Abstract

Discretion is an authority owned by government officials in terms of performing an act that is deemed desperately needed by the community. The Government Administration Act Article 1 number 9 explains that discretion is a decision and action taken by government officials to overcome concrete problems which in the case of legislation provide a choice not to regulate, unclear, incomplete, and the existence of government stagnation. In terms of determining the position of the village head who had stopped and was dismissed the Law on Villages in 2014, stated that the replacement of the village head official was an interim official who was a civil servant in the regional government. This is deemed unclear in the regulations, besides being unclear or ambiguous, this rule has several judgments that will hamper the election of the acting village head. That way, the regional head who is obliged to still be able to carry out the duties of the public service and the application of the welfare state, thus can use the authority of discretion in terms of determining the village head official. The purpose of this discretion is done as a breakthrough and problem solver in society in general. The method of this research is juridical-normative. The approach used is the approach of legislation and conceptual approach. This is confirmed by the existence of the 1945 Constitution of the Republic of Indonesia opening of the fourth century, which states that every society needs to get welfare and elements of discretion which explains that discretion is aimed at public services, the public interest, and the needs of society. Abstract

Pancasila dalam Pusaran Globalisasi (Pancasila under Globalization) is a book that aims to see Pancasila, Indonesia's state ideology, from a global perspective. This book suggests readers consider the role of Pancasila over the world's powers of other ideologies by presenting rare insights to discuss and bridge the understanding of continuities and changes that has existed in society. Changes include, but not limited, to social, political, economic change, and linkages with various variations of society. Those changes are massively happening in the era of globalization plus with the challenges of the government to filter it. This book is a compilation of writings from various excellent academics in their fields. Moh. Mahfud MD, foremost Indonesia's professor of law and politics, delivered the book's prologue, who critically questioned 'Is Pancasila still relevant?' in the era for which Pancasila is rarely seen to implement in public life. Given the fact that hitherto Indonesia has faced problems that have come out of the nature of Pancasila. Mahfud, in his prologue, asked the reader to reflect on the true meaning of Pancasila. In short, understanding the role of Pancasila in this globalized world, particularly as the nation's ideology, has become essential so that every Indonesian citizen will have a much more similar understanding, perception, and attitude towards Pancasila.

Abstract

Law No. 26 of 2007 concerning Spatial Planning gives authority to the Government of Malang City to arrange settlement arrangements in the river border area. Based on the Regional Regulation of Malang City Number 4 of 2011 concerning Malang City Spatial Planning, the tourism sector plays an important role for the economic growth of urban communities. In the case of structuring the Brantas River bank area in Malang City if it is managed for tourism business, is it appropriate if it is reviewed with the aim of Malang City Regional Regulation Number 11 of 2010 concerning the Implementation of Tourism. However, it should be noted if the availability of residential land in Malang is narrower due to economic factors, less assertive sanctions, limited land, urbanization, and generation of land, landowners who control settlements in river border areas, community contributions those lacking in settlement arrangement in river border areas, as well as weak supervision and law enforcement on the establishment of settlements in the river border area. Abstract

This study aims to obtain similarities and differences regarding legal formulation in online prostitution. Hitherto, prostitution has remained to exist in Indonesian society. In context, the existing perpetrators of prostitution do not peddle conventionally but also virtually, in which online prostitution that gradually increases is a common term that refers to this phenomenon. The current law enforcement against perpetrators of online prostitution performs as the consequence of the national law in which national laws have yet remained to accommodate in criminalizing perpetrators of online prostitution. The criminalization of perpetrators in online prostitution may contrast with the principle of legality so that national laws should accommodate perpetrators of online prostitution regarding their criminal liability. In particular, these national laws should address whether to prohibit the attitude that proliferates online prostitution so that perpetrators of online prostitution should be accountable for their crimes. Henceforth, this measure intends to avoid the overlap of the principle of legality in criminal law. Keywords: Online Prostitution, Criminal Liabilities, Principle of Legality.

Abstract

Currently, the Corruption Eradication Commission (KPK) is regulated by law, which is considered to have an inferior institutional status and affect the performance of corruption eradication in Indonesia. This institutional inferiority can be judged on the basis of authority and institutions. This paper specifically discusses the institutional status of the Corruption Eradication Commission which is considered inferior and builds discourse through efforts to include the Corruption Eradication Commission as a state institution regulated in the 1945 Constitution. The analysis of this institution as a non-state institution that is not directly outlined in the 1945 Constitution influences its power in efforts to eradicate corruption. Abstract

