Abstract

This research aims to describe the contributions of zakat, infak, s}adaqah and wakaf (Islamic philanthropy) toward the civil society movements in Indonesia and the problems surrounding it. This study raised the case of Yayasan Solopeduli Surakarta, an Islamic philanthropy management agencies. This research uses the socilogical approache of law. The primary data sources are administrators and managers, and agency activities organized by the Yayasan Solopeduli Surakarta. Secondary data are relevant papers, brochures and dictionaries. Data were collected by interview and observation and documentation. Data analysis was performed with a fixed ratio (constant comparative method) which includes datareduction, categorization and synthesization, as well as the formulation of an answer. In the analysis process, the data are associated with theories of civil society.The findings of this research show that zakat, infak, s}adaqah and wakaf managed by Yayasan Solopeduli Surakarta contributes to the formation of the pillar of civil society and the enforcement of civil society values. Firsly the charity value as showed by existence of the agency that always builds the care spirit of the haves for the poor, as well asby most its programs that offer free service concept, in the field of education, health, and other public service. Secondly, the independence value, especially from the aid of the government. The impact is, thatthe agency moves freely by itself paradigm. Thirdly juctice value as showed by the most programs that support the poor society. However, actually the agency is far from, but doesn’t recognize the civil society discourse as seen by the west. That is why, it doesn’t go along with the contemporery issue of civil society, such as democracy and gender equality. The interpretation of mustahiq surrounds the classic one.

Abstract

This article explores how daily experience of the women living in the polygamous family in Langsa, Aceh. The primary argument proposed in this paper is that conflict, in fact, emerges from husband decision to practice polygamy in domestic life despite the belief of some women who accept that Islam countenances the practice of polygamy. The conflict sometimes arises among wives, between husband and the wives or among children of different wives. To prove such argument, the investigation of the daily experience of polygamous family such as the relation among the wives, household financial management, articulation of fairness on both physical and spiritual fulfilment, celebration of religious days (‘Idul Fitri and ‘Idul Adha), as well as upbringing of children was carried out during second semester of 2011. The data was collected through semi-structured interview, observation to the domestic life of the polygamous family, and documentation on divorce suit as a result of practiced polygamy. This study revealed that peaceful family (keluarga sakinah) as often regarded as one of the ultimate goals of marriage would never be attained through such practice.

Abstract

After the new order (ORBA) has collapsed, HTI is the most solid and has the widest network among the other new Islamic movements that always struggle to implement the Sharia. Furthermore, HTI is the most radical movement because HTI does not only have aims to implement the Sharia but to build Islamic caliphate as well. How the Sharia concept in caliphate frame and the HTI effort in realizing the aims is the focus of this qualitative research. To answer this question, the researcher interviews some HTI activists and attends in some HTI activities in Yogyakarta. According to HTI, the Sharia encompasses every life aspect; such as worship, ethic, food, drink, dress or mu’amalah (government, economy, education, justness. Etc). The Sharia can only be applied perfectly (kaffah) in the Islamic caliphate system. The efforts of HTI in implementing the Sharia in the system of caliphate country are explained by using the Doug Macadam’s theories of social movement; those are 1) political opportunities 2) mobilizing structures; either internal, by tathqif, or external, by tathqif jama’i and talab al-nusrah, 3) framing process by sira’ al-fikri, kifah siyasi and tabanni masalih al-‘ummah. Refering to the social movement, HTI is a revolutionary movement which aims to replace the old social order at all by a new system. This movement tries to save and free the ummah from the broken and kufr system along with social critics to some social troubles which create crisis in life. Therefore, HTI will grow widely in social order which is full of poverty, injustice, corruption and all arbitrariness. Otherwise, HTI will be difficult to be big movement in the prosperous and just countries.

Abstract

This writing is aimed at exploring the models of zakat distribution that might be most applicable in modern era. This is necessary sine the zakat distribution presently doesn’t meet the persons in need maximally. Besides, the unnecessary impacts of zakat sometimes occur such as creating envy and quarreling among the people. Zakat can be distributed in consumptive and productive models. Consumptive models is a model in which zakat is directly give to the people to consume. In the productive models, zakat is distributed in such a way that zakat not is directly consumed at once but it is given to the people for production activity. Productive models involve In Kind, Revolving Fund (al-qard al-hasan), and mudarabah system. In kind system, zakat is distributed in the forms of production equipments. People use those equipment for productive activities so they can do business for their life. In revolving fund (al-qard al-hasan) system, zakat is given similar the the system in al-qard al- hasan, but and quarreling the profit of the business is shared with the zakat management board.

