Abstract

The reforms that have occurred in Indonesia have changed the joints of the life of the nation and state. One of them is changing the centralistic system of government. The demand for reforms related to the broadest possible implementation of regional autonomy is the beginning of the implementation of the decentralization principle in Indonesia. This principle can be reflected in the presence of the Special Autonomy policy, one of which is in Papua Province. This research uses a normative legal research method with a statutory approach. The results of this research show that the stipulation of special autonomy status for Papua Province is legally based on Law Number 21 of 2001 concerning Special Autonomy for Papua Province. This law is an attempt by the central government to develop Papua to be the same as other regions. There are many specializations and special rights that the Papuan people have obtained through the determination of this status, but they are still not being implemented in real terms in the field. This is due to government inconsistencies, especially when viewed from a good governance perspective. Good governance in the principle of participation in Papua has not been implemented properly because of the existence of considerable power as a cultural representation which has not fully represented the Papuan people so that many rights and opinions and voices of the Papuan people have not been implemented.

Abstract

The existence of human civilization has entered a comprehensive stage of progress, the real form of this progress can be seen from the increasingly advanced development of information and communication technology. These technological advances have also been exploited in the financial transaction sector with the presence of technology-based financial institutions (fintech). The formation of laws that specifically regulate the implementation of the fintech industry, especially online fintech loans, is very necessary because the current regulations have not been able to fully accommodate legal issues that arise in the implementation of online lending fintech activities. One of the most crucial problems that arise in the implementation of fintech activities is the absence of strict sanctions that can be used by law enforcers in eradicating illegal online loan fintech service providers whose existence often violates the rights of public consumers. With the enactment of a law that specifically regulates the implementation of online loan fintech services, it is hoped that it can provide guarantees and legal certainty, especially in protecting people's rights.

Abstract

Kebebasan dalam hidup merupakan suatu hak mutlak yang harus dimiliki oleh setiap manusia tanpa terkecuali. Karena dengan adanya kebebasan bagi seseorang akan meningkatkan kualitas hidup yang lebih baik lagi. Jika melihat banyak kasus mengenai kekerasaan dan penganiayaan yang terjadi seringkali membuat banyak orang bertanya mengenai arti kebebasan dan hak hidup yang menjadi milik diri sendiri. Seperti salah satu kasus terjadi kepada Tenaga Kerja Indonesia (TKI) yang bekerja diluar negeri. Kita sering mengetahui banyak warga negara Indonesia yang memilih bekerja di luar negeri karena beberapa faktor, meskipun begitu warga negara yang menjadi TKI tetap mendapat perlindungan hukum dan juga tetap memiliki hak sebagai warga negara Indonesia. Media pemberitaan memberitakan mengenai penganiayaan yang terjadi terhadap TKI membuat banyak pihak turun tangan untuk mengatasi permasalahan tersebut seperti diplomat Indonesia yang ada pada negara tempat terjadinya kasus tersebut. Contoh kasus nya adalah kekerasan yang didapat seorang TKI oleh duta besar dari Arab Saudi. Adapun beberapa hukum yang mengatur mengenai beberapa kasus penganiayaan TKI diluar negeri yakni hukum diplomatik dan konsuler. Pada penilitian ini mengangkat tema yang berjudul “Perlindungan Hukum Terhadap Tenaga Kerja Indonesia Yang Mengalami Kekerasan : Hukum Diplomatik Dan Konsuler”, dalam pembahasan kali ini melakukan analisis mengenai bantuan hukum yang dapat diterima oleh warga negara yang memiliki pekerjaan di luar negeri.

