Abstract

ABSTRAKPenelitian ini bertujuan untuk mengetahui dan menganalisis bagaiamana penanganan pemutusan hubungan kerja dan apa saja kendala yang dihadapi dalam penanganan pemutusan hubungan kerja.Penangan yang dilakukan oleh pihak Disnaker dalam kasus pemutusan hubungan kerja adalah dengan mempertemukan kedua belah pihak yaitu pihak pengusaha dengan pekerja dan mencoba menyelesaikan kasus dengan kekeluargaan, apabila tidak ditemukannya titik temu maka kasus akan diserahkan kepada bidang PHI dan mediator memiliki hak penuh dalam penyelesaian dari kasus tersebut.Dalam proses penyelesaiannya, pihak Disnaker masih mengalami kendala-kendala seperti sulitnya mendatangkan pengusaha untuk hadir dalam pertemuan atau sidang yang diadakan oleh Mediator, Hal itu bisa membuat proses berlangsung lebih lama walaupun ada jangka waktu penyelesaian. Kemudian perselisihan yang diajukan oleh pekerja melalui Serikat Pekerja Nasional, tidak dilengkapi dengan surat kuasa dari pekerja, sehingga proses tidak bisa dilanjutkan karena tertib administrasi tidak dipenuhi. Kata kunci :PHK, Serikat Pekerja Nasional, dan PHI.

Abstract

ABSTRAK Dalam penerapan pidana kumulatif terbagi ke dalam beberapa tahap yaitu tahap penuntutan, tahap putusan dan tahap pelaksanaan putusan atau eksekusi. Dalam tahap penuntutan perkara Narkotika, Jaksa Penuntut Umum harus memperhatikan ketentuan pidana dalam pasal tertentu dari Undang-Undang Narkotika yang telah dilanggar. Berhubung ketentuan pidana kumulatif dalam Undang-Undang Narkotika tidak ditentukan tentang kurungan pengganti denda yang merupakan pidana yang berhubungan dengan kekayaan terdakwa dan karena itu mengalami kesulitan dalam hal eksekusinya, maka jaksa dalam penuntutan perkara Narkotika juga mencantumkan tentang pidana kurungan pengganti denda tersebut. Sedangkan dalam tahap menjatuhkan putusan perkara Narkotika, hakim terikat pada dakwaan penuntut umum, bukti-bukti yang sah di persidangan dan terikat pada ketentuan pidana dalam Undang-Undang Narkotika. Adapun dalam tahap pelaksanaan putusan pengadilan (eksekusi), pelaksanaan putusannya terbagi atas tiga yaitu : pelaksanaan (eksekusi) pidana penjara, pelaksanaan (eksekusi) pidana denda dan pelaksanaan (eksekusi) pidana kurungan pengganti denda. Sikap penegak hukum terhadap Tindak penyalahgunaan Narkotika pada dasarnya aktif karena Tindak pidana yang diatur dalam Undang-Undang No. 35 Tahun 2009 tentang Narkotika merupakan delik relatif. Walaupun tidak ada pengaduan penuntutan hanya ada laporan atau informasi tentang adanya Tindak penyalahgunaan Narkotika, maka penegak hukum melihat adanya Tindak semacam ini tetap akan memproses sesuai dengan hukum yang berlaku. Dalam peristiwa pengaduan tidak diperuntukkan menuntut peristiwanya, akan tetapi menuntut orangnya yang melakukan Tindak penyalahgunaan Narkotika tersebut.

