Abstract

The Covid-19 pandemic has entered its 2nd year. This epidemic hit all aspects of people's lives, from the aspects of health, education, tourism, economy, social, culture, politics to 'changing' civilization. Various ways have been taken by various parties to be able to remain healthy and still be able to "live" in the midst of a pandemic that no one can be sure of when it will end. “Jogo tonggo” is one of the local wisdom-based programs launched by the Governor of Central Java, Ganjar Pranowo, which is predicted to be able to overcome various sectors, especially the economy, health and social sectors. This local wisdom of jogo tonggo has proven to be effective in helping food security, accelerating the rate of information regarding the handling and education of Covid-19, triggering human moral awareness to comply with regulations and create solidarity to protect each other and meet the needs of neighbors so as to increase the immunity of Covid-19 sufferers (OTG) and their families until the cure rate for Covid-19 patients can increase.Keywords: Jogo Tonggo; Effectiveness; Local Wisdom; Covid 19 AbstrakPandemi Covid-19 sudah memasuki awal tahun ke-2. Wabah ini memukul seluruh sendi kehidupan masyarakat, mulai segi kesehatan, pendidikan, pariwisata, ekonomi, sosial, budaya, politik sampai ‘mengubah’ peradaban. Berbagai cara ditempuh oleh berbagai pihak untuk bisa tetap eksis sehat dan tetap bisa ‘hidup’ ditengah pandemi yang tidak ada yang bisa pastikan kapan berakhir. ‘Jogo tonggo’ adalah salah satu program berbasis kearifan lokal yang dicanangkan oleh Gubernur Jawa Tengah, Ganjar Pranowo yang digadang-gadang mampu mengatasi berbagai sektor terutama ekonomi, kesehatan dan sosial. Kearifan lokal jogo tonggo ini terbukti efektif membantu ketahanan pangan, percepat laju informasi mengenai penanganan dan edukasi mengenai covid-19, memicu kesadaran moral kemanusiaan untuk taati peraturan serta timbulkan solidaritas saling menjaga dan pemenuhan kebutuhan tetangga hingga bisa meningkatkan imunitas penderita Covid-19 (maupun OTG) dan keluarganya hingga tingkat kesembuhan pasien Covid-19 bisa meningkat.Kata Kunci: Jogo Tonggo; Efektifitas; Kearifan Lokal; Covid 19

Abstract

Alquran contains the order for deliberation, but it does not clearly explain the deliberation system. This article investigates several hadiths concerning al-Shura, the Prophet's deliberation practices, the issues discussed, and who to consult. The normative approach is used in this study, with a focus on the concept of Al-Shura and comparative democracy. The purpose of this article is to compare Islamic discourse and the concept of deliberation with Western-style democracy. Deliberation is one of the values of constitutional political ethics in the life of an Islamic state, according to this article. Similarly, there is a significant distinction between Western-style democracy and delusional democracy.Keywords: Law; Democracy; Al-Shura Abstrak:Perintah musyawarah terdapat dalam Alquran, namun tidak menjelaskan sistem bermusyawarah secara jelas. Artikel ini mengupas  beberapa hadits yang berhubungan dengan al-Syura, praktek-praktek musyawarah Rasulullah Saw, persoalan-persoalan yang dimusyawarahkan serta dengan siapa bermusyawarah. Penelitian ini menggunakan pendekatan normatif dengan fokus pembahasan pada analisa konsep Al-Syura dan demokrasi secara komparatif. Artikel ini bertujuan untuk membandingkan wacana dan konsep musyawarah dalam Islam dan demokrasi ala barat. Artikel ini menemukan bahwa musyawarah merupakan salah satu nilai etika politik yang konstitusional dalam kehidupan negara Islam. Demikian pula terdapat perbedaan yang cukup signifikan antara demokrasi ala Barat dengan musyawarah dalam Islam.Kata kunci: Hukum; Demokrasi; Al-Syura

