Abstract

The demands upon democracy and development discourse on good governance bring government officials for also must accommodate new challenges. The development of government officials should be initiated from leader level who can build the importanceof moral. Moral development of the government officials for creating good governance to reduce bureaucracy demoralization and public policy manipulation should be showed on the public satisfaction and warranty that governance and democracy are useful, equivalent and effective for the public interest. Good governanceimplementation requires capacity dimensions which in this time tends to be ignored and only pay less attention is moral things.

Abstract

Pergerakan lembaga peradilan dirasakan sangat lamban dalam menangkap, mengikuti dan merespon dinamika masyarakat yang terus berubah. Lembaga peradilan masih terus berkubang dengan putusan-putusan yang selalu beralaskan hukum dan undang-undang. Padahal dalam hukum sendiri diharapkan hakim mampu berkreasi sesuai dengan tuntutan masyarakat dan perkembangan zaman. Namun demikian secercah harapan sudah dimunculkan dengan putusan-putusan yang mampu merespon dinamika masyarakat.Hukum progresif memberikan warna baru yang tetap berbicara dengan nurani rakyatnya. Hukum untuk manusia, hukum tidak lagi sepenggal peraturan untuk diterapkan, tetapi merupakan satu kesatuan yang tidak dapat dipisah-pisahkan, disitulah ruh hukum itu akan diketemukan.

Abstract

Buying and selling transaction through internet makes people everywhere and at any time easy to make buying and selling agreement without face-to-face encounter. By electronic buying and selling transaction, people can buy and sell effectively and efficiently everywhere and at any time. In transacting, people keep referring to the existing legal norms. In buying and selling transaction through internet, various legal problems that can inflict a loss upon the other parties will appear. By the existence of the Law No. 11/2008 on Information and Electronic Transaction, it is hoped that the emerging dispute among the parties in the buying and selling transaction through internet can be settled.

Abstract

Konsumen tidak mempunyai posisi tawar yang kuat saat berhadapan dengan PDAM Kota Semarang karena sangat bergantun pada air yang dipasok oleh PDAM Kota Semarang. Sebaliknya PDAM Kota Semarang memanfaatkan keadaan mi untuk mengeksploitasi konsumen. Konsumen tidak menuntut sesuai hukumyang berlaku karena budaya hukum konsumen mempunyai penilaian yang negatif terhadap hukum itu sendiri. Akibatnya tidak ada sengketa yang diselesaikan sesuai hukum yang berlaku Pemberdayaan merupakan salah satu cara untuk memberi konsumer, kekuatan agar dapat memperoleh hak-haknya secara mandiri dan mempunyai posisi tawar yang sama dengan PDAM Kota Semarang.

Abstract

The Commercial Court is a special court within the General Courts. ThisCommercial Court has the authority to accept, examine and adjudicate the case foran application for bankruptcy statements, request for a delay in the obligation to paydebts (PKPU), other claims and intellectual property rights (IPR).This study aims todetermine the scope of duties and authority of the Commercial Court, the legalstanding of Creditors and Debtors after the dispute has been decided by HakimNiaga and has permanent legal force and the implementation of the execution at theCommercial Court. The approach method used in this research is sociologicaljuridical with the Semarang City research area, especially the SemarangCommercial Court. The research subjects included those involved in the proceedingsat the Semarang Commercial Court. Primary data and secondary data are obtainedthrough field surveys and literature studies.Based on the research and analysisresults, it is known that the scope of duties and authority of the Commercial Court isto accept, examine and decide on the case for an application for bankruptcystatements, postponement of the obligation to pay debts (PKPU), other claims andcases included in the field of intellectual property rights (IPR).The legal standing ofthe parties is that for the Debtor after being declared bankrupt by the CommercialCourt Judge, he loses the right to manage the bankrupt assets owned by him, but theDebtor's civil rights as a person (personrechi) is not lost.Regarding the execution ofthe Commercial Court that is still guided by the provisions of HI R / RBg as theexecution of civil cases in the District Court, this is because Law No. 4 of 1998 hasnot been regulated separately. Especially for the execution of the forged Brand case,the mark of the falsified goods / products is carried out at the Directorate General ofTrademark, Copy and Patent of the Ministry of Justice and Human Rights in Jakarta

Abstract

In order to carry out the crime prevention and control policy, there are two ways thatcan be carried out, namely the use of penal facilities or criminal (legal) sanctions,and the use of other facilities (nonpenal). Thus the use of criminal (legal) sanctions isone of the policies in criminal politics, which in this case is not a means that occupiesa strategic position and causes many problems. Moreover, if it is associated with theuse of criminal sanctions to achieve the purpose of prevention as one of the premise ofabolitionist understanding. As a means of law enforcement policy in order to controlcrime, the use of criminal (legal) sanctions is not an absolute. Even if it will be used,then the problem is the policy of its use must be rational by paying attention to thehumanistic approach and social interests that contain certain values that need to beprotected. As a criminal policy, the extreme attitude to eliminate criminal (legal)sanctions is not a policy step. Because what needs to be done in policies to controland overcome crime is an integrated approach between penal and non-formalpolicies. This non-formal activity occupies a key and strategic position that must beintensified and streamlined in controlling and overcoming crime, not eliminatingcriminal law.

