Abstract

The implementation of decisions issued by the State Administrative Court (PTUN) constitutes a critical element in ensuring the effectiveness of judicial review over governmental action and maintaining administrative accountability within a rule-of-law framework. This study examines the implementation of PTUN decisions by administrative bodies or state administrative officials through a non-empirical legal research design employing a normative juridical approach. The analysis is conducted using statutory, conceptual, and doctrinal approaches based on legislation, legal doctrines, judicial norms, and scholarly literature concerning administrative justice and execution mechanisms. The findings demonstrate that although PTUN decisions possess final and binding legal force, their implementation remains constrained by fragmented execution arrangements, limited coercive instruments, absence of detailed implementing regulations concerning administrative sanctions and forced payments, and continued dependence on voluntary compliance by administrative officials. These conditions weaken legal certainty, reduce the effectiveness of judicial protection, and hinder the realization of the General Principles of Good Governance (AUPB). The study argues that implementation should be reconstructed as an integrated legal process supported by stronger enforcement mechanisms, institutional coordination, and a compliance-oriented administrative culture to enhance the authority of administrative adjudication and strengthen accountable governance.

Abstract

This study evaluates the implementation of the Serang Panimbang Expressway as a National Strategic Project in Indonesia using William N. Dunn’s policy evaluation framework. The research employed an empirical qualitative approach through a single instrumental case study design. Data were collected through semi structured interviews with key stakeholders involved in project planning, implementation, and supervision, supported by documentary evidence from government reports and policy documents. The analysis focused on six evaluation dimensions consisting of effectiveness, efficiency, adequacy, equity, responsiveness, and appropriateness. The findings indicate that the project has significantly improved regional connectivity and strengthened development opportunities in previously less accessible areas. Implementation performance was influenced by land acquisition challenges, financial constraints, cost escalation, and administrative coordination issues that affected project timelines. Stakeholders generally perceived the project as strategically beneficial for regional economic growth, although concerns remained regarding the distribution of benefits, environmental impacts, and institutional responsiveness to public complaints. The study concludes that the project remains appropriate and justified within the National Strategic Project agenda because its long term public value exceeds the implementation challenges encountered. Strengthening environmental governance, community engagement, and interinstitutional coordination is essential to improve the sustainability and legitimacy of future infrastructure development initiatives.

Abstract

The practice of unregistered polygamous marriages remains a persistent phenomenon in Indonesia despite the existence of legal provisions regulating the requirements and procedures for polygamy. Such marriages are commonly conducted without official registration and judicial authorization, creating legal uncertainty and potentially undermining the rights of women and children. This study aims to analyze the legal and sociological dynamics of unregistered polygamous marriages and examine the urgency of criminalization as a mechanism for protecting women’s rights. The research employs a normative legal method using statutory and conceptual approaches. Legal materials were obtained through library research, including legislation, legal literature, and relevant scholarly studies. The analysis was conducted qualitatively using Progressive Legal Theory and Utilitarian Theory as analytical frameworks. The findings indicate that unregistered polygamous marriages persist due to interpretations that prioritize the fulfillment of classical Islamic legal requirements while disregarding marriage registration obligations under national law. Marriage registration serves as a crucial instrument for ensuring legal certainty and protecting women’s rights. Criminalization is not intended to prohibit polygamy permitted under Islamic law but to prevent injustice, family neglect, and violations of women’s rights while promoting substantive justice and broader social welfare.