Abstract

One of the cultural results in people's life that is thick with cultural heritage is the traditional house. Houses in general have a function as a place of shelter, rest and activity. The house, as a place where a group of people has lived for a long time, has undergone various changes. The changes that occur are seen in the form, meaning, function and value of the house. The traditional houses of the people in East Nusa Tenggara are diverse in form and function and are integrated into social life. One of them is a traditional house which is also called a sacred house as a form of community culture in North Central Timor Regency. This study aims to identify and describe the perspective of the Amaf tribe in Sonaf Maubesi, Insana District towards the existence of Uem Le'u and the role of Uem L'eu in various aspects of the life of the Amaf tribe in Sonaf Maubesi, Insana District. This study uses a qualitative approach that is descriptive. The type of data needed in this study is primary data and secondary data and the instruments used to obtain data in this study are the researchers themselves because researchers are the primary data collection tools. Data collection techniques used were interview techniques, questionnaires and documentation. While the data analysis technique used in this study is a qualitative descriptive analysis technique. This technique will be developed by means of Interpretative Versthehen, meaning that all the data obtained are grouped based on themes or categories and then analyzed partially. From the research carried out, the results of this study show that the Amaf tribe in Sonaf Maubesi, Insana TTU sub-district still has a sacred perspective, which is full of meanings and customs and beliefs in the existence of Uem Le'u. In the aspect of religion or belief, the people of the Amaf tribe today still believe that Uem Le'u is the place where God is believed to reside and the dwelling place of the ancestors who inhabited heaven or the final resting place. Meanwhile, in the social aspect, Uem Le'u is still a gathering place for the Amaf people from various groups or strata of society to carry out a traditional ceremony related to the beliefs of the local community.Keywords: Culture; Custom home Abstrak:Salah satu hasil kebudayaan dalam kehidupan masyarakat yang kental akan pewarisan budaya yaitu rumah adat. Rumah pada umumnya memiliki fungsi sebagai tempat berteduh, beristrahat dan beraktifitas. Rumah sebagai tempat yang ditinggali sekolompok manusia dalam jangka waktu yang lama, telah mengalami berbagai perubahan. Perubahan yang terjadi dilihat pada bentuk, makna, fungsi serta nilai dari rumah tersebut. Rumah adat masyarakat di Nusa Tenggara Timur memiliki keberagaman dalam bentuk dan fungsi serta menyatu dalam kehidupan bermasyarakat. Salah satunya adalah rumah adat yang juga disebut rumah keramat sebagai wujud budaya masyarakat di Kabupaten Timor Tengah Utara. Penelitian ini bertujuan untuk mengidentifikasi dan mendeskripsikan tentang Perspektif suku Amafdi Sonaf Maubesi Kecamatan Insana terhadap eksistensi Uem Le’u dan Peran Uem L’eu dalam berbagai aspek kehidupan masyarakat suku Amaf di Sonaf Maubesi Kecamatan Insana. Penelitian ini menggunakan pendekatan kualitatif yang bersifat deskriptif. Jenis data yang dibutuhkan dalam penelitian ini yaitu data primer dan data sekunder serta instrumen yang dipakai untuk mendapatkan data dalam penelitian ini adalah peneliti sendiri karena peneliti merupakan alat pengumpul data utama. Teknik pengumpulan data yang digunakan adalah teknik wawancara, angket dan dokumentasi. Sedangkan teknik analisis data yang digunakan dalam penelitian ini adalah teknik analisis deskriptif kualitatif. Teknik ini akan dikembangkan dengan cara verstheheninterpretative artinya semua data yang diperoleh dikelompokkan berdasarkan tema atau kategori kemudian dianalisis secara parsial. Dari penelitian yang dilaksanakan maka hasil penelitian ini yaitu masyarakat suku Amaf di Sonaf Maubesi Kecamatan Insana TTU masih memiliki perspektif yang sakral, yang sarat akan makna dan adat istiadat serta kepercayaan terhadap eksistensi Uem Le’u. Dalam aspek agama atau kepercayaan, masyarakat suku Amaf pada saat ini masih percaya bahwa Uem Le’u merupakan tempat bersemayamnya Tuhan yang dipercayai dan tempat tinggalnya para leluhur yang mendiami surga atau tempat peristirahatan terakhir. Sedangkan pada aspek sosial Uem Le’u masih merupakan tempat berkumpulnya masyarakat suku Amaf dari berbagai golongan atau strata masyarakat guna melaksanakan suatu upacara adat yang berkaitan dengan kepercayaan masyarakat setempat.Kata Kunci: Kebudayaan; Rumah Adat

