Abstract

ABSTRAK Skrispsi ini membahas bagaimana efektifitas pengaturan investasi usaha jasa pertambangan batubara menurut Undang-Undang Nomor 4 Tahun 2009 Tentang Pertambangan Mineral dan Batubara (UU Minerba). Selain itu, menbahas mengenai akibat hukum dari kewajibanpemegang IUP atau IUPK untuk menggunakan perusahaan jasa pertambangan lokal/atau nasional. Serta akibat hukum dari kewajiban pemegang IUP atau IUPK untuk melaksanakan sendiri kegiatan penambangan dan pengolahan pemurnian. Metode yang dipergunakan dalam penelitian ini adalah normatif-empiris. Hasil penelitian menunjukkan bahwa kegiatan usaha jasa pertambangan batubara dilaksanakan berdasarkan pasal 124 UU Minerba yaitu dengan  mewajibkan pemegang IUP atau IUPK mengutamakan menggunakan perusahaan jasa pertambangan lokal dan/atau nasional, serta mewajibkan pemegang IUP dan IUPK melaksanakankegiatan penambangan, pengolahan dan pemurnian sendiri. Akibat hukum dari ketentuan pemegang IUP atau IUPK mengutamakan menggunakan perusahaan jasa lokal dan/nasional menyebabkan perbedaan perlakuan terhadap perusahaan jasa pertambangan lokal dan perusahaan jasa pertambangan asing, dan hal ini melanggar prinsip national treatment yang diakui dalam perjanjian perdagangan internasional. Adapun akibat hukum kewajiban pemegang IUP atau IUPK melaksankan kegiatan penambangan, pengolahan dan pemurnian sendiri menyebabkan pemegang IUP atau IUPK wajib mengakhiri atau tidak memperpanjang perjanjian kerjasama dengan perusahaan jasa pertambangan dan hal ini berpotensi menimbulkan gugatan hukum. Hasil penelitian ini secara umum menyarankan agar kegiatan usaha jasa pertambangan yang dilakukan oleh perusahaan jasa pertambangan didukung dengan regulasi yang lebih jelas tentang pengaturan perusahaan jasa pertambangan asing. Kata Kunci : Pertambangan Batubara, Investasi, Pemegang IUP atau IUPK dan Perusahaan Jasa Pertambangan Batubara.

Abstract

ABSTRACTBoth parties must be acting in good faith in implementing the agreement. There are times when good faith has been fully carried out and considered, but the implementation of the agreement is still in a deadlock (deadlock). This is where the attention is required towards compliance so that an event can be resolved satisfactorily. Of course, as with any item something that contains award (waardering), compliance is unlikely to result in a settlement of events that satisfy every man, but always is not absolute (relatief), which is worth in the thoughts and feelings of people who are in charge of completing a events, such as the judge or government agency after watching all the factors, which can be used in the minds and the natural feelings of the people that. Occurred close relationship between the doctrine of good faith in the implementation of the agreement and the theory of confidence at the time of the agreement. The good faith (Article 1338 paragraph 3) and propriety (Article 1339) is generally mentioned in the same breath, if the judge after examining the propriety of an agreement can not be implemented then the treaty would be contrary to public order and decency. Agreement is not only determined by the parties in the formulation of the agreement, but also determined by the good faith and decency, so in good faith and decency were also determines the content of the agreement. Thus a particular treaty agreement borrowing money if implemented not in good faith (in bad faith) such agreement is contrary to public order and morality and legal norms in force.

Abstract

ABSTRACTCyberbullying crimes happens because the rise of the Internet users, especially social networking users (Facebook, Twitter, and other) without some basic knowledge of ethics in the use of Internet technology.The formulation of the problem are why cyberbullying is a crime and how to manage cyberbullying crimes on law number 11 of 2008 on Information and Electronic Transactions.The research found that cyberbullying has any impact that can not be underestimated, cyberbullying that happen continuously can lead to prolonged depression that would eventually lead to the victim wishes to undertake extreme measures, like to end their lives by suicide. Cyberbullying crimes in Indonesia has legal provisions and sanctions has been regulated in Law Number 11 of 2008 on Information and Electronic Transactions.Based on the matter is expected that Internet users especially social networking users can more prudence in using internet technology, so the crime of cyberbullying can be avoided. Key words: Cyberbullying , Cybercrime

