Abstract

Indonesia has a wide variety of ethnic, so it is very vulnerable to various conflicts such as discriminatory treatment of ethnic minorities. Despite laws prohibiting racial and ethnic discrimination, discriminatory acts still occur in some parts of Indonesia. Discrimination against ethnic minorities is a serious and complex problem and can take many forms, such as unfair treatment, negative stereotypes, exclusion, restrictions on access to resources and opportunities, and acts of violence and persecution that harm ethnic minorities. Some ethnic minorities that often experience discrimination in Indonesia include ethnic Chinese, Papuans, Dayaks, and several other ethnicities. One of the main causes of ethnic discrimination is due to prejudices and stereotypes that develop in society. These stereotypes often lead to the exclusion of ethnic minorities. Ethnic identity plays an important role in shaping perceptions, attitudes, and behaviors of individuals and groups, and can provide valuable insights for the management and handling of issues of ethnic discrimination. This can be the focus of research to identify how the role of ethnic identity can provide a deeper understanding of how ethnic identity can be used as a tool in addressing ethnic minority discrimination. The method in this study is qualitative descriptive with data collection techniques through literature studies such as journals, textbooks, handbooks, notes, and appendices related to the research topic, and the data analysis using content analysis. The results showed that to overcome the problem of ethnic discrimination, collective efforts from various parties are needed. In this regard, the role of media and education is very important to build awareness about diversity and reduce negative stereotypes. It is hoped that with awareness and cooperation from various parties, ethnic discrimination in Indonesia can be reduced and eliminated gradually.Keywords: Identity, Ethnicity, Discrimination, Stereotype, Minority

Abstract

Shariah banking amidst a prolonged economic crisis is the right thing for Indonesians. This is because most Indonesian people are not only Muslims, but the Syariah banking system itself is also siding with the customer (not harmful) and in line with the concept, i.e., justice and cooperation. With their capitalist core, conventional banks are economic institutions that do not guarantee the right solution. Even it tends to drag and plunge the customer into the abyss of poverty. Because usury is applied to make the customer not free to move and expand their business. One of the products in Islamic banking is qardhul hasan which offers no-interest loans. The funding purpose of qardh al-hasan is in line with one mission of BAZIS to eradicate a mustahiq be muzakki. On a large scale, if developed intensively, it could help alleviate poverty in Indonesia. It certainly needs the political will (support) of the government seriously.Keywords: qardh al-hasan, poverty, Islamic banking, fatwa Abstrak:Kehadiran perbankan syariah di tengah krisis ekonomi yang berkepanjangan merupakan hal yang tepat bagi masyarakat Indonesia. Hal ini karena tidak hanya masyarakat Indonesia yang mayoritas beragama Islam, tetapi sistem perbankan Syariah sendiri juga berpihak kepada nasabah (tidak merugikan) dan sejalan dengan konsep yaitu keadilan dan kerjasama. Bank konvensional dengan inti kapitalismenya merupakan lembaga ekonomi yang tidak menjamin solusi yang tepat. Bahkan cenderung menyeret dan menjerumuskan pelanggan ke jurang kemiskinan. Karena praktik riba yang diterapkan membuat nasabah tidak leluasa bergerak dan mengembangkan usahanya. Dengan mengkaji produk perbankan dan fatwa Dewan Syariah Nasional tentang qardh al-hasan yang menawarkan pinjaman tanpa bunga, ditemukan tujuan dari produk tersebut yang sejalan dengan salah satu misi BAZIS untuk meningkatkan mustahiq menjadi muzakki. Dalam skala besar, jika dikembangkan secara intensif dapat membantu mengentaskan kemiskinan di Indonesia. Abstract