Abstract

AbstractThe right to privacy is a personal right of every individual which must be protected by the state in accordance with the mandate of the constitution. Along with the development of information and communication technology, the discourse regarding the right to privacy has come under the spotlight again given the high intensity of personal data utilization, especially by corporations in the digital business era. This research will further analyze the use of consumer personal data by corporations from a legal perspective. The research method used is library research through a statute approach. The results of this study indicate that there is still obesity in regulations related to personal data protection in Indonesia, where the total reaches 30 regulations in various sectors. Moreover, this reality is exacerbated by the inadequacy of the Ministry of Communication and Information Technology (Kominfo) in conducting surveillance and investigations related to personal data protection. The result of all of this is the creation of legal loopholes that are often exploited to carry out crimes in the form of hacking and theft of personal data that harm consumers and the wider community. Therefore, there is a need for legal reform accompanied by a reconception of supervisory agencies regarding the protection of personal data as an integral part of upholding privacy rights in an era of constitutional disruption. Keywords: Personal Data Protection, Privacy Rights, Corporation, Constitution. AbstrakHak privasi merupakan hak pribadi setiap individu yang wajib dilindungi oleh negara sesuai dengan amanat konstitusi. Seiring dengan perkembangan teknologi informasi dan komunikasi, diskursus perihal hak privasi kembali mendapat sorotan mengingat tingginya intensitas pemanfaatan data pribadi, terutama oleh korporasi di era bisnis digital. Penelitian kali ini akan menganalisa lebih jauh terkait penggunaan data pribadi konsumen oleh korporasi dari perspektif hukumnya. Adapun metode penelitian yang digunakan adalah penelitian kepustakaan melalui pendekatan perundang-undangan (statute approach). Hasil dari penelitian ini menunjukkan bahwa masih terjadinya obesitas regulasi terkait perlindungan data pribadi Di Indonesia, dimana totalnya mencapai 30 Undang-Undang di berbagai sektor. Terlebih, realita tersebut semakin diperburuk dengan tidak optimalnya Kementrian Komunikasi dan Informatika (Kominfo) dalam melakukan pengawasan dan investigasi terkait perlindungan data pribadi. Akibat dari semua itu ialah terciptanya celah hukum yang kerap kali dieksploitasi untuk melancarkan kejahatan berupa peretasan dan pencurian data pribadi yang merugikan konsumen serta masyarakat dalam cakupan yang lebih luas. Oleh karena itu, diperlukannya reformasi hukum yang diiringi dengan rekonsepsi lembaga pengawas terkait perlindungan data pribadi sebagai bagian integral dari penegakan hak privasi di era disrupsi berdasarkan konstitusi. Kata kunci: Perlindungan Data Pribadi, Hak Privasi, Korporasi, Konstitusi.

Abstract

This study provides an overview of strengthening the merger of state-owned sharia banks, namely BNI Syariah, BSM, BRI Syariah which merged into Bank Syariah Indonesia (BSI). The purpose of the study was to determine the legal arrangements for strengthening the merger of Islamic banks to become BSI and its impact on the stability of state finances during the COVID-19 pandemic. The research method used in this study uses normative research with a statutory approach and a conceptual approach. Primary sources of law use legal regulations related to mergers of banking institutions and secondary sources of law from several kinds of literature such as journals and books relating to the issues being discussed. Meanwhile, legal material analysis techniques are used descriptively. The result of the research is the strengthening of the merger of BUMN Islamic banks starting with the existence of an agreement that is outlined in the written form of an Islamic commercial bank merger agreement as regulated in several applicable legal regulations. The merger of Islamic commercial banks during a pandemic is the right step to maintain the country’s economic stability, as stated in Perpu No.1 / 2020 and POJK No.18 / POJK.03 / 2020. The impact of the merger of Islamic commercial banks, of course, has a positive impact, Indonesian Islamic banks can compete globally by prioritizing more complete services, wider coverage, and better capitalization. For the state, it is certainly a good thing that can be done by the Ministry of BUMN, by initiating the merger of 3 sharia-based state-owned subsidiaries (BNI Syariah, BSM, BRI Syariah) merging into PT. Abstract

Islamic work ethic and Islamic responsibility towards social and personal is a necessity. This responsibility is a form of statement about interpersonal and social care for the company. One of the areas studied is Islamic banking in Indonesia. The method used is through a quantitative approach through the analysis tool E Views. From the research results, it is found that so far the work ethic of Bank Syaraih employees is good and has positive values and Islamic social responsibility of Islamic Banks on financial performance does not show significant results because the test is carried out in a parsian manner, but if it is carried out simultaneously with Islamic Corporate Governance (ICG). , then the results will be significant.Keyword: Islamic work Ethic (IWE), Islamic Corporate Social Responsibility (ICSR) AbstrakEtos kerja dan Tanggung jawab Islam terhadap sosial dan personal adalah suatu keniscayaan. Abstract

