Abstract

This study aims to analyze the role of the Indonesian Constitutional Court in carrying out its function as a stronghold of law enforcement in Indonesia after the reform era, as well as evaluate the extent to which this institution has succeeded in protecting human rights through its decisions. Methods: This research is categorized as normative legal research with a philosophical and analytical approach. The focus is on rational, critical, and philosophical analysis of the legal issues raised. The analytical descriptive method is used to describe the applicable legislation, legal theory, and positive law enforcement practices related to the problem under study. Results: The results show that the Indonesian Constitutional Court plays an important role in upholding the Constitution and social justice with a careful and balanced approach. Key decisions such as No. 18/PUU-V/2007, No. 75/PUU-XIII/2015, and No. 102/PUU-XXI/2023 highlight the importance of legislative autonomy, legal clarity, and certainty, as well as the presumption of innocence and prudence in political intervention. The application of Aharon Barak's theory of "proportionality," Lon Fuller's "legal certainty," and Alexander Bickel's "judicial restraint" provides insight into ensuring a balance between human rights, legal certainty, and the integrity of due process.

Abstract

Intellectual Intelligence is the thinking ability possessed by every individual where this intelligence can help a person to be able to adapt to the environment around them through thinking about various things through metacognitive processes. One area of knowledge that is predicted to have an influence on increasing intellectual intelligence is Arabic, where Arabic is the language of the Koran which is rich in vocabulary, language structure and beautiful language style. However, this has not been proven, especially for UIN Maulana Malik Ibrahim Malang students. For this reason, researchers want to conduct research on the role of Arabic in increasing the intellectual intelligence of students at UIN Maulana Malik Ibrahim Malang. The aim of this research is to determine the role of Arabic in increasing students' intellectual intelligence. The research method used is descriptive qualitative with data collection techniques through observation and documentation with primary data sources, namely UIN Maulana Malik Ibrahim Malang Postgraduate students, class F in 2023. The data collected was then analyzed in depth to determine the research results. The research results show that Arabic can play a role in improving students' intellectual intelligence through three aspects, namely dalil, mahfudzot, work, and learning outcomes. Propositions and mahfudzot include verses from the Koran, Hadith of the Prophet, and sayings of the Shafi'i Faith. Works in the form of Masrohiyyah and calligraphy. Meanwhile, student learning outcomes include cumulative achievement index (GPA), general knowledge scores, and competition achievements at the Arabian Peninsula Festival

Abstract

In Indonesia, conflict over norms or disharmony in laws and regulations is a legal problem that often occurs. This is motivated by the existence of several legal mechanisms that overlap between the regulations below and the regulations above. As happened in Nanggroe Aceh Darussalam Province between customary law and positive law, which in this case is Qanun law. In this article, we will discuss efforts to harmonize norms between customary law and Qanun in Nanggroe Aceh Darussalam using descriptive qualitative methods. Efforts to resolve disharmony in statutory regulations are resolved by several alternatives, namely: 1) Right to Judicial Review of Legislative Regulations; 2) Constitutional Route; 3) Minister of Law and Human Rights Regulation Number 23 of 2018 concerning Harmonization of Draft Ministerial Regulations, Draft Regulations of Non-Ministerial Government Institutions, or Draft Regulations from Non-structural Institutions by Legislative Regulation Makers issued by the Ministry of Law and Human Rights; 4) Regulation of the Minister of Law and Human Rights Number 2 of 2019 concerning Resolving Disharmony in Legislative Regulations Through Mediation.

Abstract

This research aims to determine the effect of Electronic Word of Mouth (eWOM) on purchasing intensity and trust as a mediating variable with the research object Mother of Pearl (MOP) Beauty. The sampling method used was convenience sampling, the sample used involved 280 e-commerce users who were familiar with the MOP Beauty brand. Data was collected and analyzed using Structural Equation Modeling (SEM) via SmartPLS software. The research results show that there is a positive influence of information quality, information quantity, information credibility on trust, while information usefulness has a negative influence on trust. Furthermore, trust, information quality, information credibility, information usefulness have a positive influence on purchase intention, while information quantity shows no positive influence on purchase intention. This research can contribute to understanding the role of eWOM and trust in the context of purchasing cosmetic products, especially the MOP Beauty brand, so that they pay attention to and utilize eWOM as an effective marketing tool, while strengthening consumer trust in the brand. Based on the background discussed, this research aims to analyze the relationship between eWOM and purchase intention. However, different from previous studies, this research adds trust as a mediating variable in the relationship between the dependent and independent variables. Choosing the research object Mother of Pearl Beauty is because it is a cosmetic product owned by influencer Tasya Farasya, which is one of the cosmetic brands that has the most sales in Indonesia.

Abstract

This research aims to determine the influence of price, product quality, and personal selling on consumers' purchasing decisions regarding tempe. This study utilizes a quantitative approach as the research method, employing a questionnaire distributed incidentally. The study involves a sample of 96 individuals who meet the author's criteria, determined using the Lemeshow formula. Quantitative data analysis technique is employed, utilizing statistical methods to analyze the data. The statistical method used is Smart-PLS. Based on the research findings, it was discovered that price has a positive and significant impact on tempe  purchasing decisions in the village of Sepande, Sidoarjo. Product quality has a positive and significant influence on tempe purchasing decisions in the village of Sepande, Sidoarjo. Personal selling has a positive and significant effect on tempe purchasing decisions in the village of  Sepande, Sidoarjo. Furthermore, within this context, price, product quality, and personal selling collectively have a significant impact on tempe  purchasing decisions in the village of Sepande, Sidoarjo.