Abstract

ABSTRACT       The reasons that led to discord between husband and wife regarding the authority of parenting when child custody has been set by the judge can occur for several reasons, namely: Tension and feel hostility that appear in trial of cases of divorce often leads spouses each hold themselves more deserving custody; Problem child closeness or emotional relationship with one of the parties (mother or father); Problems in the financial matter for child care. Factors - factors underlying the judgment the judge in determining custody of children of divorce are divided into 2 factors, factors Parents: Factors parents in the form of an agreement between the two sides I (husband and wife), a state of mental / moral parents as well as the economic situation of parents; Factors Children: Child factors such as age and the proximity of one of the children with both parents. Constraints faced the judges in determining custody of children of divorce are divided into two factors, namely: factors relating to the proceedings in the trial: factors relating to the proceedings in the court among others, the plaintiff did not submit a request for custody of the child in the lawsuit divorce and one of the parties is not present on the day of the trial has been set. Factors related to the litigants: factors relating to the litigants in the form of one of the parties not known to exist and the child from the marriage between the plaintiff and the defendant who is not in the care of the plaintiff or the defendant.

Abstract

ABSTRAK Dalam mengulang sewakan mobil antar pemilik mobil dengan pihak jasa persewaan mobil sering terjadi karena adanya keterbatasan mobil yang dimiliki oleh jasa persewaan mobil yang kemudian berusaha mencukupinya dengan melakukan sewa mobil kepada pemilik mobil. Hal ini bisa terjadi karena adanya saling kepercayaan dan ketergantungan antara pihak jasa persewaan dan pemilik mobil. Pihak jasa persewaan membutuhkan tambahan mobil yang akan disewakan, sementara itu pihak pemilik mobil membutuhkan calon konsurnen yang datang pada jasa persewaan mobil. Perjanjian mengulang sewakan pada prinsipnya, mengulang sewakan kembali barang yang disewa tidak diperbolehkan jika tidak ada persetujuan dari pihak pemilik mobil (pihak yang menyewakan), sebaliknya jika ada persetujuan dari pihak pemilik mobil maka harus jelas dituliskan dalam perjanjian sewa menyewa bahwa pihak jasa persewaan diperbolehkan untuk menyewakan kembali barang yang disewa.Upaya yang dapat dilakukan jika terjadi wanprestasi adalah melalui jalan musyawarah antara para pihak dengan memperhatikan isi dari perjanjian yang telah dibuat sebelumnya. Jika melalui jalan tersebut belum bisa menyelesaikan masalah yang ada, maka diambil solusi lain dengan kesepakatan para pihak. Dan jika melalui upaya-upaya yang ada tidak juga dapat menyelesaikan masalah tersebut, akan diambil tindakan hukum baik perdata maupun pidana. Apabila tindakan wanprestasi yang dilakukan sampai menghilangkan barang yang disewa jalur yang ditempuh adalah melalui hukum pidana dan perdata sedangkan jika hanya sebahagian saja barang yang rusak atau hilang akan ditempuh jalur perdata. Namun pada intinya persoalan yang ada akan diselesaikan secara baik-baik antar para pihak.

Abstract

ABSTRACTBasic needs of every human being in life is to take clothing, food and shelter. To achieve the welfare of the coveted by every human being, then the first requirement must be fulfilled for clothing, food and shelter for every human being is, in order to live in peace in accordance with the craved. Basic needs in the areas of board (home) as the top priority of every human being, because the house is the residence that serves, among others, as a shelter, educate and nurture domestic life and interact with other families in order to organize a better life and to achieve prosperity desired.The availability of land for housing is very limited and very expensive. Then the solution offered is the construction of housing with vertical systems commonly called flats. However modest apartment rental utilization should be based on a lease agreement homes, apartment units that can be rented flats are located in the management and supervision of local governments that builds on the Local Government Budget and Central Government for the sake of helping people who do not have a place to stay and one forms of public welfare purposes.