A solid and responsible execution of construction management is referred to as good governance. Understanding the ideals behind good government is the secret to understanding it. A calculation of a government's success can be obtained by starting with the ideals in the philosophy of governance. As we enter the age of globalization and the introduction of regional sovereignty, the government's roles and obligations grow in tandem with the community's growing demand for fast, convenient, cheap, and decent services. The public wants the government to pay serious resources to fighting graft, collusion, and nepotism (KKN) in order to build a prosperous future. In this paper, a descriptive qualitative methodology is used with the aim of making it easier for writers to describe, analyze, and understand about Good Governance and Leadership.Keywords: Good Governance, Leadership, Governance  AbstrakDalam konsep governance, pemerintah hanya menjadi salah satu actor dan tidak selalu menjadi aktor yang menentukan. Good Governance adalah suatu peyelegaraan manajemen pembangunan yang solid dan bertanggung jawab. Kunci utama memahami good governance adalah pemahaman atas prinsip-prinsip di dalamnya. Bertolak dari prinsip-prinsip dalam konsep governance akan didapatkan tolak ukur kinerja suatu pemerintahan. Memasuki era globalisasi dan pelaksanaan otonomi daerah, tugas dan tanggung jawab pemerintah kian meningkat sesuai dengan menguatnya tuntutan masyarakat untuk memberikan pelayanan yang cepat, mudah, murah,dan baik. Abstract

This research examines the effect of innovative capability, knowledge management and intellectual capital (intangible assets) on competitive advantage and firm performance (studies on budget accommodation in Semarang). The increasing number of hotels in Semarang city is an intriguing phenomenon; considering the background of the city itself for its lack of fame on its tourism business. However, it does not hinder investors’ intention to keep opening their businesses in the area of accommodation services. The results of the pre-research interview stated that the increasing competition made the occupancy level troubling for the accommodating service entrepreneurs, both budget accommodation and standard and upper-class hotels. This research processed 50 samples consisting of 1 - 3 star hotels, budget hotels (non-star ones) and guesthouses. The data collection method was collected by spreading out questionnaire form to the respondents. Furthermore, the data was processed using analysis tool known as Partial Least Square (PLS). This study concludes that innovative capability, knowledge management, and intellectual capital which are part of the intangible assets of the firm have a positive effect on competitive advantage. Furthermore, competitive advantage also has a positive influence on firm performance. This study provides managerial implications that budget accommodation service entrepreneurs are able to improve their competitive advantage and firm performance through understanding and managing their intangible assets.Keywords: firm performance, competitive advantage, innovative capability, knowledge management, intellectual capital. AbstrakPenelitian ini menguji pengaruh kapabilitas inovatif, manajemen pengetahuan dan modal intelektual (aset tidak berwujud) terhadap keunggulan kompetitif dan kinerja perusahaan (studi tentang akomodasi anggaran di Semarang). Meningkatnya jumlah hotel di kota Semarang merupakan fenomena yang menggelitik; mengingat latar belakang kota itu sendiri karena kurangnya ketenaran pada bisnis pariwisatanya. Namun hal tersebut tidak menghalangi niat investor untuk tetap membuka usahanya di bidang jasa akomodasi. Hasil wawancara pra penelitian menyatakan bahwa persaingan yang semakin ketat membuat tingkat hunian semakin meresahkan pengusaha jasa akomodatif, baik akomodasi budget maupun hotel standar dan kelas atas. Penelitian ini mengolah 50 sampel yang terdiri dari hotel bintang 1 - 3, hotel melati (non bintang) dan losmen. Metode pengumpulan data dilakukan dengan menyebarkan kuesioner kepada responden. Selanjutnya data diolah dengan menggunakan alat analisis yang dikenal dengan Partial Least Square (PLS). Penelitian ini menyimpulkan bahwa kapabilitas inovatif, manajemen pengetahuan, dan modal intelektual yang merupakan bagian dari aset tak berwujud perusahaan berpengaruh positif terhadap keunggulan bersaing. Keunggulan bersaing juga berpengaruh positif terhadap kinerja perusahaan. Studi ini memberikan implikasi manajerial bahwa pengusaha jasa akomodasi anggaran mampu meningkatkan keunggulan kompetitif dan kinerja perusahaan melalui pemahaman dan pengelolaan aset tidak berwujud mereka.Kata Kunci: Kinerja perusahaan; Keunggulan bersaing; Kapabilitas inovatif; Manajemen pengetahuan; Modal intelektual