Abstract

Ahli Waris Pengganti memiliki problematika dalam bentuk implementasinya pada Hukum Islam yang berakar pada ketidakjelasan aturan yang ada, hal ini didasari pada status kedudukan dari ahli waris pengganti dalam memeperoleh hak waris dari ahli waris yang telah meninggal tersebut tidak dikenal di dalam jenis pembagian waris secara Islam, sebagaimana ahli waris pengganti tersebut masih memiliki ikatan keturunan darah secara langsung (nasab), saudara, dan pasangan dalam ikatan perkawinan (suami/istri) dari ahli waris yang telah meninggal tersebut. mengetahui secara jelas dan lengkap, mengenai kedudukan ahli waris pengganti secara mendasar dalam mendapatkan harta waris yang diperoleh dari hak seseorang yang telah  meninggal. Melalui KHI sebagaimana berwujud sebagai Instruksi Presiden Nomor 1 Tahun 1991 mengandung ketentuan mengenai kedudukan ahli waris pengganti, sehingga menjadi instrumen dasar bagi penulis dalam menentukan aturan hukum dan bentuk kaidah hukum bagi ahli waris pengganti dalam ketentuan pembagian harta waris yang sesuai dengan syariat hukum islam. Pada eksistensinya tidak mampu tidak dapat memberikan bentuk kejelasan yang lebih merinci terkait kedudukan ahli waris pengganti yang memiliki sifat “Ketidakpastian” dikarenakan mengandung unsur Tentantif dan tidak memberikan kedudukan yang mutlak bagi ahli waris pengganti.

Abstract

Philosophically PMK (Constitutional Court Decision) Nr. 69/PUU-XIII/2015 based on way of life, awareness, and legal ideals such as the mystical atmosphere and Indonesian Nation according Pancasila and The Constitutional of The Republic of Indonesia Article 28E Paragraph (2). Sociologically, based on legal needs society regarding the leniency when the marriage agreement was made that is the phenomenon of a husband and wife for some reason feels they needed to make a marriage agreement after the wedding day was held. Juridically, the issuance of PMK Nr. 69/PUU-XIII/2015 is not solely on the basis of unconstitutionality, but also on a conflict of norms between Article 29 Paragraph (1) of Act Nr.  Year 1974 with general provisions of the ageement in Book III Code of Civil Law. Referring to PMK No.69/PUU-XIII/2015 which was strengthened by Act Nr. 2 Year 2014, Notary has the right to ratified the marriage agreement into an authentic deed so that there is no justifiable reason for the Department of Population and Civil Registration and Office of Religious Affairs rejects the authentic nature of the deed which is validated bay notary.

Abstract

The objective of research was to find out the suitability of the use of protected forests in Karanganyar Regency for tourist attractions with statutory and concerning the legality of retribution withdrawal by local governments which is legal because local governments have regional autonomy.With the legal issue, the author uses normative research methods with perspective research of used cases and regulatory approaches. Nature tourism is one form of protected forests utilization that falls into the group of environmental services utilization according to Article 1 number (6) Regulation of Minister of Forestry Number P.47/MENHUT-II/2013. The helding of tourism in protected forest areas is allowed with the provision not to reduce, change, or eliminate its main functions, change the landscape, and damage environmental elements. However, in the implementation, the parties that involved didn't apply it as it used to be, there were persons who violated the rules that have been made. In addition to violations in the use of protected forests as tourist attractions, other problems occurred was the withdrawal of the retribution, in interviews that the author did with the management of protected forests, it claimed that the withdrawal of retribution in tourist attractions that use protected forests is basically not the right of the local government because the manager of the protected forest doesn't come from the local government but Perum Perhutani instead.

Abstract

This study analyzes the authority of the local government in harmonizing, unifying, and strengthening the concept of the Provincial Regional Regulation Draft. 15 of 2019 concerning Amendments to Law no. 12 of 2011 and their application in South Sumatra Province. The results of the analysis and discussion show that the regional government is not authorized to harmonize, unify, and consolidate the draft Provincial Regulation Draft after the issuance of Law No. 15 of 2019. After the issuance of this Law, harmonization, unification, and strengthening of the draft Provincial Regulation Draft are carried out by ministries or institutions that run a government in the field of law previously coordinated by the legal bureau (regional government apparatus). This activity is a form of deliberation in establishing law and one of the principles in Islamic nomocracy and democracy in Islam. The implementation of harmonization, unification, and consolidation of the draft Provincial Regulations in South Sumatra has not been under the provisions in Law No. 15 of 2019. The process of harmonizing, unifying, and strengthening the concept of the Draft Provincial Regulation in South Sumatra is still being implemented by the regional government (legal bureau as regional apparatus). Suggestions from researchers, namely that the provisions in Law no. 15 of 2019 and it is necessary to guide to human resources in the South Sumatra Province. This process needs to be linked to the concept of Maqhasid Syariah so that the substance of the Provincial Regulation does not conflict with the public interest (benefit).