The development of Sharia banking is increasing, the progress can be seen in the field of the economic sector where many commerce transactions are done in collaboration with inter-religious communities and even carried out by the cooperation between Muslim and non-Muslim communities. The orientation of marketing is how to package the process to meet consumers' needs and desires as the main target in making marketing successful by analyzing consumer behavior through consumer behavior analysis and how the brand image of Sharia banking products can give preference in deciding to buy the product. This research uses quantitative research methods with variables as Consumer Behavior (X1), Brand Image (X2), and Purchase Decision (Y). The research results are R Square (R2) or the square of the R value, which shows the coefficient of determination. This figure will be converted into a percent meaning that the percentage contribution of the influence of Muslim and Non-Muslim Consumers' Behavior variables on the Sharia Banking Product Purchase Decision variable. The R2 value is 0.836, meaning that the percentage contribution of the influence of the Brand Image of Sharia Banking Products on the Decision to Purchase Sharia Banking Products is 83.6%, while the remainder is influenced by other variables not included in this model. This increase (83.6%) is significant even though it is not as perfect as 100% in terms of impact.Keywords: Consumer Behavior; Brand Image; Purchasing Decisions; Banking AbstrakPerkembangan perbankan Syariah semakin maju,kemajuan bisa dilihat bidang ekonomi yang  banyak perniagaan yang transaksi berkerjasama dengan antar umat beragama bahkan ada kerjasama yang di lakukan oleh masyarakat Muslim dan non muslim. Orientasi dari pemasaran yaitu bagaimana untuk mengemas proses untuk memenuhi kebutuhan dan keinginan konsumen sebagai sasaran utama dalam mensukseskan pemasaran dengan  menganalisis perilaku konsumen   melalui analisis perilaku konsumen dan bagaimana Brand Image produk bank Syariah yang bisa memberikan preferensi dalam memutuskan untuk membeli produk.penelitian ini menggunakan metode penelitian kuantitatif dengan variable perilaku konsumen (X1) dan Brand Image (X2 ) variable Keputusan Pembelian variable (Y). Hasil penelitian R Square (R2) atau kuadrad dari nilai R, yaitu menunjukkan koefisien determinasi.Angka ini akan diubah kebentuk  persen, yang artinya persentase sumbangan pengaruuh variabel Perilaku Konsumen Muslim Dan Non Muslim terhadap variabel Keputusan Pembelian Produk Perbankan Syariah. Nilai R2 sebesar 0,836 artinya persentase sumbangan pengaruh Brand Image Produk Perbankan Syariah terhadap Keputusan Pembelian Produk Perbankan Syariah sebesar 83,6%, sedangkan sisanya diperngaruhi oleh variabel lain yang tidak dimasukkan dalam model ini. Angkat tersebut (83,6%) sudah termasuk signivikan walupun tidak sesempurna 100% dalam titik pengaruh.Kata kunci: Perilaku Konsumen; Brand Image; Keputusan Pembelian; Perbankan

