Abstract

AbstractCivil Servants (PNS) as the state apparatus has a very strategic position and a decisive role in organizing the government and development. As a state apparatus, civil servants are obliged to carry out government and development tasks with full loyalty and adherence to Pancasila, the 1945 Constitution, the state and government. Therefore, civil servants as implementers of legislation must endeavor to adhere to any laws and regulations in carrying out official duties.The authority of the judges of the State Administrative Court in resolving the civil service dispute In accordance with Law No.51 of 2009 on the State Administrative Court, it is stated that the judge of the court is an official performing the task of the judicial authority, in which the judicial authority's duties are in order to administer the judiciary and the judiciary itself has the obligation to examine, hear and decide a case. In short, a State Administrative Judge is an official authorized to examine, hear and decide a case within the State Administrative Court.

Abstract

Abstrak        Penyelenggaraan undian dengan hadiah ini tidak hanya sekedar basa-basi tetapi dilakukan dengan praktek kejujuran sebagaimana dapat diketahui dari kenyataan adanya konsumen yang memperoleh hadiah fantastis berupa uang tunai maupun mobil baru maupun dalam bentuk tabungan bernilai ratusan juta rupiah.        Dalam membahas pokok permasalahan dan menganalisis data yang telah diperoleh, maka penulis menggunakan segala informasi dan data yang telah diperoleh, baik itu data primer maupun data sekunder. Kemudian penulis analisis secara kualitatif yang kemudian disajikan secara deskriptif       Mengacu pada isi dari Pasal 35 ayat (2) UU Perkawinan, maka status kepemilikan atas harta benda yang berasal dari undian berhadiah yang didapatkan di dalam sebuah perkawinan adalah merupakan harta pribadi dari suami maupun isteri yang menjadi pemenang dari undian berhadiah tersebut. Oleh karenanya, suami atau isteri yang menjadi pemenang adalah merupakan pemilik mutlak dari hadiah undian yang ia peroleh dan berhak sepenuhnya untuk melakukan perbuatan hukum atasnya tanpa ada persetujuan terlebih dahulu dari pihak lain.

Abstract

ABSTRACTThis study examines and addresses issues concerning the role of legal counsel in the investigation process; as well as the constraints faced by legal counsel in carrying out the defense in the investigation process.This study includes a descriptive type of empirical legal research. Research data using primary data and secondary data, primary data is original data obtained by researchers from the first hand from the main source in this case data obtained by the author from field research or research directly at Samarinda  Police Station and then also to the Legal Counsel who accompany suspect to know its role in process of investigation, secondary data is data obtained by researcher from library research and documentation which is result of research and processing of others who have been willing in the form of books or documentation usually provided in library. Sources of data in this study are secondary data sources consisting of primary legal materials, secondary legal materials, and tertiary legal materials. Data collection techniques used are interview (interview) and literature study. Data analysis technique used is a qualitative data analysis that is a research procedure that produces analytical descriptive data that is what is expressed by respondents in writing or oral, and also the real behavior is researched and studied as something intact.The role of legal counsel in the investigation process that includes how the case of his position, because in the case of the position is threatened with the punishment of five years and above then must be accompanied by legal counsel. The legal advisor who accompanied the suspect was appointed by the investigator of the Samarinda  Police Resort through a letter of appointment which essentially contained a request to assist the suspect in the investigation process. Then on how the role of legal counsel in the investigation process that includes the rights, obligations, authority, steps, and actions in accompanying the suspect in the process of investigation. Then explained about the constraints faced by legal counsel in carrying out the defense in investigation process at Samarinda  Resort Police. Whereas the application of Article 115 of the legal advisors is only seen and heard only, and its presence only with the consent of the investigator whether allowing or not, if there is a matter that the legal advisors feel is not true then become a separate record for legal counsel to be submitted to the hearing. Investigators when using violence in obtaining information can be subject to Article 422 Penal Code and can be pre-trial.

