CCTV (Closed Circuit Television) recordings, which are electronic evidence, are circumstantial evidence in Case Number 777/Pid.B/2016/Pn.Jkt.Pst Juncto Appeal Decision Number 393/PID/2016/PT.DKI Juncto Cassation Decision Number 498/K/Pid/ 2018 Juncto PK Decision Number 69 PK/Pid/2018, because the CCTV (Closed Circuit Television) was not taken directly by the investigator, but by an unauthorised person, witness Dermawan Salihin, who went directly to Olivier Restaurant and took the CCTV USB (Closed Circuit Television), which was then seized by the police, the electronic evidence was not obtained lawfully. Furthermore, in criminal cases, because the Indonesian criminal procedural law system adopts the Stelsel negatief wettelijk system, where only evidence that is lawful according to the law can be used for proof, and the collection of evidence must be done lawfully, then because during the trial process, information was obtained from witnesses presented in the criminal case that the CCTV footage was taken by someone who was not authorised to do so, it can be legally interpreted that the CCTV footage cannot be used as evidence or as circumstantial evidence.

Abstract

Waste disclosure represents a crucial aspect of corporate social responsibility, serving to ensure transparency and meet stakeholder expectations. This study aims to analyze the effect of Firm Reputation on the Extent of Waste Disclosure among publicly listed companies in Indonesia. A quantitative approach was employed using Two-Stage Least Squares (2SLS) regression analysis, with secondary data obtained from annual and sustainability reports of companies listed on the Indonesia Stock Exchange. The findings indicate that firms with strong reputations tend to disclose waste-related information more extensively as a strategy to maintain legitimacy in the public eye and to enhance firm value. These results imply that a positive reputation serves as a key driver of environmental transparency.

Abstract

Marriage is a legal event founded on a mutual commitment between a man and a woman to build a lasting and eternal household. However, as time passes and the life of a husband and wife progresses, problems often become part of the dynamics of domestic life. Domestic problems often result in sexual violence against children and women in particular. The role of the family in creating harmony and comfort has a significant impact on ensuring the safety of women, especially children and wives. Domestic violence, which is often experienced by women and children, is not solely the responsibility of the two individuals in the household. The role of the state is crucial in protecting and resolving issues of sexual violence in accordance with applicable law. This article aims to provide public understanding, particularly regarding family law and how to protect women and children to prevent sexual violence. A good understanding of family law is expected to be a preventative measure against sexual violence against women and children.