Abstract

Instagram is one of the media used for da’wah. In da'wah there are several elements, including the material or message in the form of aqidah, shari'ah and akhlaq. One of the da'wah accounts that uses instagram is @tehjasmineunpad. This research examines the message of da'wah on the account in increasing the attractiveness of followers. The focus of the research is the da’wah messages contained and the most dominant da’wah messages seen from the interest of followers. This study aims to find out what messages are contained and what messages are the most dominant seen from the interest of followers. This research method uses a qualitative method with observation sheet technique for three juries and in-depth interviews with followers. The sample of this research was 87 posts which were calculated based on the Slovin formula with purposive sampling technique. The results showed that the messages contained in the post were aqidah, shari'ah and akhlaq, with the dominance of the most da'wah messages being akhlaq. The message of da'wah that is in accordance with the interest of followers of @tehjasmineunpad in the results of the interview is also akhlaq. So, the results of this study explain the compatibility between the dominant da'wah messages posted with followers' interest in  messages.Keywords: Da'wah  message, attractiveness, followers, content. AbstrakInstagram merupakan salah satu media yang dimanfaatkan untuk berdakwah. Di dalam dakwah terdapat beberapa unsur, diantaranya materi (pesan) dakwah yang berupa aqidah, syari’ah dan akhlak. Salah satu akun dakwah yang memanfaatkan instagram tersebut adalah @tehjasmineunpad. Jurnal ini mengkaji pesan dakwah pada akun @tehjasmineunpad dalam meningkatkan daya tarik bagi followers. Fokus penelitian ini yaitu pesan dakwah yang terkandung pada akun tersebut dan pesan dakwah yang paling dominan dilihat dari ketertarikan followers. Penelitian ini bertujuan untuk mengetahui pesan apa saja yang terkandung pada akun instagram @tehjasmineunpad dan pesan apa yang paling dominan dilihat dari ketertarikan followers akun tersebut. Metode penelitian ini menggunakan metode kualitatif dengan teknik lembar observasi untuk juri dan wawancara secara mendalam kepada followers akun @tehjasmineunpad. Sampel penelitian ini berjumlah 87 postingan yang dihitung berdasarkan rumus slovin dengan teknik purposive sampling. Hasil penelitian menunjukan bahwa pesan yang terkandung pada postingan akun instagram @tehjasmineunpad adalah aqidah, syari’ah dan akhlak, dengan dominasi pesan dakwah terbanyak adalah akhlak. Adapun pesan dakwah yang sesuai dengan ketertarikan followers akun instagram @tehjasmineunpad pada hasil wawancara adalah akhlak juga. Jadi, hasil penelitian ini menerangkan adanya kesesuaian antara pesan dakwah dominan yang diposting akun instagram @tehjasmineunpad dengan ketertarikan followers terhadap pesan akhlak.Kata Kunci: Pesan dakwah; daya tarik;  followers; konten

Abstract

Ethics is usually closely related to the values and norms that exist in a society. In practice, political ethics demands that all claims to the right to organize association be accounted for on basic moral principles. Therefore political ethics seeks to help society to realize the noble state ideology into objective political reality. This study discusses the Machievelli’s view of political ethics and its comparison with the Islamic theory of political ethics. Previous research focused more on understanding political ethics according to Machievelli only and understanding political ethics according to Islam only. While this research will complement the last gap research, namely comparing the understanding of political ethics according to Machievelli and Islam. The authors used a descriptive method with data collection techniques in journals, articles, and other literature in this study. From the perspective of Machievelli, ethics is often considered secondary or not essential. Political ethics cannot be applied in international politics and prioritizes self-interest rather than moral principles. Realizing self-interest by the state is seen as a right, or a duty considered a realist principle. In contrast, Islam views political ethics as a guide that upholds the values of justice and respects human rights to create sustainable peace under religious norms.Keywords: Political Ethics, Machievelli, Al MawardiAbstrakEtika biasanya berhubungan erat dengan nilai dan norma yang ada dalam suatu masyarakat. Dalam praktiknya, etika politik menuntut agar segala klaim atas hak untuk menata masyarakat dipertanggungjawabkan pada prinsip-prinsip moral dasar. Maka dari itu etika politik berusaha membantu masyarakat untuk mewujudkan ideologi negara yang luhur ke dalam realitas politik yang nyata. Penelitian ini membahas tentang pandangan Machievelli terhadap etika politik dan perbandingannya dengan pandangan Islam terhadap etika politik. Dalam penelitian sebelumnya, penelitian lebih terfokus pada pemahaman etika politik menurut Machievelli saja dan pemahaman etika politik menurut Al Mawardi saja. Sedangkan penelitian ini akan melengkapi Gap penelitian sebelumnya, yaitu membandingkan pemahaman etika politik menurut Machievelli dan Al Mawardi. Dalam penelitian ini, penulis menggunakan metode deskriptif dengan teknik pengumpulan data berupa jurnal- jurnal, artikel-artikel, dan literatur lainnya. Menurut Machievelli, etika adalah hal yang seringkali dianggap sekunder atau tidak pokok. Etika politik tidak dapat diterapkan dalam politik internasional dan mengutamakan kepentingan diri daripada prinsip moral. Mewujudkan kepentingan diri oleh negara dipandang sebagai sebuah hak, atau tugas yang dianggap menjadi prinsip kaum realis. Sementara, Islam memandang bahwa etika politik merupakan prinsip yang menjunjung tinggi nilai-nilai keadilan dan menghormati hak asasi manusia, sehingga tercipta suatu kedamaian yang berkelanjutan dibawah norma-norma agama.Kata Kunci: Etika Politik, Machievelli, Al Mawardi