Abstract

The article discusses the potential of Indonesia's abundant natural resources as a foundation for achieving equitable prosperity, as mandated by the 1945 Constitution. It emphasizes the importance of managing these resources through the development of science and technology to enhance national competitiveness. The research highlights the need for effective commercialization of research outcomes, which can include theories, ideas, and practical products, to create economic value and benefit society. The study identifies an ideal model for business contracts in the commercialization of research results, advocating for a proportional profit-sharing agreement. This model ensures fairness between researchers and funding entities, promoting equitable rights and obligations. The research methodology is empirical, focusing on social phenomena and realities within the community, and involves interviews and data collection from various tourism destinations in East Java. The findings suggest that the commercialization of research results, particularly in the context of edutourism, requires clear contractual agreements to delineate the rights and responsibilities of all parties involved. This approach aims to foster sustainable tourism development while maximizing the economic benefits derived from research innovations.

Abstract

The aim of this study is to examine the correlation between the trustworthiness of influencers and the attitude of Generation Z in influencing their intention to make purchases, utilizing the theory of planned behavior. This study utilizes a quantitative approach and applies a purposive sampling procedure to collect a total of 218 samples. The analysis is performed using Structural Equation Modeling (SEM) and aided by AMOS 24 Graphics software. This study discovered a significant positive correlation between online customer reviews and attitude. Attitude has a significant positive correlation with brand loyalty, purchase intention, and electronic word of mouth. Brand loyalty also has a significant positive correlation with purchase intention. There are new findings, namely a significant positive correlation between influencer's trustworthiness and attitude, and electronic word of mouth has a significant negative correlation to purchase intention. This study has implications for companies regarding product quality and consistency of product ratings that cause eWOM to have a negative relationship with purchase intentions. This research has an update on the variable, namely the influencer's trustworthiness, to measure influencer trust in consumers.

Abstract

The snake fruit processing company UD Salacca faces several challenges in its snake fruit processing activities, including people, machines, methods and the environment. The aim of this research is to identify the challenges faced by UD Salacca in snake fruit production. The risk management method used in this research follows the ISO 31000:2008 guidelines using the House of Risk (HOR) Model, which includes steps for risk identification, risk analysis, risk evaluation, and risk management. 22 risk events (risk factors) have been identified from 9 process activities and 17 risk agents (risk causing factors), of which there are 5 high priority risk causes. The causes of this risk include the mixing process taking less than three hours, weather and pest factors, not being careful when loading, and not being careful in the sorting process using traditional grinding equipment. From the research results, 18 proposed mitigation strategies were found from 9 process activities. Some of the strategies proposed include the use of machines in the ripening process, the use of tools to peel snake fruit, the use of personal protective equipment when working, supervision and implementation of work operational standards during harvest, and the use of assessment checklists when sorting snake fruit. Early handling strategies are needed by salacca businesses to anticipate major risks. These results can be used to increase the company's effectiveness in handling risk management

Abstract

The self-potential (SP) method investigated leachate distribution near Rawa Kucing. Rawa Kucing is the main landfill in Tangerang that burned almost the entire area. A total of 78 SP data points were scattered throughout the study area. The SP values range from -20 to 16 millivolts, dominated by negative values attributed to electrokinetic processes. The results suggest that a highly conductive zone in the study area may have been caused by high contamination from leachate. The possible direction of leachate flow is towards the Cisadane stream, located west of the landfill. On the other hand, a quantitative interpretation of SP was conducted for two profiles, AA’ and BB’. The result shows that the vertical spreading of leachate was found at a depth of h 6,59 and 3,53 meters and H 8,10 and 4,34 meters for AA' and BB', respectively, with an angle of 28,810. Additionally, groundwater samples were collected from four sites near the landfill to assess groundwater quality using physical and chemical analysis. Based on the Indonesian Ministry of Health Regulation, most parameters indicated low contamination. Statistical analysis revealed that the groundwater near the landfill was worthy of consumption. Based on the results, rainfall during the study significantly reduced the concentrations of contaminants in leachate due to dilution.

Abstract

It is generally admitted that a relationship exists between financial system development and economic growth, although the nexus between these two is complex. Due to the advancement of technology, P2P lending has become a growing industry in Indonesia as an alternative credit different from a conventional bank, which also might contribute to fostering economic growth. This paper's purpose is to analyze the contribution of P2P lending to Product Domestic Regional Bruto (PDRB) in 5 provinces in Java, which are Banten, DKI Jakarta, West Java, Central Java, DI Yogyakarta, and East Java, using fixed effect panel regressions from Q1-2020 to Q2-2022 period. This paper finds a significant and positive impact of P2P lending on real PDRB growth, with a 0,0754% magnitude. Although there is a positive impact, many challenges still need to be overcome in the P2P lending industry.
