Focus and Scope Given that the study of human rights involves many scientific elements that are interdisciplinary in nature, Jurnal HAM accepts submissions of scientific articles discussing human rights in Indonesia and beyond from the lens of, but not limited to, legal studies, social sciences, politics, languages, international relations to communication. The scope of human rights writing covers two aspects, namely Civil and Political Rights and Economic, Social and Cultural Rights, with the scope of study areas such as: Case studies on human rights issues; Regulation and protection of human rights; Economic, social and cultural rights; Civil and political rights; National and international human rights policies; Human rights in law enforcement; Business and human rights; Institutions and institutionalization of human rights. The study areas mentioned above are not an exhaustive list of studies on human rights. For this reason, the Jurnal HAM remains open for manuscripts with objects to be analyzed related to human rights.

Abstract

Fenomena deret tunggu eksekusi mati bukan hanya menjadi masa tunggu terpidana mati dalam proses pengajuan upaya hukum permohonan grasi ke Presiden, tetapi juga menjadi bentuk penghukuman tersendiri bagi para terpidana mati. Rumusan masalah membahas tiga hal. Pertama, bagaimana alternatif penanganan deret tunggu terpidana mati dari sudut pandang hak asasi manusia yaitu hak sipil politik (hak hidup) hak ekonomi, sosial dan budaya (hak kesehatan jiwa)?. Kedua, apa upaya yang telah dilakukan Lembaga Pemasyarakatan dalam memenuhi hak dasar terpidana mati?. Ketiga, bagaimana alternatif lainnya dalam penanganan fenomena deret tunggu? Metode yang digunakan adalah metode penelitian yuridis empiris yang merupakan penelitian hukum sosiologis dengan melakukan wawancara dan studi pustaka. Hasil penelitian menunjukkan bahwa alternatif pidana yang dapat menggantikan pidana mati dan tantangan penerapannya yaitu kembali ke tujuan pemidanaan sebagai koreksi sosial dimana hal ini tidak hanya menghukum narapidana. Perlu terdapat perubahan dalam sistem penegakan hukum termasuk institusi terkat. Tantangan alternatif pengganti pidana mati adalah political will dari pemerintah dengan mengedepankan hak asasi manusia terpidana mati. Selain itu, pemenuhan hak kesehatan jiwa terpidana mati harus didukung oleh tenaga profesional tentang kejiwaan.

Abstract

Perdagangan orang merupakan kejahatan transnasional. Tahun 2019, KPPA mencatat 213 kasus dan meningkat menjadi 400 kasus pada tahun 2020. Kondisi ini mewajibkan negara mengambil tindakan tegas untuk melindungi warga negara khususnya perempuan dan anak agar tidak terjebak dalam perdagangan orang. Tujuan penulisan artikel ini adalah untuk menganalisis peran organisasi internasional dan regional dalam mengatasi persoalan perdagangan orang, peran pemerintah dan aparat penegakan hukum dalam penyelesaian tindak pidana perdagangan orang di Indonesia serta upaya perlindungan kepada korban perdagangan orang. Penelitian ini menggunakan metode penelitian yuridis normatif dengan kajian kepustakaan. Bahan hukum primer yang digunakan adalah Undang-Undang Nomor 21 Tahun 2007 Tentang Tindak Pidana Perdagangan Orang (TPPO). Hasil penelitian menunjukkan bahwa IOM dan ASEAN telah melakukan berbagai upaya untuk penanganan perdagangan orang melalui fasilitasi pembuatan regulasi, diplomasi antar negara transit dan negara tujuan, koordinasi antar kementerian dan kepolisian untuk penindakan secara cepat dan tepat. UU TPPO tidak menimbulkan efek jera karena memberikan sanksi rendah. Pemerintah Indonesia harus lebih meningkatkan upaya pencegahan dan perlindungan terhadap korban, serta menetapkan hukuman yang dapat menjerakan pelaku.