Abstract

Indonesia's gradual termination of numerous Bilateral Investment Treaties since 2014 has generated significant debates concerning the future architecture of foreign investment dispute settlement and the adequacy of domestic legal institutions in replacing conventional Investor State Dispute Settlement mechanisms. This study examines the legal implications of treaty termination for investor protection and evaluates the capacity of domestic institutional arbitration to serve as an alternative forum for resolving foreign investment disputes. Employing a non empirical normative legal research design, the study relies on statutory analysis, conceptual analysis, and comparative legal analysis of Indonesian legislation, investment arbitration jurisprudence, policy documents, and scholarly literature. The findings indicate that the termination of Bilateral Investment Treaties has altered the normative foundation of foreign investment protection by reducing direct access to treaty based arbitration while expanding the importance of domestic legal institutions. Although Indonesia possesses a formal arbitration framework capable of supporting dispute resolution, institutional legitimacy, procedural transparency, arbitrator independence, and international recognition remain critical challenges for the transition from international arbitration to domestic forums. The study further demonstrates that future investment governance requires the establishment of a specialized investment arbitration framework integrating sustainability principles, investor obligations, human rights considerations, and climate justice commitments. A reformed domestic arbitration architecture is essential for balancing regulatory sovereignty, legal certainty, and long term investor confidence within Indonesia's evolving investment regime.

Abstract

This study examines development planning within the Flood Free Serang Program in the City of Serang with particular attention to planning processes, stakeholder coordination, and implementation effectiveness. The research employed a qualitative case study approach involving key actors from BBWS C3, the Serang City Government, the Public Works and Spatial Planning Office, the Environmental Agency, and community representatives. Data were collected through semi structured interviews, document analysis, and institutional reports, and were analyzed using an interactive qualitative framework. The findings indicate that development planning was formulated through an integrated perspective that addressed flood causes across river systems, urban infrastructure, environmental management, and community engagement. Collaborative governance emerged as a critical factor supporting policy implementation through coordination among governmental institutions and local stakeholders. The program contributed to reduced flood occurrence in several locations and strengthened institutional capacity for flood management. Challenges persisted in relation to budget constraints, community awareness, land use pressures, and limitations in cross sector collaboration. The study highlights the importance of integrated planning, adaptive governance, and participatory approaches for strengthening urban flood resilience and supporting sustainable development in rapidly growing urban areas.

Abstract

Early childhood represents a critical developmental period during which fundamental psychological processes are established and shaped through interactions with educational and social environments. This study examined student psychology in early childhood education through a qualitative literature review that synthesized evidence from educational psychology, child development, and early childhood education research. Data were obtained from peer reviewed journal articles, scholarly books, and academic publications selected according to their theoretical and empirical relevance. The analysis employed qualitative content analysis involving literature identification, screening, coding, thematic synthesis, and interpretation. The findings indicate that psychological development is influenced by interconnected factors encompassing supportive developmental environments, meaningful learning experiences, and adaptive responses to changing educational contexts. Family and educational environments contribute to cognitive, emotional, and social development, while engaging learning approaches strengthen motivation, autonomy, creativity, and socioemotional competence. The review also highlights the growing importance of psychological adaptation in response to educational disruptions, digital learning environments, technological innovation, and emerging instructional challenges. These findings suggest that effective early childhood education requires an integrated psychological framework that supports holistic development, learning engagement, wellbeing, and educational resilience in contemporary learning environments.

Abstract

This study develops a critical conceptual examination of the changing relationship between digital communication, accountability, and legitimacy in contemporary platform environments. Using a non-empirical qualitative design grounded in critical literature synthesis and abductive conceptual interpretation, the study integrates scholarship from accounting, digital culture, legitimacy theory, sustainability reporting, and platform governance to explain how organizational performance is increasingly interpreted through symbolic visibility rather than exclusively through formal reporting mechanisms. The analysis identifies three interconnected transformations. First, accountability increasingly operates performatively through recurring digital narratives, visual formats, and public interaction. Second, legitimacy becomes progressively shaped by symbolic recognition and communicative circulation, producing forms of social validation that may appear persuasive despite limited evidentiary grounding. Third, the expansion of algorithmically mediated visibility creates new tensions between public attention and accounting materiality, generating conditions of reduced auditability and intensified dependence on symbolic indicators. The study proposes a multilayer analytical framework consisting of actor, claim, formula, validation, and verification dimensions to distinguish communicative legitimacy from accountable performance. The article contributes theoretically by extending accounting inquiry toward platform-mediated accountability and contributes methodologically through a conceptual model for interpreting digital reporting practices beyond conventional disclosure frameworks.