Abstract

ABSTRACTThe registration of land rights through the Adjudication project in Samarinda, in practice is not complicated and the registration is easy. Where the location has been determined based on the criteria in the decision of the Minister of Agrarian Affairs no. 3 of 1995 where the location of the evidence is still small or the land has not been registered by the owner. Land registration through this adjudication is more effective than sporadic land registration by the landowners themselves. For in Samarinda The registration of land through the adjudication project has reached the target of 10,000 fields because in Samarinda from land registration through the project Adjudication according to Government Regulation No.24 of 1997 and Article 19 UUPA has been reached that is the legal certainty of each with the existence of certificate as evidence. In the implementation of registration through this adjudication project can not be separated from the factors that support the cheap registration fee is only Rp. 13,500,00 and the registrant does not need to pursue administrative care, and the registration requirements are easy, so this implementation is easier to implement. However, there are also factors that hamper the government, which includes short time, the presence of problematic soil, lack of complete data on the land to be registered, and the government in providing counseling must be repeatedly. While the inhibiting factor of the community as the land owner includes the required data has not been attached, the parcel number does not match the transferred number, or also the deletion in the certificate is not executed, filling the application letter of incomplete rights, and the silence if there is a mistake the data has been collected by the Adjudication Team so that this will affect the implementation of registration of land rights through adjudication projects. With the factors that hinder the findings of efforts to overcome them, such as by increasing the registration time and not only targeted 5,000 field 1 team, and provide counseling to land owners to complete the land data, and to resolve the land dispute (if the dispute), also held unfit data correction where the land owner actively checks the land data that has been announced by the Adjudication Team. Thus the factors hindering the implementation of the registration of land rights systematically through adjudication projects can be overcome so that the implementation runs smoothly in accordance with the objective of Government Regulation No.24 of 1997 on the need for land registration.

Abstract

ABSTRACTThis Legal Writing aims to know about the legal protection afforded to victims of crime of rape and punishment given to perpetrators of rape crimes. Efforts to protect victims of rape in the criminal justice system can not be separated from the participation of the parties involved in the criminal justice system, even though the rules on the protection of victims have been regulated in such legislation. It will not work effectively and maximally when in practice the elements that can support the achievement of victim protection are not mutually supportive We may also recognize the existence of criminal sanctions in the Criminal Code in article 285 up to article 288. Keywords: Legal Protection, Crime, Rape.

Abstract

Abstract      Law No. 30 of 2004 concerning Notary, is expected to provide better legal protection to the community or to the Notary itself. A Notary as an officer, is a place for someone to be able to obtain advice that can be relied upon.      In addition to creating an authentic deed, a notary is also obliged directly or indirectly to maintain smooth proceedings occur, including with regard to the judicial process, both in the criminal and civil justice.      Notary according to the law, should not take sides, it means that the notary in helping the parties to formulate in deed, must consider the interests of both parties and should keep that relate to the content deed made. Especially in case of a dispute between the two sides, which resulted in the investigation of the notarial deed.      It should be for all parties, both investigators, prosecutors, and judges can respect, uphold the oath of office, official secret, and the right of refusal held by a notary, and should be able to work together well and remained firm on their Code of Conduct in every profession there except for the notary profession though. Given these efforts, it is expected as part of efforts to enforce the law and is also expected to positively impact the law enforcement itself.

Abstract

ABSTRACT In the era of globalization and free trade as it is today, many emerging various products and / or services marketed to consumers in Indonesia, if not careful in choosing products and / or services consumers want, then consumers will only be objects of exploitation from irresponsible business actors, because unwittingly consumers only take for granted goods and / or services consumed. While food is a commodity that has a high risk because the food is consumed by the community for its survival. But in practice, the trade of food products shows that there are still many business actors who deliberately sell food products that have expired, it is very harmful from consumer rights because it can endanger the health and safety of consumers. Based on the condition of the circulation of food, it can be formulated some of the problems as follows: how the regulation of consumer protection on the distribution of expired food and problems faced by consumers in consuming expired food, and how the form of legal protection against food consumers expired and coaching and supervision of government and agencies which is related to the circulation of expired food, and how the business actors account for the expiration of expired food and consumer dispute resolution mechanisms that can be taken to resolve various violations.
