Abstract

A lawsuit is a civil claim regarding rights involving a dispute with another person. A lawsuit whose formulation does not meet the requirements or has formal defects so that the subject matter of the case is not examined results in the lawsuit not being accepted (niet ontvankalijeke verklaad). As in the Medan District Court decision Number 79/Pdt.G/2023/PN Mdn, it was stated that the lawsuit could not be accepted. This case study research aims to find out mistakes that might be made in filing a civil lawsuit and understand why the lawsuit was rejected in case Number 79/Pdt.G/2023/PN Mdn. This research was conducted using a normative juridical problem approach. Using primary, secondary and tertiary legal materials with library data collection techniques which are then analyzed using qualitative techniques. The results of this research show that a lawsuit filed in court must meet the formal requirements as regulated in article 118 HIR or article 142 RBG. In the decision in case Number 79/Pdt.G/2023/PN Mdn with the claim for breach of contract it was declared inadmissible because the plaintiff's claim was vague and unclear (obscuur libel). Vagueness and lack of clarity in the plaintiff's claim, which in the main case concerns breach of contract. and the plaintiff in the main case of breach of contract, whether in the posita or petitum of the plaintiff's lawsuit, does not specify any obligations that the defendant has not carried out to the plaintiff, including the number and date of the invoice for which the defendant has not yet fulfilled and paid the plaintiff, punishing the Plaintiff in the Convention/Defendant in the Reconvention to pay court costs which to date amount to Rp. 1,291,500.00 (one million two hundred ninety-one thousand five hundred rupiah).

Abstract

This research discusses strategies for developing tourist attractions in Jembrana Regency, especially the Nirwana Garden Bali tourist attraction. In the situation of a tourist attraction that is classified as a new category, there are many obstacles that need to be faced at this time. Data on tourist visits from February to December 2022 is used to see changes in the number of tourist arrivals during that period. The research method used in this research is a qualitative method. Data collection was carried out by interviews, observation and documentation. The results of this research explain that 1). The strengths are the availability of facilities and government support, 2). The opportunity is government support through electronic service provision programs, 3). The results of the SWOT analysis are adding tourism promotion media, tour packages, making souvenirs and adding facilities.

Abstract

The large population in a country is not comparable to the number of job opportunities in that country, so many citizens look for work abroad as migrant workers. International legal protection is needed for migrant workers through international organizations/institutions such as the International Labor Organization (ILO). The research method used is a normative legal research method. This research discusses how Indonesian migrant workers are regulated in international law, where protection for migrant workers is contained in the International Convention Concerning the Protection of the Rights of All Migrant Workers and Their Family Members. The Convention was declared in New York on December 18 1990 against crimes against migrant workers such as human trafficking, unpaid wages, recruitment of undocumented or illegal workers, and even the death of migrant workers in the destination country.

Abstract

When deciding to have a pet, of course a person cannot be separated from the risks and responsibilities for their pet. In the criminal law, article 490 of the Criminal Code explains that pet owners must be responsible for all actions caused by their animals. The results of this research show protection for dog bite victims that unlawful acts caused by animals according to criminal law in Article 359 of the Criminal Code can be held accountable to the owner of the pet dog because his mistake (negligence) caused another person to die, punishable by a maximum prison sentence of five year or a maximum imprisonment of one year. A sociological legal perspective views the effectiveness of law in society regarding unexpected negligence caused by pets, that there is still a lack of firm rules for each individual to regulate specific procedures and standards that must be met by dog pet owners. The spread of rabies to victims is due to the lack of public knowledge regarding procedures for dealing with rabies and preventive measures after the bite of a rabid animal.

Abstract

This article aims to find out how the Pelindungan Hukum Mejan “Sebagai Ekspresi Budaya Tradisional Dalam Pengembangan Peraturan Daerah Di Kabupaten Pakpak Bharat”. This problem is focused on the efforts made to maintain cultural heritage in the form of mejan pakpak, lack of public awareness in maintaining cultural heritage in the form of mejan pakpak, legal protection efforts for traditional cultural expressions mejan pakpak. In order to approach this problem, a theoretical reference from Satijipto Raharjo is used, according to which legal protection is providing protection for human rights, which are harmed by other people and this protection is given to the community so that they can enjoy all the rights granted by law. Referring to this theory, Law Number 28 of 2014 and PERDA of Pakpak Bharat district No. 3 of 2016 were used. Data was collected through observation, interviews and documentation and analyzed qualitatively. This study concludes that the importance of legal protection for tablen as an expression of traditional culture in Pakpak Bharat Regency. Mejan has cultural values that are very important for the Pakpak Bharat community. This article also discusses regional government efforts to protect tabletops, such as by issuing regional regulations that regulate the protection of tabletops.

