Abstract

ABSTRAK  Seseorang petugas asuransi jiwa yang berperan sebagai tenaga atau orang yang menawarkan program-program dari perusahaan asuransi jiwa harus dapat memberikan gambaran dari rencana program-program yang ditawarkan tersebut secara jelas dan meyakinkan. Namun petugas yang dimaksud di atas oleh perusahaan asuransi jiwa ditunjuk tersendiri dan biasanya petugas yang demikian itu disebut Petugas Dinas Luar. Dan petugas yang dimaksudkan seperti tersebut di atas itu adalah petugas yang berstatus pegawai tetap serta wakil dari perusahaan yang diberi kepercayaan dari perusahaan untuk memasarkan program-programnya.Antara penanggung atau perusahaan asuransi dan tertanggung yang telah membuat perjanjian asuransi jiwa dan telah disepakati oleh kedua belah pihak itu, maka terjadi hubungan hukum. Dari hubungan hukum itu, maka menimbulkan hak dan kewajiban bagi para pihak dalam perjanjian asuransi jiwa.Tertanggung atau penerima manfaat atau ahli warisnya yang tidak dapat meneruskan kontraknya dan meminta pembayaran premi yang sudah terlunasi, maka perusahaan asuransi akan mengembalikan uang premi yang sudah diperhitungkan atau menurut perhitungan dari perusahaan asuransi jiwa yang merupakan bagian dari kewajibannya. Dan sisanya adalah nilai tebus yang harus dikembalikan, karena memang merupakan hak pemegang polis. Jika sampai berakhirnya masa kontrak asuransi tidak terjadi evenement, maka dilaksanakan expiratie atau pengakhiran kontrak yang berupa pembayaran secara penuh sebesar nilai kontrak.

Abstract

ABSTRAKTujuan penelitian ini adalah (1) untuk mengetahui perbedaan antara delik penghinaan menurut Kitab Undang-Undang Hukum Pidana (KUHP) dengan penghinaan menurut Undang-Undang Nomor 11 Tahun 2008 tentang perbuatan yang dapat dikualifikasikan sebagai delik penghinaan melalui Informasi dan Transaksi Elektronik dan (2) untuk mengetahui dasar pertimbangan hukum hakim terhadap pelaku tindak pidana pencemaran nama baik melalui media elektronik dalam Perkara Pidana Nomor : 87/Pen.Pid.Sus/2017PN.Smr.Penelitian ini menggunakan penelitian normatif, dengan bahan hukum primer sebagai instrumen dalam menemukan isu hukum delik penghinaan, baik yang terdapat dalam Undang- Undang Nomor 11 Tahun 2008 maupun yang terdapat dalam KUHP. Tekhnik memperoleh bahan hukum selanjutnya dilakukan dengan melakukan penelusuran atau penelitian di lapangan (Field Research) yang diperoleh dengan melakukan wawancara langsung dengan Penasehat Hukum terdakwa di Pengadilan Negeri Samarinda.Hasil penelitian menunjukkan bahwa perbedaan antara delik penghinaan menurut KUHP dengan penghinaan menurut Undang-Undang Nomor 11 Tahun 2008 dapat dibagi dalam tiga kriteria sifat pembeda, yaitu berbeda dalam penggolongan delik penghinaan; berbeda dalam pengaturan ancaman pidananya; dan berbeda pula dalam pemaknaan atas unsur diketahui umum terkait ketentuan penghinaan berdasarkan KUHP dan UU ITE; dan perbuatan yang dapat dikualifikasikan sebagai delik penghinaan berdasarkan Undang-Undang Nomor 11 Tahun 2008 Tentang Informasi dan Transaksi Elektronik, yaitu delik penghinaan yang terdapat dalam Pasal 27 ayat 3 UU ITE sebagai species delicht dari KUHP (genus delicht), sehingga konsekuensi hukumnya penggolongan delik penghinaan yang terdapat dalam KUHP juga diberlakukan berdasarkan Pasal 27 ayat 3 UU ITE.   Kata Kunci : Delik Penghinaan dan Media Elektronik