Abstract

AbstractIn the development of the world, with the formation of a state is necessary law for the security of its citizens. The law regulates the entire device of the people's devices in the country. There are written laws, such as the 1945 Constitution, the Criminal Code Law, jurisprudence, treaties and so forth, made by the Executive Body together with representatives in the DPR, and there are also unwritten laws such as: customary law, law customs, etc., made by people empowered by the people, such as community leaders and recognized by the people and upheld by law enforcement.The entrepreneurs providing sea transport services, in this case play an important role to promote domestic trade because it helps facilitate the flow of freight in the form of goods and passengers (people) from one area to another. To manage it is not only required to operate the ship as a tool to provide sea freight services, it is also necessary knowledge of domestic trade, organization, administration, sound management, engineering, nautics, marine law, etc. and knowledge of the stockpiling procedures or compaction of the cargo in the space of each hatch of the ship in such a way that the maximum capacity of the vessel (full) and the capacity or carrying capacity of the vessel (down) or in other words is achieved full and down.

Abstract

ABSTRACT The press has an important role in people's lives. Because the Press disseminates information, news, ideas, thoughts or feelings to a person or group of people to others. The influence of the Press itself produces a positive and negative impact therefore the press has a social responsibility for what is delivered.The research technique that I use is the Normative Juridical Research. This research is conducted by reading, quoting and making important notes that have relevance to the writing of this thesis. Juridical legal research means research that refers to the existing literature study or to the secondary data used. While Normative means legal research aimed at acquiring Normative knowledge about the relationship between one rule with other rules and application in practice.The conclusion that, first in the Act No. 40 of 1999 on the Press has been running in accordance with applicable provisions. But in its application is still found irresponsible elements. Secondly, the legal consequences arising out of the Press that are not conducive to Law No. 40/1999 are contained in Article 137, Article 154, Article 155 of the Indonesian Criminal Code which sufficiently provides a deterrent effect against persons who misuse their profession as informers Keywords: Press, Information, News

Abstract

ABSTRAKBank telah dijadikan sarana utama untuk menyimpan hartakekayaan yang berasal dari tindak pidana, dikarenakan sektor ini yangbanyak menawarkan jasa-jasa dan instrumen dalam lalu lintaskeuangan, yang akan digunakan untuk menyembunyikan asal usulsuatu dana. Upaya untuk menyembunyikan atau menyamarkan asalusul harta kekayaan yang diperoleh dari tindak pidana inilah yangdikenal sebagai pencucian uang (money laundering) atau dalambeberapa literatur dikenal dengan pemutihan uang dan uang yangdiperoleh dari tindak pidana sering disebut uang kotor (dirty money)atau hot money.

Abstract

ABSTRACT  That the validity of the sale and purchase that has been declared by the Panel of Judges by taking the example in civil case No. 30 / Pdt.G / 2002 / PN.Smda still premateur. But it has come true in a verdict. Therefore, the party should be defeated or dissatisfied with the verdict, exercising its right to take legal remedy ie the appeal during the court decision has not had permanent legal force (Inkracht Van Gewisjde), after 14 (fourteen) days of the verdict is notified. However, if it has lapsed 14 (fourteen) days after the award is given to the defeated party but not exercised its right, the court decision shall be deemed to have permanent legal force (Inkracht Van Gewisjde). That the legal force of the sale and purchase agreement regardless of the principle of freedom of contract as stated in article 1338 Civil Code can not be said to have the power of law. But it has become a reality, the legal power of the sale and purchase agreement as in this case to be said the legal power of the sale and purchase agreement depends on the validity that has been decided by the court. As to the fact as has been decided by the court that it was a sale and purchase agreement has been strengthened and declared legally valid. Therefore, inevitably the sale and purchase agreement between Defendant I and Defendant II was canceled.