Abstract

Public trust has become an essential factor in determining the effectiveness of digital communication platforms in accommodating community aspirations. This study aims to measure and compare the level of public trust in the Instagram accounts @abouttng, a community-based media platform, and @lapor_laksa, the official Instagram account of the Tangerang City Government, in facilitating public aspirations. The research employed a quantitative approach with a comparative design. Data were collected from 200 respondents, consisting of 100 followers of @abouttng and 100 followers of @lapor_laksa, selected through quota sampling and accidental sampling techniques. Public trust was measured through cognitive, affective, and behavioral dimensions, while hypothesis testing was conducted using the Independent Samples t-test. The findings revealed a significance value of 0.000, which was lower than the established significance level (α = 0.10), indicating that the null hypothesis was rejected and the alternative hypothesis was accepted. The results confirm a significant difference in public trust between the two Instagram accounts. Respondents generally perceived @abouttng as more responsive, transparent, interactive, and effective in managing public complaints and disseminating information than @lapor_laksa. These findings suggest that communicative performance plays a more decisive role in shaping public trust than formal institutional status within digital public communication environments.

Abstract

The rapid expansion of blockchain technology and the emergence of Non-Fungible Tokens (NFTs) have transformed digital ownership models and generated significant challenges for contemporary copyright law. This study examines the legal relationship between NFT ownership and copyright protection, analyzes the legal issues arising from blockchain-based digital asset transactions, and evaluates the regulatory implications for Indonesia. Employing a normative legal research design with conceptual, comparative, and doctrinal approaches, the study analyzes statutory regulations, legal doctrines, and scholarly literature concerning NFTs, blockchain governance, and intellectual property rights. The findings indicate that NFT ownership does not automatically transfer copyright ownership of the underlying digital work, creating substantial legal uncertainty regarding licensing, royalty distribution, authorship recognition, and rights enforcement. Although blockchain technology offers innovative mechanisms for authentication, traceability, and automated royalty management through smart contracts, these technological features remain insufficient to resolve fundamental legal questions concerning copyright ownership and infringement. The study further identifies regulatory gaps within Indonesia’s existing legal framework, particularly the inability of current copyright and digital transaction regulations to adequately address decentralized digital asset ecosystems. The research recommends regulatory reform focused on clarifying ownership rights, strengthening copyright protection mechanisms, and developing adaptive governance frameworks capable of accommodating technological innovation while ensuring legal certainty.

Abstract

The increasing globalization of trade has intensified trademark disputes involving well-known trademarks, particularly those arising from registrations made in bad faith. In contemporary trademark law, protection is no longer confined to similar goods or services, as the unauthorized use of well-known marks on dissimilar goods may create consumer confusion, dilute trademark reputation, and result in unfair competition. This study aims to examine the legal criteria for determining well-known trademark status and to analyze the legal construction of bad faith in trademark registration involving dissimilar goods through the Starbucks trademark dispute in Indonesia. The research employs a normative legal research method using statutory, conceptual, and case approaches. Primary, secondary, and tertiary legal materials were collected through library research and analyzed using qualitative descriptive methods. The findings reveal that the status of a well-known trademark is determined not only by formal registration but also by public recognition, promotional intensity, international reputation, duration of use, and market penetration. The study further demonstrates that trademark registration for dissimilar goods may constitute bad faith when intended to exploit the goodwill of a famous mark. Supreme Court Decision No. 836 K/Pdt.Sus-HKI/2022 confirms that the first-to-file principle cannot be applied rigidly when evidence of bad faith and the protection of a well-known trademark are at stake. The decision reflects a substantive approach that prioritizes fairness, consumer protection, and the prevention of unfair competition. These findings highlight the importance of balancing procedural certainty with substantive justice in strengthening the protection of well-known trademarks within Indonesia’s trademark law framework.