Abstract

Abstract             In Article 23E paragraph (1) of the Constitution of the Republic of Indonesia Year 1945 states that "In order to examine the management and accountability of state finances held an Audit Board that is free and independent." Based on these provisions can be understood that the Supreme Audit Agency (BPK ) is a state agency that is free and independent in the accountability report on the examination of state financial management by the government. President as head of the government in administering the state holds sway over the country's financial management. Power management of state finances is then delegated to the Minister of Finance, Minister / Head of Institution and Local Government is the Governor, Regent / Mayor. The financial management of the country is used as the overall activities of the country's financial management officer in accordance with the position and authority, including planning, implementation, monitoring and accountability. Obligations of governments and other institutions to implement public finance management must be orderly, obedient to laws and regulations, efficient, economic, effective and transparent with regard fairness and propriety. After the planning and implementation of state finances, the next is the role of the CPC in the process of problem identification, analysis, and evalusai conducted independently, objectively and professionally based standards checking, to assess the validity, accuracy, credibility and reliability of information on the management and financial responsibility of the State , Through Law No. 15 Year 2006 regarding the Audit Board, CPC as the state institutions free and independent in examining the management and financial responsibility the state has an important role. In this case the CPC role in improving accountability and achieving good governance at central and local government. In order to support good governance in state administration, public finance management should be organized in a professional, open and responsible in accordance with the basic rules established in Law Examination, Management and Accountability of State Finance. With that goal the establishment of the state of Indonesia as stipulated in paragraph four of the Constitution of the Republic of Indonesia Year 1945 to realize the welfare state (welfare state) will be reached.

Abstract

ABSTRACT           This study entitled "Immigration Crime Against Abuse Residence Permit For Foreigners Samarinda According to Constitusin No. 6 of 2011 Concerning Immigration”. Core issues that were examined in this study are: first, how the legal action against the abuse of residence permits for foreigners Samarinda according to Constitusion No. 6 of 2011 on Immigration? second, what the Roles and Responsibilities of Class I Immigration Office Samarinda City related to Constitusion No. 6 of 2011 on Immigration? Based on the core of the problem above, the purpose of this study are: first, to know how the legal action against the abuse of residence permits for foreigners in the city of Samarinda, according to Constitusion No. 6 of 2011. Second, to find out what the roles and responsibilities of Class I Immigration Office in Samarinda relating to Constitusion No. 6 of 2011. This study is included normative juridical research, namely by reviewing the related licensing, regulations applicable law, including the norms and principles contained therein. Data was collected through library research and field research. Data analysis is done by juridical qualitative, ie the research results contained in the form of descriptive narrative  From the data can Authors gather the data obtained as follows: Repression deportation against the misuse of permit to live in the city of Samarinda Period In 2015 as many as 15 foreigners, in January - June 2016 the Immigration Office of Samarinda issued at least issued 90 temporary stay permits to foreigners, while foreigners who are deported as a result of misuse of permit to live in the city of Samarinda many as 3 people.          On the basis of these conclusions, the author proposes suggestions: first, Immigration Office Class I Samarinda need to increase human resources (HR) in quantity to form and train civil servant investigators (investigators) in the framework of action strangers .. ABSTRAK Kecantikan merupakan idaman bagi semua wanita, untuk mencapai tujuan yang diinginkan, berapa banyak uang yang dikeluarkan hanya untuk mendapatkan apa yang mereka idam-idamkan. Tetapi berapa banyak wanita yang kurang pengetahuan dan informasi, mereka menggunakan kosmetik mengandung bahan kimia berbahaya agar cepat mendapatkan hasil yang diinginkan, tidak memperdulikan efek samping yang ditimbulkan dikemudian hari.Badan POM RI  melakukan pengawasan kosmetik dengan Sispom tiga lapis  yaitu Pengawasan yang dilakukan oleh Produsen, Pengawasan yang dilakukan oleh konsumen dan Pengawasan yang dilakukan oleh Pemerintah atau Badan POM RI. Kosmetik sebelum beredar dipasaran harus dinotifikasi oleh produsen ke Badan POM RI dengan Kode NA yang berarti Negara yang mendaftarkan produk kosmetik Negara Asia, NB yang berarti Negara yang mendaftarkan produk kosmetik Negara Australia, NC yang berarti Negara yang mendaftarkan produk kosmetik Negara Eropa, ND yang berarti Negara yang mendaftarkan produk kosmetik Negara Afrika, NE yang berarti Negara yang mendaftarkan produk kosmetik Negara Amerika. Kosmetik  mengandung bahan kimia berbahaya banyak beredar karena banyak permintaan dari konsumen atau pemakai, hal inilah yang menyebabkan penjual atau pedagang  dengan berbagai cara mereka harus menjual kosmetik tersebut karena cukup menguntungkan,  perbuatan tersebut melanggar hukum dengan ancaman cukup tinggi yaitu 10 tahun sampai dengan 15 tahun penjara dan denda Rp 1.000.000.000 sampai dengan Rp 1.500.000.000 yang terdapat dalam undang-undang  No. 36 tahun 2009 tentang Kesehatan.Yang menjadi tuntutan bagi konsumen dalam menggunakan kosmetika adalah bermutu, bermanfaat dan aman apabila digunakan dan cepat mendapatkan hasil yang diinginkan.Putusan hakim dalam perkara mengedarkan kosmetik mengandung bahan kimia berbahaya atau tanpa ijin edar tidak membuat efek jera terdakwa atau pelaku, hal ini menjadi tantangan terberat bagi petugas Balai Besar POM di Samarinda.Kurangnya pembinaan dan sosialisasi dari instansi terkait seperti Dinas Kesehatan Kota Samarinda, Kepolisian dan Balai Besar POM di Samarinda tentang efek samping dari penggunaan kosmetik mengandung bahan kimia berbahaya dan menekan atau mengurangi penjualan kosmetik yang dilarang tersebut agar masyarakat terlindungi.Untuk itu diharapkan kepada konsumen atau pemakai agar menggunakan kosmetik yang telah terdaftar atau yang telah ternotifikasi di Badan POM RI .

