Abstract

In providing legal assurance and protection for both health service providers or doctors and the receivers of health services or patients, a set of laws is required to be the sign for them. How is the legal resolution when there is a alleged malpractice performed by a doctor ? The Indonesian Medical Disciplinary Board is the authorized institution to determine the presence of error (alleged malpractice) performed by a doctor in applying the medical science and decide the sanction. In terms of the negligence performed by medical practitioners in their profession, it must be settled first through mediation. In this case, the health law and the doctrine of health services is as the norm of Lex spesialis.

Abstract

Arbitrase adalah penyeleaian sengketa diluar pengadilan. Penyelesaian sengketa dengan cara arbitrase lebih menarik para pengusaha, pedagang atau investor karena arbitrase memberikan kebebasan dan otonomi yang sangat luas kepada para pihak.Arbitrase bisa menjadi solusi penyelesaian masalah terhadap ketidakpastian sehubungan dengan sistem hukum yang berbeda yang disebabkan karena para pihak yang bersengketa berasal dari yurisdiksi hukum yang tidak sama.Alasan dipilihnya arbitrase juga disebabkan karena beberapa hal seperti adanya kebebasan, kepercayayaan dan keamanan, keahlian, cepat dan hemat biaya, bersifat rahasia, bersifat non preseden, kepekaan arbiter, pelaksanaan keputusan dan adanya kecenderungan yang modern.Prosedur arbitrase setidak- tidaknya harus melalui beberapa tahap yaitu, negosiasi, pengangkatan para arbiter dan penyelenggaraan arbitrase, putusan serta pelaksanaan dari arbitrase itu sendiri. Putusan arbitrase bersifat final dan mempunyai kekuatan hukum tetap dan mengikat para pihak, oleh karena itu tidak dapat diajukan banding, kasasi atau peninjauan kembali.

Abstract

The success of the criminal proceeding system highly depends on the evidence revealed. The fact is that the criminal procedure recognized various type of evidence and witness testimonial is considered by the law enforcement i.e Police, State Attorney, or Judge as a key factor to determine the success of a conviction process. So important that it is seen insufficient for a conviction process to stand with the absence of witness testimony. Nevertheless, the attention given to secure the interest of the witness or the victim is not sufficient compared to the usage of witness in revealing crimes. Many people are reluctant in testifying by the reason of security, fear of intimidation by the law enforcement or suspect, time and financial loss without reimbursement, etc. Regardless its several advantages and weaknesess, the existence of Act No.13 Year 2006 (Undang-undang No. 13 tahun 2006) regarding Witness and Victim Protection, is expected to improve the position of the victim and the witness within the criminal proceeding system in order to endorse people who are knowing, hearing, or even suffer from a certain crime to testify before a criminal proceeding.

Abstract

Industrial relations dispute settlement can be done through litigation and nonlitigation. The process of settlement of disputes through litigation in the courts, resulting in agreements that are not yet able to embrace the adversarial common interests, tend to cause new problems, slow in its solution, requiring expensive, unresponsive, and caused animosity between the parties. While the dispute settlement process through non-litigation out of court to produce an agreement that is win-win solution, which guaranteed the confidentiality of the dispute by the parties, to avoid delays caused due to procedural and administrative problems in a comprehensive settlement in togetherness, and still maintain good relations . The only advantage of non-litigation process is the nature of confidentiality, because the process of trial and even the decision was not made public. Dispute settlement mechanism is a win-win solution can be done in stages: first stage Bipartite tail, a settlement through consultation between workers with employers without the intervention of third parties. The second stage through mediation, which is implemented by the Government settlement through a mediator which is responsible for mediation can be a mediator in resolving disputes between workers with employers, or through conciliation, the conciliation officer is appointed and dismissed by the Secretary of Labor based on advice union organization or unions. However, if the settlement is not reached agreement may be pursued to the Indonesian National Arbitration Board conducted by the National Arbitrator, and succeeded in reaching an agreement made when the deed of settlement which is binding (the final and binding).