Abstract

Law enforcement against pollution and environmental destruction include : (a). Lawenforcement efforts, both preventively, by providing counseling to industry actorsand to surrounding communities to participate in maintaining and preserving theenvironment. (b). The EIA also becomes one of the main requirements in obtaining anabsolute environmental permit prior to obtaining a business license. (c). Any processof formulation and application of pollution prevention and/or environmentaldamage and mitigation and law enforcement instruments requires the integration ofaspects of transport, participators, accountability and fairness. Preventive effortsundertaken by the apparatus include, counseling and monitoring of the communityby building stake holders commitment in their perceptions and cooperation tomaintain, preserve and manage the environment as well as preventive efforts. Whilerepressive efforts by the apparatus are dealing with the investigation to the forefrontof the threat of criminal, civil, and administrative sanctions. But of the three effortsthat are most often done is an effort with the instrument in a preventive mannerwithout waiting for the occurrence of environmental disputes.

Abstract

Pancasila has become the agreement of the Indonesian people as the basis of theUnitary State of the Republic of Indonesia, but in its implementation effortsexperience various obstacles both internal and external. Pancasila as a view of thenation's life needs to be implemented in real life, this has been exemplified by thefounding fathers of the nation through hard work and struggle to produce Indonesianindependence. Concern for the legal conditions that are in favor so far from theelement of justice makes the mind interested in discussing whether the values taughtby Pancasila are still heeded or ignored. Pancasila which is the nation's ideology asa view of life and the foundation in the activities of society, nation and state isimpressed only to be memorized without application, including in the field of law. Thequality of the state which is the benchmark for safeguarding the nation's ideology iseagerly awaited to control the implementation of a just law based on the noble valuesof Pancasila. Pancasila as the basis of the State is based as a source of law inIndonesia. All laws and regulations must be an elaboration of the principlescontained in Pancasila. All laws and regulations that are not in accordance withPancasila, are null and void. Therefore, to be able to understand the accuracy of lawsand regulations, it is necessary to understand the concepts, principles and valuescontained in Pancasila. Pancasila as the basis of the state is implemented to be alegal norm that is compelling, binding and sanctions.

Abstract

The mining divestment policy has 3 main key components. First, how much is thedivestment amount. Second, who can buy divested shares. Third, how much is the saleprice of the divested shares. The first element, the divestment requires that everyforeign-owned mining company divest a portion of the increased shares to thegovernment, BUMN or national private sector. (Government Regulation Number 1of 2017, concerning Amendments to Government Regulation Number 23 of 2010,concerning the Implementation of Mineral and Coal Mining Business Activities).The second element, regarding the divestment rules, determines who can buy(Permen ESDM No. 9 of 2017, concerning Procedures for Stock Divestment andMechanism for Determining the Price of Divestment Shares in Minerba MiningBusiness Activities).While the third element is the rule that determines the stock pricewhen it is sold, the share price offered to the Government is determined throughnegotiation. (Government Regulation No. 23 of 2010, concerning theImplementation of Mineral and Coal Mining Business Activities).Industrialdevelopments in the country are still difficult to do, including mining. According toArchandra Tahar, Deputy Minister of Energy and Mineral Resources (ESDM) thereare at least three factors inhibiting the development of the mining sector in Indonesia.These three factors are the problem of banking, technology and political interestrates.

Abstract

Curia Novit Jus: means that judges are considered to know and understand all laws,therefore the court is prohibited from refusing to examine, hear, and decide on a casethat is filed under the pretext that the law does not exist or is unclear, but is obligatoryto examine and judge him. Judges as judicial organs are considered to understandthe law. Therefore the judge must provide services to every justice seeker who asks forjustice to him. If the judge provides services in resolving disputes, finds no writtenlaw, the judge must explore the unwritten law to decide on legal cases as a wiseperson and fully responsible to the Almighty God, himself, society, nation and state.In a Criminal Case if the fact witness is not identified, the judge digs the facts in thetrial, through the statement of the Criminal Law Expert to obtain confidence indeciding the case, the expert information obtained in the criminal case used to decidethe case.
