Abstract

Waqf is considered to be one of the most important institutions of voluntary sector which exists in the Islamic heritage. Waqf have a dual function; religious and social, which makes it still always exist until today. In performing its role, waqf institutions will face the problems of the management of waqf. Blurring property ownership of institutions of social charity with waqf property, is one of the problems experienced by those waqf institutions. Besides that what needs to be done if the results of the management of waqf property is still lacking to fulfill the rights of mawqūf ‘alayh or oppositely. The other problem is about the right of mawqūf ‘alayh to rent waqf property below the standard prices. This paper aims to describe the problems mentioned above as well as effort to solve the problems in authoritative Islamic perspectives. One of the methode is the implementation of tarjīḥ to the scholars argumentations.

Abstract

Ḥisāb and ru’yat always be warm conversations when there is an early determination of Ramadhan and Shawwal. At that time, there are always two camps of scholars in reacting, the scholars who hold on to ḥisāb (calculating the calendar) on one side, and on the other hand hold to ru’yat al-hilāl (seeing the moon directly). This in turn often leads to time differences in setting the beginning of the month among Muslims. With the aim to unite the people in starting their worship, some scholars try to understand the texts of these traditions about ru’yat al-hilāl by trying to find the 'illat (reason) of the laws of hadiths about ru’yat al-hilāl. Their study of the 'illat law resulted in the conclusion that the ru’yat al-hilāl is only a suitable means for the people that time and may not suitable for Muslims in this modern era. Therefore Muslims must use other wasīlah (means) which further guarantee the realization of the purpose of law, namely modern astro­nomy. The conclusion of the law from the side of the discovery of ‘illat seems to be less suited to the purpose of ta'līl al-aḥkām, is to establish textual texts in addition to discovering the forms of development of the texts.

Abstract

This paper aims to reveal fiqh's review of Intellectual Property Rights (IPR) and their relationship with monopolies that can harm humankind. There are two opinions in contemporary fiqh regarding IPR; first, Ahmad al-Ḥujjī al-Kurdī, which states that IPR as part of worship, should not be hidden and should not be monopolized and exploited by anyone. Second, Muṣṭafā Zarqā, Muḥammad Fatḥī al-Duraynī, Muḥammad Sa'īd Ramaḍān al-Būṭī who agree with the protection of IPR. Through literature study and descriptive analysis approach, this paper concludes that if intellectual property rights cause harm to society and the state, especially in the exploitation of material rights, then it has created a monopoly that is detrimental and prohibited. Every country has different policies to protect IPR when it does not harm the community and the state.

Abstract

Unification of the Islamic calendar was much needed and is a major requirement for Muslims today in the running of worship. Uniformity in to worship and celebrate Islamic holy days is something that has been long awaited. An expectation of the Islamic calendar is determining who has the certainty that a better and more organized for various purposes. However, it is in conflict with a different concept of the new moon from several groups paradigm respectively, both from the perspec tive of science and religion. Hilāl is one of the main sources in the preparation of the I slamic calendar. Currently, the definition of the new moon is very diverse. Which d efinition is used for the initial determination new month of hijriyah, both from the perspective of astronomy or fiqh, or combination of them. Therefore, the article is devoted to the redefinition of the concept of the new moon from the perspective of science and fiqh, that synergy occurs between fiqh and the astronomical new moon to determine new month of Islam. So that the unity of the Islamic calendar can be realized well.***Penyatuan kalender Islam sangat dibutuhkan dan merupakan syarat utama bagi umat Islam saat ini dalam menjalankan ibadah. Keseragama n dalam beribadah dan merayakan hari besar Islam adalah sesuatu yang telah lama ditunggu. Harapan atas kalender Islam adalah sebuah kalender yang memilikikepastian (akurasi) lebih baik dan lebih terorganisir untuk berbagai keperluan. Namun dalam realitas terdapat perbedaan pandangan tentang konsep bulan baru oleh beberapa kelompok, baik dari perspektif ilmu pengetahuan maupun agama. Hilāl adalah salah satu sumber utama dalam penyusunan kalender Islam. Saat ini definisi bulan baru sangat beragam, padahal definisi inilah yang digunakan untuk penentuan awal bulan ba ru Hijriyah, baik dari sudut pandang fikih astronomi atau kombinasi dari mereka. Artikel ini difokuskan untuk mendefinisikan kembali konsep bulan baru dari sudut pandang ilmu pengetahuan (astronomi) dan fikih. Abstract