Abstract

AbstractEnvironmental law in general to solve environmental problems especially caused by human activities. Environmental problems for humans can be seen in terms of environmental quality decline.The presence of massive coal mining activities in Tenggarong Seberang sub-district of Kutai Kartanegara Regency has caused damage to the environment in the region. Surely this is very inconvenient for the life of the surrounding community. One of the efforts to reduce the level of environmental pollution as a result of coal mining activities is through strict environmental monitoring and law enforcement against companies that pollute the environment.There are 3 (three) things studied in this research are: 1) How many cases and types of environmental imaging conducted by coal mining companies in Tenggarong Seberang Sub-district Kutai Kartanegara Regency during the last 5 years (2011-2015)? ; 2) what are the forms given to companies for environmentalists in Tenggarong Seberang sub-district of Kutai Kartanegara Regency for the last 5 years (2011-2015)? and 3) What are the procedures for monitoring and sanctioning the companies that pollute the environment? The method used in this research is the normative method and sociological method (empirical).Based on the results of research that has been done, the number of environmental dispute cases related to coal mining activities in Tenggarong Seberang District Kutai Kartanegara Regency during the period 2011-2015 as many as 52 cases and environmental components which are the activities of air (17 cases), soil (36 cases), air / vibration (3 cases) and cumulative (1 case). The number of companies reported as many as 27 companies and cases that have been completed as many as 50 cases while 2 cases are still in the process of completion. The highest number of cases in 2012 is as many as 14 cases while the number of cases occurred in the year 2013 as many as 6 cases. All cases.Implementation of sanctions to coal mining company in Tenggarong Seberang Sub-district Kutai Kartanegara Regency for 2011-2015 period as many as 8 companies with billing forms namely written warning (3 companies), government coercion (3 companies) and freezing of environmental permit (2 companies), while the word replacement termination no company got the order. The amounts divided in 2011 and 2012 are 3 companies each and in 2013 as 2 temporary companies in the last 2 years (2014-2015) there is no company. Forms of sanction given to companies that conduct the environment (pollution and / or environmental damage). Not all cases are sick or only 15.38% of cases of pollution and / or environmental damage are given sanctions.The Regional Environment Agency (BLHD) of Kutai Kartanegara Regency already has Standard Operating (SOP) related to environmental law enforcement in Kutai Kartanegara Regency, namely: 1) SOP of Administrative Sanction Implementation in the field of Environmental Protection and Management and SOP of Environmental Law Enforcement. Nevertheless BLHD Kutai Kartanegara does not yet have SOP related to law enforcement related to. The main obstacle of BLHD Kutai Kartanegara in conducting supervision and enforcement of environmental law is the number of personnel (PPNS and PPLHD) and limited operational fund.

Abstract

ABSTRACT The Code of Penal (Penal Code) has set a certain period of time on the subject of prosecution, may be expired by law. The provisions in the Criminal Code article 78 is actually set up for criminal prosecution expired rights, but it should also be linked to the right to run a penalty. Time of death of the right to run a longer sentence than the death the right of criminal prosecution because the accused is certain errors. The criminal act of forgery as governed by Article 263 Penal Code was actually a criminal act that should be done deliberately up to declare a person charged with a criminal act of forgery was proven, the prosecutors and judges must prove the existence of the will of the defendant to act in a false or falsified letter. The intent of the defendants to use their own letter as the letter is genuine and not faked or to make any other person a letter that he created artificially, required the knowledge of the defendants that of the use of the letter that he has made is false or that he trumped it can cause harm.

Abstract

ABSTRACT This study entitled " Pemberian Izin Pembangunan Mini Market Pada PT. Indomarco Prismatama Tanpa Peninjauan Lapangan Oleh Badan Pelayanan Perizinan Terpadu Di Kota Samarinda ". The main issues examined in this study are: first, What is the requirements which is required by the government of Samarinda to control the establishment of minimarket in its territory? second, what is the Legal Action taken by the Government of Samarinda about the violation of letter of business market permission, if the permit were granted without any review by the authority? This study is included normative juridical research, by reviewing the related licensing, regulations applicable law, including the norms and principles contained there in. Based on the analysis the researchers did in order to address issues raised in this study, it can be concluded as follows: first, implement the concept through policies that stipulated in Peraturan Presiden RI No. 112 Tahun 2007 tentang Penataan dan Pembinaan Pasar Tradisional, Pusat Perbelanjaan, Toko Modern and Rancangan Perda Kota Samarinda (later become local regulations) on 2015 About Penataan dan Pembinaan Pasar Tradisional, Pusat Perbelanjaan, dan Toko Modern. . Abstract