Abstract

Pemenuhan hak-hak anak kelompok minoritas tetap menjadi tema signifikan terkait implementasi UU tentang Perlindungan Anak. Kelompok minoritas dengan berlandaskan agama adalah hal yang menarik untuk diketahui terkait sejauh mana pemenuhan hak-ahak anak di kalangan mereka. Kelompok penghayat Kepercayaan Sunda Wiwitan di Cireundeu, Cimahi, Jawa Barat merupakan kelompok minoritas yang masih mengalami hambatan perlindungan hak-hak anak. Sebagai hasil pendekatan kualitatif, artikel ini berupaya menggali upaya perlindungan hak-hak anak di komunitas ini. Hasil penelitian menunjukkan bahwa hak-hak anak penghayat Sunda Wiwitan Cireundeu tidak sepenuhnya terabaikan. Hak untuk mengekspresikan identitas diri, memiliki pendidikan, kesejahteraaan dan pelayanan kesehatan serta hak terbebas dari perundungan telah terpenuhi dengan baik. Meskipun demikian, hak-hak sipil mereka tampak belum terpenuhi. Hal ini menciptakan beberapa masalah yaitu adanya anak yang belum memiliki akte kelahiran, dua model KTP kepercayaan, hasil pengisian akte kelahiran yang tidak dikehendaki serta praktik pengurusan akte yang tidak berlaku. Melalui Dinas Kependudukan dan Catatan Sipil Kota Cimahi, Kementerian Dalam Negeri semestinya memperhatikan standar dalam pengurusan dokumen administrasi sipil warga penghayat Kepercayaan Sunda Wiwitan Cireundeu.

Abstract

Cyberspace is the interdependent network of information technology infrastructures such as the internet, telecommunications networks, and computer systems. Meanwhile, Indonesia's Law Number 11 of 2008 and its amendment through Indonesian Law Number 19 of 2016 governing cyberspace have been viewed to contradict and infringe other areas of law, such as protection of press or freedom of expression. Hence, this study seeks to identify the controversies and problems regarding the law deemed urgent for amendment. Further, this study creates recommendations so the government may amend electronic information policy more fairly and efficiently. This study uses a judicial normative and comparative approach. This research tries to analyze the existing regulations and the implementation and compare Indonesia's cyberspace regulation with other States'. This study finds that Articles 27(3) and 28(2) of the law criminalize defamation and hate speech in an overly broad manner and that Article 40(2)(b) allows the government to exercise problematic censorship. As a result, they have infringed the freedom of the press and general freedom of expression in practice. In response to this, this study compares similar provisions from other States and recommends amendment the articles to become narrower and more clearly defined.

Abstract

All living things philosophically need the land, especially humans. Human need land to maintain their lives. Based on it, the protection of human rights in obtaining land rights is essential as well as in defending their land rights. Defending the land means preserving life. The research problem in this paper is how the legal protection of human rights in obtaining land rights in Indonesia? This paper aims to learn about legal protection for human rights in obtaining land rights in Indonesia. Therefore, to maintain and ensure legal protection of human rights in obtaining land rights in Indonesia, it has been regulated in the 1945 Constitution of the Republic of Indonesia and then regulated explicitly in Law Number 5 of 1960 concerning Regulations about Basic Agrarian Fundamentals. However, it still has weaknesses in the legal protection of human rights in obtaining land rights in Indonesia. So, it can be concluded that the legal protection of human rights in obtaining land rights in Indonesia still has weaknesses. Therefore, the government and the DPR RI are supposed to immediately revise Law Number 5 of 1960 about Basic Regulations on Agrarian Principles.

Abstract

There is so much recognition that the availability of land, technology, seeds and weather only determines food security. However, evidence suggests that farmer availability has an important role in overcoming food security challenges. Indirectly, guaranteeing the availability of farmers is an important indicator to ensure the right to food. This article aims to discuss how farmer availability and regeneration are related to food security. This article also wants to reflect on how the availability of adequate policies on agricultural sustainability has an important meaning in guaranteeing the right to food. By using normative legal research and Reform Oriented Research, this article will answer several problems. First, how is the relation between farmer regeneration and food security? Second, what is the state's responsibility to guarantee the right to food? Third, how is the formula of farmer regeneration policies to maintain food security? This article clarifies that farmer availability has a significant influence on food production. This article also finds that the state has an important role in developing agricultural regulations to guarantee food security. At its peak, this article proposes targeted policy support to enable the availability of regulations on farmer regeneration to address food security challenges.