Abstract

ABSTRACTUsed clothing is now a product that is often sought by various circles masyarakat.Mereka who choose these items have a variety of reasons that vary, there are assuming that imported goods have a better quality, some also want to have it because the price of these items more affordable. Then, what's so great about that used clothes? Why is it reaching into society regardless of age? And if there is danger of the used clothes, we all know that our domestic products are difficult to compete with foreign products, especially coupled with the government's policy of free trade with China and ASEAN in 2015, of course our products will be increasingly lost only in terms of quality , creativity, innovation, up to the price. Not only new items imported but used goods imported including clothing. According to data from the Ministry of Industry of the Republic of Indonesia in the 1st quarter of 2013 there are about 112 containers containing used clothing and all, the goods do not have the complete illegal aliases, which come from all Indonesian ports, mostly through port in Pekanbaru Riau we know Kemenperin banned from imported used clothes since 2003 ago. Import and Export activities are not separated by the laws and regulations. Since the beginning of export and import activities have been regulated in the legislation until now there are still applicable to those that have not been valid or have changed. In order to realize the rules of legislation based on Pancasila and the 1945 Constitution, which contained the principles of justice, upholds the right of every member of society, and places Customs Obligations as state obligations reflecting the participation of community members in collecting funds through payment of import duty , then came the Law Number 10 Year 1995 About Customs. Law Number 17 Year 2006 regarding Amendment to Law Number 10 Year 1995 regarding Customs. Law No. 17 of 2006 does not alter the full content of the previous law, but there are several Articles that have been deleted and added to the content of the law. In addition to the emergence of Law Number 10 Year 1995, there are also derivatives of this legislation, namely the Decree of the Minister of Industry and Trade No. 230 / MPP / Kep / 7/1997 on goods subject to import trade regulation. This regulation appears as an explanation of the contents of Law Number 10 of 1995. This minister's decision to impose restrictions on imported goods that may enter the territory of the Republic of Indonesia. Abstract

ABSTRACT In the system of Election in Indonesia, one could choose if already registered in the voters list (DPT), because it concerns the right to choose a person to make choices and express their aspirations in general elections. The purpose of the study is to examine the implementation of the legislation, especially the General Elections Commission Regulation No. 4 of 2015 on voter data collection process and any obstacles encountered in the field to ensure the eligibility of voters. The method used normative juridical-empirical collection of primary data obtained directly from field research and interviews with sources in related institutions, namely the Commission of Samarinda, while secondary data from the library research.PKPU No. 4 of 2015 on implementation as guidelines for updating the voters have been effective for the accuracy of data being generated, the problems that arise in the process Determination of the voters list have also been followed up by the Commission Samarinda, and during the administration of elections and local elections since 2004 have never been there the voting public who take legal actions related concerned are not enrolled in DPT. KPU Kota Samarinda and its staff should improve further the performance and coordination so that the results of updating voters' data in the future to be better and the accuracy of the resulting data becomes more valid, the community must participate oversee and supervise the process of updating the voter data to produce accurate data and valid. Keywords        :   Implementation, Regulation Election Commission, voters list, the General Election Commission

Abstract

ABSTRAKDaerah kawasan sempadan sungai adalah kawasan sepanjang kiri kanan sungai, termasuk sungai buatan/kanal/saluran irigasi primer, yang mempunyai manfaat penting untuk mempertahankan kelestarian fungsi sungai. Zonasi daerah kawasan sempadan sungai khusunya Sungai Mahakam Samarinda mengacu dalam Peraturan Daerah Nomor 2 Tahun 2014 Pasal 34 ayat (2) butir (a) yakni 15 meter dari kaki tanggul sungai. Sebelum melakukan pembangunan apapun khusunya bangunan yang berada di pesisir sungai harus memperhatikan ketentuan-ketentuan yang ada salah satunya adalah ketentuan batas zonasi sempadan sungai. Selain ketentuan zonasi sempadan sungai ada beberapa hal lain yang harus diperhatikan yakni hal yang boleh dan hal-hal yang tidak boleh dilakukan berdasarkan ketentuan ITBX untuk zona perlindungan setempat dan sub zona sempadan sungai yang bersumber dari Rencana Detail Tata Ruang (RDTR) dan Peraturan Zonasi Kecamatan Sungai Kunjang Kota Samarinda.Tujuan dilakukannya penelitian ini adalah untuk mengetahui sejauh mana batas-batas zonasi Sungai Mahakam berdasarkan Peraturan Daerah Nomor 2 Tahun 2014, untuk mengetahui apakah pemberian izin terhadap pembangunan Big Mall Samarinda telah sesuai dengan Peraturan Daerah Nomor 2 Tahun 2014, dan untuk mengetahui sanksi-sanksi terhadap pelanggaran yang terjadi berdasarkan Peraturan Daerah Nomor 2 Tahun 2014.Hasil penelitian penulis berdasarkan kondisi real yang ada, maka pada penulisan skripsi ini pembangunan Big Mall Samarinda yang terletak di Jalan Untung Suropati, Sungai Kunjang Samarinda sangat dekat dengan daerah kawasan sempadan sungai dan ternyata tidak memenuhi ketentuan yang ada yakni kurang dari 15 meter sehingga hal tersebut adanya pelanggaran secara teknis yakni melanggar jarak zonasi sempadan sungai berdasarkan Peraturan Daerah Nomor 2 Tahun 2014 dari pihak Big Mall Samarinda.Kata Kunci: Zonasi Kawasan Sempadan Sungai.
