SAMAWA: Jurnal Hukum Keluarga Islam
SAMAWA: Jurnal Hukum Keluarga Islam adalah jurnal akademik yang ditelaah sejawat (peer-reviewed) dan berfungsi sebagai wadah ilmiah untuk pengembangan kajian Hukum Keluarga Islam. Jurnal ini memuat hasil penelitian teoretis maupun empiris yang bertujuan memberikan kontribusi terhadap wacana klasik sekaligus perkembangan kontemporer di bidang Hukum Keluarga Islam. Fokus utama jurnal ini mencakup kajian Hukum Keluarga Islam dari perspektif normatif, historis, sosiologis, dan hukum perbandingan, baik di Indonesia maupun di negara-negara Muslim lainnya meliputi hal-hal berikut: Perkawinan dalam Islam Mencakup kajian tentang akad nikah beserta rukun dan syaratnya; mahar, wali, dan saksi; hukum, prosedur, serta praktik poligami; pembatalan pernikahan (fasakh nikah); serta studi perbandingan hukum perkawinan dalam berbagai sistem hukum. Perceraian Membahas kajian ilmiah mengenai talak beserta jenis, prosedur, dan akibat hukumnya; khulu’ (perceraian atas permintaan istri); fasakh (pembatalan pernikahan); ruju’ (rujuk setelah perceraian) beserta syarat dan prosedurnya; serta analisis yurisprudensi terhadap kasus-kasus perceraian dari berbagai perspektif. Nafkah, Hak Asuh Anak, dan Perwalian Mencakup kajian tentang kewajiban nafkah suami; nafkah pasca perceraian seperti nafkah iddah, mut’ah, dan nafkah anak; pengaturan hak asuh anak (hadhanah) setelah perceraian; serta perwalian terhadap anak di bawah umur, baik wali nikah maupun wali yatim. Kewarisan, Wasiat, dan Hibah Mengkaji pembagian warisan menurut hukum Islam; wasiat, termasuk ketentuan, batasan, dan pelaksanaannya; hibah (pemberian), meliputi syarat hukum, mekanisme, serta kemungkinan pembatalannya; serta analisis yurisprudensi terhadap kasus kewarisan dalam berbagai konteks. Mediasi dan Penyelesaian Sengketa Keluarga di Pengadilan Agama Berfokus pada proses dan prosedur mediasi, peran mediator dalam penyelesaian sengketa keluarga, serta strategi peningkatan keberhasilan mediasi dalam kerangka peradilan agama. Isu Gender dalam Hukum Keluarga Islam Membahas keadilan gender dalam hukum keluarga, menelaah perspektif kesetaraan antara laki-laki dan perempuan, serta menganalisis bentuk dan dampak bias gender dalam praktik dan implementasi hukum keluarga Islam. Reformasi dan Kodifikasi Hukum Keluarga di Dunia Islam Mengkaji perubahan dan reformasi hukum keluarga, menelaah proses dan model kodifikasi di Indonesia serta negara-negara Muslim lainnya, dan menganalisis peluang serta tantangan dalam pelaksanaan reformasi hukum keluarga yang efektif. Studi Perbandingan Hukum Keluarga Menganalisis persamaan dan perbedaan antar mazhab dalam hukum Islam, mengkaji perspektif perbandingan hukum keluarga lintas negara, serta menelaah hubungan dan interaksi antara hukum Islam, hukum adat, dan hukum positif dalam pengaturan masalah keluarga. Studi Empiris tentang Praktik Hukum Keluarga Islam di Masyarakat Meliputi penelitian lapangan mengenai implementasi hukum keluarga Islam dengan pendekatan sosiologis, antropologis, dan yuridis; serta mengkaji pengaruh adat lokal terhadap praktik dan penafsiran hukum keluarga dalam berbagai komunitas.

This study attempts to examine the prohibition of proposing to a partner who is undergoing ta'aruf from the perspective of the four main schools of thought in Islam: Hanafi, Maliki, Syafi'i, and Hanbali. Ta'aruf is a process of introduction between two individuals that aims to get to know each other better before deciding to proceed to marriage. In this context, the legal issue of proposing to someone who is undergoing the ta'aruf process with another person has become a debate among scholars. Each school of thought has a unique view and different arguments in responding to this problem. This study uses a qualitative method with a descriptive analytical approach. Data were obtained through literature studies from various fiqh books and the views of contemporary scholars. The results of the study show that although there are differences in the details of the explanations and exceptions given by each school of thought, in general the four schools of thought agree that proposing to a partner who is undergoing ta'aruf with another person is a prohibited act. This prohibition is based on the principle of maintaining ethics, respecting the ongoing process, and avoiding conflict in society. Keywords: Prohibition, Ta'aruf, Couple, Madzahibul Arba'ah.