Abstract

The problem of poverty that be falls in the muslim communities is influenced by the systems used inthe distribution of zakah funds. Each system used has some advantages and disadvantages in accordancewith the priority issues to be resolved. If the priority is to reduce poverty, then decentralization isthe best choice of either of these options. This paper would like to reiterate the importance of decentralizeddistribution of charity funds so that funds raised by an area will be returned to the area and theproblems of poverty faced from which the funds collected will soon be resolved.

Abstract

This study describes the implementation of the principle of accountability in the management ofproductive waqf in the form of Islamic Hospital in Magelang City. The results showed that IslamicHospital is a core business managed by waqf institutions and has experienced significant developmentswith a marked number of users is increasing. The principle of accountability on the Rumah Sakit Islam(Islamic Hospital) Kota Magelang implemented by the Board of Supervisors to supervise routinelybased on a report prepared by the Director of RSI. Implementation of this principle on endowmentsinstitutions is expected to increase the confidence of stakeholders. For the future, supervision throughan external audit needs to be programmed to improve accountability and public trust.

Abstract

Waqf in Islam is one way to invest in property for the sake of the world and the hereafter. The development of waqaf must still be in the sharia corridor so that its ubudiyah and iqtishadiyah values remain. Islamic law will not be known even as DSN MUI has just released its fatwa in October 2016 which is the investment benefit and sharia life fatwa, but some sharia insurance institutions and wakaf institutions in Indonesia first applied this form of waqf. The legal status of a wakaf law on Islamic insurance policy under Islamic law includes productive wakaf. However, in terms of its ownership element as a waqf object has not been fully owned by wakif so ulama differed in opinion, although in principle has been owned by wakif, but still opens the dispute space because the waqf object is not yet fully owned. The wakaf law of syariah insurance policy itself is still potentially canceled by wakif or by sharia insurance if one of them wakif get difficulty paying the premium before maturity. Implementation of waqf syariah insurance policy at Al-Azhar Wakaf Institute Jakarta has not yet fully complied with the rules of Fatwa DSN MUI because the fatwa has just come out in the end of 2016 and socialized in early 2017, whereas the wakaf will be known as sharia insurance policy in the community.

Abstract

Human resources have a very important role in a company organization especially when compared to other resources. Employee performance is a very important thing in an effort to achieve change in order to achieve its goals. This study discusses the influence of the quality of human resources on the performance of sharia banking employees in Aceh and how efforts should be made in improving the quality of sharia banking human resources in Aceh. The research method used is a mixed method (Mixed Method). Based on test variables obtained by tcount of 3.859 while t table of 2.048 the results of this calculation indicate that tcount t table with a significance level of 0.001 or probability above α = 5%. Thus the results of statistical calculations indicate that the variable quality of human resources has a significant influence on employee performance. Which means that the higher the quality of human resources, the higher the performance of employees in Islamic banking. Efforts to improve the quality of banking Human Resources can be done through: 1) Evaluation of a sustainable Islamic economic curriculum in higher education institutions. 2) Establish a faculty / Islamic economic study program in accordance with the needs of the Islamic banking market. 3) Higher Education collaborates with Bank Indonesia to carry out Islamic economic education and training for students and employees of Islamic banks. 5) Education and training on banking to improve the quality of human resources in sharia banking is a short-term effort that can be done now. While the efforts made in the long term are by organizing education that is synergized between the education provider (college) user (bank) and the person in charge of education (government).

Abstract

This paper discusses the Hejric calendar system by Mohammad Shawkat Odeh, one of Muslim astrono-mers from the Islamic world who offers new criterion for lunar crescent’s visibility and the Hejriccalendar system. This article describes and analyzes some concepts proposed by Odeh concerning hisab(calculation) and rukyah (moon-sighting) such as criteria for the crescent visibility. The criteria offered byOdeh is the result of a long-time research (from 1859 – 2005 and totalled 737 observations). TheUniversal Hejric Calendar proposed by Odeh divides the world into two zones: the westerns zonecovers American continent and the eastern zone covers Asian, African, Australian, and European conti-nents. Although there are some problems caused by the division of zones, the idea that most ofMuslim countries includes in the same zone is expected to reduce the problem of dissimilarity indetermining the new moon. Consequently, the unification of the first date of the month and also theIslamic calendar is possible.

Abstract

The focus of this research is to reveal the method of istinbath jamaah al nadzir law in determining the beginning of the month. The method research is used descriptive with a qualitative approach. Data was collected by interview to the leadership of jamaah al-nadzir and jamaah al-nadzir society. Prophet bequeathed early determination method can be determined by methods rukyah (saw) and hizab (counting) months. The results showed that jamaah al-nadzir determine the beginning of the month with rukyah method (see) and hizab (counting) in contrast to a predetermined previous scholars. Leaders of jamaah al-nadzir is an absolute determinant beginning and end of the month to see some of them looking directly lunar and see the sea level at high tide and low tide.