This article aims to discuss the issues of the relationship between Islam and state in the Islamic political perspective in Indonesia. This study was motivated by the desire to criticize the development and “up and down” relationship between Islam and state that is very dynamic coloring political situation in “Islamic majority country” Indonesia. This article concluded that understanding the relationship between religion and state with Islamic political approach is not meant to establish a religious state or an Islamic state of Indonesia, but more on filling spaces are functionally religion in order society, nation and state. The relationship between Islam and state can be integrated in a functional relationship equally aspire to nobility. Even integralistic, symbiotic, and secularistic relations, each should be viewed as a form of complementary. Facing the development of modernization, the relationship between Islam and state should be articulated as an effort to always adapt to the development of society in its various aspects, such as: the globalization of the world political economy, science and technology, the development issues of democracy, gender, human rights, pluralism, both nationally and internationally.

Abstract

This article aims to answer some questions: what is the meaning of “equal right” and “religious freedom” written in the text of UUD 45? How if, in the name of religious freedom, other people’s rights are offended? how if, in implementing Islamic law, others people’s rights are offended? Indonesian Constitution (UUD 45) gives freedom to every follower of a given religion to concretize his religious convictions in public life provided that, in doing so, the fundamental right of others are not offended. The UUD 45 also gives freedom to every citizen to make his religious convictions or religious teachings become a state legal policy as long as he or she follows the procedural constitution written in the UUD 45. However, after becoming state legal policy, Islamic law can no longer be claimed “Islamic Law”, because it’s now provided for answering the partial question of life, namely how to administer the state. From a sociological point of view, in order that the process of legislation runs smoothly, Islamic Law should first be transformed into living norms. Hence, it will be easier for the society to abide the law which originated from living norms. Since the function of law in maintaining public peace and order depends, for its effectiveness, on the actual social norms of the community, social acceptance is of great importance. Two ways of resolution will be discussed in this article, these are democratic resolution and transforming Islamic Law into social norms.[]Artikel ini bertujuan untuk menjawab beberapa pertanyaan, apa arti "hak yang sama" dan "kebebasan beragama" yang tertulis dalam teks UUD 45? Bagaimana jika atas nama ke­bebasan beragama bersinggungan dengan hak orang lain? Bagaimana pula jika dalam menerapkan hukum Islam mengganggu ataupun mengabaikan hak orang lain? UUD 1945 memberikan kebebasan kepada setiap penganut agama untuk mengekspresikan ke­yakinan agamanya dalam kehidupan publik dengan cacatan tidak mengganggu dan mengabaikan hak orang lain. UUD 1945 juga memberikan kebebasan kepada setiap warga negara untuk membuat keyakinan agama atau ajaran agamanya menjadi ke­bijakan hukum negara selama tetap mengikuti prosedur yang tertulis dalam UUD 1945. Namun, setelah menjadi kebijakan hukum negara, hukum Islam tidak dapat lagi diklaim sebagai "Hukum Islam", karena hukum tersebut telah dibuat dalam rangka mem­berikan solusi terhadap berbagai macam permasalahan dalam kehidupan, lebih tepatnya hukum ter­sebut telah menjadi pengatur sebuah Negara. Dari sudut pandang sosiologis, agar proses perundang-undangan berjalan lancar, Hukum Islam pertama-tama harus diubah menjadi norma hidup sehingga akan lebih mudah bagi masyarakat untuk mematuhi hukum yang berawal dari norma hidup. Karenanya hukum berfungsi dalam menjaga ketertiban publik, dan ini bergantung pada norma sosial yang berlaku pada masyarakat, sehingga akan mudah diterima oleh masyarakat. Dua tawaran solusi akan dibahas dalam artikel ini, yaitu: resolusi demokratis dan meng­ubah Hukum Islam menjadi norma sosial.