Abstract

Online gambling is a crime that is contrary to state law, religious law and societal norms. Gambling is a form of game of chance which is an illegal act. As technology develops, online forms of gambling emerge whose scope crosses national borders. The research method used is qualitative research. The approach method in the research used a statutory approach and a conceptual approach. The results of the research state that the provisions relating to online gambling that apply in Indonesia violate religious law, state law and societal norms. Violation of criminal law in online gambling, violating 55 of the Criminal Code, Article 303 bis of the Criminal Code, Article 303 of the Criminal Code, and Article 45 paragraph (2) and 27 paragraph (2) of Law Number 19 of 2016 Amendment to the ITE Law Number 8 of 2011 concerning Information and Electronic Transactions.Keywords: Online gambling; responsibility; perpetrator AbstrakJudi online termasuk tindak Pidana kejahatan yang bertentangan dengan hukum negara, hukum agama, dan norma masyarakat. Seiring perkembangan teknologi maka timbul bentuk perjudian yang dilakukan secara online yang ruang lingkupnya melintasi batas suatu negara. Metode penelitian yang digunakan adalah penelitian kualitatif. Metode pendekatan dalam penelitian digunakan pendekatan perundang-undangan dan pendekatan konseptual. Hasil penelitian menyatakan bahwa ketentuan berkaitan judi online yang berlaku di Indonesia melanggar hukum agama, hukum negara, dan norma masyarakat. Pelanggaran hukum pidana dalam judi online, melanggar 55 KUHP, Pasal 303 bis KUHP, Pasal 303 KUHP, dan Pasal 45 ayat (2)  dan 27 ayat (2) Undang-Undang Nomor 19 Tahun 2016 Perubahan UU ITE  Nomor 8 Tahun 2011 tentang Informasi dan Transaksi Elektronik.Kata kunci: Judi online; pertangnggung jawaban; pelaku

Abstract

Produksi terdiri dari barang dan jasa, kegiatan tersebut meniscayakan pertukaran barang dan/ jasa dengan uang. Dalam syariah jasa dikenal dengan kafalah, ia termasuk pada rumpun akad tabarru’ (tolong-menolong) dan ulama klasik bersepakat bahwa tidak dibolehkan berlaku komersil pada akad jenis ini. Namun seiring berkembangnya kegiatan ekonomi syariah, praktik kafalah bukanlah hal yang dapat terelakkan. Ia menjelma menjadi lembaga keuangan syariah yang berperan penting dalam perkembangan ekonomi syariah. Untuk itu, pada fatwa DSN-MUI nomor 11/DSN-MUI/IV/2000 tentang Kafalah dikatakan bahwa penjamin dapat menerima imbalan (ujrah) sepanjang tidak memberatkan para pihak. Penelitian menggunakan studi litertaur dimana penulis mengumpulkan pendapata para jumhur ulama baik di masa klasik dan masa kontemporer. Kesimpulan pada penelitian ini menunjukkan bahwa pertimbangan pemberian ujrah pada akad Kafalah oleh DSN-MUI bertumpu pada kemasalahatan yang ditimbulkan jauh lebih besar daripada bertindak sebaliknya. Melalui fatwa ini, pemberian ujrah pada kafalah ikut serta menstabilkan (mencegah dan menangani krisis) sistem keuangan nasional.Kata Kunci: DSN-MUI; kafalah; tabarru’; ujrah Abstract:Production consists of goods and services, these activities necessitate the exchange of goods and/services with money. In sharia services known as kafalah, it belongs to the family of tabarru' (mutual help) contracts and classical scholars agree that it is not permissible to apply commercially to this type of contract. However, along with the development of Islamic economic activities, the practice of kafalah is not inevitable. It was transformed into an Islamic financial institution which played an important role in the development of Islamic economics. For this reason, in the DSN-MUI fatwa number 11/DSN-MUI/IV/2000 concerning Kafalah state that the guarantor can receive compensation (ujrah) as long as it won’t be burdensome to the parties. The research uses a literature study where the author collects the opinions of a large number of scholars in both the classical and contemporary times. The conclusion of this study shows that the consideration of giving ujrah in the Kafalah contract by DSN-MUI relies on the problems that arise far greater than acting otherwise. Through this fatwa, giving ujrah to kafalah participates in stabilizing (preventing and dealing with crises) the national financial system. Keywords: DSN-MUI; kafalah; tabarru'; ujrah

