Abstract

The purpose of this study was to describe the various conditions that  background household workers who are motivated to migrate internasioanal; sending remittances to their home town and the impact of migration international TKI on social, economic, and  culture  in the area of origin. The approach of the research is quantitative approach., collecting data with interview techniques. and. indept interview / in-depth interviews to sharpen and enrich the information phenomenon sosial.Analisis data with descriptive analysis and paertial laest square.The results showed an increase in production efficiency with a shorter time, production capacity and product quality improved so that it can meet consumer demand. Abstract

Density of crossing vessels in straits used for international navigation, such as in the Malacca Strait, allows the occurrence of serious pollution of sea water in the strait. In addressing marine pollution in straits used for international navigation in Indonesia, it is necessary to the management arrangements of marine pollution in straits used for international navigation in Indonesia. In connection with the management of marine pollution in straits used for international navigation, it is deemed necessary to have the ideal management of marine pollution in straits used for international navigation in Indonesia.This research is a law that is normative by using a main approach of legislation, with a source of legal materials through library research.Indonesia has ratified the Convention 1982 on the Law of the Sea through Act No. 17 of 1985; therefore, the Indonesian government should establish law as a legal product that regulates Indonesia as an archipelagic State traveled its waters by foreign ships of the easy and high chance in causing sea pollution. The concept of the ideal management of marine pollution in straits used for international navigation is integrated and coordinated by the agency related to the marine pollution in Indonesia. By using the marine pollution liability compensation to the principle of strict liability, it could beneficial for the injured party due to marine pollution. It is expected that the Indonesian government immediately establishes statutory laws and regulations relating to the management of pollution at sea; the academics at universities participating socializing marine management in particular marine pollution from shipping foreign vessels in Indonesian waters. Keyword :  Management of Marine Pollution;  Straits Used for International Shipping; Convention 1982 on the Law of the Sea; Indonesia

Abstract

The means of law harmonization is a very popular topic discussed by law scholars and business practitioners. The means of law harmonization through the substantive rules of the law of international trading is regarded efficient to prevent conflicts among systems of law which are subscribed by each country. The main goal of law harmonization is to look for homogeneity from fundamental principles through all of systems of law available (which will be harmonized). CISG in arranging the contract is viewed from the principle of consensus so that the absence of the things will not affect the validity of the contract. CISG does not arrange the relationship of law between the validity of a covenant and its implications. The contract of selling and buying in CISG, instead of requiring an agreement between two sides, requires real actions. The things being sold and bought must be free of rights and demand of the third side, expect the buyer who agrees to receive the things and complies to the rights and demands.

Abstract

Recruitment is a series of events to find and attract job applicants motivation, ability, skills and knowledge required in order to cover the flaws identified in the staffing plan. In most of the industrial age, family networks continue to complement the main base manpower recruitment. The purpose of this study is to determine the role of social capital networks as a method of recruitment. The analysis method used is descriptive qualitative approach. "Contacts " in the network to help job seekers with a very effective way to find new jobs. Social capital is measured by the extent of the network - a network of friends. Bridging social capital a person enters the labor market as well as those who are still unemployed . Salt cellar is one of the cigarette industry that leverage social capital networks in recruitment method. In addition to family networks, private networks in each individual also profitable. On the side of the ladder for example. Size of personal networks of individuals have a positive influence and should be counted on the possibility of getting a job. Private network through friends, neighbors and contacts also help candidates salt warehouse laborers to enter the enterprise. In conclusion, the significant role of social capital networks in recruitment in PT Gudang Garam Tbk Kediri, East Java. Skipped Network is friendship, family, and " contact" (personal networks).

Abstract

The transformation of economic structure is not only act as a sector dominance contributing to Gross Regional Domestic Product, but also acts as the dominance of labor sector absorption. In 1994, the dominance of primary sector in contributing East Java’s Gross Regional Domestic Product is already replaced by secondary sector and later by tertiary sector in 2004. The labor sector absorption is still dominated by agricultural sector until now. This research was aimed to describe the patterns of Transformation of economic structure and changes in the proportion of labor in East Java Province from 1998 to 2012, as well as analyzed the effect of each variables. By using factor analysis for latent variables first, the quantitative result based on path analysis has proved that economic growth and income per capita has a direct effect to the Transformation of economic structure. The increase of economic growth and income per capita has lead to the decrease in agricultural (primary sector) and industrial (secondary sector) proportion in contributing East Java’s GRDP which is followed by the increase proportion in trade, hotel and restaurant (tertiary sector). The Transformation of economic structure has a direct effect to change the proportion of labor, whereas the economic growth and income per capita have indirect effect to that. During this process, the agricultural labor absorption decreased very slowly while industrial labor absorption increased slowly, as well as the trade, hotels and restaurants. The results also showed that the changes in the the proportion of labor has direct effect to income per capita along with the domination of high productivity sector such as trade, hotels and restaurants which leads the economic growth.Keywords : Transformation of economic structure, changes of the proportion of labor, economic growth, income per capita

