Abstract

Existing studies on Indonesia’s blasphemy law have primarily focused on its constitutional foundations and judicial interpretation, particularly through analyses of decisions by the Constitutional Court. This study examines the intricate dynamics of blasphemy laws in Indonesia, with a particular focus on their implications in the digital era. Building on this body of work, including Melisa Crouch’s influential study on law and religion in Indonesia, this article shifts attention to the practical criminalization of blasphemy in the context of social media. While these laws aim to protect religion and religious values, they often result in the criminalization of certain expressions, particularly in virtual spaces. This research scrutinizes the intersection between blasphemy laws and the Electronic Information and Transactions Law, highlighting the tensions between freedom of expression, the right to practice religion and belief, and the role of technology in modern legal frameworks. The primary analysis adopts a critical criminological perspective, suggesting that those in power can legislate and criminalize anyone. This study examines the impact of public perceptions on legal processes in blasphemy cases. Data collection techniques include searching and sorting related news articles and legal text documents. Thematic analysis is employed to uncover patterns and dynamics of power embedded in the narratives. The findings indicate how these legal tools exacerbate societal divisions and contribute to the escalation of inter-religious tensions, especially in the context of online content, reflecting broader sociopolitical dynamics and moral judgments. The research results underscore the need for a more nuanced understanding of blasphemy law and a critical re-evaluation of its application, taking into account both legal and philosophical perspectives. The media plays an important role in shaping narratives and influencing judicial outcomes, emphasizing the intersection of law, media, and society in the context of blasphemy allegations

Abstract

Pada penghayat kepercayaan terhadap Tuhan Yang Maha Esa di Indonesia, diskriminasi seringkali menimpa. Meski berbagai program pemerintah telah dilakukan untuk melindungi penghayat kepercayaan, namun celah diskriminasi masih terjadi. Hingga sekarang masih ditemukan pola intoleransi terhadap kelompok agama minoritas melalui mobilisasi kelompok intoleran. Adapun tujuan penelitian ini yaitu untuk mendeskripsikan secara rinci Diskriminasi terhadap Penghayat Kepercayaan di Indonesia sebagai Cerminan Ketidaksinkronan Nilai Pancasila dan Hak Asasi Manusia serta Dampaknya terhadap Kesehatan Mental. Pendekatan yang digunakan pada penelitian ini yaitu pendekatan kualitatif, sedangkan jenis penelitian yang digunakan yaitu studi kepustakaan. Adapun sumber data yang digunakan dalam penelitian ini yaitu sumber data sekunder seperti buku catatan, artikel jurnal, serta data dari internet seperti situs website resmi. Hasil penelitian ini yaitu diskriminasi yang dilakukan seperti pembakaran sarana ibadah penghayat kepercayaan Kejawen Urip Sejati dan pengucilan terhadap penghayat kepercayaan Kaharingan di Kalimantan merupakan sesuatu yang tidak dibenarkan oleh Pancasila dan prinsip hak asasi manusia, hal tersbut juga dapat menganggu kesehatan mental para penghayat yang mnenjadi korban. Kesimpulan penelitian ini yaitu adanya diskriminasi yang terjadi  mengingatkan kita kembali kepada Pancasila untuk diamalkan lebih kuat agar hal serupa tidak terjadi lagi sehingga hak asasi manusia bisa ditegakkan untuk kesehatan mental bangsa  Indonesia.

Abstract

This study explores the intersections of divine femininity and Islamic mysticism in Johann Wolfgang von Goethe’s Faust and West-östlicher Divan [West–Eastern Divan], positioning these canonical works as fertile ground for intercultural literary inquiry and postcolonial English Language Teaching (ELT). Employing hermeneutic, intertextual, and comparative literary methods, this research uncovers Goethe’s engagement with Sufi metaphysics, the Qur’an, and Persian poetic traditions—particularly his intertextual dialogue with Hafiz and the implicit spiritual kinship with Islamic thinkers such as Rabiah al-Adawiyah and Muhammad Iqbal. Central to this inquiry is Goethe’s concept of the Ewig-Weibliche [Eternal Feminine], which, when read through Islamic mystical lenses, reveals a syncretic spiritual vision that transcends Orientalist binaries and patriarchal norms. The paper argues that integrating these texts into ELT pedagogy encourages both aesthetic appreciation and critical intercultural understanding—especially within postcolonial, Muslim-majority contexts like Indonesia. By reinterpreting canonical Western literature through Islamic and gender-inclusive frameworks, this study contributes to both Goethean scholarship and transformative, decolonial approaches to literary pedagogy.

Abstract

Traditional approach on security has emphasized on the issues of border and sovereignty of states. This paper examines the complex interplay between governance, human security and geopolitical transformations in the context of forced migration, focusing on the experience of Afghan refugees in Indonesia after 2021. The research argues that Indonesia’s “informal” governance approach, in the absence of a domestic legal framework, has placed refugees in a prolonged state of “limbo”. This situation has directly impacted on various dimensions of their human security, including economic, social and psychological security. Using content analysis and case study methods, this article shows that the Taliban’s takeover of Afghanistan in 2021, as a geopolitical trigger, has exacerbated existing challenges and fueled multiple insecurities for refugees. The findings emphasize that relying solely on international cooperation is not enough and that countries need to establish a domestic legal framework to provide effective governance based on human dignity. Finally, this article emphasizes the importance of adopting a comprehensive human security approach to managing refugee crises and offers suggestions for policymakers in Indonesia and other host countries.

Abstract

Perkembangan teknologi telah menggeser praktik dakwah dari ruang fisik menuju ruang digita dengan dinamika identitas yang lebih kompleks. Penelitian ini menyoroti fenomena politik nicknaming melalui studi kasus Dennis Lim, pendakwah Tionghoa Muslim yang dikenal dengan sapaan “Koh Dennis”. Dengan pendekatan kualitatif melalui netnografi dan wawancara mendalam, penelitian ini menganalisis bagaimana nickname digunakan sebagai strategi pembentukan identitas, serta bagaimana audiens memaknai simbolik penyemataan sapaan tersebut. Kerangka Communication Theory of Identity (Michael Hect) dipakai untuk memahami keterkaitan lapisan personal, relasional, dan komunal dalam konstruksi identitas dakwah digital. Hasil penelitian menunjukkan bahwa penggunaan sapaan “Koh” tidak sekadar label personal, tetapi berfungsi sebagai strategi branding yang memperkuat kedekatan, mengartikulasikan identitas secara otentik, serta menciptakan representasi komunal yang menantang dominasi etnis dalam ruang dakwah Islam. Secara praksis, nicknaming memungkinkan dakwah menjadi lebih inklusif, cair, dan mudah diakses, meski penerimaan publik tetap dipengaruh oleh norma kultural serta legitimasi keagamaan yang berlaku.