Abstract

Decision making by leaders in an organization is quite difficult. Moreover, if the organization is the largest state-owned organization, it is necessary to hold a deliberation to reach a consensus, but whether the deliberation is appropriate or not according to Islamic teachings. The purpose of this research is to find out how the concept of syuro and its implementation by the MPR RI? This study uses a qualitative method. The results of this study state that in the context of siyasa Syar'iyah the concept of Shura is a constitutional principle in Islamic monocracy that must be implemented, and shura is placed as the main principle in solving social, political, and governmental problems. This is to prevent the birth of decisions that are detrimental to the public interest or the people. This shows that the concept of deliberation applied by the MPR is in accordance with the concept of shura formed by Rasulullah in terms of making rules, because making decisions that are public in Islam it must be based on decisions resulting from deliberations for consensus, just like during the MPR RI in designing a statutory regulation, namely the deliberation system.Keywords: Deliberation; MPR RI; Siyasa Sharia  AbstrakPengambilan keputusan oleh pemimpin dalam sebuah organisasi merupakan suatu hal yang cukup sulit. Apalagi kalau organisasi tersebut adalah organisasi terbesar milik negara, maka perlu dilakukan sebuah musyawarah untuk mencapai mufakat, namun apakah musyawarah yang dilakukan ini sudah sesuai atau belum menurut ajaran Islam.  Tujuan penelitian ini adalah untuk mengetahui bagaiman konsep syuro dan implementasinya oleh MPR RI? Penelitian ini menggunakan metode kualitatif. Hasil penelitian ini menyatakan bahwa dalam konteks siyasah Syar’iyah konsep Syura merupakan suatu prinsip konstitusional dalam monokrasi Islam yang wajib dilaksanakan, dan syura diletakkan sebagai prinsip utama dalam menyelesaikan masalah-masalah sosial, politik, dan pemerintahan. Hal ini untuk mencegah lahirnya keputusan yang merugikan kepentingan umum atau rakyat. Hal ini menunjukan bahwa konsep musyawarah yang diterapkan oleh MPR RI, telah sesuai dengan konsep syura yang dibentuk oleh Rasulullah dari segi pembuatan aturan, karena dalam pengambilan keputusan yang bersifat untuk umum dalam Islam haruslah dengan keputusan hasil musyawarah untuk mufakat, sama seperti halnya saat MPR RI dalam merancang sebuah peraturan perundang-undangan yaitu dengan sistem musyawarah.Kata Kunci: Musyawarah; MPR RI; Siyasah Syariah