Abstract

National Police Commission of Indonesia is regarded by many as an external oversight committee Indonesian National Police, although in reality this assumption wrong. National Police Commission is not an external police oversight commission. It is said not by the external oversight committee is not equipped with the authority to examine and investigate the perpetrators of violations of codes of conduct and abuse of authority other duties.The purpose of the research in this paper is first, to examine and analyze how the existence of the National Police Commission in terms of construction law as an external watchdog Indonesian National Police, second, to examine and analyze why the authority of the National Police Commission did not reflect the external oversight bodies Indonesian National Police, the third, to examine and analyze how forms of authority and duties that should be owned by the National Police Commission as an external watchdog Indonesian National Police.Contributions expected from this research are to enrich the knowledge and understanding to empower an organization, particularly the National Police Commission, related to the functions, duties and authority of the National Police Commission, especially in terms of authority to do inspections and investigations against police officers and the perpetrators of violations of the code of conduct abuse of authority other duties.Conclusion of the study explained that the absence of authority to inspect and conduct an investigation of police officers and the perpetrators of violations of ethics code violations authority other duties affect the effectiveness performance of duties as a watchdog function. National Police Commission is not able to check and investigate the police officers concerned.Keywords: professionalism, oversightor, external, authority, commission

Abstract

The mud islands referred to as muddy land are a new natural resource that in economical terms is potential for farming and brackish-water business resulting in the authority and ownership of the land by the local society. On the one hand, the written state law suggests that muddy land is state propety dominated by government. In fact, history shows that local society has authority over it for generation according to the prevailing customs.The authority of muddy land (aanslibbing) in Gresik sub-provinve and Pasuruan requaire law certainty warranty, in other words, the extension of the Indonesian Agrarian Law is still pluralistic. For the society of Gresik and Pasuruan,it could be a social sensitivity if it is not handled wisely by considering the prinsiple of certainity and usefullness.Keywords: muddy land (aanslibbing), authority and ownership

Abstract

This research aims to: (1) Find out the mechanism of funding mudharabah on BMT UGT Sidogiri, Malang branch. (2) Analyze the emergence of agency and its enforcement in funding mudharabah on BMT UGT Sidogiri Malang branch. Qualitative approach was used in this research method using a case study. Research findings show that: (1) There is no appropriateness of mechanism application of shared profit in terms of its requirement and its payment related to its decision of shared profit as it does not conform to DSN-MUI’s fatwa and concept as well as sharia economist’s opinion. (2) The presence of agency issue which is adverse selection encountered by BMT UGT as it is related to customer’s character which is unpredictable as well as the presence of moral hazard in the form of unconformity of financial use available in contract. This results from BMT’s incapability of doing intensive watch. (3) The enforcement already performed was by monitoring via direct interaction and giving intensives in the form of limitation decided by BMT UGT such as a long term restriction and the amount of funding.Keywords: theory of agency, enforcement, mudharabah, BMT

Abstract

The objective of this research is to answer questions of: 1) What is the division of affairs between government structures in terms of mining affairs in the City of Palu; 2) How mining affairs is being managed in the City of Palu; 3) What are the conflicts between government, business people, and community around the mining area in managing mining in the City of Palu; 4) What are the alternatives to manage effective and efficient mining affairs. This research is suing qualitative approach with the intention to analyze some phenomenon regarding the organization of mining affairs, conflicts of mining, and the alternative solutions. Data collection technique is conducted through interviews, observations, and documentations. The outcome of the research shows that: 1) there is an overlap in the organization of mining affairs between government structures, both in politics and administration. In the organization of mining affairs in Poboya, political aspect is being prioritized than the administrative aspect. It is proofed by the dominance of downstream approach (conflict resolution of Poboya minefield) done by city government, rather than upstream approach (policy making) that ensures the management of public mining in Poboya; 2) the lack of roles and stakeholders in the process of formulating mining policy, institutional issues, and the weakness of community participation in formulating mining programs; 3) Regarding uncertainties within the community and business people in managing minefield, each of them feels that they have the right to manage or exploit the mining areal based on their authority upon the mining area of Poboya. This research recommends the need to organize the mining affairs which refers to the importance of clear management on government structure. The political aspect is highlighting the need to do cooperative formulation, creating mining policy which is based on reality, filtering aspiration and creating rules. While the administrative aspect is highlighting the programs of control coordination, a good and environmental-friendly mining, clear regulation, as well as coordination between actors who are involved in the organization of mining affairs in the City of Palu.Keywords: decentralization, mining affairs and conflict

Abstract

The objective of this research is to improve students’ ability in appreciating poetry through inductive model. Method of research used in this study is modified Research and Development. Data analysis technique that is used is descriptive analysis. The result of research shows that learning through inductive model that concern on eight instructional steps can improve students’ ability in appreciating poetry. The improvement can be seen numerically from evaluation result average in every treatment. In the implementation I, the evaluation result average shows number 60.9, in the implementation II shows number 62.4 and in the implementation III shows number 65.3, while the observation result average in the implementation I from ‘less’ criteria gradually become ‘enough’ criteria, in the implementation II from ‘enough’ criteria gradually become ‘good’ criteria an in the implementation III from ‘good’ criteria gradually become ‘very good’ criteria.Keywords: inductive model, appreciation, poetry, research and development