Obscene crime is the immoral act that has attack the physical and psychic of the victims continuously, especially if the victims are minors, so it is required to be appropriate law enforcement. Obscene against children is a case that has difficult proofs, so it is can not be judged only by manifestations without based on the beliefs of judges and related theories. This article contains 2 (two) issues, namely: (1) Is the singular indictment formulated by the public prosecutor in verdict number: 52/Pid.B/2014/PN.Lok under the defendant's conduct? (2) Is the judge's consideration who was declared that the defendant is not guilty doing the obscene crime in verdict number: 52/Pid.B/2014/PN.Lwk under the facts revealed in the court.This paper uses a normative juridical research, by statute approach (statute approach) and conceptual approach (conceptual approach). Obtained conclusions that (1) the singular indictment formulated by the public prosecutor in verdict number: 52/Pid.B/2014/PN.Lwk is under the defendant's conduct (2) the judge consideration who was declared that the defendant is not guilty doing the obscene crime in verdict number: 52/Pid.B/2014/PN.Lwk is not following the facts revealed in the court. Abstract

Makalah ini bertujuan untuk mengkaji kewenangan peyelesaian perselisihan hasil pemilu di tingkat lokal yang diberikan kepada Mahkamah Konstitusi. Analisis ini membahas masalah yang cukup besar dan implikasi lebih lanjut terhadap manajemen pengadilan dan desain kelembagaan untuk mendorong lintasan demokratisasi di negara ini dalam rezim pasca-otoritarianisme. Dengan menggarisbawahi bahwa Mahkamah Konstitusi diberikan kewenangan yang besar, dan banyaknya kasus yang ditangani MK menjadikan lembaga ini kelebihan beban dalam usaha menjaga konstitusi, analisis ini mengkritik sejauh lembaga ini dapat menangani kekuasaan dan mengadili kasus-kasus yang diajukan ke pengadilan dengan perselisihan pemilu yang efisien berikut ini terhadap jumlah terbatas hakim konstitusi dan skandal korupsi di antara mereka. Pada akhirnya, makalah ini menyoroti penerapan pembentukan pengadilan adhoc dalam menangani sengketa pemilu yang diajukan ke lembaga ini yang dapat memastikan manajemen pengadilan yang efektif dan efisien untuk mempromosikan rezim konstitusional Indonesia. Kata kunci: Mahkamah Konstitusi, Pemilihan Umum Kepala Daerah, Desain Kelembagaan.

Abstract

This research is a normative juridical legal research using a statutory approach and a conceptual approach. The collection of material through the literature study method, with primary and secondary legal materials. Furthermore, the legal material is studied and analyzed by the approaches used in this study to answer legal issues in this study. The results of this study indicate: the reduction of the period of detention is one of the conditions that must be met in a decision when the accused is detained. Failure to fulfill these conditions makes the verdict null and void. The problem that occurs is that in conditional criminal decisions, there is often no mention of a reduction in prison terms. Likewise, decisions are null and void which are not strictly regulated in the existing laws and regulations. Detention is the discretion of law enforcement officers that should not be applied to every suspect or defendant. So that the perpetrators of minor crimes or the losses incurred are small, detention is not always necessary. Even if the detention has been carried out, the judge can issue a verdict according to the period of detention. This is to ensure that the apparatus not only enforces the law but also upholds justice. KEYWORDS: Convict, Detention, Conditional Criminal.

Abstract

Maritime boundaries play an essential role in determining the state's sovereignty, rights to exploit natural resources, maintain security, and territorial integrity. However, maritime boundaries often overlap between states, which can amount to conflicts. Maritime areas whose boundaries have not been agreed between neighboring states are referred to as “undelimited maritime boundaries” (UMB). Indeed, Article 74 of the United Nations Convention on the Law of the Sea 1982 has set out rules regarding UMB. However, conflicts still arise between states; for instance, the conflict related to law enforcement between Indonesia and Viet Nam in the South China Sea. This study aims to analyze law enforcement issues and the rights and obligations of states in UMB under international law. This study uses normative legal research which applies the method of legislative, conceptual, and analytical approaches. This study finds that states involved in UMB are prohibited from carrying out excessive law enforcement since it could trigger more conflicts and will hamper the ongoing final maritime delimitation negotiation process. In order to ensure zero conflicts during the negotiation process, this paper recommends that Indonesia should make every effort to enter into a comprehensive provisional arrangement about UMB with its neighboring states. Abstract

Pengurangan masa tahanan menjadi hal yang wajib dicantumkan dalam suatu putusan pemidanaan, baik itu putusan pemidanaan biasa maupun pemidanaan bersyarat. Menurut ketentuan dalam pasal 1 angka 12 KUHAP bahwa upaya hukum adalah hak terdakwa atau penuntut umum untuk tidak menerima putusan pengadilan yang berupa perlawanan atau banding atau kasasi atau hak terpidana untuk mengajukan permohonan peninjauan kembali dalam hal serta menurut cara yang diatur dalam undang – undang ini. Perlawanan juga sering disebut verzet. Perlawanan merupakan upaya hukum berdasarkan undang – undang dalam hal – hal yang telah ditentukan yang umumnya bersifat insidentil yang tidak dimaksudkan terhadap putusan akhir dari pengadilan negeri.