Abstract

Efforts to eliminate and prevent the practice of P2GP/FGM which are considered human rights violations against women are carried out by banning P2GP/FGM in several countries, one of which is Egypt. Meanwhile, there is no regulation or policy to stop P2GP/FGM in Indonesia. Seeing the decline in the prevalence of FGM practices in Egypt, the authors are interested in analyzing the transplantation of P2GP/FGM prohibition settings through a comparative study of Indonesian and Egyptian laws. This research is normative legal research with a conceptual approach and comparative law. Comparative law studies are conducted to get an overview of solutions to the same problems in other countries. The practice of P2GP/FGM in both Indonesia and Egypt is based on ancient traditions and not for medical or religious purposes. The striking difference between the two countries in eliminating FGM practices is the commitment to regulate FGM in legal instruments in their countries. Therefore, in dealing with problems with the same root cause, Indonesia can refer to the same solution, namely by formulating legal instruments regarding P2GP/FGM as a criminal act by carrying out legal transplants adapted to the ideals of the Indonesian legal state.

Abstract

The research focuses on the role of the constitutional complaint authority of the German Constitutional Court (Bundesverfassungsgericht/ BVerfG). The research question is how do BVerfG's system and role protect citizens' fundamental rights? The research aims to know the system (urgency, regulations) and the role/ performance of BVerfG in carrying out its authority. This research is normative legal research with regulation and case approach. The results show that BVerfG has received 240,251 (98%) cases from 1951 - 2020 (6,000 cases per year), with a successful application rate of approximately 2% of the total decisions. This paper discusses three cases regarding the decision-related global supervision, the prohibition of wearing the hijab in a legal traineeship, and the case of the European Central Bank/ECB's asset purchase program. BVerfG shows that there is the best role in protecting the fundamental rights of citizens from court decisions that violate fundamental rights. The best practices of the BVerfG are recognition and reference in arranging the Constitutional Court in other countries from the Continental European and Anglo-Saxon legal systems. For Indonesia, it becomes a reference in adding the constitutional complaint authority to the Indonesian Constitutional Court in the future.

Abstract

This study aims to explore the collaborative effort by the Civil Society Organization (CSO) and its significance to encourage corporations in terms of compliance and implementation of the United Nations Guiding Principles on Business and Human Rights (UNGP), particularly in palm oil plantations in North Sumatra. Integration of human rights values into conducting business activities is mandated by UNGP. Indeed, each of the principal actors of UNGP has a governance system to govern their powers and influences and a so-called polycentric governance system. Therefore, a collaboration strategy for strengthening synergy to implement UNGP is needed. This research is conducted by qualitative analysis method with an exploratory design study by collecting data through interviews and various secondary references related to UNGP and its commentaries and reports on this relevant study. The result indicates that PKPA's programs enhance the capacity building of the primary stakeholder including people who are potentially affected by the company's activities. This is the strategic partnership to incorporate UNGP into palm oil plantation business activities. This research recommends that the PKPA's programs, especially REBOUND can be able to be developed by creating new participative modelsto strengthen the implementation of UNGP, mainly human rights due diligence mechanism and access to effective remedies affected by corporations.

Abstract

The study aims to analyze "Thursday's struggle for action" in seeking justice for human rights. This research is a type of descriptive research with a qualitative approach. Techniques used to collect data uses observations, interviews, and searches of documents and archives. The subject of this study is a "Thursday Action" and determination of the study subject using Purposive. This study shows the struggle of the victims' families who never get tired, showing their longing related to the clarity provided by the government. Komnas HAM has recommended that there have been human rights violations against various cases of disappearances and acts of violence. There are indications that the perpetrators of human rights violations are not ordinary people. The state's commitment to resolving cases of human rights violations is a key variable in resolving stalled cases in the Attorney General's Office.