Abstract

DE200 and DE405 are Development Ephemeris (DE) series released by the National Aeronautics and Space Administration (NASA) in 1981 and 1997. NASA uses DE405 to predict solar eclipses in 2011-2020. While before 2011 and after 2020 NASA uses VSOP87/ELP200 theory-based DE200. Why NASA not only use more updated series DE405 and still use old release DE200? What is the difference of DE200  accuracy compared to DE405 to predict solar eclipse? This needs to be researched because the solar eclipse predicted by NASA is used as a reference by the researchers. To answer this question, this paper proposes a solar eclipse computation algorithm based on DE200 and DE405 data and the results will be compared with the results of observations of the March 9, 2016, solar eclipse that have been carried out langit selatan to find out a more accurate DE series. The results of this study indicate that the DE200 series is more accurate than DE405 with an average difference of 0.5 - 0.6 seconds with the results of observations.

Abstract

This article intends to analyze the case of Garut Regent dismissal, Aceng Fikri from his position according to al-Mawardi’s Fiqh Siyasah perspective. Reasons for the dismissal  was a violation of Article 28 f  UU No. 32 / 2004 on Regional Government. The article states that the head of regional and the deputy of head of regional are prohibited from misusing authority and violation of the oath of position. In addition, he is also considered not to meet the obligation for local office as mentioned in Article 27 point (1), letter e, which is the regional head and deputy regional head has the obligation to obey and enforce all laws and regulations. In the perspective of Fiqh Siyasah al-Mawardi, an unfairly leader can dismissed from his post. One indicator of an injustice leader is a violation of ethics.

Abstract

This study intends to find the answer to the problem of judicial accommodation of the National Sharia Council of the Indonesian Ulama Council’s (NSC-IUC) fatwa in Islamic banking regulations. With the legislations approach the answers obtained that institutional structure of NSC-IUC and motivation discharge of fatwa of NSC-IUC making it well accepted as the basis of Islamic bank operations. But the framework of regulation could potentially cause uncertainty. Therefore it is necessary to strengthen the fatwa of NSC-IUC through three scenarios, namely the mandate, making the NSC-IUC as state institution, and the adoption and transformation of NSC-IUC’s fatwa into legislation better.[]Penelitian ini bermaksud mencari jawab terhadap problem yuridis akomodasi fatwa DSN-MUI dalam regulasi perbankan syari’ah. Dengan pendekatan perundang-undangan, diperoleh jawaban bahwa struktur kelembagaan DSN-MUI dan motivasi keluarnya fatwa DSN-MUI menjadikannya diterima secara baik sebagai dasar operasio­nal bank syari’ah. Hanya saja kerangka pengaturannya berpotensi menimbulkan ketidakpastian. Oleh karena itu, diperlukan penguatan fatwa DSN-MUI melalui tiga skenario, yaitu pemberian mandat, menjadikan DSN-MUI sebagai institusi negara, adopsi dan transformasi fatwa DSN-MUI ke dalam peraturan perundang-undangan secara lebih baik.

Abstract

This paper reveals Gus Dur's ijtihād paradigm of contemporary fiqh in Indonesia in answering the problems of life. This study is a type of library research by tracing Gus Dur's works, Gus Dur's thought studies and other related scientific studies. This research uses the approach of Milton K. Munitz's thinking and the frame of mind ‘Abd al-Majīd al-Najjār. This research found that the conservative ijtihād paradigm has led to conservative fiqh which is unable to establish dialectics between fiqh norms and socio-cultural and humanitarian values, which can even lead to radical Islamic movements and acts of terrorism. Therefore, Gus Dur's contemporary jurisprudential ijtihād paradigm is needed to build this dialectic. Theoretically, the Gus Dur ijtihād paradigm has characteristics promoting different socio-cultural and humanitarian values from Islamic reformers. In practical terms, the Gus Dur ijtihād paradigm has made Indonesian socio-cultural values a consideration in understanding and applying contemporary fiqh without changing existing fiqh norms. Gus Dur's contemporary fiqh has also become the basis for maintaining the Pancasila ideology, the 1945 Constitution, the Unitary State of the Republic of Indonesia and Unity in Diversity.