ABSTRAKPenelitian ini bertujuan untuk mengetahui bagaimana pelaksanaan layanan program Jaminan Kecelakaan Kerja (JKK) pasca transformasi PT JAMSOSTEK menjadi BPJS (Badan Penyelenggara Jaminan Sosial) Ketenagakerjaan dan untuk mengetahui bagaimana akuntabilitas kinerja BPJS (Badan Penyelenggara Jaminan Sosial) Ketenagakerjaan.Penelitian ini dilakukan di Kota Samarinda, dengan mengambil data yang relevan serta melakukan wawancara dengan pihak-pihak yang terkait dalam hal ini pihak penyelenggara BPJS dan pihak-pihak yang terkait dan pihak-pihak yang terkait dalam penulisan skripsi ini.Metode penelitian skripsi ini menggunakan metode penelitian kepustakaan (LibraryResearch) dan metode penelitian lapangan (FieldResearch). Metode penelitian kepustakaan yaitu metode penelitian dengan melakukan pengumpulan data pustaka atau bahan bacaan yang relevan dengan penelitian yang dilakukan, sedangkan metode penelitian lapangan yaitu penelitian yang dilakukan dimana penulis akan terjun langsung ke lapangan.Hasil penelitian ini menunjukkan bahwa pasca transformasinya JAMSOSTEK menjadi BPJS Ketenagakerjaan, pemerintah telah memberikan dukungan penuh untuk pelaksanaan BPJS diantaranya dengan menetapkan jenis pelayanan kesehatan, menetapkan anggaran dan subsidi iuran. Adapun fokus utama dalam skripsi ini adalah program Jaminan Kecelakaan Kerja (JKK) Pasca bertransformasi dinilai telah banyak memberikan peningkatan dalam kualitas layanannya, dan juga penambahan program yang memberi manfaat lebih untuk penggunanya, baik dari segi benefit maupun tarifnya yang dinilai cukup ekonomis. Namun, penulis belum bisa mengatakan pelayanan dan akuntablitas BPJS yang telah diberikan berjalan sempurna sebagaimana mestinya, karena penulis masih menemukan ketidaksesuian didalamnya Kata Kunci: Kecelakaan Tenaga Kerja Harian Lepas , BPJS

Walaupun tidak ada pengaduanpenuntutan hanya ada laporan atau informasi tentang adanyaTindak penyalahgunaan Narkotika, maka penegak hukum melihatadanya Tindak semacam ini tetap akan memproses sesuai denganhukum yang berlaku. Abstract

ABSTRACT Darma Dwi Apriana Saputri, NPM: 13.11.1001.1011.204, “Perlindungan Masyarakat Hukum Adat Kutai Terhadap Hak Ulayat Di Kutai Kartanegara (Tinjauan Hukum Perda Provinsi Kalimantan Timur Nomor 1 Tahun 2015)”. (Dibimbing oleh Kunti Widayati, SH., MH dan Isnawati, SH., MH).Penelitian ini dilakukan untuk menentukan tentang perlingungan masyarakat Hukum Adat Kutai terhadap Hak Ulayat di Kutai Kartanegara di tinjau dari Hukum Perda Provinsi Kalimantan Timur No. 1 Tahun 2015. Dalam pengumpulan data, penulis menggunakan metode Normatif/Pendekatan yang disesuaikan dengan masalah penelitian tersebut diatas dan juga didapat dari berbagai sumber literatur dari bahan pustaka dengan memeriksa bahan di perpustakaan. Dan data dianalisis dengan menggunakan deskriftif-kualitatif yang bertujuan untuk menggambarkan secara lengkap ciri-ciri dari suatu keadaan dilapangan, yang memberikan gambaran yang sangat jelas tentang perlingungan masyarakat Hukum Adat Kutai terhadap Hak Ulayat di Kutai Kartanegara.Hasil penelitian menunjukkan bahwa berdasarkan Perda Provinsi Kalimantan Timur Nomor 1 Tahun 2015, Undang-Undang Dasar 1945 telah menegaskan keberadaan masyarakat adat. Pengakuan atas eksistensi ini perlu dilengkapi dengan pengakuan dan perlindungan atas hak-hak yang menyertai keberadaan masyarakat adat yang harus sesuai dengan isi yang tercantum di dalam Konstitusi Negara yang mengakui keberadaan masyarakat hukum adat, yaitu di dalam Pasal 18B Undang-Undang Dasar 1945 yang menyatakan bahwa Negara mengakui dan menghormati kesatuan-kesatuan masyarakat hukum adat beserta hak-hak tradisionalnya sepanjang masih hidup dan sesuai dengan perkembangan bangsa, masyarakat dan prinsip-prinsip Negara Kesatuan Republik Indonesia yang diatur dalan Undang-Undang. Penghormatan dan pengakuan terhadap eksistensi hak ulayat sebagai hak asasi manusia secara implicit juga diatur dalam Pasal 28I ayat (3) Undang-Undang Dasar 1945 (hasil perubahan ke dua UUD 1945 yang ditetapkan pada tanggal 18 Agustus 2000), bahwa identitas budaya dan hak masyarakat tradisional dihormati selaras dengan perkembangan zaman dan peradaban, selanjutnya pada hasil perubahan ke empat UUD 1945, dalam Pasal 32 ayat (1) bahwa Negara memajukan kebudayaan nasional Indonesia di tengah peradaban dunia dengan menjamin kebebasan masyarakat dalam memelihara dan mengembangkan nilai-nilai budayanya dan Negara perlu mengelola kemajuan masyarakat agar menjadi potensi dalam pembangunan, bukan menjadi penyebab konflik.Kata kunci: Masyarakat Hukum Adat, Hak Ulayat, Peraturan Daerah Kaltim