Abstract

AbstrcakThe thesis entitled Juridical Review of Local Regulations of East Kalimantan Province No. 1/2015 on the Guidelines for Recognition and Protection of Indigenous People’s Community in East Kalimantan Province, is written to answer two following problem formulation: 1) Based on synchronicity of legislation, can this Local Regulation of East Kalimantan Province be taken as juridical basis for recognition and protection of Indigenous People’s Community of East Kalimantan?; 2) Can this local regulation be applied effectively as juridical basis for providing recognition and protection for indigenous people’s community in East Kalimantan?In writing the thesis, the writer conducted a normative juridical review of the Local Regulation of East Kalimantan Province No. 1/2015 on the Guidelines for Recognition and Protection of Indigenous People in East Kalimantan Province by collecting law material in the forms of legislations, local regulations and also theory on indigenous people’s community, on custom law that is relevant in doing study on this local regulation, through library research method.This thesis consists of 4 (four) chapters and it is written in the following systematic composition:Chapter I is the Introduction containing the reasons of selecting the title and background of the writing, limitations of the issues discussed, purpose and object of the writing and expected benefits of the writing and also the research method used.Chapter II contains theoretical framework which covers four main points; Firstly, Indigenous People’s community; Secondly, the Adat Law; Thirdly, the Traditional Rights of Indigenous People over the Land, and; Fourthly, Local Regulations in Theory of Legislation.Chapter III is an analysis of the Local Regulations of East Kalimantan Province itself in the form of juridical review of two matters. First, the writer elaborated synchronicity of the Government Regulation of East Kalimantan Province No. 1/2015 in the configuration of related legislation’s codes of law on that same matter. Second, the writer made a review on the effectiveness of the government regulation as juridical instrument for Recognition and protection of Indigenous People’s community in East Kalimantan.Chapter IV contains the conclusions and recommendations after doing juridical review of the Local Regulation of East Kalimantan Province No. 1/ 2015.Keywords: Recognition and Protection of Indigenous People’s Community in East Kalimantan.

Abstract

ABSTRACTIn meeting the needs of every day people always need others, both in meeting the needs of primary and secondary and tertiary needs. In this modern age, people use the covenant as one form of binding between one party and another, this is done in an attempt to avoid self-disputes. On the other hand, the agreement occurs because both parties do want each other and have a high level of dependence between each other.Pardon actually can be used as a recovering agency to correct "errors" in the implementation of the law. Although there is already a herziening institute that can be used by the convicted person, but clemency that is outside the legal domain and outside of this criminal justice system, can be a president as a means to correct and demonstrate his legal wisdom. In America as a developed country where the level of prudence and control over its law enforcers is very high, the occurrence of errors in the law is still very high as well. Things like this could happen in Indonesia. It is the duty of the President to treat doubts about possible legal weaknesses. So that clemency can reflect the level of wisdom of the President and the society.