Abstract

Judicial commission is an independent institution and born of the demands for reform and to perform reformation the Justice Institute has the function to propose the appointment of Supreme Court Justices and overseeing Supreme Court Justices and Judges in all the judiciary courts under the Supreme Court as referred to in the 1945 Constitution of the Republic of Indonesia. Supervision that is carried out by the Judicial Commission includes preventive to repressive supervisions in order to preserve and uphold the honor, dignity, and conduct of judges. With such that existence and function, the judicial commission holds an important and strategic role in the effort to realize the clean and respectable judiciary, as well as reforming the judiciary and create an independent judiciary, impartial (neutral), competent, transparent, uphold the high-values of justice and truth, and authoritative, capable for upholding the authority of law, the aegis of law, and justice.

Abstract

Marriage is a part of human life on this earth, and in Indonesia live many human diverse religions recognized by the government, so that in everyday life they are interacting with each other and sometimes will lead to marriage among those who different religions, this would cause problems and the validity of the marriage, therefore, in order not to cause problems and legitimate marriage according to the religion and the government, then the marriage should be according to their religion and the laws of marriage in force, namely Law No. 1 of 1974.

Abstract

Tugas kepolisian adalah suatu tugas yang dilengkapi dengan kekuasaan, kekuatan dan wewenang yang tujuannya adalah untuk memperlancar melaksanakan tugasnya. Untuk mencapai efektivitas dan efisiensi tugas kepolisian, kepadanya diberikan keleluasaan bertindak atau diskresi yang berdasarkan atas penilaian pribadi anggota kepolisian, dimana diskresi ini merupakan bagian dari proses penegakan hukum dan bukannya tanpa batas. Dalam implementasinya, sikap tindak diskresi polisi ada batas-batasnya yang diatur dalam perundang-undangan baik tertulis maupun tidak tertulis.

Abstract

This paper discusses civil liability of medical personnel in radiology services to patient safety. Doctors as medical personnel in carrying out their duties must be accountable for the actions taken when providing health services to patients. The civil responsibility of the doctor is intended to prevent / avoid the things that are not desirable, also aims to obtain compensation for losses suffered by a patient. This civil liability is based on wanprestasi (article 1243 Civil Code) as well as unlawful acts /onrechtmatigedaad (article 1365 Civil Code), using the doctrine "Res Ipsa Loquitur".

Abstract

In the framework of the arrangement of the street hawkers in the city of Semarang, Semarang Municipality normatively has issued the Local Regulation No. 11 of Semarang City 2000 on the Regulation and Development of the street hawkers. This research used an empirical legal research and the analytical desriptive. The Implementation of the Regional Regulation No. 11 of 2000 on Regulation and Development of the street hawkers, technically made by the Office of Semarang City Market on duty and authorized to regulate the presence of street hawkers in all areas of Semarang. In the field implementation is coordinated by the Office of the District and the Subdistrict Office. The obstacles encountered in the implementation of the Regional Regulation No. 11 of 2000 on Regulation and Development of the street hawkers in Semarang, viz : lack of legal awareness, lack of supervision by the law enforcement officers, relocation, unadequate strategic, and economical factors.

Abstract

The Government of Indonesia has issued legislation governing dismissal Police officers who committed the crime, stated in Government Regulation No. 1 of 2003 Article 11, paragraph 1, letter a, and the Police Regulation No. 14 of 2011 on the Police Ethic Code, however, there are still police officer(s) who violate the Police Ethic Code. The enforcement implementation of the Police Ethic Code in the Bidpropam of Central Java Police based on the Police Regulation No. 14 of 2011 Article 21 was carried out by the Police Ethic Code Commission in accordance with Police Regulation 19 of 2012 Article 30 against the perpetrators of criminal acts and who have obtained legally binding court decision, through Court of Police Ethic Code Commission against criminals for getting Dismissal Decision With No Honor. Constraints in the enforcement of Police Ethic Code in Bidpropam of Central Java Police is the disharmony between Article 17 and Article 22 of the Police Regulation, No. 14 of 2011, the limited power accreditor and limited working room, the Police Ethic Code Commission could be fickle, the courtroom is not permanent, human resource, namely accreditor,should be really professional.
