Abstract

Restorative justice provides an alternative mechanism for resolving criminal cases by emphasizing recovery of the victim’s losses, accountability of the offender, and restoration of social relations. In the theft of furniture-making tools in Baros District, the resolution process involved the victim, two perpetrators, their families, community representatives, and the police, resulting in a peace agreement and compensation of IDR 8,000,000. A juridical-empirical approach with a sociological perspective was employed through literature review and field research, with primary data obtained from interviews, observation, and documentation and secondary data derived from legislation, books, journals, and previous research. The findings demonstrate that the Baros Sector Police exercised discretion in resolving the case through restorative justice despite the offense being charged under Article 363 of the former Criminal Code and involving circumstances that raised questions concerning the formal and material requirements for restorative settlement. The decision was influenced by several considerations, including the victim’s willingness to forgive, the neighborhood relationship between the parties, the educational future of one perpetrator, the perpetrators’ willingness to accept responsibility, compensation for the victim’s losses, and the preservation of social harmony. The case consequently demonstrates a gap between the normative requirements of restorative justice and its practical application, while also illustrating the role of juridical, sociological, and philosophical considerations in police discretion. Clearer implementation guidelines are required to ensure consistency and legal certainty in restorative justice practices.

Abstract

Early marriage remains a social and legal concern in Jombang Regency, requiring preventive interventions that combine legal awareness and educational approaches. The implementation of School-Age Youth Guidance (Bimbingan Remaja Usia Sekolah/BRUS) in Peterongan District in 2026 was examined through an empirical legal research design using a socio-legal approach. Primary data were collected through in-depth interviews and field observations involving the Head of the Peterongan Religious Affairs Office (KUA), certified Islamic religious counselors and BRUS facilitators, school guidance and counseling teachers, and participating students. Secondary data consisted of relevant regulations, academic literature, program documents, and marriage dispensation records. The findings indicate that BRUS implementation generally follows the procedures stipulated in Directorate General of Islamic Community Guidance Decree No. 1012 of 2022, including registration, pre-test, core sessions on healthy youth and self-management, reflection, and post-test evaluation. However, implementation involves adjustments, particularly the reduction of instructional time to approximately 120 minutes per session and participant numbers reaching around 50 students per group, exceeding the prescribed maximum. Key operational constraints include conflicts with school schedules, limited program funding and quotas, and the insufficient availability of certified facilitators. Mitigation measures include flexible scheduling, prioritization of target schools, and facilitator capacity building through Training of Trainers. The findings highlight the importance of strengthening intersectoral coordination and expanding program capacity to improve the reach and continuity of BRUS as a school-based preventive intervention against early marriage.Early marriage remains a social and legal concern in Jombang Regency, requiring preventive interventions that combine legal awareness and educational approaches. Abstract

The circulation of counterfeit AQUA-branded bottled water gallons in Pinang District, Tangerang City, has caused losses to consumers, both economically and in terms of health. This counterfeiting practice is carried out by refilling used gallon containers with water that does not meet hygiene standards and marketing it as an original product. Such conditions potentially violate consumers' rights to safety, comfort, and security in consuming goods as stipulated in Law Number 8 of 1999 concerning Consumer Protection and Law Number 17 of 2023 concerning Health. This study aims to analyze legal protection for consumers, as well as the legal remedies and responsibilities of business actors regarding the circulation of counterfeit AQUA-branded bottled water gallons. The research employs a normative juridical method using statutory and conceptual approaches, supported by secondary data and primary data obtained through interviews. The results indicate that consumers are entitled to legal protection, compensation, and dispute resolution mechanisms in accordance with applicable laws and regulations. Business actors who distribute counterfeit bottled water gallons may be held liable under civil law. This study concludes that legal protection has been adequately provided; however, its effectiveness requires stronger supervision, consumer education, and stricter law enforcement to prevent the recurrence of counterfeit products in society.

Abstract

in land administration in Indonesia, but it also creates legal challenges concerning the protection of personal data contained in electronic land records. Electronic certificates contain physical and juridical information related to land rights holders, making data security, access control, accuracy, and accountability important legal concerns. This article examines the legal protection of personal data in the implementation of electronic land certificates through normative legal research using statutory and conceptual approaches. The analysis focuses on the legal framework governing electronic land documents, personal data protection, data processing responsibilities, and the relationship between public access to land information and individual privacy. The findings indicate that electronic land certificates provide greater efficiency, facilitate data management, and reduce the risks associated with loss, physical damage, and document falsification. However, electronic management also creates risks involving unauthorized access, data leakage, misuse of information, inaccurate data, and weaknesses in human resource capacity. Law Number 27 of 2022 on Personal Data Protection and Regulation of the Minister of Agrarian Affairs and Spatial Planning/National Land Agency Number 3 of 2023 provide an important legal basis for protecting personal data in electronic land administration. Effective protection requires stronger system security, periodic data validation, access restrictions based on authority, clear accountability mechanisms, improved personnel competence, and public education to ensure secure and legally reliable electronic land administration.