Abstract

Law enforcement against narcotics crimes has been widely carried out by law enforcers and has received many judge's decisions. Thus, it is hoped that law enforcement will be able to act as a deterrent to the spread of illicit trade and the distribution of narcotics. In the narcotics case with case number 1392/Pid.Sus/2023/PN Mdn, this case is related to methamphetamine drugs which are often called methamphetamine by ordinary people. The charges from Article 114 paragraph (1) of Law No. 35 of 2009 concerning Narcotics has been fulfilled, namely that the criminal act was committed without right or against the law of possessing, storing, controlling or providing Class 1 (one) narcotics in non-plant form in the form of 2 (two) packs of methamphetamine-type narcotics wrapped in plastic Clip translucent clear weighing 2 (two) grams net. The judge's decision is the culmination of a case that is being examined and tried by the judge. Therefore, of course the judge making a decision must pay attention to all aspects therein, starting from the need for caution, avoiding as little as possible inaccuracy, both formal and material, to having technical skills in making it.

Abstract

The important role of education as a necessity in obtaining the knowledge and education required by every student from the initial education level to the higher education level, each field of science provides different knowledge, including citizenship education which includes political education, law, democracy, social culture, the Constitution, and Pancasila where in the application of this knowledge, character education for citizens in accordance with national culture is taught as the goal of citizenship education, the field of citizenship education has a special role in character education apart from other education which also includes character education such as religious education and guidance and counseling education. Character education in citizenship science includes the values ​​contained in Pancasila as the main guideline for character education in students with understanding and implementation of Pancasila values ​​in everyday life being the main basis for the character of citizens. Apart from that, it teaches character education regarding community culture. By using the literature study research method, which can provide a discussion of citizenship education which is the basis of national character, we can understand the scope of citizenship education as education based on science as character education which shapes the character of citizens according to national culture.

Abstract

Education has a very strategic role in improving the quality of human resources in an effort to realize the ideals of the Indonesian nation to realize shared prosperity and create a smarter life in national life. The success or failure of achieving educational goals really depends on how student learning is experienced at the educational level at school. This research uses a quantitative approach which can be interpreted as research based on positivistic philosophy which is used for research on certain populations and samples. The type of research used is quasi-experimental or quasi-experimental, which is a design that has a control group, so it cannot function fully to control external variables that influence the implementation of the experiment. Research on Civics Teachers for class IX students at SMP Negeri 27 Medan, using Project Based Learning can improve students' social skills, because students are given the time and opportunity to investigate, search, find and solve their own problems with the material they are studying, so that students can understand the basic concepts and increase learning experiences. Based on the objectives above, it can be concluded by the author that the aim of the citizenship project is to help students understand the rights and obligations of citizenship and be responsible for citizenship, develop citizenship skills, increase student activity and creativity. Because basically this learning model focuses on students in developing problem solving in order to improve the competencies possessed by students

Abstract

Welding is an inseparable part of industrial growth because it plays a major role in engineering and repair of metal production. So it is almost impossible to grow a factory without involving welding. The most widely used welding methods are liquid welding with an arc (Electric Arc Welding) and gas. Not all metals have good weldability, including medium alloy steel. The problem limit in this research is St 60 steel plate, welding using DC electric welding with RB E70024 electrodes with a diameter of 2.6 mm, with a current variation of 70 Amperes, using a single V type with angles of 50,150,300,450,600, the test carried out is the angle welding position camp V and tensile test. This research was conducted to determine the comparison and influence of electric current strength in St 60 steel material on the welding position of V seam corners and tensile test results of 638.43 Mpa, while variations in current strength experienced a decrease of 44.91 Mpa, 1167 respectively. 67 Mpa and 178.7 Mpa for the rew material group.

Abstract

Where research on motorbikes is to determine the heat that occurs in engine components and determine the materials contained (used) in these engine components, when the engine operates with varying transmissions (loads). Some of the engine components that will be tested include: Crankcase, Muffler, Engine oil. The test was carried out on a Honda Revo F1 Fit type motorbike, using tools: Tachometer, Infrared thermometer, Stopwatch. However, the things that are used as a benchmark and in order to get efficient data, the testers set: engine speed 3000rpm, time 5 minutes, and initial temperature of engine components 29⁰c. Materials really determine the quality of the engine components, because the materials contained in engine components play an active role in maintaining engine temperature stability, with different environmental temperatures and variable rotation, and varying transmission (load). If the quality of the materials in the engine components is reduced, and the temperature is not controlled when the engine is operating, it will result in overheating (over healing).