Abstract

Regulations that become positive state laws, when they are made, cannot be separated from political influence, both from the executive, legislative and social conditions. This factor affects the speed of regulation. This economic interests content includes those in power, owners of capital, or the community's interests. The history of regulation development in the legal politics behind the regulation include leasing and guarantees, starting from buying and selling in the Civil Code, guarantees when lending and borrowing up to the minister of Finance. How is the development of leasing and guarantee law, the laws that govern it and how the rule of law corridors to the regulatory needs of the development of treaties on assets are the focus of discussion in this journal article.Keywords: Leasing; Guarantee Law; Legal Politics AbstrakPeraturan yang menjadi hukum positif negara, saat dibuat  tidak lepas dari pengaruh politik, baik pengaruh pihak eksekutif, legislatif dan kondisi sosial masyarakat. Anasir ini mempengaruhi cepat tidaknya suatu peraturan saat dibuat, muatan kepentingan ekonomi pemegang kekuasaan, pemilik modal ataupun kepentingan masyarakat. Sejarah perkembangan suatu peraturan dari waktu kewaktu, dapat terlihat politik hukum dibalik peraturan tersebut, misalkan ketentuan leasing dan jaminan, berawal dari jual-beli yang ada dalam KUHPerdata, jaminan saat pinjam meminjam sampai dengan Peraturan-peraturan Menteri Keuangan. Bagaimana perkembangan leasing dan hukum jaminan, perundang-undangan yang mengaturnya serta bagaimana koridor negara hukum terhadap kebutuhan peraturan dari perkembangan perjanjian-pejanjian dalam harta kekayaan menjadi fokus pembahasan dalam artikel jurnal ini.Kata Kunci: Leasing; Jaminan; Kebijakan Hukum

Abstract

The commitment of state to expand the market share of sharia bank in Indonesia become reality with the approval of corporate action of merger for 3 state-owned Sharia banks, namely Bank Syariah Mandiri (BSM), Bank Negara Indonesia Syariah (BNIS) and Bank Rakyat Indonesia Syariah (BRIS) by the Financial Services Authority (OJK). The effective date of the merger has become effective starting on February 1, 2021 and is currently becomes Bank Syariah Indonesia (BSI). The merger is an effort for sharia bank to make greater extent in terms of capital, asset, market and image. On the other hand, there are some considerations that must be conducted seriously so that the post-merger phase does not harm all the stakeholders such as parties who have been and will be involved post-merger, status of the employment agreement, cooperation agreement with other parties, and integration of customer data. To analyze this problem, the method used is juridical-normative with conceptual and statute approach. Therefore, the employment agreement must be reviewed between the employer and the employee so that the relationship of labor law is conducted clearly, as well as the review for ongoing cooperation with other parties. In case of data consumer, there must be a guarantee in the process of integrating customer data from 3 banks into 1 bank in the form of big data so that the path to good corporate governance (GCG) for Bank Syariah Indonesia can be achieved measurably. Keywords: Merger, Sharia Bank, and Good Corporate Governance (GCG) AbstrakKomitmen negara memperluas pangsa pasar bank Syariah di Indonesia semakin menjadi kenyataan dengan disetujuinya aksi korporasi berupa merger 3 bank BUMN syariah yaitu Bank Syariah Mandiri, BNI Syariah dan BRI Syariah oleh Otoritas Jasa Keuangan (OJK). Merger telah berlaku efektif mulai tanggal 01 Februari 2021 dan saat ini menjadi Bank Syariah Indonesia (BSI). Merger merupakan ikhtiar untuk membawa bank syariah semakin besar baik dari segi modal, aset, pasar dan image. Namun di sisi lain, terdapat rambu-rambu hukum yang wajib diperhatikan secara serius agar tahap pasca merger tidak merugikan stakeholders yaitu seperti pihak-pihak yang sudah dan akan terlibat dalam operasionalisasi bank, status perjanjian kerja, perjanjian kerjasama dengan pihak lain, dan integrasi data nasabah. Untuk menganalisis masalah ini, metode yang digunakan adalah yuridis-normatif dengan pendekatan konsep (conceptual approach) dan perundang-undangan (statute approach). Oleh karena itu, perjanjian kerja harus ditinjau kembali antara pemberi kerja dan penerima kerja sehingga terciptanya hubungan hukum ketenagakerjaan yang jelas, begitu juga dengan perlunya review perjanjian dengan pihak lain yang sedang berjalan dan akan berjalan serta jaminan pengelolaan dalam fase pengintegrasian data nasabah dari 3 bank menjadi 1 bank dalam sebuah big data. Dengan cara tersebut, jalan menuju good corporate governance (GCG) bagi Bank Syariah Indonesia dapat tercapai dengan terukur. Katakunci: Merger, Bank Syariah dan Tata Kelola Perusahaan Yang Baik