The Iddah period is a period that must be passed by a woman whose husband has died, is divorced by her husband, or whose Iddah period has expired. The provisions of the Iddah period in Islamic law have been determined based on the evidence of the texts, which are based on the conditions of society during the time of the Prophet Muhammad SAW. However, along with the advancement of medical technology, there are several provisions of the Iddah period that need to be reviewed. This study aims to examine the provisions of the Iddah period in Islamic law in the era of advancing medical technology. This study uses a normative legal research method with an interpretation approach. The results of the study indicate that there are several provisions of the Iddah period that need to be reinterpreted in the era of advancing medical technology. For example, the provisions of the Iddah period of 4 months and 10 days for women whose husbands have died need to be adjusted to the development of medical science regarding gestational age. Reinterpretation of the provisions of the Iddah period needs to be carried out so that Islamic law remains relevant and in accordance with the times. This reinterpretation also needs to be carried out while adhering to the principles of Islamic law, namely justice, welfare, and legal certainty. This research aims to examine the standard of marital maintenance (nafkah) in polygamous marriages from the perspective of Islamic law and Marriage Law No. 1 of 1974. The method used is normative legal research with a case study of polygamy rulings at the Jombang Religious Court from 2021 to 2023. The results show that the practices at the Jombang Religious Court have fulfilled the principle of minimum sufficiency according to Islamic law and statutory regulations, although discrepancies exist in interpreting the form and amount of maintenance. These findings are expected to contribute to strengthening regulations and judicial practices to protect wives' rights in polygamous marriages. Keywords: Polygamy, Fiqh, Legislation

Marriage in the iddah period is a complex legal issue in Islamic fiqh and national marriage regulations in Indonesia.This research uses a literature study method with a qualitative normative-descriptive approach that analyzes shar'i arguments, scholarly opinions, and national legal regulations related to iddah.The results show that in Islamic law, marriage in the iddah period is invalid and can have serious consequences such as nasab disputes, uncertainty about the status of children, and violations of sharia principles. On the national legal side, regulations such as the KHI and the Marriage Law have adopted the principles of iddah, but have not provided explicit sanctions for violations. The phenomenon of flash marriages and siri marriages during the iddah period is still common due to weak public understanding, lack of administrative supervision, and economic pressures. The difference between classical fiqh and positive law in determining the beginning of the iddah period also has the potential to cause conflicts of interpretation. These findings emphasize the need for regulative reform and contextual Islamic law education as well as strengthening digital administrative systems in marriage institutions. This study concludes that the successful implementation of the iddah period as a legal and moral institution depends on the harmony between fiqh norms and positive law, as well as the synergy between public education and bureaucratic modernization to maintain the integrity of Islamic family law in Indonesia. This paper aims to provide a comprehensive explanation of the regulations on child adoption in various Muslim countries, focusing on the legality, legal status of children, and legal implications. The research method used is library research. The data obtained in this study are from several journals, articles, and other literature related to the discussion of the law of child adoption in Muslim countries. This study uses a comparative approach by comparing the legal system of child adoption in various Muslim countries, either from the formal legal aspect or from the legal implications. The results of this study show that each Muslim country has its own legal rules in terms of child adoption. Legally, adoption in Muslim countries allows the adoption of children which aims to provide welfare to the child's life, but the terminology used is different, thus giving rise to different perceptions in terms of child adoption arrangements. The diversity of regulations in the context of child adoption in various Muslim countries not only reflects differences in legal interpretations, but also manifests socio-cultural dynamics and the evolution of Islamic legal thought in different regions. Domestic violence (DV) is a multidimensional issue that encompasses legal, social, and cultural aspects. Although regulations such as Law Number 23 of 2004 on the Elimination of Domestic Violence have been enacted, in reality, the implementation and protection for victims remain weak. Many DV cases are resolved informally due to strong social norms and patriarchal cultural values, especially in certain regions of Indonesia. This article examines the effectiveness of family mediation approaches from an Islamic perspective as an alternative resolution for domestic violence. In Islam, mediation or tahkim is viewed as a peaceful solution grounded in the values of justice, compassion, and victim protection. Through a normative juridical approach and qualitative analysis, this article highlights that Islamic mediation can serve as a resolution instrument that not only reconciles but also ensures the safety and rights of victims—provided it is conducted by competent mediators who understand victim protection principles. Therefore, synergy between Islamic law and positive law is essential to achieving justice and preventing recurring violence within families.