Abstrak Merek dan Indikasi Geografis salah satu cabang Hak Kekayaan Intelektual diatur dalam Undang-Undang Nomor 20 Tahun 2016 tentang Merek dan Indikasi Geografis. Merek adalah tanda yang dapat ditampilkan secara grafis  berupa gambar, logo, nama, kata, huruf, angka, susunan warna dalam bentu 2 dimensi atau 3 dimensi untuk membedakan barang dan/ atau jasa yang diproduksi oleh orang atau badan hukum dalam kegiatan perdagangan. Merek dibedakan atas merek dagang dan merek jasa.Merek dagang adalah merek digunakan pada kegiatan perdagangan sedangkan merek jasa adalah merek yang digunakan pada jasa dalam kegiatan perdagangan. Syarat merek dagang mendapat perlindungan apabila telah diterbitkan sertifikat merek. Merek dagang ditolak pendaftarannya karena tidak memilik daya pembeda. Permasalahan, apa problematika yang muncul pada merek dagang  dan mengapa pentingnya dilakukan  pendaftaran merek dagang? Metode penelitian yang digunakan, penelitian kepustakaan. Jenis penelitiannya normatif. Pendekatan penelitian, adalah pendekatan konseptual, pendekatan kasus dan pendekatan perundangan. Data hasil penelitian kepustakaan dianalisa secara kualitatif. Hasil penelitian, problematika yang muncul dalam merek dagang adalah terdapat merek yang tidak memiliki daya pembeda, merek terdaftar lebih dahulu menggugat merek yang kemudian, pentingnya pendaftaran merek memiliki daya pembeda agar pendaftaran merek diterima, diterbitkan sertifikat merek, mendapat perlindungan hukum dari pemerintah. Kata kunci: Pendaftaran, Merek Dagang , Daya Pembeda AbstractMarks and Geographical Indications are one of the branches of Intellectual Property Rights regulated in Law Number 20 of 2016 concerning Marks and Geographical Indications. A brand is a sign that can be displayed graphically in the form of images, logos, names, words, letters, numbers, color arrangements in 2-dimensional or 3-dimensional form to differentiate goods and/or services produced by individuals or legal entities in trading activities. Brands are differentiated into trademarks and service marks. Trademarks are brands used in trading activities, while service marks are brands used for services in trading activities. Trademark requirements receive protection if a trademark certificate has been issued. Trademark registration is rejected because it does not have distinguishing power. Problems, what problems arise with trademarks and why is it important to register a trademark? The research method used is library research. The type of research is normative. Research approaches are the context approach, problem approach and regulatory approach. Data from library research were analyzed qualitatively. The results of the research show that the problem that arises in trademarks is that there are brands that do not have distinguishing power, the registered mark first challenges the brand and then the importance of registering a mark has distinctive power so that the mark registration is accepted, a brand certificate is issued, and it receives legal protection from the government. Keywords: Registration, Trademark, Differentiating Powe

Abstract

This study aims to explain and evaluate the performance of the Solok City KPU in the process of compiling the voter list update and to analyze the factors that impede the performance of the Solok City KPU. This research uses qualitative methods and case study methods. The results of the study concluded that the various stages of the Thorok City KPU data updating program agenda were carried out in accordance with the stages and schedules that had been set as well as the rules of the election organizers, but did not optimally analyze the capacity of the election organizers. If left unchecked, the overcapacity of the mandate holders in carrying out their mandated duties will have a negative impact on the quality of the work of the executive branch in the upcoming election. This was later correlated with the obstacles to the performance of Solok City KPU officials when updating the voter lists in the 2019 elections.Keywords: Evaluation; Performance; KPU AbstrakPenelitian ini bertujuan untuk menjelaskan dan mengevaluasi kinerja KPU Kota Solok dalam proses penyusunan pemutakhiran daftar pemilih dan menganalisis faktor-faktor yang menghambat kinerja KPU Kota Solok. Penelitian ini menggunakan metode kualitatif dan metode studi kasus. Hasil kajian menyimpulkan bahwa berbagai tahapan agenda program pemutakhiran data KPU Kota Thorok dilakukan sesuai dengan tahapan dan jadwal yang telah ditetapkan serta aturan penyelenggara pemilu, namun tidak secara maksimal menganalisis kapasitas penyelenggara pemilu. Overkapasitas para pemegang mandat dalam menjalankan tugas yang diamanatkannya, jika dibiarkan akan berdampak negatif terhadap kualitas kerja lembaga eksekutif pada pemilu mendatang. Hal itu kemudian dikorelasikan dengan penghambat kinerja petugas KPU Kota Solok saat pemutakhiran daftar pemilih pada Pemilu 2019.Kata Kunci: Evaluasi; Kinerja; KPU