Abstract

The application of business licensing as a part of the ease of doing business has shifted the obligations present for business actors. One of the forms of said change is the absence of an obligation to conduct EIAs as a basic requirement to acquire a business license. This could boost investment in Indonesia. On the other hand, it also can prompt legal risks that are the revocation of business licenses towards actors that had failed to fulfill business license through OSS RBA. This provision impacts the application of the sustainable finance principle. Without the requirement of EIAs as the prerequisite of business licenses, banks gain the challenge of adjusting their approach towards the gaining of profits from long-term investments depends on a sustainable future on administering of credits by banks. The article aims to analyze the legal implications of changing regulation upon EIAs requirement on business licensing through Online Single Submission towards the application of the sustainable finance principle and the juridical consequences of the use of licenses based on commitments in the approval of bank credit. This research uses a normative juridical approach specifying in the descriptive analysis of primary and secondary law sources. The changed regulation upon EIAs requirement on business licensing through Online Single Submission has legal consequences for the bank to adjusting lending based on the debtor’s business activity stages and requiring EIA as the basis to provide credit on the applications of sustainable finance principle. Sustainable principle pushed out the alteration of banks' approach in the initiation of sustainable economic development with the gaining of profits from long-term investments dependant on future sustainable policy frameworks. The bank must take that approach is through policy frameworks that support sustainable economic development by crystallizing EIAs as a tool for credit decision.

Abstract

Children are the next generation of the nation and every parent's dream. To be able to form children that can be relied upon and become a hope for both parents and useful for the nation and state, the role of parents in guiding and caring for their children is very important. In the Hindu religion books have been explained about children such as Manawa Dharmasastra, Sarasamuccaya, Slokantara and Silakrama. For example in the weda explained Until the age of five, parents must treat their children as kings. In the next ten years as a servant, and after age sixteen and above must be treated as a friend. In this sloka explained, it is better for us to give punishment to children when they make a mistake, as long as it's only natural. If you always spoil a child and have never been banned in any case, then he will get used to what is wrong. According to the Law of the Republic of Indonesia Number 23 Year 2005 concerning Child Protection also confirms that what is meant by a child is someone who is not yet 18 (eighteen) years old, including children who are still in the womb. A child must get good treatment and protection from the womb until birth and growing up. For this reason, the role of parents in understanding and deepening the teachings in the Vedas is very important. We must understand correctly what is the child's needs.

Abstract

This study aims to analyze the legal basis for the acquisition of land and building rights fees in Buleleng Regency. This research is a type of legal research with empirical juridical studies because this research deals with data. This research took place in Singaraja City, especially in the Regional Government Financial Management Agency (BPKPD) Buleleng Regency. Data were collected using observation and interview methods. The data analysis was conducted in a descriptive qualitative manner. Based on the results of the analysis, the legal basis for the Acquisition Fee for Land and Building Rights is relevant to the Regulation of the Minister of Finance, the collection of Fees for Acquisition of Land and Building Rights (BPHTB) is entirely carried out by the regions, this is due to policies on objects, subjects, rates, and tax bases fully stipulated by the Regional Government and adapted to the conditions and objectives of regional development. This policy is adjusted to the Regional Regulation of Buleleng Regency Number 1 of 2011 concerning Law Number 28 of 2009 concerning Regional Taxes and Regional Retributions for the regulation of the imposition of local taxes on Fees for Acquiring Rights on Land and Buildings (BPHTB).