Marriage in Islam is part of the Prophet’s sunnah, not only as a form of worship but also as a legal institution, one aspect of which is the practice of ta’lik talak (conditional divorce) declared after the marriage contract. In Indonesia, this practice serves as a legal mechanism to protect wives from potential abuse of power by husbands. This study employs a qualitative method with a library research approach, drawing data from Abu Ishaq Al-Syatibi’s Al-Muwāfaqāt fī Uṣūl al-Sharī‘ah and relevant supporting literature. The results indicate that ta’lik talak is normatively justified under Article 45 paragraph 1 of the Compilation of Islamic Law (KHI) and aligns with the principle of maslahah (public interest) in Islamic legal theory. Ta’lik talak serves a dual function: as a moral reminder for the husband and as legal protection for the wife, preventing arbitrary actions and encouraging household harmony. According to Al-Syatibi, maslahah must protect essential human rights, serve collective good, and avoid subjective interests. Therefore, the practice of ta’lik talak embodies maqāṣid al-sharī‘ah (higher objectives of Islamic law), contributing to the realization of a harmonious and righteous family life. Abstract This research discusses the regulation of child custody (hadhanah) after divorce in Islamic family law in Indonesia and Malaysia. The main focus lies on the juridical comparison and implementative practices in the two countries that have a background of Islamic law as part of their national legal systems. In Indonesia, child custody arrangements are regulated in the Compilation of Family Law, while in Malaysia it is regulated in the Islamic Family Law Act applicable in each state. This research uses a qualitative approach with a comparative law method and document analysis. The results of this study show that both countries recognize the principle of the best interests of the child as the main basis in determining custody, but there are differences in the decision-making mechanism, the role of Islamic courts, and the implementation of decisions in the field. This research recommends harmonizing the principles of child protection in the Islamic legal system with the development of international child rights to ensure optimal protection for children after divorce. This article examines the transformation of the concept of ijbar (parental authority in marriage) in Islamic family law, from its classical fiqh construction to contemporary legal realities, amid growing concern over child marriage and marriages conducted without genuine consent in religious court proceedings. In classical fiqh, ijbar is understood as the guardian’s—particularly the father’s—authority to arrange a child’s marriage in the name of perceived welfare, even without explicit consent. In modern legal contexts, however, this concept raises serious concerns when the consent of female marriage candidates is still interpreted through silence. Employing a normative-juridical approach, this study compares classical fiqh doctrines, positive law, and a maqasid al-shariah perspective. The findings reveal a persistent gap between legal reforms that emphasize consent and judicial practices that continue to rely on passive consent. Such practices risk perpetuating unequal power relations and enabling subtle forms of coercion. This article argues for clearer normative guidance to ensure that marital consent is obtained freely and consciously. By prioritizing human dignity and individual autonomy, this study contributes to strengthening Islamic family law reform in line with principles of justice and maqasid al-shariah. Economic stability, as part of the concept of kafaah, plays a vital role in establishing a harmonious and sustainable marriage from the perspective of Islam and the social reality of the Kaliwates community. This research employs a qualitative approach using a case study method through literature review and in-depth interviews with local residents. The findings reveal that scholars differ in their views regarding economic stability as an element of kafaah; the Hanafi and Hanbali schools consider it important, while the Shafi’i and Maliki schools do not require it strictly. The people of Kaliwates perceive economic stability as important, though it can be built together after marriage, provided there is communication, cooperation, and mutual commitment. They apply practical strategies such as joint business ventures, role-sharing, and mutual respect to maintain household harmony amid financial disparity. The study concludes that economic readiness supports family stability, even though it is not a requirement for the validity of marriage. Scientifically, this study contributes to strengthening the understanding of kafaah in the economic context and offers practical recommendations for prospective couples and the broader community in approaching marriage proportionally according to Islamic teachings.
